Porter, Commissioner Wayne Clifford, Technical Administrator The Lower Hood Canal Clean Water District meeting was called to order at 1:34 p.m.by Chairperson William O. Hunter. APPROVAL OF MINUTES: Cmmr. Porter/Faughender moved and seconded to approve the minutes of September 19, 1994 as corrected. Motion carried unanimously. F-aye; H-aye; P-aye. HEARING - BOUNDARIES WITHIN THE ALDERBROOK AREA The Board held a public hearing to consider changing the boundaries of the Lower Hood Canal Clean Water District within the Alderbrook area. Wayne Clifford, Technical Administrator, explained he has reviewed the USGS topographic maps and is familiar with the area around Alderbrook. Three options were recommended: 1) Leave the whole community inside the Lower Hood Canal Clean Water District. 2) Divide Alderbrook along the Manzanita Boulevard,which is the approximate boundary of the watershed. 3) Completely remove all of Alderbrook from Lower Hood Canal Clean Water District. A map was provided displaying the proposed boundary and the existing boundary of the district. Chairperson Hunter noted a petition was received with 41 signatures and four individual letters supporting removal of the Alderbrook area from the District. Mr. Clifford reviewed the existing boundary of the Clean Water District along Sections 1,2,3,4, and 5. He recommended the Board extend the Manzanita Boulevard line in Sections 5,4,3,2,and 1 across(parallel instead of angled up) into the Case Inlet watershed. It was noted this would be a more natural dividing line than originally selected. It would also maintain the whole community in tact. It appears from the map most of the community is south of Manzanita Drive. Board Member Faughender asked how much population is south of Manzanita Drive. Mr. Clifford noted there were 97 residences (sewage systems) in the affected area, as recorded by the Assessor. Chairperson Hunter noted Carson Lake also drains down into Shumocher Creek. Harry Martin asked if the dividing line follows the section lines. The Board noted it appears it follows a quarter section line. Mr. Martin questioned if they have checked with a geologist for drainage on that. Chairperson Hunter interjected the drainage seemed quite clear to him when he was in the area. John Simpson spoke in favor of withdrawing Alderbrook area. LOWER HOOD CANAL CLEAN WATER DISTRICT OCTOBER 17, 1994 -PAGE 2 Chairperson Hunter added Mr.Simpson was one of the original persons who brought to the County's attention the area should be withdrawn from the Clean Water District. Elizabeth Jarvis asked how septic systems which Alderbrook uses not flow into the Canal. Mr. Clifford responded the homes being discussed are not on the Alderbrook sewer plant. Cmmr. Faughender/Porter moved and seconded to close the public hearing. Motion carried unanimously. F-aye; H-aye; P-aye. Cmmr.Porter/Faughender moved and seconded to alter the boundaries of the Lower Hood Canal Clean Water District to delete that portion of Alderbrook which is south of Manzanita Drive and extend the new boundary straight over to the section line as recommended by staff. Motion carried unanimously. F-aye; H-aye; P-aye. Cmmr. Porter/Faughender moved and seconded to adopt the ordinance amending Ordinance No. 103-93, Resolution Nos. 48-93,70-93 and 75-93 relating to the formation and establishment of the boundaries of the Lower Hood Canal Clean Shellfish Protection'District. Motion carried unanimously. F-aye; H-aye; P-aye. Ordinance No.94-01 George Rickels asked about the funds already paid into the District by those in the area being withdrawn. Chairperson Hunter responded those which have paid will be automatically refunded. No action is required by the citizens. CONCURRENCE OF COUNTY COMMISSIONER ACTION . 9/27/94-Advisory Board Applicant - Robert W. Faughender/Porter moved and seconded to concur with actions of September 27. Motion carried unanimously. F-aye; H-aye; P-aye. Cmmr. Faughender/Hunter moved and seconded to concur with the October 4 action. H-aye; P-nay; P-aye. Cmmr. Porter expressed she still has an objection to the scoreboard sign on Belfair Annex. POLICIES & PROCEDURES -MASON COUNTY CLEAN WATER DISTRICT Wayne Clifford,Technical Administrator,announced there are a few changes since the last copy was distributed. The purpose of the policies is to provide the maximum amount of accountability for the operation of the Clean Water District. He discussed some of the changes made - - Page 3, Section 2 - There was an additional paragraph which talked about the purpose of the district. The purpose for each district is going to vary somewhat._ Each district will be shaped by the Commissioners and Advisory Committees. This was a comment from the Totten/Little Skookum Clean Water District Advisory Board. They felt it should be shaped with their mission statement. LOWER HOOD CANAL CLEAN WATER DISTRICT OCTOBER 17, 1994 - PAGE 3 Section 3.2- They had listed advisory board and changed it to advisory committee for clarity. They will use the term committee when describing the advisory committees and use the term board when referring to the Board of Commissioners. Page 4, Section 4.1.3 - legislative body (corrected typographical error) Frank Bishop referred to page 4; Section 3.12 - Refers to complex system over 3,500 gallons per day; nothing is said about a simple system. He felt there should be another category for others than the standard system. On Page 5, Section 5.1.3 - It was questioned if all systems are assessed one rate. Mr. Clifford commented this isn't really applicable to Totten/Little Skookum Clean Water District. Under the Lower Hood.Canal Clean.Water District if there is a condominium there could be-one.tank which all the units plug into. They will be assessed as a multiple connection/larger on-site system at $250 vs. the average resident fee of$52. Chairperson Hunter referenced Section 3.12 which defines a complex system. Harold Fitzwater asked if a system with a half dozen homes has one fee. Cmmr. Porter stated it is a higher multiple connection system fee as opposed to six individual fees. Mr. Clifford interjected it also states where applicable. Reference would need to be made to the Fee Resolutions. Cmmr. Porter added the recommendation is it would be a flat fee for a structure attached to a system. In the Lower Hood Canal Clean Water District they had a more complex fee structure. Harold Fitzwater noted there still appears to be a problem with the language. In the Totten/Little Skookum Clean Water District they don't have any policies/procedures which were approved by the Board. He expressed concern about allowing too much flexibility for an individual to set up policies without a hearing and also the monetary trail this might avoid. Cmmr.Porter referred to Mr. Fitzwater's written comments and noted that appears to be a concern which runs throughout his comments. She asked if Mr. Fitzwater also wants it clarified the District program should be approved after a public hearing is held. She asked if he also wanted it clarified the policy document must be approved by the legislative body. Mr. Clifford commented when he wrote the scope of work for the grant that was the concept he had at the time this would be the process. The language is still in the grant and possibly should be amended to reflect that. Harry Martin asked about Section 5.8 dealing with delinquent accounts. It was felt there should be a date in about delinquent accounts. Mr.Clifford stated he follows the state law RCW 36.94.150 as used by the Treasurer that accounts are delinquent after 60 days of statement date. Harry Martin questioned if there is any way tG address the financial hardship with low interest payments. Chairperson Hunter stated there are low interest loans available for repairs. LOWER HOOD CANAL CLEAN WATER DISTRICT OCTOBER 17, 1994 - PAGE 4 Mr. Clifford stated this is addressed in Section 5.5 relating to partial payments. George Rickel commented Section 5.4 and 5.5 seem contradictory. Cmmr. Porter explained Section 5.5 deals with payments less than$52 a month and the balance of the $52 still owing at the end of the year. Section 5.4 is deferring payment and using some other asset attached to the title as a lien. At the time of sale, the money would be collectable by the County. She added the County may want to say they must check in to see if they still qualify for deferred payment. There was discussion if an individual should check in every two years. Harold Fitzwater referred to Section 4.3.2 and questioned about donations. It was noted the grammar needs to be worked.on in that section. Cmmr. Porter asked if 15 days is realistic under Section 5.3.1.1 and 5.3.1.2. Mr. Clifford commented in some cases it hasn't been. There was discussion that Section 5.8 establishes an account which will become delinquent and begin to accrue interest after 60 days. Then they are given an additional 15 days for a second notice of delinquency. ADJOURNMENT The meeting adjourned at 2:27 p.m. due to no further business. Respectfully Submitted, Rebecca S.
