WHEREAS, Mason County's Health Department has identified a
potential public health risk from ground disposal of septage;
WHEREAS, the Department of Ecology has requested Mason County
to terminate the practice of septage trenching at the Mason County
Landfill;
WHEREAS, the Board of Mason County Commissioners feels it is
necessary for the immediate preservation of the public health and
safety that an alternative septage disposal method be employed at
the Mason County Landfill to truck the septage to an appropriate
site;
WHEREAS, Solganic Service Corporation appears to be the only
available organization which could provide transfer from a tanker -
transfer location at the Mason County Landfill to their Lewis
County disposal site;
WHEREAS, RCW 36.40.180 authorizes the County Commissioners to
declare a nondebatable emergency and make expenditures necessary
to meet an emergency without further notice or hearing;
WHEREAS, RCW 36.32.270 authorizes the County Commissioners to
dispense with bidding requirements in an emergency situation when
public safety or property are damaged or threatened; and
WHEREAS, an emergency exists at the Mason County Landfill
requiring the immediate temporary contracting with a septage
transport and disposal service;
NOW, THEREFORE BE IT RESOLVED, that Mason County Landfill
shall establish a complete closure of the landfill to ground
disposal of septage; and
BE IT FURTHER RESOLVED, that an emergency as defined by RCW
36.32.270 and 36.40.180 does exist and that the Department of
General Services is authorized to proceed immediately to contract
with Solganic Service Corporation to provide transport and disposal
of septage collected at the Mason County Landfill.
