PURPOSE This Request for Services is entered into by and between the Thurston County (hereafter "THURSTON") and Mason County (hereafter "MASON") for MASON to lend an 85-foot long bridge to THURSTON to use as a temporary structure at the crossing of the Mox Chehalis Creek on Cooper Rd SW. THURSTON will utilize the bridge until installation of a permanent structure is completed, as outlined in the estimated schedule below. This Request for Services is required under the terms of lnterlocal Agreement ("ILA") #17-006 between THURSTON and MASON. 2. SERVICES This work has been requested by THURSTON and will be performed consistent with the ‘Master Interlocal Agreement between Thurston County & Mason County for Transportation Services’ executed on June 6, 2017. The costs associated with this Request for Services shall be $0. The schedule to perform the required activities and tasks with an estimated completion date of November 30, 2023 are provided in the table below. This timeline may be modified by mutual agreement of Mason and Thurston. ACTIVITY/TASK ESTIMATED TIMELINE Inspect Bridge (at MASON storage yard) JUNE 2022 Pick up bridge (from MASON storage yard) JUNE or JULY 2022 Place and utilize bridge (Cooper Rd SW and Mox Chehalis Creek) JUNE or JULY 2022 - NOVEMBER 2023 Return bridge (to MASON storage yard) By NOVEMBER 30, 2023 2.1 RESPONSIBILITY OF MASON MASON shall: a. Provide access to their storage yard for THURSTON and its contracted agents to inspect the bridge prior to being transported to THURSTON’s project site. b. Provide access to their storage yard for THURSTON and its contracted agents to pick up the bridge and return the bridge at MASON storage yard according to the timeline above. c. Allow THURSTON to use the bridge until completion of the timeline above. d. MASON agrees to lend the bridge to THURSTON at no charge. e. MASON will inspect the bridge upon THURSTON’s delivery to MASON’s site and within 30 days notify THURSTON of any damage needing repair. MASON COUNTY Request for Services by County Cooper Rd SW at Mox Chehalis Creek Culvert Replacement, Project #9C-W024 Page 2 of 4 2.2 RESPONSIBILITY OF THURSTON THURSTON and/or its contracted agents shall: a. Provide MASON with at least 72-hour notice before coming to the MASON storage yard to inspect, pick up, and return the bridge. b. Inspect the bridge prior to being transported to THURSTON’s project site. c. Transport the bridge to and from the MASON storage yard according to the timeline above. d. THURSTON will pay all costs associated with the pick-up, temporary installation, return to MASON, and any repairs needed due to THURSTON’s use of the bridge. e. THURSTON will return the bridge in the same or better condition than when it was initially inspected by THURSTON and its contracted agents. 2.3 ADMINISTRATION The following individuals are designated as representatives of the respective parties. The representatives shall be responsible for administration of this Request for Services and for coordinating and monitoring performance under this Request for Services. In the event such representatives are changed, the party making the change shall notify the other party. THURSTON’s office administration representative shall be Dawn Ashton, 9605 Tilley Rd S. Ste. MASON representative shall be the County Engineer, Michael Collins, 100 Public Works Dr, Shelton, WA 98584, 360-427-9670 Ext. 452, MCollins@masoncountywa.gov. 3. RECORDS RETENTION AND AUDIT During the progress of the work and for a period not less than six (6) years or other required state record retention period from the final date of payment, the records and accounts pertaining to the work and accounting therefore are to be kept available for inspection and audit by either party in accordance with the Washington State Public Records requirements and copies of all records, accounts, documents, or other data pertaining to the work will be furnished upon request. If any litigation, claim, or audit is commenced, the records and accounts along with supporting documentation shall be retained until all litigation, claim, or audit finding has been resolved even though such litigation, claim, or audit continues past the 6-year retention period. Each party will promptly notify the other of any such litigation hold on records. 4. TERM This Request for Services shall become effective upon execution. This Request for Services will be terminated after the bridge is returned to MASON and determined by MASON to be in acceptable condition, or pursuant to the termination language in ILA# 17-006.
