AN ORDINANCE creating a Lake Management District for Island Lake pursuant to Chapters 36.61 RCW, to be designated Mason County Lake Management District No. 1 for Island Lake. WHEREAS, Chapter 36.61 RCW authorizes the Board of Mason County Commissioners to initiate the creation of lake management districts; WHEREAS, the Board of Mason County Commissioners found creation of a lake management district for Island Lake to be in the public interest through adoption of Resolution of Intention No. 18-98; and WHEREAS, the proposal to create the lake management district received a majority of the votes cast by property owners within the proposed district pursuant to RCW 36.61.080-.100. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Mason County as follows: Mason County Lake Management District No. 1 for Island Lake, as proposed in attached Resolution No. 18-98 adopted on February 24, 1998 is hereby created. BE IT FURTHER ORDAINED THAT: 1. Rates and charges for Lake Management District No. 1 shall be included in Mason County's annual property tax statements. Properties which do not receive a property tax statement will receive a separate billing statement for these rates and charges. 2. The total amount of the Lake Management District No. 1 rate and charge.shall be due and payable on or before the 30th day of April and shall be delinquent after that date; however, if one-half of such rate and charge is paid on or before the said 30th of April the remainder shall be due and payable on or before the 31 st day of October and shall be delinquent after that date. 3. If a payment is received in conjunction with a combined property tax and Lake Management District No. 1 rate and charge, and the payment is less than the amount due, the payment shall be applied first to the annual property tax of the parcel and any remaining amount to the Lake Management District No. 1 rate and charge. Auditor/Accounting Assessor Treasurer i RE SOLUTION NO.18-98 A RESOLUTION declaring the intention of the Board of County Commissioners to establish Lake Management District No. 1 for Island Lake pursuant to Chapter 36.61 RCW and setting the public hearing on formation of the same. WHEREAS, there is an indication of siguificaut support from Island Lake property owners for formation of a Lake Management District (LMD) as evidenced by submittal of LMD petitions, several well attended meetings, and favorable responses to an informal written survey conducted by the Island Lake Steering Committee; and WHEREAS, the Board of County Commissioners has considered the Island Lake Eurasian Watermilfoil Eradication and Aquatic Plant Management Plan recommended by the Island Lake Steering Conmmittee which would be the basis for the work plan for the LMD which includes provisions for eliminating the Eurasian Watermilfoil from the Lake while protecting and enhancing fish and wildlife habitat; The Board of County Commissioners enters the following findings of fact: 1. Formation of an LMD to protect Island Lake's beneficial uses and water quality is in the public interest. This is evidenced by the broad support expressed by Island Lake property owners evidenced by the number of signatures appearing on the LMD petitions and Jhe Watermilfoil Eradication and Aquatic Plant Management Plan prepared by the Island Lake Steering Committee. All properties with the LMD boundaries have direct access to the lake and enjoy significant opportunity to enjoy the lake through passive and active recreation which is reflected in relatively higher property values. These property owners will collectively share the greatest amount of benefit from the lake management program. Benefit to each property is appropriately reflected in the rates, which provide for a charge based on the appraised value of the property. 2. The financing of the lake improvement or maintenance activities is feasible. The LMD will obtain a loan in the amount of$115,000, to be retired by the rates and charges to district landowners over the life of the LMD. The amount to be collected in sufficient to complete the plan. 3. Adequate provisions have been made to protect fish and wildlife. Aquatic herbicides have been approved for use by the US Enviromnental Protection Agency for the use irt,lakes and reservoirs used for human drinking water consumption. The herbicide will not harm fish or wildlife, and by eliminating the Eurasian Watermilfoil, the native flora and fauna should be restored. 4. Financial security should not be required to cover the costs of the LMD process. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners for Mason County as follows: 1. Pursuant to RCW 36.61.030, the Board of Mason County Commissioners hereby designates the proposed LMD as Mason County Lake Management District No. 1 for Island Lake. 2. The nature of the lake improvement or maintenance activities proposed is application of the aquatic herbicide, into the lake by a licensed professional under permit issued by the Washington Department of Ecology to eradicate Eurasian Watermilfoil, followed in subsequent years with underwater surveys and spot treatment for as long as adequate funding remains. The strategy and methods to accomplish these objectives are detailed in the Island Lake Eurasian Watermilfoil Eradication and Aquatic Plant Management Plan, and will be implemented in conformance with State and County requirements. i Resolution No. 18-98 Page 2 of 2 3. Annual rates and charges will be collected to raise funds to support LMD activities. The total amount of money proposed to be raised by rates and charges is $143,033, which amount will be collected in approximately equal annual installments of$28,607 over five years (which includes yearly estimated interest on the loan). It is anticipated that revenue bonds or notes payable from such rates and charges will be issued to finance the activities of the LMD. 4. The duration of the proposed LMD is five years. 5. The proposed boundaries of the District are all properties fronting Island Lake in Mason County, Washington. 6. A Steering Committee composed of volunteers who own property within the Lake Management District will be appointed by the Mason County Commissioners. The purpose of the Committee is to work in cooperation with assigned county staff to provide citizen input to the county on management decisions within the context of the LMD charter. The Committee will give input to developing, monitoring, and modifying work plans for each year. The Committee will track expenditures and work program progress with information supplied by Mason County staff. 7. Financial security will not be required to be posted to cover costs of the LMD process as authorized by RCW 36.61.030. 8. A public hearing on the formation of proposed LMD No. 1 shall be held on March 27, 1998, 7:00 p.m. at Fire Protection District No. 11 Firehall,E 130 Island Lake Rd., Shelton, WA.
