Amending Ord. 77-93 and 136-01 Interim Resource Ordinance for Landslide Hazard Areas ORDINANCE NU E - 3 INTEREVI AMENDMENT TO MASON COUNTY RESOURCE ORDINANCE NO . 77 - 939 REGARDING LANDSLIDE HAZARD AREAS LAST AMENDED IN ORD . 136-01 AN ORDINANCE adopting interim amendments to Mason County Resource Ordinance 77-93 with regard to landslide hazard areas as last amended in Ordinance development regulations, 136- 01 , under the authority of Chapters 36 . 70 and 36 . 70A RCW . WHEREAS , Mason County regulates landslide hazard areas and requires geological assessments and geotechnical reports for development in or near such areas ; WHEREAS , the Resource Ordinance as currently written requires an engineer to prepare geotechnical reports or to oversee their preparation; WHEREAS , state law, Chapter 18 .220 RCW, provides for the licensing and regulation of geologists, and has required the licensing of geologist since July of 2002 ; WHEREAS , Mason County currently has received applications for development that must be reviewed in a timely manner and that have geotechnical reports prepared by licensed engineering geologist; WHEREAS , there is an immediate need for appropriate review in landslide hazard areas, for licensed geologists to be able to exercise their professions, and for development to be able to proceed in a timely way; NOW, THEREFORE, BE IT HEREBY ORDAINED , that the Board of Commissioners of Mason County hereby ADOPTS an amendment to the Resource Ordinance, Ordinance 77-93 , as amended, as follows : Section 1 . Amend 17 . 01 . 100 LANDSLIDE HAZARD AREA - SUBSECTION (E) GEOTECHNICAL REPORT — paragraph 3 . Qualifications of Preparer, to read as follows : The Geologic Assessment shall be prepared at the discretion of the Director by either a licensed civil engineer with specialized knowledge of geotechnical/geological engineering or a licensed geologist or engineering geologist with special knowledge of the local conditions . The Geotechnical Report shall be prepared at the discretion of the Director by a licensed civil engineer with specialized knowledge of geotechnical/geological engineering or a licensed engineering geologist . Section 2 . These interim amendments shall become effective March 4 , 2003 and shall remain in effect through September 4, 2003 .
