The fees paid for the MEP application($480) and site inspection ($70) were receipted and a copy of the receipt was mailed to you for your records. In the letter, I noted that check number 5864, in the amount of$110, was being returned. It appeared that the check was intended to satisfy the requirement for a site restoration bond. Unfortunately, the Planning Department is not able to accept restoration bonds in check form. I enclosed the bond form that is required in the August 5, 2002 letter, as well as section 17.01.200 of the Mason County Resource Ordinance which addresses bond requirements (17.01.200(I)(3)). As noted in the August 5, 2002 letter, you will need to obtain a reasonable estimate for the cost of conformance with the specifications of the restoration plan, including corrective work necessary to restore the disturbed area. If the $110 figure is based on an estimate for the cost of conformance with the specifications of the restoration plan, please document the cost of the 102 cedar trees, and planting and monitoring costs. The bond will be held for a period of three years. After the Director determines that restoration has been completed in compliance with approved plans and the three-year monitoring period has expired, the bond or other security shall be released. The County may collect against the bond when work which is not completed is found to be in violation of the conditions set forth in the restoration plan and/or the Director determines that the site is in violation of the purposes of the chapter. The bond form must be notarized, and two copies of the form must be returned to the Mason County Planning Department (copy of section 17.01.200 enclosed for your review). The Mason Environmental Permit application and associated restoration plan have been forwarded to Planner Rick Mraz for review for completeness. Rick advised me that the permit applications are on hold, pending receipt of the restoration bond. Again, thank you for your cooperation and assistance in resolving this matter. The enforcement file will be closed as soon as I receive the completed bond restoration form. In the August 5, 2002 letter, I requested that you submit the form by August 16, 2002. The complainant alleged that trees and vegetation were removed from a wetland area. While on site, I observed that a moderate amount of land clearing has taken place. The land clearing spans an area that appears to progress from fairly well drained upland to wetland at the lower portion of the property. I conducted a second site inspection with Senior Planner Rick Mraz on June 6, 2002. The purpose of the second site inspection was to determine the Category classification of the wetland. Rick and I determined that the length of the wetland extends approximately 190 feet. The wetland averages at least 15 feet in width, and is therefore at least 2,500 square feet in approximate size. As the wetland area is not characterized by more than 90% invasive vegetative species, the wetland is a Category 3 Wetland. I realize that some time has passed from my first date of inspection to present. I took the time to have the wetland categorized and also to research the legal file. Categorization was critical in determining whether County regulations apply to the site. I also needed to conduct a detailed legal file search to determine whether the wetland flagging observed on-site was a part of prior County review. I found no evidence of such review. As the land clearing activity took place within a regulated wetland and associated buffer area, the following "after the fact" permit application and associated material must be submitted: 0 Mason Environmental Permit A permit application is enclosed for your convenience. The permit application fee is $480 ($160 standard fee tripled due to "after the fact" status). The permit requirement is provided for in Mason County Resource Ordinance section 17.01.070 (copy of section 17.01.070 enclosed for your review). • Restoration Plan Submit a Restoration Plan in compliance with section 17.01.200(I)of the Mason County Resource Ordinance addressing restoration actions to achieve compliance with the Ordinance (copy of section 17.01.200 enclosed for your review). • Restoration Bond A bond form is enclosed. Refer to the enclosed section 17.01.200 of the Mason County Resource Ordinance for information on bond requirements (17.01.200(I)(3)). You will need to obtain a reasonable estimate for the cost of conformance with the specifications of the restoration plan, including corrective work necessary to restore the disturbed area. At that time Kristin French from Mason County Code Enforcement, noted that a moderate amount of land clearing had taken place in an area that appeared to progress from a well drained upland to wetland at the lower portion of the property. In accordance with the Mason County Resource Ordinance Section 17.01.100(F)(5),this restoration plan addresses the issue of restoring the disturbed area along with removing five additional danger trees. The purpose of this plan is to maintain wildlife habitat and ecological functions upheld by the wetland zone and associated buffer while protecting existing structures and public safety. Extent of Disturbance Tree clearing efforts encroached into a class III wetland on the premise that the trees were posing a direct threat an existing residential structure on the property. 12 mature red alders (Alnus rubra) were removed effecting approximately 800 sq. ft according to the delineated wetland boundary. These affects include removal of nutrients, increased solar radiation, and decreased structural habitat in relation to the wetland. All Western Red Cedar(Thuja plicata) were left intact and continue to maintain high levels of shade and structural habitat within the zone. Groundcover species including sword fern (Polystichum munitum), skunk cabbage (Lysichiton americanum), and salmonberry (Rubus spectabilis) have experienced minimal disturbance and are expected to recover. Future Disturbance Future tree falling activity will involve 5 more alders existing within the protected zone and will impact roughly 400 sq ft. of wetland. The purpose is to protect existing powerlines. These practices will not remove nutrients or structural habitat. The fallen trees will be left within the protected area. There will be no heavy equipment operated within the riparian management zone. Equipment parked outside the protected area will be strategically positioned so that it can assist in safely maneuvering the trees down into the protected zone. This will minimize disturbance to vegetative and geomorphic structure that could otherwise occur during the removal process. Measures Necessary for Restoration of Previous Disturbance The major component of this restoration plan is the replanting of native trees within the disturbed area. There were 12 large alder trees removed from the area within the restoration zone. Because the shallow root systems make larger alders a more probable threat to nearby structures, 72 cedar tree seedling at least 3 years old will be planted within the restoration zone. This will prevent future issues associated with large trees and shallow root systems. The presence of remaining maples and alders precludes the need to plant additional species. The tree seedlings will be flagged after planting in order 1) to relocate them for future maintenance. The overall restoration zone will encompass at least 800-1200 sq ft. There is no need to remove fill, regrade contours or excavate materials as outlined in the requirements of section 17.01.100. There is currently a patch of Himalayan Blackberries (Rubus discolor)existing within the restoration zone. All Himalayan Blackberry bushes will be removed before planting the cedars. Measures Necessary for Restoration of Future Disturbance Currently there are five alders within the protected area that are a threat to existing power lines. These alders be fallen away from the power lines and left within the protected wetland area to provide nurse log habitat and return nutrients to the soil. Also, there will be 30 additional cedars planted within the area of disturbance. Each seedling will be three years old when planted. The tree seedlings will be flagged after planting in order to relocate them for future maintenance. Although the long-term affect is projected to be negligible, vegetation damage may occur within the RMZ during the future falling process. Any mortality will be addressed by re-vegetating disturbed areas with pre- existing species. Shrubs would be planted two feet apart to optimize stabilization potential. They will also be placed in a random pattern to mimic natural conditions. Location of Proposed Mitigation Action A location map is attached which provides a spatial representation of the project area. Schedule for Restoration The restoration of the identified area will commence and be completed during March of 2003. 102 cedar trees will be planted within the restoration area as well as any shrubs that are needed. Following restoration the area will be maintained as a protected wetland and associated buffer. Monitoring Plan Monitoring of the site will begin in the fall of 2003 and maintained on a seasonal basis. The information gathered will provide the following. 1) Condition of reintroduced plant species; 2) the use of the site by wildlife species; 3) any disturbance and its effect on the restoration effort;4) any corrective measures that may be deemed necessary to provide the desired restoration outcome. This monitoring will be in effect for the duration of three years. The information gathered will be provided in an annual report and submitted to the Director of Mason County Department of Community Development if necessary. Sandra Jacobson is the coordinator for the native plant program and provided the following information during a phone conversation on July 26, 2002. The trees will be ordered in January of 2003 and received before March of 2003. The cost of the trees is $10.00 per bundle. Bundles include 10 trees between 18 and 24 inches. No further cost will be needed for restoration because the landowner wishes to do the planting on his own. There is a$110.00 check enclosed to fulfill the restoration bond requirement of this chapter. Reasonable Use: A legal concept that has been articulated by federal and State of Washington courts in regulatory taking cases. Mason County Resource Ordinance 99 Revised H1103 IN G. LIEN Mason County shall have a lien for any civil penalty imposed or for the cost of any work of abatement done pursuant to this Section, or both, against the real property on which the civil penalty was imposed or any of the work of abatement was performed and against any other real property owned by any person in violation. The lien shall be subordinate to all existing special assessment liens previously imposed upon the same property and any recorded encumbrances except for state and county taxes, with which it shall be on a parity. The Board shall cause a claim for lien to be filed for record with the Auditor within ninety calendar days from the date the civil penalty is due or within ninety calendar days from the date of completion of the work or abatement performed by Mason County pursuant to this Section. The claim of lien shall contain the following: 1. The authority for imposing a civil penalty or proceeding to abate the violation, or both; 2. A brief description of the civil penalty imposed or the abatement work done, or both, including the violations charged and the.duration thereof, the time the work is commenced and completed and the name of the persons or organizations performing the work; 3. A legal description of the property to be charged with the lien; 4. The name of the known or reputed owner; and 5. The amount, including lawful and reasonable costs, for which the lien is claimed. The lien may be foreclosed by a civil action in Mason County Superior Court. H. CRIMINAL PROCEDURES After the Director has exhausted civil options or if criminal negligence is apparent the Director may refer to the Prosecuting Attorney for a determination action under RCW 9.66.010. I. RESTORATION For property which contains designated wetlands, aquatic management areas, or terrestrial habitat management areas or their vegetation areas which has been disturbed, or landslide, seismic or erosion hazard areas on which a structure has been built or located in violation of this Chapter, no permit or approval or development of the. property shall be authorized or granted for a period of up to three (3) years from completion of restoration as determined by the Director. In the event of intentional or knowing violation of this Chapter, the County may bring an action against the owner of the land or the operator who committed the violation. This restoration section is also applicable to Mitigation for Wetland Impacts (Section 17.01.070 F) as modified below. 1. Restoration Plan. a. Where any designated wetlands, aquatic management areas, or terrestrial management areas or their vegetation area which has been disturbed, or subject to a permitted fill requiring mitigation, or landslide, Mason Counfy Resource Ordinance 93 Revised 3105102 seismic or erosion hazard areas or their buffers has been disturbed or a structure has been built, the applicant shall cause to be prepared, by a qualified biologist, plant ecologist, geologist or similarly qualified professional, as appropriate, a restoration plan which shall include as a minimum the following: (1) The extent of disturbance, or permitted action requiring mitigation, including an inventory of all vegetation cleared; and (2a) Measures necessary to restore the critical areas or their buffers/vegetation area, including removal of fill, regrading to original contours, if necessary, replacement of excavated material, revegetation of all cleared areas with native trees and/or plants and removal of structures; or (2b) Location of the proposed mitigation action, ownership, and methods to recreate,.as nearly as possible, the original wetlands or vegetation area in terms of acreage function, geographic location and setting. (3) A schedule for restoration; and (4) A monitoring plan to evaluate periodically the success of the restoration and provide for amendments to the plan which may become necessary to achieve its purpose. b. In preparing and approving the restoration plan, the applicant and the County, respectively, should consult with the Department of Wildlife, Department of Natural Resources, Department of Fisheries, and the Department of Ecology as appropriate. C. The restoration plan shall be prepared at the applicant's cost and shall be approved by the Director. The Director may approve, reject or approve the plan with conditions. All restoration shall be consistent with the approved restoration plan. 2. Monitoring. In any designated critical area where restoration has been required, the applicant, at its own cost, shall provide for seasonal monitoring of the site by a qualified biologist or other qualified professional, for a period of three years after completion. The applicant shall submit an annual report to the Director which discusses i) the condition of introduced or reintroduced plant species; ii) the condition of open water areas or other water features; iii) use of the site by fish and wildlife species; iv) any disturbances or alterations and their affects on the restoration; v) additional or corrective measures which should be taken to ensure the success of the restoration; and vi) other information which the Director considers necessary to assess the status of the restoration. 3. Restoration bond. Prior to commencing restoration of a wetland, deep water habitat, tributary stream or protected species habitat, or their vegetation area or a steep or unstable slope, the applicant shall post with the Director a bond or other security in an amount sufficient to cover the cost of conformance with the conditions of the restoration plan, including corrective work necessary to provide adequate drainage, stabilize and restore disturbed areas, and remove sources of hazard associated with work which is not completed. After the Director determines that restoration has been completed in compliance with approved plans and the monitoring period has expired, the bond or other security shall be released. The County may collect against the bond when work which is not completed is found to be in violation of the conditions set forth in the restoration plan and/or the Director determines that the site is in violation of the purposes of this Chapter.
