MASON COUNTY DEPARTMENT OF COMMUNITY SERVICES DETERMINATION OF MITIGATED NONSIGNIFICANCE (WAC 197-11-340) SEP2019-00093 Description of Proposal: This SEPA is associated with an application to waive 2- acres of a 5.7-acre parcel from a 6-year development moratorium,which was the normal consequence of a Class III FPA(#2420043).This level parcel in bounded to the south by Cloquallum Creek which is designated "Conservancy" by the Mason County Shoreline Master Program.The waiver envelope is 150'from the creek and the eventual house will be setback an additional 15'. A buffer for an off-site wetland extends 110' into the NW corner of this parcel and is excluded from the waiver envelope.The site has been stumped and is subject to replanting to DNR specifications,outside of the waiver envelope. Development with hard surfaces (buildings, parking and lawns)will be limited to the eastern 215' of the waiver envelope and the balance will be pasture or orchard. Staff has inspected the site and found no environmental damage. No other critical area issues.The new owner was not associated with the original FPA.The balance of the parcel will remain under the moratorium until 4/12/2024. The Department of Ecology (Ecology)reviewed the environmental checklist and has the following comment(s): WATER RESOURCES: Jacquelyn Metcalfe,Watermaster(360)407-6471 In Washington State,prospective water users must obtain authorization from the Department of Ecology before diverting surface water or withdrawing ground water, with one exception. Ground water withdrawals of up to 5,000 gallons per day used for single or group domestic supply, industrial purposes, or for the irrigation of up to one-half acre of lawn and garden are exempt from the permitting process. Water use under the RCW 90.44.050 exemption establishes a water right that is subject to the same privileges, restrictions, laws and regulations as a water right permit or certificate obtained directly from Ecology. Under a new law that became effective January 19, 2018 (ESSB 6091),new ground water withdrawals from wells within the Lower Chehalis watershed may use a maximum annual average of 3,000 gallons per day,per connection, for indoor and outdoor domestic uses. RCW 90.44.050 still limits the overall withdrawal to 5,000 gallons per day and up to one-half acre of lawn or noncommercial garden irrigation for the entire project as long as the annual average does not exceed 3,000 gallons per day per connection. Any use above this level requires a water right permit.
