Realignment of Portion of Capital Hill Development Agreement with Manke LumberMASON COUNTY COMMISSIONERS RESOLUTION NO: 15 - 0 7 WHEREAS, Manke Family Resources, L.P., and Manke Lumber, Inc. ("Manke") desire to have a portion of Capital Hill Road realigned so it does not pass through certain portions of Manke property in the vicinity of Johns Prairie Road, and; WHEREAS, Manke is willing to provide a portion of the necessary substitute right of way for a new alignment and to construct a new road segment to Mason County specifications, including paved lanes, shoulders and drainage ditches, and; WHEREAS, the Port of Shelton ("the Port") is willing to provide a portion of the necessary substitute right of way, and; WHEREAS, the Port and Manke have entered into a development agreement for said realignment and road construction, and; WHEREAS, Mason County Public Works ("the County"), the Port and Manke have negotiated proposed development agreements for said realignment and road construction, and; WHEREAS, the proposed development agreement between the County and Manke calls for the County's vacation of a portion of the current right of way of Capital Hill Road in favor of Manke, said vacation taking place after satisfactory construction of the new road segment. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS that the proposed realignment of a portion of Capital Hill Road is hereby approved, and the Board of County Commissioners is authorized to sign said development agreements on behalf of Mason County. BE IT FURTHER RESOLVED that the County Engineer shall administer said development agreements on behalf of Mason County. ADOPTED this 13 t h Day of February, 2007.
