The Mason County Board of Health Appeal Hearing was called to order at 11:05 a.m. on
May 14, 1999 by Chairperson Mary Jo Cady. Board Member John Bolender was absent.

We call this special Mason County Board of Health Meeting to
order. Ah...it is 11:05 a.m. on May 14th, 1999. Do we have a
motion?
I would move that the Mason County Board of Health uphold the
findings of the Health Officer and that the mobile home located at
1701 Agate Loop Road is considered solid -waste and must be
removed and properly disposed of at a county permitted facility.
Ok. I will second that motion. You've heard the motion moved
and seconded, that the Mason County Board of Health uphold the
findings of the Health Officer, that the mobile home located at 1701
Agate Loop Road is considered solid -waste and must be removed
and properly disposed of at a county permitted facility and that we
also adopt the findings...

I will read the Findings of Fact.
This matter came on for hearing on May 6th, 1999 before the Mason
County Board of Health based on William Petty's Appeal of the
Health Officer's Final Determination dated February 4th of '99. The
Board heard the testimony of witnesses, considered exhibits and
entered the following Findings of Fact: Mason County Health
Department issued a Notice and Order to William Petty requiring
the removal of a mobile home from the Petty property located at
1701 East Agate Loop Road, Shelton, Washington; parcel number
also on there. Mr. Petty failed to comply with the terms of the
Notice and Order, by not removing the mobile home from the
premises as required. The mobile home mentioned in the Notice
and Order is solid waste as that term is defined by Washington
State Code and County Health Regulation and is subject to
abatement. Mr. Petty is in violation's of State and County Health
Regulations for failing to comply with the County's Notice and
Order. Based on the above Finding of Fact, the Board enters the
following: Conclusion's of Law - this Board has jurisdiction to hear
and decide this appeal. The mobile home owned by William Petty
is located at 1701 Agate Loop Road and it is solid waste as that
term is defined by WAC 173-304-173. The mobile home located at
1701 Agate Loop Road is out of compliance with the Mason
County Solid Waste and Bio-Solid Handling and Facilities Handling
Regulation 3.09.01 which states: All residential solid wastes must
be stored onsite in a proper manner and disposed of in a proper
manner. The determination then finds that the Mason County
Board of health upholds the findings of the Health Officer.
