WHEREAS, Growth Management Hearings Boards are established under the
Growth Management Act (RCW 36.70.A) to review and decide whether counties are
complying with the requirement of the Growth Management Act; and
WHEREAS, recent Board decisions frustrate efforts to conclude comprehensive
plans by requiring such plans to be based on outdated and inflexible population
projections; and
WHEREAS, acceptability of Growth Management requires flexibility in population
forecasting and requires recognition of existing population distribution;
NOW THEREFORE BE IT RESOLVED, because the Growth Management
Hearin as Boards are exceeding their statutory authority and in recent decisions
substantially the Growth Management Act, Mason County is requesting the Thurston
County Superior Court to stay the effect of the decisions until a trial can occur and the
merits of the State Legislature has the opportunity to clarify the Growth Management Act
in the 1995 Legislative Session.
