This agreement between Mason County , ereinafter referred to as " COUNTY , '
and Associated Businesses of the South Shore ; a nonprofit organization , hereinafter
referred to as the "ASSOC . BUSINESSES OF THE SOUTH SHORE . "
WITNESSETH :
That in consideration of the terms and conditions contained herein , the parties
hereto covenant and agree as follows :
I . The ASSOC . BUSINESSES OF THE SOUTH SHORE agrees to provide a
web site , Fourth of July at Union event , Lady Washington Visit , and Christmas on the
Canal event as approved by the Mason County Tourism Task Force . The Mason
County Tourism Task Force has determined this event meets the criteria as outlined in
RCW 67 . 28 . 080 :
" . . . advertising , publicizing , or otherwise distributing information for the purpose
of attracting and welcoming tourists . . . "
II . The ASSOC . BUSINESSES OF THE SOUTH SHORE will submit to the
COUNTY documentation ( invoices , etc . ) verifying the money was spent for the web
site , Fourth of July at Union event , Lady Washington Visit , and Christmas on the Canal
event .
III . The ASSOC . BUSINESSES OF THE SOUTH SHORE will hold the COUNTY
harmless from all claims of every kind and character arising out of or in any way
connected with the services given by it for the COUNTY .
IV . It is understood that the ASSOC . BUSINESSES OF THE SOUTH SHORE is
an independent contractor and is not an agent of the COUNTY , and all personnel used
by the ASSOC . BUSINESSES OF THE SOUTH SHORE in connection with the
rendering of services contemplated by this contract shall be employees of the ASSOC .
BUSINESSES OF THE SOUTH SHORE and not the COUNTY , and shall have no claim
against the COUNTY for compensation or other benefits available to the employees of
said COUNTY .
V . This agreement shall be for a term of nine months beginning April 1 , 2001 .

VI . The COUNTY will remit $ 1 , 200 in Hotel/Motel funds to the ASSOC .
BUSINESSES OF THE SOUTH SHORE for the services to be performed under this
contract . Funds paid for such services will be used to furnish only the services
contemplated by this contract and will not be diverted by the ASSOC . BUSINESSES
OF THE SOUTH SHORE to any other person or used for any other purpose . ASSOC .
BUSINESSES OF THE SOUTH SHORE records of receipt and expenditure of such
funds will be made available on request by County officials and the State Auditor for
review .
