SUPERCEDES ORDINANCE NO. 637
AN ORDINANCE relating to Emergency Services
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MASON COUNTY, AND THE CITY OF SHELTON, STATE OF WASHINGTON,
as follows:
PURPOSE: The declared purpose of this Ordinance is to
provide for the establishment and operation of a local
organization for Emergency Services to provide for the
preparation and carrying out of plans for civil defense and
emergency functions for the protection and benefit of persons
and property within this County/City and to provide for the
coordination of the Emergency Services with all other public
agencies, private persons, corporations, and organizations
pursuant to RCW Chapter 38.52 Emergency Services.
DEFINITION: Emergency Services means the preparation for
and the carrying out of all emergency functions, other than
functions for which the military forces are primarily
responsible, to minimize and repair injury and damage
resulting from disasters caused by enemy attack, sabotage, or
other hostile action, or by fire, flood, storm, earthquake,
or other natural causes, and to provide support for Search
and Rescue operations for persons and property in distress.
EMERGENCY SERVICES COUNCIL
MEMBERSHIP: The Mason County Emergency Services Council
is hereby created and shall consist of the following:
A. The Board of Mason County Commissioners and the
Mayor of the City of Shelton. The Chairman of the Board of
County Commissioners shall act as Chairman of the Emergency
Services Council.
B. The Director of Emergency Services who shall be Vice
Chairman. In his absence, the Coordinator of Emergency
Services shall serve.
POWERS AND DUTIES: It shall be the duty of the Mason
County Emergency Services Council, and it is hereby
empowered, to review and recommend for adoption civil defense
and emergency service plans and agreements and such
resolutions and rules and regulations as are necessary to
implement such plans and agreements. The Emergency Services
Council shall meet upon the call of the Chairman, or in his
absence from the County or inability to call such a meeting,
upon the call of the vice-chairman.
DIRECTOR OF EMERGENCY SERVICES, POWERS AND DUTIES: There
is hereby created the office of Director of Emergency
Services and the position of Coordinator of Emergency
Services.
The Director is hereby empowered and directed, and, in his
absence, the Coordinator is hereby empowered and directed:
A. To prepare and revise an emergency services
operating plan for the County and City conforming to the
State Emergency Services Plan and program.
B. To control and coordinate the efforts of the
Emergency Services organization of the County and City for
the accomplishment of the purposes of this Ordinance.
C. To direct coordination and cooperation between
departments, services, and staff of the Emergency Services
organization of this County and City.
D. To 'represent the Emergency Services organization of
the County and City in all dealings with public and private
agencies pertaining to civil defense and disaster.
In the event of disaster, the Director is hereby
empowered, and in his absence, the Coordinator is hereby
empowered, with the concurrence of the Chairman of the Mason
County Emergency Services Council:
A. To make and issue rules and regulations on matters
reasonably related to the protection of life and property as
effected by such disaster, provided, however, such rules and
regulations must be confirmed at the earliest practicable
time by the Emergency Services Council.
B. To obtain vital supplies, equipment, and such other
properties found lacking and needed for the protection of
life and property as affected by such disaster, provided,
however, such rules and regulations must be confirmed at the
earliest practicable time by the Emergency Services Council .
C. To require emergency services of any County/City
employee, and in the event of a proclamation by the Governor
of the existence of a disaster, to command the aid of as many
citizens of this community as he considers necessary in the
execution of his duties; such persons shall be entitled to
all privileges, benefits and immunities as are provided by
State Law for registered emergency services workers.
D. To execute all of the special powers conferred upon
him by this ordinance or by resolution adopted pursuant
thereto, all powers conferred upon him by statute, agreement
approved by the Council, or by any other lawful authority.
E. To requisition necessary personnel or material of
any City/County department or agency.
EMERGENCY SERVICES ORGANIZATION: All County and City
employees, together with those volunteer forces enrolled to
aid them during a disaster, and all groups, organizations and
persons who may by agreement or operation of law, including
persons pressed into service charged with duties incident to
the protection of life and property in this county during
disaster, shall constitute the Emergency Services
organization of the County of Mason.
REPEAL OF CONFLICTING ORDINANCES AND RESOLUTIONS: Any
existing Civil Defense or Emergency Services or disaster
ordinances and resolutions are hereby repealed and superseded
by this Ordinance Provided, that it is the intent of the
Board of County Commissioners and the City of Shelton in
enacting this ordinance that it shall be a revision and
continuation of the ordinance or resolution repealed by this
resolution, and the status of volunteers shall not be
affected by such repeal, nor shall Civil Defense or Emergency
Services plans and agreements, rules and regulations or
resolutions adopted pursuant to such repealed resolution be
affected by such repeal until amended, modified, or
superseded and provided in this Ordinance.
EFFECTIVE DATE: This ordinance is hereby declared to be
necessary for the preservation of the public peace, health,
and safety, and shall take effect immediately.
SEVERABILITY: If any provision of the Ordinance or the
application thereof to any person or circumstances is held
invalid, such invalidity shall not affect other provisions or
application, and to this end the provisions of this ordinance
are declared to be severable.
