No permit or exemption authorizing construction shall extend for a term of more than five years. If actual construction of
a development for which a permit has been granted has not begun within two years after approval, the Review
Authority, the Mason County Planning Department, shall review the Mason Environmental Permit(MEP)and upon
showing good cause, may extend the initial two year period by one year. No permit shall be extended unless the
applicant has requested such review and extension prior to the exporation date.

Thank you for the opportunity to comment on the determination of nonsignificance for the
Sandoval Bulkhead Repair/Pier and Replacement Project(SEP2017-00017& SHX2017-00014)
located at 311 North Marine View Drive in Hoodsport as proposed by Barbara and Randolph
Sandoval. The Department of Ecology(Ecology)reviewed the environmental checklist and has
the following comment(s):

The following construction activities require coverage under the Construction Stormwater
General Permit:
1. Clearing, grading and/or excavation that results in the disturbance of one or more
acres and discharges stormwater to surface waters of the State; and
2. Clearing, grading and/or excavation on sites smaller than one acre that are part of a
larger common plan of development or sale, if the common plan of development or
sale will ultimately disturb one acre or more and discharge stormwater to surface
waters of the State.
a) This includes forest practices(including, but not limited to, class IV conversions)
that are part of a construction activity that will result in the disturbance of one or
more acres, and discharge to surface waters of the State; and
3. Any size construction activity discharging stormwater to waters of the State that
Ecology:
a) Determines to be a significant contributor of pollutants to waters of the State of
Washington.
b) Reasonably expects to cause a violation of any water quality standard.

If there are known soil/ground water contaminants present on-site, additional information
(including,but not limited to: temporary erosion and sediment control plans; stormwater
pollution prevention plan; list of known contaminants with concentrations and depths found;
a site map depicting the sample location(s); and additional studies/reports regarding
contaminant(s))will be required to be submitted.

site operators must apply for a permit at least 60 days prior to discharging stormwater from

Project Name: Sandoval Bulkhead Repair and Pier& Float Replacement
Project Description: The proposed action is the repair of an existing wood bulkhead and the installation of a
replacement pier and float. New shoreline access stairs and an upland shoreline retaining wall
will also be installed, and an existing shoreline shed and shoreline access stairs with
associated landings will be removed. Overwater coverage at the site will be reduced by
approximately(approx.)290 square feet(sf), and the number of piling posts will be reduced
from approx. sixteen (16)to ten (10).
PROVISIONS
TIMING - PLANS- INVASIVE SPECIES CONTROL
1. TIMING LIMITATION: During any calendar year during the life of the permit:
a)work may be begin once the lake draw-down has begun and the work area is at least 5 feet from the water.
b) For the protection of fish life, all work must be completed by April 1. This is due to the seasonal variations and
unpredictability of the increasing lake level.
2.APPROVED PLANS: You must accomplish the work per plans and specifications submitted with the application and
approved by the Washington Department of Fish and Wildlife, entitled "Sandoval Drawings_01.13.2017", submitted
03/22/2017, except as modified by this Hydraulic Project Approval.You must have a copy of these plans available on
site during all phases of the project construction.
3. INVASIVE SPECIES CONTROL: Thoroughly clean all equipment and gear before arriving and leaving the job site to
prevent the transport and introduction of aquatic invasive species. Properly dispose of any water and chemicals used to
clean gear and equipment. You can find additional information in the Washington Department of Fish and Wildlife's
Invasive Species Management Protocols (November 2012), available online at
hftp://wdfw.wa.gov/publications/01490/wdfwOl 490.pdf.
NOTIFICATION REQUIREMENTS
4. PRE-AND POST-CONSTRUCTION NOTIFICATION: You, your agent, or contractor must contact the Washington
Department of Fish and Wildlife by e-mail at HPAapplications@dfw.wa.gov; mail to Post Office Box 43234, Olympia,
Washington 98504-3234; or fax to (360)902-2946 at least three business days before starting work, and again within
seven days after completing the work. The notification must include the permittee's name, project location, starting date
for work or date the work was completed, and the permit number. The Washington Department of Fish and Wildlife
may conduct inspections during and after construction; however, the Washington Department of Fish and Wildlife will
notify you or your agent before conducting the inspection.
5. PHOTOGRAPHS:You,your agent, or contractor must take photographs of the job site before the work begins and

after the work is completed. You must upload the photographs to the post-permit requirement page in the Aquatic
Protection Permitting System (APPS)or mail them to Washington Department of Fish and Wildlife at Post Office Box
43234, Olympia, Washington 98504-3234 within 30-days after the work is completed.
6. FISH KILL/WATER QUALITY PROBLEM NOTIFICATION: If a fish kill occurs or fish are observed in distress at the
job site, immediately stop all activities causing harm. Immediately notify the Washington Department of Fish and
Wildlife of the problem. If the likely cause of the fish kill or fish distress is related to water quality, also notify the
Washington Military Department Emergency Management Division at 1-800-258-5990.Activities related to the fish kill
or fish distress must not resume until the Washington Department of Fish and Wildlife gives approval. The Washington
Department of Fish and Wildlife may require additional measures to mitigate impacts.
STAGING, JOB SITE ACCESS, AND EQUIPMENT
7. Establish staging areas(used for equipment storage, vehicle storage, fueling, servicing, and hazardous material
storage) in a location and er that will prevent contaminants such as petroleum products, hydraulic fluid,fresh
concrete, sediments, sedirn nt-laden water, chemicals, or any other toxic or harmful materials from entering waters of
the state.
8. Use existing roadways t, 'vel paths.
9. This Hydraulic Project p oval does not authorize the removal of riparian zone vegetation.
10. Retain all natural ha' ita eatures on the bed or banks including large woody material and boulders. You may move
these natural habitat fe tu_u s during construction but you must place them near the preproject location before leaving
the job site.
11. Limit the use of equipment waterward of the ordinary high water line to hand tools only.
12. Remove soil or debris from the drive mechanisms (wheels,tires,tracks, etc.)and undercarriage of equipment prior
to operating the equipment waterward of the ordinary high water line.
13. If wet or muddy conditions exist, in or near a riparian zone or wetland area, use equipment that reduces ground
pressure.
14. Check equipment daily for leaks and complete any required repairs in an upland location before using the
equipment in or near the water.
15. Use environmentally acceptable lubricants composed of biodegradable base oils such as vegetable oils, synthetic
esters, and polyalkylene glycols in equipment operated in or near the water.
CONSTRUCTION-RELATED SEDIMENT, EROSION AND POLLUTION CONTAINMENT
16. Work in the dry.
17. Protect all disturbed areas from erosion. Maintain erosion and sediment control until all work and cleanup of the job
site is complete.
18.All erosion control materials that will remain onsite must be composed of 100% biodegradable materials.
19. Stop all hydraulic project activities except those needed to control erosion and siltation, if flow conditions arise that
will result in erosion or siltation of waters of the state.
20. Prevent project contaminants, such as petroleum products, hydraulic fluid, fresh concrete, sediments, sediment-
laden water, chemicals, or any other toxic or harmful materials, from entering or leaching into waters of the state.
21. Use tarps or other methods to prevent treated wood, sawdust, trimmings, drill shavings and other debris from
contacting the bed or waters of the state.
22. Deposit waste material from the project, such as construction debris, silt, excess dirt, or overburden, in an upland
area above the limits of anticipated floodwater unless the material is approved by the Washington Department of Fish
and Wildlife for reuse in the project.

23. Do not burn wood treated with preservatives,trash, waste, or other deleterious materials waterward of the ordinary
high water line.
24. Deposit all trash from the project at an appropriate upland disposal location.
CONSTRUCTION MATERIALS
25. Store all construction and deconstruction material in a location and manner that will prevent contaminants such as
petroleum products, hydraulic fluid, fresh cement, sediments, sediment-laden water, chemicals, or any other toxic or
harmful materials from entering waters of the state.
26. Do not stockpile construction material waterward of the ordinary high water line.
27. During construction you may stockpile construction material, except fresh concrete and petroleum products,
waterward of the OWHL provided you place the construction material no more than ADD TEXT HERE feet waterward
of the ordinary high water line.
28. Use only clean, suitable material as fill material (no trash, debris, car bodies, tires, asphalt, concrete, etc.).
29. Angular rock,the rock must be large enough and installed to withstand the 100-year peak flow. OR Angular rock,
the rock must be large enough and installed to withstand the ADD TEXT HERE-year peak flow.
30. To prevent leaching, construct forms to contain any wet concrete. Place impervious material over wet concrete that
will come in contact with waters of the state. Forms and impervious materials must remain in place until the concrete is
cured.
31. Do not use wood treated with oil-type preservatives (creosote, pentachlorophenol)in any hydraulic project. You
may use wood treated with waterborne preservatives (ACZA,ACQ)provided the wood is approved by the Western
Wood Preservers Institute for use in the aquatic environment.Any use of treated wood in the aquatic environment must
follow guidelines and best management practices available at www.wwpinstitute.org.
PIER, RAMP,AND FLOAT
32. Remove the existing pier, ramp and float and associated materials from waters of the state. Do not relocate the
structure within waters of the state without written authorization from Washington Department of Fish and Wildlife.
33. The structure must include functional grating. The grating material's open area must be at least sixty percent.
a. Grating installed parallel to the length of the pier must extend the length of the pier and cover at least thirty
percent of the deck area.
b. The ramp must have one hundred percent of the entire deck surface covered in functional grating.
C. The float must have at least thirty percent of the entire deck surface covered in functional grating. Orient grating
so the lengthwise opening maximizes the amount of light penetration.Any objects that are not part of the structure on,
above, or below the grating should not block light penetration. Flotation must be located under the solid decked area
only.
34. Fully enclose and contain flotation for the structure in a shell (tub)or 20-25 mm polyethylene or polyurethane
wrap. The shell or wrap must prevent breakup or loss of the flotation material into the water. The shell or wrap must not
be readily subject to damage by ultraviolet radiation and abrasion.
35. Do not construct skirting, including batter fencing, around piers, docks or floats.
36. Use of treated wood for decking is not authorized, but may be used for structural elements. Treated wood subject to
abrasion by vessels,floats, or other objects must incorporate approved design features such as rub strips to minimize
abrasion of the wood.
DEMOBILIZATION AND CLEANUP
37. Do not relocate removed or replaced structures within waters of the state. Remove and dispose of these structures
in an upland area above the limits of anticipated floodwater.
38. Before the end of the in-water work period specified in the"timing limitations" provision, remove all temporary

stream crossings and restore the bed and banks to preproject condition.
39. Upon completion of the project, restore the disturbed bed, banks, and riparian zone to preproject condition to the
extent possible.
40. Completely remove any temporary fill before the end of the in-water timing window if the fill material could erode
and deliver sediment-laden water into waters of the state.
41. Restore bed and bank elevations and contours to preproject condition.
42. To prevent fish from stranding, backfill trenches, depressions, and holes in the bed that may entrain fish during high
water or wave action.
43. Upon completion of the project, remove all materials or equipment from the site and dispose of all excess spoils
and waste materials in an upland area above the limits of anticipated floodwater.
44. Remove temporary erosion and sediment control methods after job site is stabilized or within three months of
project completion, whichever is sooner.

The person(s)to whom this Hydraulic Project Approval is issued and operator(s)performing the work may be held liable
for any loss or damage to fish life or fish habitat that results from failure to comply with the provisions of this Hydraulic
Project Approval.
Failure to comply with the provisions of this Hydraulic Project Approval could result in a civil penalty of up to one
hundred dollars per day and/or a gross misdemeanor charge, possibly punishable by fine and/or imprisonment.
All Hydraulic Project Approvals issued under RCW 77.55.021 are subject to additional restrictions, conditions, or
revocation if the Department of Fish and Wildlife determines that changed conditions require such action. The person(s)
to whom this Hydraulic Project Approval is issued has the right to appeal those decisions. Procedures for filing appeals
are listed below.
MINOR MODIFICATIONS TO THIS HPA: You may request approval of minor modifications to the required work timing
or to the plans and specifications approved in this HPA unless this is a General HPA. If this is a General HPA you must
use the Major Modification process described below. Any approved minor modification will require issuance of a letter
documenting the approval. A minor modification to the required work timing means any change to the work start or end
dates of the current work season to enable project or work phase completion. Minor modifications will be approved only
if spawning or incubating fish are not present within the vicinity of the project. You may request subsequent minor
modifications to the required work timing. A minor modification of the plans and specifications means any changes in the
materials, characteristics or construction of your project that does not alter the project's impact to fish life or habitat and
does not require a change in the provisions of the HPA to mitigate the impacts of the modification. Minor modifications
do not require you to pay additional application fees or be issued a new HPA. If you originally applied for your HPA
through the online Aquatic Protection Permitting System (APPS), you may request a minor modification through APPS.

APPEALS INFORMATION
If you wish to appeal the issuance, denial, conditioning, or modification of a Hydraulic Project Approval (HPA),
Washington Department of Fish and Wildlife (WDFW)recommends that you first contact the department employee who
issued or denied the HPA to discuss your concerns. Such a discussion may resolve your concerns without the need for
further appeal action. If you proceed with an appeal, you may request an informal or formal appeal. WDFW encourages
you to take advantage of the informal appeal process before initiating a formal appeal. The informal appeal process
includes a review by department management of the HPA or denial and often resolves issues faster and with less legal
complexity than the formal appeal process. If the informal appeal process does not resolve your concerns, you may

taken under Chapter 77.55 RCW. Please refer to that rule for complete informal appeal procedures. The following
information summarizes that rule.

appeal of that action. You must send your request to WDFW by mail to the HPA Appeals Coordinator, Department of
Fish and Wildlife, Habitat Program, 600 Capitol Way North, Olympia, Washington 98501-1091; e-mail to
HPAapplications@dfw.wa.gov; fax to (360)902-2946; or hand-delivery to the Natural Resources Building, 1111
Washington St SE, Habitat Program, Fifth floor. WDFW must receive your request within 30 days from the date you
receive notice of the decision. If you agree, and you applied for the HPA, resolution of the appeal may be facilitated
through an informal conference with the WDFW employee responsible for the decision and a supervisor. If a resolution
is not reached through the informal conference, or you are not the person who applied for the HPA,the HPA Appeals
Coordinator or designee will conduct an informal hearing and recommend a decision to the Director or designee. If you
are not satisfied with the results of the informal appeal, you may file a request for a formal appeal.

appeal is suspended during consideration of a timely informal appeal. If there has been an informal appeal, you may

response to the informal appeal.
C. FAILURE TO APPEAL WITHIN THE REQUIRED TIME PERIODS: If there is no timely request for an appeal,the
WDFW action shall be final and unappealable.
