Moratorium for Building Permits in Plat of Beards Cove RESOLUTION NO. 37-92 EMERGENCY DECLARATION WHEREAS, the Mason County Department of General Services, Building Department, has placed a moratorium for building permits in the plat of Beards Cove, Section 30, Township 23N,Range 1 W,W.M.,Mason County in cooperation with the Mason County Department of Community Development Utilities Division; WHEREAS, the Mason County Department of Community Development has determined that the production level of well #3 has decreased and its ability to recharge itself has diminished to the point that production levels would not meet projected summer demand and the lack of source has a significant impact on standby fire flow capability; WHEREAS, the Department of Ecology has requested that a moratorium be placed on additional connections to the Beards Cove Water system because one of the systems' sources is experiencing a loss of capacity: and WHEREAS, the Board of Mason County Commissioners feels it isnecessary for the immediate preservation of Public Health and safety that steps be taken to provide the lot of owners of Beards Cove adequate water; and WHEREAS, RCW 36.32.270 authorizes the Mason County Commissioners to dispense with bidding requirements in an emergency situation when public safety or property are damaged or threatened; and WHEREAS, an emergency exists at the plat of Beards Cove requiring the immediate temporary contracting with a well drilling company; NOW, THEREFORE BE IT RESOLVED, that an emergency as defined by RCW 36.32.270 does exist and that the Department of Community Development is authorized to proceed immediately to contract with a well drilling company who would proceed with well installation.
