Altering Lake Limerick Division I 1757732 Page : 2 of 3 06 / 12 / 2002 03 : 20P DIR OF COMM DEVELOPMENT RESOL 11 . 00 Mason Co , WA ALTERATION TO LAKE LIMERICK, DIVISION I RESOLUTION 32 - 02 On March 28 , 1966 , the Plat of Lake Limerick, Division 1 , located in Section 27 , Township 21 North, Range 3 West, W . M . , was recorded in Volume 6 pages 34 though 37 inclusive records of Mason County, Washington . WHEREAS , The Dedication included in Lake Limerick, Division 1 , is as follows : Know all men by these presents that Osberg Construction Company, a Washington corporation by Allan F . Osberg, Vice President and John Osberg, Assistant Secretary and Lake Limerick Corporation, a Washington corporation by Mark J . Antoncich, President and Kenneth W . Engle, Assistant Secretary, the undersigned, owners of the land hereby platted hereby declare this plat and dedicate to the use of the public forever all streets , avenues, places and sewer easements or whatever public property there is shown on the plat and the use thereof for any and all public purposes not inconsistent with the use thereof for public highway purposes . Also the right to make all necessary slopes for cuts and fills upon the lots , blocks , tracts , etc . shown on this plat in the reasonable original grading of all the streets , avenues , places , etc , shown hereon. Also the right to drain all streets over and across any lot or lots where water might take a natural course after the street or streets are originally graded . WHEREAS , The final plat contains EASEMENT PROVISIONS , which state : All lots shall be subject to an easement 5ft in width and parallel with and adjacent to all lot lines for purposes of installation and maintenance of utilities and drainage and shall also be subject to the right for overhang of electric and telephone wires over portions of lots where roadway curvature causes the same to occur . WHEREAS , RCW 58 . 170215 — Alteration of subdivision — Procedure , provides a method by which a person interested in the alteration of any subdivision or the altering of any portion thereof may proceed; WHEREAS , Frank and Dorothy Query, owner of lot 65 and Lake Limerick Country Club owner of lot 66 of Lake Limerick Division 1 , have made application though their agent Daniel F . Holman PLS , with the Mason County Board of County Commissioners requesting an alteration to the easement running approximately west to east 165 . 33 feet between these said lots , for the purpose of adjusting the property line to accommodate existing improvements on lot 65 ; WHEREAS , the application contains the signatures of the majority of those persons having an ownership interest of lots , tracts , parcels , sites , or divisions in the subject subdivisions or portion thereof, WHEREAS , Lake Limerick Community Club (homeowners association and water system) , Mason County Public Works , PUD #3 , and Qwest have relinquished their interests in the easement; WHEREAS , the Mason County Board of County Commissioners did notify the affected landowners as required by RCW 58 . 17 . 215 ; WHEREAS , a public hearing was held on April 9 , 2002 , at 9 : 15 am, in the Commissioners Chambers ; a WHEREAS , after due consideration it appears to be in the best public interest to approve 3 the request made by Frank and Dorothy Query; 1 00 0 co NOW THEREFORE BE IT RESOLVED that the Board authorizes the alteration of the �. MM N previously described 5 foot easements between Lots 65 and 66 in the Plat of Lake Limerick, Division 1 , with the understanding that the easement is being removed so the boundary between lots 65 and 66 can be adjusted .
