The continuation of the 6/20/94 meeting was called to order at 2:00 p.m. by Chairperson Porter.
APPROVAL OF MINUTES
Cmmr. Hunter/Faughender moved and-seconded to approve the minutes of June 20, 1994 as circulated.
Motion carried unanimously. F-aye; H-aye; P-aye.
CORRESPONDENCE
None at this time.
STAFF REPORT
Mr.Clifford explained at the last meeting the Board decided to continue the meeting so the Advisory Committee
could have one more chance to get together and discuss their proposals. After the last Advisory Committee
meeting the basic message they gave us was they still supported the $45 assessment recommendation. They
wanted the District to evaluate how that will affect the budget.
Mr. Clifford commented they will be working with the Conservation District to review the projection of the
budget.
Chairperson Porter added,a public hearing would be needed to take comments and consider adopting any fee.
At that time, part of the testimony could be how it would affect operations such as budgets next year.
Cmmr. Hunter/Faughender moved and seconded to establish a public hearing to consider the Totten/Little
Skookum Clean Water District Fee of$45 on 7/18/94 at 2:15 p.m.as recommended by the Advisory Committee.
Motion carried unanimously. F-aye; H-aye; P-aye.
PUBLIC COMMENTS
Harold Fitzwater questioned the Board on why have the receipts for Totten-Little Skookum Clean Water District
been deposited in Water Quality. He specifically referred to $36,000 which was the shellfish growers money.
Chairperson Porter questioned if he had seen the correspondence from the Auditor accepting the letter from
the Shellfish Growers as complying with the audit intent.
Mr. Fitzwater also asked why has the Current Expense contribution (identified in the District Program dated
12/93) never shown up in any receipt for Totten/Little Skookum.
Chairperson Porter explained it was receipted in the Water Quality budget.
He questioned why an effort is being made to charge the Clean Water District amount in excess of what the
grant program identifies.

Chairperson Porter responded there are activities the Advisory Committee and Totten-Little Skookum Clean
Water District Board agreed were important enough to do even though they weren't eligible for grants. The
grant eligibility is not the total program for Totten-Little Skookum Clean Water District. There are activities
outside of grant eligibility which they have taken action to approve.
Mr. Fitzwater requested a copy of where the action is listed.
Chairperson Porter added it is approved by budget action. It was part of the recommendation from the Advisory
Committee when they recommended the original fee. The fee was to support an overall water quality budget
that included grant eligible activities and some activities which were not grant eligible. That was how they built
the original $45 fee and the budget for that. It is ratified by the budget's adoption.
Mr. Fitzwater commented he hasn't seen anything which authorizes those charges.
Chairperson Porter again stated the budget authorizes the charges.
Mr. Fitzwater felt there was no effort to identify budget vs. grant according to the records which he has found.
Chairperson Porter commented that it is the difference between the grant reporting and the overall budget it
is the difference which would be non-grant eligible.
Mr. Fitzwater questioned if there needed to be an attorney present to ensure the County is within its legal
authority.
Cmmr. Porter responded the County has checked with the Attorney and has been advised the District is within
its legal authority. Also, the internal Auditor has been consulted and the District has been advised all the
activities meet with audit requirements.
Board Member Faughender commented the County is of the opinion that the intent of the District was to do
a complete job in the Clean Water District which may take more funds than the grant contains. The Board
concentrates on the task to be done.
Chairperson Porter concluded that the first task taken by the Advisory Committee was the task of deciding
whether to accept the grant. The District was formed knowing work was needed throughout the watershed. A
grant was offered to perform work, but it had some criteria attached such as a timelines and provisions that
Conservation District be a partner with extensive farm plan work. The County wanted this type of work done,
but hadn't decided on the timeline. The original formation of the District was not because of the grant. The
grant may have required a water district, but the formation was because of the Consent Order and the quality
of the water.
