The permits required for a continuous bulkhead on two lots would be 2 separate building permits,2 separate MEP's, 1 Habitat
Management Plan (provided it addressed each parcel)and 1 SEPA checklist. I am assuming these lots have SFR's on them...if not
they may require Substantial Development permits(depending on valuation).Otherwise they would need 2 shoreline exemptions.

7a. Describe the proposed work that needs aquatic permits: Complete plans and specifications should be provided for all work
waterward of the ordinary high water mark or line, including types of equipment to be used. If applying for a shoreline permit,describe all
work within and beyond 200 feet of the ordinary high water mark. If you have provided attached materials to describe your project,you still
must summarize the proposed work here. Attach a separate sheet if additional space is needed.
Shoreline protection is to be constructed using steel 1-beams and treated lumber along approximately 100 lineal
feet of frontage. Height of the bulkhead to be a maximum of 14 feet above the existing beach grade at the OHW
elevation of 738 feet. Steel 1-beams to be augered in by hand a minimum of 6 feet(2 feet in width)and filled with
concrete. Bulkhead shall be reinforced by steel tieback cables and concrete anchor blocks. Entire bulkhead to be
backed with filter fabric, gravel,and topsoil running the length of the bulkhead,then planted with native
vegetation. Minimal vegetation shall be disturbed. Manmade debris on the beach, including Gabion baskets,
shall be removed from the site. Materials and equipment shall be driven to the site.
7. Location of proposal, and directions to the site. Give sufficient information for a person to understand the precise location of your
proposed project. Take SR Hwy 101 to Hoodsport, then turn left on North Lake Cushman Rd. Turn left on Standstill
Drive and follow to the site.

DRAWINGS MUST BE ATTACHED. NOTE: Applicants are encouraged to submit photographs of the project site,but these DO NOT substitute for drawings. THE CORPS
OF ENGINEERS AND COAST GUARD REQUIRE DRAWINGS ON 8-112 X 11 INCH SHEETS. LARGER DRAWINGS MAYBE REQUIRED BY OTHER AGENCIES.
7b. Describe the purpose of the proposed work and why you want or need to perform it at the site. Please explain any specific needs that
have influenced the design.
The proposed bulkhead replacement, as per the owner's request, is for protection of the bluff,which is eroding
due to wave action from boat wake and wind. The design has been chosen, because the bluff is too steep and
unstable to support a traditional rock bulkhead.
7c. Describe the potential impacts to characteristic uses of the water body. These uses may include fish and aquatic life,water quality,
water supply, recreation and aesthetics. Identify proposed actions to avoid, minimize, and mitigate detrimental impacts and provide
proper protection of fish and aquatic life. Identify which guidance documents you have used. Attach a separate sheet if additional
space is needed.
The proposal will result in minimal negative impacts to the waterbody,which shall be mitigated through the use
of BMP's and the planting of native vegetation.

Thank you for the opportunity to comment on the mitigated determination of nonsignificance for the
DeLeo Bulkhead project (SEP2009-00008) located at 61 North Gull Place in Hoodsport as proposed by
Therese DeLeo. The Department of Ecology(Ecology) reviewed the environmental checklist and has the
following comment(s):

The applicant should consider alternatives to treated wood or other chemically treated wood for in-
water construction of wooden structures. Over time,treated wood may contaminate nearby
sediment and cause toxicity for aquatic organisms.
Fresh uncured concrete in direct contact with the water is toxic to aquatic life. All concrete shall be
poured in the dry and allowed to cure a minimum of seven (7) days before contact with water.
Erosion control measures must be in place prior to any clearing,grading,or construction. These
control measures must be effective to prevent soil from being carried into surface water by
stormwater runoff. Sand, silt, clay particles, and soil will damage aquatic habitat and are considered
pollutants when discharged to waters of the state.
Any discharge of sediment-laden runoff or other pollutants to waters of the state is in violation of
Chapter 90.48,Water Pollution Control, and WAC 173-201A,Water Quality Standards for Surface
Waters of the State of Washington,and is subject to enforcement action.
During construction, all releases of oils, hydraulic fluids,fuels, other petroleum products, paints,
solvents, and other deleterious materials must be contained and removed in a manner that will
prevent their discharge to waters and soils of the state. The cleanup of spills should take
precedence over all other work on the site.
Proper disposal of construction debris must be on land in such a manner that debris cannot enter
Lake Cushman or cause water quality degradation of state waters.

CONDITIONS OF THIS DETERMINATION
1) All provisions of the Habitat Management Plan shall be enacted.

2) Minimum vegetation shall be removed. Native vegetation shall be planted along the top of
the bulkhead as identified in the Habitat Management Plan.

3) Holes for the posts will be augered by hand with hand tools:
X
4) No construction to take place when the water level of Lake Cushman is elevated
(approximately May 26th to October 1 st).
X
5) Geosynthetic filter fabric shall be used to "back" the bulkhead as identified in the Habitat
Management Plan. X
6) Aquatic friendly sealant shall be applied to the concrete used in the project.
X
7) Existing woody debris shall be anchored along the toe of the bulkhead to lessen toe
erosion, after construction is completed. A site plan of the placement/location of the wood
debris shall be submitted to the County prior to building permit issuance.

8) ACZA treated wood used in the project shall undergo one or more of the following .BMP's to
minimize leaching of contaminants:
1 Aqua-Ammonia Steaming Cycle (AASC);
2. Post Treatment Kiln Drying;
3. Minimum Plant Holding Time (MPHT). In addition to recommendations for the ACZA
BMP's-Amendment #1 for MPHT treatment, all ACZA treated wood shall be held under
cover a minimum of 3 weeks at constant temperature that meets or exceeds 60degrees F.
If the ambient temperature is less than 60 degrees F, then ACZA treated wood must
undergo the Post Treatment Kiln Drying, noted above;
4. In-Retort Ammonia Removal Plus Plan Holding Time; as conditioned in previous section
(3), but held under cover for a minimum of 1 week, at constant temperature that meets or
exceeds 60 degrees F;
5. ACZA wood treatment methods shall be verified by providing a signed and dated
certification from a third party. X
9) Residential developers and individuals shall be required to control erosion during
construction. Removal of vegetation should be minimized and any areas disturbed should
be restored to prevent erosion and other environmental
impacts.X

strictly adhered to.

height. The access stairs and landings shall follow the bluff contour,
insofar as it is possible while keeping all stairs and landings level
(i.e. the back edge of all stairs and landings will be less than 30

inches in height, while the front edge may be over 30 inches above
grade in order to compensate for steep slopes).

SUBJECT: Review of the State Environmental Protection Act(SEPA), SEP2009-00008 and
SEP2009-00009, Bulkhead located at 61 and 60 N Gull Place, Hoodsport, WA;
Lake Cushman; Section 05,Township 22 North, Range 04 West, Mason County,
WRIA 16.6002
The Washington Department of Fish and Wildlife(WDFW)has reviewed the SEPA checklists
for these two proposals. They include the construction of a 280 lineal feet of I-beam pile and
ACZA treated wood bulkhead on two neighboring lots. The plans show a straight wall located
beyond the toe of the slope within the ordinary high water line(OHWL) and rising 20 feet high
on a slope heavily vegetated with native woody shrubs and young conifer trees. WDFW has the
following comments to offer.
The Habitat Management PIans(HMP) acknowledges the structure and construction will have
impacts such as the loss of benthic habitat, contamination from leaching of the wood
preservatives, the loss of native vegetation and changes in the hydraulics. Mitigation for these
impacts is not adequately addressed in the plan.
In addition, the Geotechnical Report does not appear to support the need of a structure of this
magnitude.
• 46 "properties display minor sloughing"and"trees on the steep hillside were found to be
growing reasonably straight with no indications of truck curvature typically associated
with mass landslide movements".
• #7 "properties is stable in its present geometry and condition and does not present a
landslide or geological hazard to the existing residential improvements on the subject
properties"
• #12 "existing improvements are safe"concluding with"the wall(s) is proposed to reduce
the continual erosion of the lake shoreline..."
WDFW recommends the proponents modify their proposal to include the following:
• Minimize the height of the wall to protect only the toe of the slope.
• Place the structure at the toe of the slope and follow the contour of the bank.
• Establish roughness along the wail by installing large woody material.
• Use material other treated wood.
• Identify and minimize number of access slides to reduce disturbance to the bank and bank
vegetation from sliding building materials down the bank.
• Provide a revegetation plan for all disturbed bank area and riparian area, not just for five
feet along the edge. Include in the plan tree species, not just shrubs.

It has been determined that the above project will have multiple negative
environmental impacts to the Skokomish Tribe and/or their resources¢' including multiple
Federal and State listed species. These impacts are listed in detail be and should be
thoroughly considered before any permits are issued by the permitting agencies and/or
construction begins.
• Bulkheads may disrupt the migratory and rearing behavior of juvenile salmonids
• Bulkheads prevent the recruitment of native sediment to the lake,resulting in a
loss of heterogenous substrate,and resulting in shoreline erosion at the toe or
along the shore downwind of the bulkhead. This could affect:the availability of
spawning and rearing habitat, and the forage base for a variety of fish species.
Bulkheads eliminate shallow-water habitat,which is critical a�refuge and foraging
habitat for juvenile salmonids and other small fish.
• Bulkheads reflect wave energy at the shoreline,resulting in the scour of sdiment
oat the bulkhead toe, and creating an inhospitable high-energy environment for
juvenile fish.
• The removal of vegetation during bulkhead construction could eliminate a
potential source of cover and food for juvenile salmonids,foliage fish and native
char. Vegetation removed is typically not replaced with native woody species
that could provide a future source of woody debris to the lake thereby reducing
the availability of complex refuge habitat for small fish, and attachment surfaces
for periphyton.
• The temporary turbidity associated with bulkhead construction may reduce water
quality to the detriment of juvenile fish species.

• Pile driving may disrupt the distribution and behavior of,or injure juvenile fish
species.
• Best Management Practices instituted by the Western Wood Pieservers Institute
(WWPl)should by employed for the use of ACZA treated wood when used in the
aquatic environment.
• A key to the treating process for ACZA treated wood is the presence of ammonia,
which facilitates carrying the active ingredients into the cell structure of the wood
during treatment. Evaporation and removal of the ammonia following treatment
is critical for the remaining ingredients to become stabilized,thereby minimizing
the opportunity for leaching from the product in its end use.
• It is recommended that several key pieces of large woody deb is(LWD) depicted
in the enclosed Habitat Management Plan(HMP)be anchoredlappropriately along
the shoveling to fin-ther deflect wave energy away from the proposed struture.
• In addition it is reconunended that the concrete for the proposed piles have an
aquatic friendly sealant applied to them.
• The west slope of the proposed properties is the most stable according to the
enclosed geo-report. This slope should be preserved as a Best Management
Practice(BMP)for this site's stonnwater runoff. Dispersing stonnwater into
vegetated areas of the yard should be employed as the primary stonnwater BMP
for this site and location.
• The existing bare slope above the proposed retaining wall loc tion should receive
a cover of geosynthetic filter fabric to keep the natural 1ullsid6 soils in place and
allow the seeping of groundwater through the gravel backfill ater that will be
installed between the completed retailing wall and the existing hillside slope.
• All proposed work is to be accomplished during the lake's low level period in the
late Winter and early Spring before Tacoma City Light raises the lake's water
surface elevation for summertime recreational purposes.
• The Smith-DeLeo/Latham properties,though in the vicinity of slopes identified as
hazard areas by Mason County tenninology,is stable in its present condition as
indicated in the Talija Engineering accompanying report.
The Skolcomish Tribes Tribal Historic Preservation Officer(Kris Mi ler)will be
providing comment as to the potential cultural impacts of this document and you should
not move forward with the above project until you receive those comments. Thank you
