AN ORDER MAKING LEGISLATIVE FINDINGS AND DECLARING THAT THE BEST INTERESTS OF THE COUNTY
WILL BE DETERMINED BY SELLING CERTAIN TAX TITLE REAL ESTATE .
WHEREAS, the Board of County Commissioners held a public hearing on July 6, 2004, pursuant to RCW
36 . 34 . 040, to consider the sale of tax title lands in accordance with RCW 36 . 35 . 120; and
WHEREAS, RCW 36 . 35 . 120 provides : " Real property acquired by any county of this state by foreclosure of
delinquent taxes may be sold by Order of the county legislative authority of the county, when in the judgment
of the county legislative authority, it is deemed in the best interests of the county to sell the real property, and
WHEREAS, RCW 36 , 35 . 120 further reserves to the the county legislative authority all mineral rights in the land
to be sold , including coal , oil , gas, gravel, minerals, ores, fossils, timber, or other resources, and the right to
mine for and remove the same ; and
WHEREAS, the Board of Mason County Commissioners has determined to reserve such resources and
easements running with the land as is authorized under the Revised Code of Washington ; and
WHEREAS, The Mason County Board of County Commissioners has determined that the best interests of Mason
County would be served by entering an Order on its records, fixing the unit or units in which the property shall
be sold and the minimum price for each of such units for cash , while reserving from sale such of the resources
as it has determined and from which units such reservations shall apply, and directing the County Treasurer to
sell such property in the unit or units and at not less than the price or prices and subject to such reservations so
fixed by the county legislative authority, and
WHEREAS, said Order has been approved by the County Treasurer in those cases where several lots or tracts of
land are combined in one unit; and
WHEREAS, Exhibit A, attached hereto, sets out several parcels of real property determined to be surplus, the
reservations and minimum price as determined by the county legislative authority;
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Board of Mason County Commissioners that the following
list of real property is declared surplus property, and shall be sold at the minimum prices for cash , and with
reservations as noted on Exhibit A .
BE IT FURTHER RESOLVED THAT the Mason County Treasurer is directed to sell at public auction to the best
and highest bidder for cash , the real property listed on Exhibit A, which auction has been set for July 23 , 2004
at 9 : 00 a . m . in the Mason County Commission Chambers, located at 411 N . Fifth Street, Building 1 , Shelton ,
Mason County, Washington .
