GRADES. ALL RELATED WORK WILL BE OUTSIDE THE HIGH ORDINARY WATER MARK AND
WILL NOT ALTER EXISTING DRAINAGE PATTERNS.
Within BINGHAM/SATSOP(EAST) and/or its associated wetlands is exempt from the requirement of substantial
development because the development is categorized under WAC 173-27-040(2) as being category
B-normal maintenance

Name of Proposal: -BINGHAM CREEK HATCHERY IMPROVEMENTS
Description of Proposal: The proposed project at Bingham_Creek Hatchery consists of two
primary elements:
1. Demolition of and replacement of five (5) rearing ponds. Existing ponds are 20' X 8099
,
proposed ponds 10' X 100' within the existing ponds footprint. The existing ponds are
cracking and are at the end of their life cycle.
2. . Pipeline replacement of hatchery water supply from Bingham Creek. Project replaces
approximately 3,050 linear feet of 24 inch concrete pipe with 24 inch solid wall fuse weld
HDPE Pipe within the existing pipeline footprint. The existing concrete.pipeline is nearing
the end of its life cycle. _
All proposed project work for both elements will be completed outside the OHW.

WDFW'has determined that this proposal will likely not have a significant_adverse impact on the

WDFW made this determination of nonsignificance(DNS) after we reviewed the environmental
checklist and other information on file with us.
We issued this DNS according to state rules.2 We will not act on this proposal for 14 days
from the date.we issued the DNS. Agencies, affected tribes,and members of the public are
invited to comment on this proposal or DNS. We must receive your comments within 14 days of
the date of this letter. This means we must receive your comments by October.26,2012.

The project is subject to review and permitting per the Mason County Shoreline Master
Program. Please contact the County for further information. The project may also be subject
to permitting from the U.S. Army Corps of Engineers (Corps)pursuant to the Clean Water
Act(CWA). Please contact the Corps in that regard. If a CWA permit is required by the
Corps, an associated permit may be required by Ecology.

Property owners, developers, and contractors are encouraged to recycle all possible leftover

The applicant proposes to demolish an existing structure(s). In addition to any required
asbestos abatement procedures,the applicant should ensure that any other potentially
dangerous or hazardous materials present, such as PCB-containing lamp ballasts, fluorescent
lamps, and wall thermostats containing mercury, are removed prior to demolition. It is
important that these materials and wastes are removed and appropriately managed prior to
demolition. It is equally important that demolition debris is also safely managed, especially
if it contains painted wood or concrete,treated wood, or other possibly dangerous materials.

Quality Standards for Surface Waters of the State of Washington, and is subject to
enforcement action.
Erosion control measures must be in place prior to any clearing, grading, or construction.
These control measures must be effective to prevent stormwater runoff from carrying soil
and other pollutants into surface water or stormdrains that lead to waters of the state. Sand,
silt, clay particles, and soil will damage aquatic habitat and are considered to be pollutants.
Proper disposal of construction debris must be on land in such a manner that debris cannot
enter water of the state and stormdrains draining to waters of the state or cause water quality
degradation of state waters.
Ecology's comments are based upon information provided by the lead agency. As such,they
may not constitute an exhaustive list of the various authorizations that must be obtained or legal
requirements that must be fulfilled in order to carry out the proposed action.

Sonia,Thank you for your timely comments on the Washington Department of Fish and Wildlife's
(WDFW) proposed Hatchery Improvements at the Bingham Creek Hatchery. I have triple checked with
the Department's Project Leader and Lead Engineer to ensure that none of the proposed work would
occur in the stream,and that we all could be assured that no silt or sediment would enter any waters of
the-state.
The proposed project construction for the pipeline replacement/repair is scheduled to occur on the
upland side of the hatchery water intake structure thus precluding any activity to occur within or below
the ordinary high water mark.Additionally,WDFW has incorporated all relevant DOE Manual
Requirements and Best Management Practices to protect water quality during the construction phase of
the proposed project.
Finally,WDFW has and will continue to coordinate and work cooperatively with Mason County's
Planning and Permitting staff to ensure all critical elements and permitting requirements are met to
their satisfaction.Again thank you for your timely and helpful comments.

The proposed project site is reached by turning east off of the Matlock-Brady Road (approximately 4.6
miles south of Matlock) onto Fish Hatchery Road and proceeding approximately 3.8 miles to the end of.
the road and onto the hatchery grounds.

Proposed project consists of two primary elements: 1. Demolish and replace five (5),concrete
rearing ponds within the existing pond's footprint. 2. Replace 3,050 feet of 24" concrete water
supply. pipe with new 24" steel pipe. The new pipeline is to be placed immediately beside the
existing pipeline. Both elements of the proposed project will be constructed on existing
grades. All related construction work will be outside-the High Ordinary Water Mark and will not
alter existing drainage.patterns.

To secure water delivery to the hatchery and eliminate fish losses that escape out of the
existing .cracked leaky ponds. Bingham Creek Hatchery provides for directed treaty and non-
treaty commercial net and selective recreational fisheries throughout the Chehalis and Grays
Harbor Basin.

The proposed project will demolish five (5) existing 20' X 80' concrete rearing ponds and replace with five (5)
new concrete 10' X100" rearing ponds as one major element of the project. The new ponds will be constructed
within the existing pond's footprint. The drains of the new ponds will be tied into the existing hatchery discharge
lines. The second element of the project is to replace approximately 3,050 linear feet of old 24 inch concrete
water supply pipe with a new 24.inch steel pipe. The replacement pipe will be buried immediately alongside the
existing pipeline. Digging of the pipeline ditch will be done with an excavator, soils removed prior to placing
new pipeline will be returned to cover new pipeline. Both elements of the proposed project will be conducted
above the.ordinary high water mark, and no in water work is associated with this project. Both elements of the
proposed project maintain existing elevations. No sediment will enter the water. Appropriate best management
practices will be followed in accordance to DOE's 2005.Manual. All sediment and construction waste associate
with the rearing pond demolition will.be removed and taken to an approved upland site for disposal. In the
unlikely event that cultural resources are uncovered during construction, work in the immediate vicinity of the
discovery will be halted, and WDFW will consult with the Washington State Historic Preservation officer.

Thanks for taking the time to talk with me about the stormwater issues and requirements for this
project. I'm writing this email to summarize our conversation and to make sure everyone is on the
same page before we move forward. To summarize, the project will only be addressing Minimum
Requirements#145.
The following is a brief narrative describing the Bingham Creek Hatchery rearing pond
replacement(RPR)project and how I interpret the 2005 DOE stormwater manual requirements
related to that work.
Project Description
The intent of the project is to replace the existing concrete rearing ponds that are cracking and are
near the end of their life cycle. To maintain fish rearing operations on site,the ponds will be
replaced with a similar concrete structure providing the same capabilities as the existing ponds.
The existing ponds are situated in a fully impervious area with slopes not greater than 1%. The
greater impervious area serving hatchery activities sheet flows into the East Fork Satsop River
along its shared length. The project will not alter the current hydraulic condition.
Ideally,this project will fall under a maintenance program due to the nature of the work and
restrictive constraints.
2005 DOE Manual
According to Fig. 2.3 and Section 2.4.2,the RPR will be a redevelopment project because we will
replace more than 2,000 SF of impervious surface (the new ponds alone are about 6,000 sf).
Following the flow chart(Fig. 2.3), we are immediately subject to Minimum Requirements #145.
We answer no to the next question about adding impervious surface or disturbing native
vegetation. If we answer yes to "Is this a road project?",then we are done and are only subject to
#145. Excluding the replacement of the ponds, the underground utility work and paving could be
considered a road project.
If we answer no to "Is this a road project?", then we get caught up in the cost of the proposed
improvements vs the assessed tax value of the existing improvements. According to the manual,
this would force us to address all Minimum Requirements#1-#10. See below.

The hatchery in general (and the RPR) is not a pollution generating facility but fish hatcheries
aren't explicitly defined in the DOE manual. The project is replacing a failing structure with
something that matches current capabilities while adding no additional impervious surface to the
site. This will have no impact to the hydraulics of the site. Base on our conversation,you agreed
with this conclusion and we decided that we will only be addressing Minimum Requirements#1-
#5.
