Alteration to Plat of Colony Surf First Addition ALTERATION TO COLONY SURF, FIRST ADDITION RESOLUTION = On February 6, 1961, the Plat of Colony Surf, First Addition, 2located in Sections 9 & 10, Township 23 North, Range 3 West, W,M. , was recorded in Volume 6, Pages 93 through 94 records of Mason County, Washington. . WHEREAS, The Dedication included in Colony Surf, First Addition, is as follows : Know all men by these presents that the undersigned Muller, his wife, owners in fee simple of the land hereby platted and Richard E. Jacobsen, D. Alison Vanderstaay and Chesterfield Development Corporation, contract purchasers there of hereby declare this plat and dedicate to the use of. the Colony Surf Community Club forever, all streets, avenues, places, and easements . Also, the right to make all necessary slopes for cuts and fills upon lots, blocks, tracts, e,t. c. , shown on this plat in the reasonable original grading of all the streets, avenues, places, e.t . c, shown hereon. Also, the right to drain all streets over and across any lot or lots where water might take a natural course after the street or streets are graded. All streets shall be private. WHEREAS, The final plat contains a Note which reads as follows : Utility Easement shall be over a 2 1/2 ' wide strip along each side of interior lot lines and over the rear 5' of each lot unless otherwise noted. WHEREAS, RCW 58 . 17 .215 - Alteration of subdivision - Procedure, provides a method by which a person interested in the alteration of any subdivision or the altering of any portion thereof may proceed; WHEREAS, Stan and Candy Johnson, owners of Lots 2 & 3 , Block 1, all in Division 1, Colony Surf, have made application with the Mason County Board of County Commissioners requesting an alteration to the easements running approximately southeast to northwest an average of 130 to 450 feet, for the purpose of obtaining a parcel combination in order to combine said lots into a single building lot . WHEREAS, the application contains the signatures of the majority of those persons having an ownership interest of lots, tracts, parcels, sites, or divisions in the subject subdivision or portion thereof; WHEREAS, the Colony Surf Homeowners Association, the Colony Surf Water System, PUD # 1, and U.S . West Communications have all relinquished their interest in the easement; WHEREAS, the Mason County Board of County Commissioners did notify the effected landowners as required by R.C.W. 58 . 17.215 ; WHEREAS, a public hearing was held on March 26, 1996, at 10 :45 AM, in the Commissioners Chambers; WHEREAS, after due consideration it appears to be in the best public interest to approve the request made by Stan and Candy Johnson; EE L F R 3 q NOW THEREFORE BE IT RESOLVED that the Board authorizes the alteration of the previously described 5 ' easement between Lots 2 & 3 , Block 1, Division 1, Colony Surf, with the understanding that there is no drainage in effect on these property lines and that the combination is for the purpose of preforming parcel combinations in order to create a single building lot. PASSED IN REGULAR SESSION this 26th day of March, 1996 .
