Hunter, Commissioner Mary Jo Cady, Chairperson The meeting was called to order at 2:00 p.m. by Chairperson Mary Jo Cady. APPROVAL OF MINUTES Cmmr. Faughender/Hunter moved and seconded to approve the September 18, 1995 minutes as circulated. Motion carried unanimously. C-aye; F-aye; H-aye. CONCURRENCE WITH COUNTY COMMISSION ACTION 10-03-95 -- Nile/Kimber Stewart Farm Fence Project approved(No Cost to Clean Water District) 10-17-95 -- DOE Denied Request to Transfer 10-31-95 -- Memorandum of Agreement Approved with Mason County Conservation District I1-14-95 -- Approved Cost Share for Roof Extension for Dick Reller Cmmr. Hunter/Faughender moved and seconded to concur with the county commission action noted above. Motion carried unanimously. C-aye; F-aye; H-aye. STAFF REPORT Mark Tompkins, reported on the survey program. Completed Inspections- 1,143 Refused Access- 117 No Contact- 50 Failures - 97 Repairs Completed- 79 The repairs are continuing to be worked on. Twelve are posted for non-occupancy;two are waiting to be installed; and four are in various stages of repair. Chairperson Cady asked if the non-occupancy are residences where families have had to move out. Mr. Tompkins presumed they were seasonal residences/cabins. Two of the non-occupancy were posted by the Building Department. FINANCIAL UPDATE Revenue for October- $791.27 Revenue to Date - $17,979.10 Expenses for October- $3,169.54 Expenses to Date- $31,944.88 The 1993 past due assessments were referred to the Treasurer in February 1994. Water Quality will be sending out another letter that past due accounts will be referred to the Treasurer's office. They continue to have payments trickle in from individuals. Cmmr. Faughender asked if there is enough money to complete the repair work. TOTTEN/LITTLE SKOOKUM CLEAN WATER DISTRICT DECEMBER 18, 1995 - PAGE 2 Mr. Tompkins stated Kim Lincoln is following up on a citizen's complaint. There should be enough funds. He questioned how much follow-up is wanted by the Board. Some people are not allowing entrance on their property for survey work. Cmmr. Faughender stated his concern is for repairs. Mr. Tompkins stated there are 18 left which are posted as non-occupancy. They may or may not ever come back. Some are cabins that probably will not be occupied. Chairperson Cady asked if the posted one's also are people that didn't pay their assessment. Mr. Tompkins responded he would have to check on that. Cmmr.Hunter suggested the non-occupancy residence owners be sent a notice that the Clean Water District program is being finalized that if they plan to occupy the building they need to work with the Health Department to demolish and remove or update the system. Cmmr. Faughender questioned if there is any discussion at the advisory board about fund balance at the end of the project. It doesn't appear there will be a lot of money. ADVISORY COMMITTEE UPDATE Warren Dawes,Totten-Little Skookum Clean Water District Advisory Board Chair,reported the advisory committee has not met since August 30. It was decided that they would not call another meeting unless something came up that required their attention. There have been no further meetings scheduled. Mr.Dawes shared that he spoke with Greg Grunenfelder,Thurston County Environmental Health Director,and asked him about their administrative search process. Thurston County is waiting for the wet season to go back out to the residences with their case. They have issued letters to all people who did not want to have inspections indicating it will be followed with an administrative search warrant if they do not come forward and comply. He expects that the great majority of the people will come forward and they will get the inspections done. But failing that,they will be following up with a second letter in January if they get no response. And failing any response from that by the first of February they will be seeking the administrative search warrants. CONSERVATION DISTRICT Jim Barnes,Mason County Conservation District,reported they are proceeding with implementation in Totten-Little Skookum as well as continuing farm planning. They have also started farm planning int he Oakland Bay Watershed, the section just north of the Totten-Little Skookum Watershed and south of Hammersley Inlet. One of their technicians is conducting a windshield survey in that area looking for residences with livestock. That is near completion. They are working with one landowner in Oakland Bay on a farm plan. To date they have 24 completed signed farm plans in the Totten-Little Skookum Watershed. One is in final draft stage and they are working with three other farmers with farm plans. Implementation is proceeding on six different properties in Totten-Little Skookum on cost share projects for the DOE cost share program. The Reller project is under construction and should be completed in January 1996. They also completed a fencing project in Little Skookum Creek. PUBLIC COMMENTS Warren Dawes spoke on behalf of himself as a private resident and shared some of his concerns of noncompliance with the Clean Water District's efforts in conducting inspections and repairing failing systems. He personally is aware of a homeowner who has a failing system and for financial reasons has not repaired the system and then there TOTTEN/LITTLE SKOOKUM CLEAN WATER DISTRICT DECEMBER 18, 1995 - PAGE 3 . are those who refuse inspection even when it is evident of the failure. He is concerned about the shellfish in the area. Harry Martin, Lower Hood Canal Clean Water District Advisory Board, brought up to the topic of administrative search warrants which was discussed at some length. It was noted systems which are obvious failures,sewage is running out,then the County has a way to go in and do something about that. If somebody just suspects that their neighbor has a problem and there is no proof, nothing obvious, then the County has no right to impose ourselves on those people. The Board asked the staff how they respond to the situation where there is a failure which is identified and it isn't being fixed. Mr. Tompkins stated he would need the name to see what is going on. Mr.Tompkins replied they would have to be one of the four categories: posted,designer proposal,waiting to install, labor. No one gets removed from the program or doesn't have to fix their system. There was discussion that the public has rights as well as private property owners. The Board concluded a system must clearly have a failure before the County can go on the property. CLEAN WATER DISTRICT SIGNS Cmmr. Hunter expressed concern about the signs for the Clean Water Districts. The sign is placed where it is draining down toward Lake Isabella and then into Bell Creek and out into Oakland Bay. Chairperson Cady asked the staff to take a look at the Clean Water District signs.
