As you know, Tacoma Power's Cushman Hydroelectric Project area (Project) includes all lands located waterward of the 742-foot elevation Project boundary. Tacoma Power also retains a 10-foot lateral easement on your leased development lot adjacent to the Project boundary. All structures and uses located waterward of 742 feet elevation, and all structures and fill placed within the 10-foot lateral easement require authorization from Tacoma Power. i Tacoma Power has reviewed your SUP application package for conformance with Tacoma Power's Shoreline Use Specifications and Permitting Guidelines (SUSPG)and has the following comments: Items Reviewed: • SUP application dated January 15, 2018 (received January 31, 2018), • Drawings (2 pages), hand drawn, dated November 8, 2017, • Tacoma Power Records. 1. Stairs. Allowed, with conditions. As shown in the above referenced drawings, you have proposed to retain your stairs leading from your development lot to you fixed pier. Conditions: The existing stairs will be permitted as a "Prior Existing Use" per Section 4.4 of the SUSPG and subject to the conditions therein. 2. Bulkhead with decking. Allowed, with conditions. As shown in the above referenced drawings, you have proposed to retain your existing wood bulkhead with wood decking. You have already removed non-embedded stairs that led from the bulkhead to the lakebed. Conditions: The existing wood bulkhead with wood decking will be permitted as a "Prior Existing Use" per Section 4.4 of the SUSPG and subject to the conditions therein. I 7 John Stratfold February 14, 2018 Page 2 of 3 3. Fixed pier. Allowed,with conditions. As shown in the above referenced drawings, you have proposed to retain your existing wood fixed pier. Conditions: The existing wood pier will be allowed to remain as a "prior existing use" per section 4.4 of the SUSPG and subject to the conditions therein. 4. Mooring buoy alternative. Allowed,with conditions. Not shown in the above referenced drawings, but shown in photos provided in your application package, you have converted your existing mooring buoy to a"mooring buoy alternative". Conditions: a) You must apply for after-the-fact permits for the buoy anchor(along with the other structures). See "Next Steps#8" below for more information. b) Your mooring buoy alternative anchor line must be tied to shore when not anchoring a vessel c) Mooring line must not float. 5. Ropes tied to vegetation. To be removed.All ropes tied to shoreline trees, stumps or other vegetation must be removed and disposed of. i 6. Debris. To be removed.All debris and abandoned materials located on Tacoma Power's property waterward of 742 feet elevation and on the lakebed fronting your development lot must be removed and disposed of at an appropriate upland facility. E Other Information: 7. Tacoma's 10-foot lateral easement area.Tacoma retains a 10-foot lateral easement on the development lots adjacent to the 742-foot elevation boundary. Any permanent structures or fill in this area must be approved by Tacoma. As shown in your drawings, you have stairs located in the 10-foot lateral easement area. 8. Cultural Resources Survey. Not required at this time. Because you are not proposing any new ground-disturbing activities and your existing structures were constructed in the ! mid-1980's, a Cultural Resources Survey(CRS)will not be required at this time. Please note that when your structures are in need of repair that will cause ground disturbance{ then a CRS will be required before Tacoma Power will issue permission for that work to occur. Please see section 6.2 of the SUSPG for further details. 9. Trimming of shoreline vegetation. Prior authorization required. Review of our photos i shows that there has been a series of vegetation cutting incidents over the years within the Project boundary fronting your development lot. Please be aware that Tacoma Power has strict vegetation management rules associated with our properties, as described in Appendix B Section 11 of the SUSPG. No cutting is allowed without first obtaining written permission from Tacoma Power. 10. Trees felled into Project area. Not allowed. Review of our photos shows that trees from your development lot have been felled into the Project area in the past. Please be aware that Tacoma Power does not allow this use of the property. You must obtain after-the-fact regulatory permits from Mason County and the US Army Corps of Engineers (ACOE)for all of your allowed existing structures and uses located on Tacoma Power property waterward of 742 feet elevation and within the 10-foot lateral easement area. Enclosed please find a letter from Tacoma Power, the land owner, allowing you to proceed with regulatory permitting for your project. Per Section 1 of the SUSPG, copies of the necessary regulatory permits are required before Tacoma Power can issue an SUP. Once obtained, please provide copies of the required permits to Tacoma Power to satisfy this requirement. If necessary, Tacoma's allowable use requirements will be modified to reflect the most stringent requirement of the other agencies. Next Steps for Tacoma Power: 12. Shoreline Use Permit. Upon verification that you completed the requirements of the short- term license, and when you provide a copy of the required after-the-fact Mason County and ACOE permits, Tacoma Power will issue a 5-year Shoreline Use Permit for the allowed uses and structures.
