Call to Order—The Chairperson called the regular meeting to order at 9:02 a.m. 2. Pledge of Allegiance—Bill Long led the flag salute. 3. Roll Call—Present: Present: Commissioner District 1 —Randy Neatherlin; Commissioner District 2 —Kevin Shutty; Commissioner District 3—Sharon Trask. 4. Correspondence and Organizational Business 4.1 Correspondence 4.1.1 Christine Vincent wrote in regarding her termination from the Timberland Regional Library. 4.1.2 Washington State Liquor and Cannabis Board sent in the following:marijuana application for The Dab Lab,change of location for OLY BOI,special occasion liquor license for the Humane Society of Mason County,marijuana and liquor licenses due to expire,and a discontinued cannabis license for Wicked Delights. 4.1.3 Jeff Carey sent in an application for the Planning Advisory Commission. 4.2 Katie Arnold presented the Public Utility District No. 1 Recognition of Mason County Public Health for Leadership during the COVID-19 Pandemic. 4.3 Cmmr. Shutty presented the Certificate of Good Practice from the County Road Administration Board. 5. Open Forum for Citizen Input Bill Long represented the Friends of Lake Cushman Dog Park Association and shared that they have identified Foothills County Park as an idea location for a quality dog park. Mason County has two other dog parks,both some distance from the Hoodsport area. The 2021 Capital Improvement Plan has a dog park identified at Foothills within the next six years. The Friends of the Lake Cushman Dog Park would like to partner with Mason County on the development of this area and has the opportunity to apply for a $25k grant to help accomplish this goal. 6. Approval of Minutes Cmmr.Neatherlin/Trask moved and seconded to adopt the April 18,2022; April 25,2022; May 2, 2022; May 9,2022; and May 16,2022 Briefing Minutes and April 26,2022 Regular Minutes as presented. Approval of Action Agenda 8.1 Approval of Warrants&Treasurer Electronic Remittances: Claims Clearing Fund Warrant#8087868-8088149 $ 1,118,319.03 Direct Deposit Fund Warrant#86844-87235 $ 748,364.90 Salary Clearing Fund Warrant#7006629-7006663 $ 1,028,644.73 Treasurer Electronic Remittance $ - 8.2 Approval for the Chair to sign the Hood Canal Regional Septic Loan Program Agreement to Terminate the Interlocal Agreement between Clallam County,Jefferson County,Kitsap County,Mason County, and the Kitsap Public Health District. 8.3 Approval for the Chair to sign the Letter of No Objection for a Special Occasion Liquor License application for United Angels 4 Pets to host an event on May 27,2022;July 29,2022;August 26, 2022;and September 30,2022 at the White Barn Home and D6cor in Belfair. 8.4 Approval of the following American Rescue Plan Act(ARPA)items:Mason County Jail Elevator and Doors and ARPA Temporary Staff until December 31,2026. 8.5 Approval to authorize Public Works to procure a deckover equipment trailer from Olympic Trailer& Truck Accessories off of the Washington State Contract for$16,874.92. 8.6 Approval for Superior Court to create,post,and fill the Administrative Secretary/Judicial Assistant position. 8.7 Approval of the culvert replacement project road closures on North Shore Road from milepost 6.90 to milepost 7.00 on Monday,July 25,2022 to Friday,July 29,2022 and on Belfair-Tahuya Road from milepost 6.5 to milepost 7.47 on Monday,June 13,2022 to Friday,June 17,2022. 8.8 Approval for the Chair to sign the contract between Mason County and The Watershed Company in order to employ the services of Watershed to complete the work outlined in the contract under Exhibit A—Scope of Work. 8.9 Approval to adopt the Career Incentive Pay Policy as Chapter 12 into the Mason County Personnel Policy. (Exhibit A,Resolution No.2022-035) 8.10 Approval for the County Administrator to sign the Professional Services Agreement with Cabot Dow Associates Inc for labor employment services not to exceed$50,000. 8.11 Approval to accept a resignation in lieu of termination from Christina Mink and Kenneth Oberg effective May 17,2022 and to approve the Separation,Release,and Hold Harmless Agreement to release and forever discharge Mason County,its officers,agents,employees,agencies,and departments from any and all existing and future claims, damages,and causes of action foreseen and unforeseen of any nature whatsoever arising out of their employment and to waive the 10-day written notice provision in 12.4 of the Collective Bargaining Agreement. 8.12 Approval for the Chair to sign the Memorandum of Understanding between Mason County and AFSCME,Teamsters Appraisers,Teamsters Community Family Health,Woodworkers Local Corrections& Support Staff,Woodworkers Local Prosecuting Attorney, Woodworkers Local Public Defense,Mason County Sheriff's Office Deputies Guild,Engineers' Guild,Teamsters General Services,and Teamsters/Operating Engineers Public Works to include Juneteenth as a paid holiday Cmmr.Neatherlin/Trask moved and seconded to approve action items 8.1 through 8.12 with the removal of items 8.3 and 8.9 for separate vote. Motion carried unanimously. N-aye; S-aye;T-aye. Item 8.3 Cmmr.Neatherlin clarified that he is not affiliated with the location nor the organizations involved with this event although his food truck will be there. He would like to abstain from the vote. Cmmr.Trask/Shutty moved and seconded to approve the Chair to sign the Letter of No Objection for a Special Occasion Liquor License application for United Angels 4 Pets to host an event on May 27,2022; July 29,2022;August 26,2022; and September 30,2022 at the White Barn Home and D6cor in Belfair. Motion carried. N-abstained; S-aye;T-aye. Item 8.9 Mark Neary shared that numerous individual briefings and conversations have been held on how to move forward with this item. The intent is to encourage individuals who work for Mason County to follow a career path for certain skillsets. To begin,the plan is to identify individuals in the engineering and accounting trades to provide an incentive for PE and CPA licenses. In order to not create salary compression,it is required to 21 May 24 , 2022 Commission Minutes provide the same incentive to positions that already require those certifications. Mark has received some responses from Elected Officials and Department Heads on how to create incentive program within other individual departments. For example,for the Prosecutor's Office,an incentive for staff to obtain paralegal status or Juris Doctor degree. This could allow their office to handle different types of court cases. For Community Development,there are numerous certifications and educations for planners. Cmmr.Trask would like to do the salary survey first and have this opened up to the entire County at once. Once the salary survey is done,then move forward with the incentives. She worked with previous director for three years and agrees that improvements need to be done for non-represented staff. How many licenses and certificates do other departments have? Without more equality she cannot move forward at this time. Cmmr.Neatherlin knows this has been worked on for a long time and agrees that it is the best thing the County has started. He supports pay raises through the salary survey as well as incentive pay. It is important to compensate staff for new modalities,furthering their education,and gaining more experience. This is a great place to start and will help retain staff. Cmmr.Neatherlin shared his thanks for Mark working on this and providing a better framework. Cmmr. Shutty is also supportive of policy and appreciates the work done so far. The Commission is unified regarding a more comprehensive salary survey and he appreciated the advocacy on that. This is a first step and is responsive to concerns. The plan is to pilot this,see how works,and continue to build on it. Cmmr.Neatherlin/Shutty moved and seconded to approve to adopt the Career Incentive Pay Policy as Chapter 12 into the Mason County Personnel Policy. Motion carried. N-aye; S-aye; T-nay. 9. Other Business(Department Heads and Elected Officials) Loretta Swanson thank for incentives,encourage and grow staff. Thank Dave for and Human Resources, Risk,and Finance team. 10. 9:15 a.m. Public Hearings and Items Set for a Certain Time Please see above options to provide public testimony. These options are available only while COVID-19 OPMA meeting restrictions are in place. 10.1 Public Hearing to adopt the revisions to Mason County Code Title 16—Plats and Subdivisions Code. Staff:Malissa Paulsen(Exhibit B,Ordinance No.2022-036) Malissa shared that the Planning Department is proposing amendments to Title 16—Plats and Subdivisions,which address changes to the procedural review ad requirements for application of regulations and application content. This is regarding boundary line adjustments, lot combinations, short subdivisions,and large lot subdivisions. The Planning Advisory Commission reviewed and accepted the revisions as proposed. Cmmr.Trask/Neatherlin moved and seconded to adopt the revisions to Mason County Code Title 16—Plats and Subdivisions Code. Motion carried unanimously. N-aye; S-aye; T-aye. 10.2 Public Hearing to inform citizens of the availability of funds and eligible uses of the 2022 Public Services Community Development Blog Grant(PS-CDBG) and receive comments on proposed activities specifically funding the Community Action Council of Lewis, Mason, and Thurston Counties (CAC)as well as receiving comments on the 2021 program. Staff:Mark Neary Mark shared that this is for the CDBG grant. In 2021,as with subsequent years,the funding of approximately$100k was used to provide service referrals for minimum of 6,430 individuals in Mason and Lewis counties of which a minimum of 3,279 must meet HUD's 51%income qualification and provide direct services and referrals for a minimum of 350 child victims. This year's allotment is 3 1 May 24 , 2022 Commission Minutes $102k,of which$3.5k will be used to off-set a portion of our administration costs. Cmmr.Neatherlin/Trask moved and seconded to approve the submission of the Community Development Block Grant(CDBG)application and authorize the County Administrator to act as the Chief Administration Official for the CDBG program. OZ. -D3b A RESOLUTION AMENDING RESOLUTION 2021-047 MASON COUNTY PERSONNEL POLICY, TO ADD CHAPTER 5.13 CAREER INCENTIVE PAY POLICY WHEREAS, it is the responsibility of the Board of Mason County Commissioners for the coordination of county administrative programs, which is accomplished through the adoption of the Personnel Policy; and WHEREAS, it is necessary and appropriate to add, remove, and update language to the Personnel Policy to ensure the best practices are incorporated, clarification of processes are implemented, and removal of outdated language is incorporated; and WHEREAS, it is necessary and appropriate to add Chapter 5.13 Career Incentive Program, effective upon execution of this agreement to add additional monthly compensation to an eligible employee's base salary to recognize career growth and development; and NOW, THEREFORE, BE IT RESOLVED, the Board of Mason County Commissioners hereby amends Resolution 2021-047 Mason County Personnel Policy to add Chapter 5.13 Career Incentive Pay Policy. WHEREAS, under the authority of Chapter 58.17 RCW, Mason County has authority to regulate the process by which land is divided; and WHEREAS, the Mason County Planning Department proposed amendments to Title 16 for clarifying purposes and to improve administrative requirements; and WHEREAS, the Department relied on approved Mason County Ordinances and consistency with state law in making amendments; and WHEREAS, on March 21, 2022 the Planning Advisory Commission held a public hearing on these amendments and voted unanimously to recommend the amendments for approval; and WHEREAS, the Board of County Commissioners conducted a public hearing regarding Mason County Code Title 16, Plats and Subdivisions on May 24, 2022; and BE IT HEREBY ORDAINED, the Mason County Board of Commissioners hereby approves and ADOPTS amendments to the Mason County Code Title 16, Plats and Subdivisions as described in ATTACHMENT A. (a) Every division of land or contiguous land for the purpose of lease,sale or transfer of ownership,into two or more but fewer than five lots(or nine lots within LIGA), parcels or tracts within the unincorporated area of Mason County shall proceed in compliance with this chapter.Contiguous parcels of land in the same ownership and having boundaries in common(MCC 16.08.330)shall be presumed to be a single parcel in determining whether or not the division of land comprises a subdivision. (b) The provisions of this chapter shall not apply to: (1) Any cemetery burial plot,while used for that purpose; (2) Any division of land in which the smallest lot created by the division is five acres or more in area; (3) Any division made by testamentary provision or the laws of descent; (4) Any division made in compliance with Chapter 16.20 and Chapter 16.38; (5) Any division of land into lots or tracts of less than three acres that is recorded in accordance with Chapter 58.09 RCW and is used or to be used for the purpose of establishing a site for construction and operation of consumer-owned or investor-owned electric utility facilities in accordance with 58.17.040(9) RCW. (6) Any division of land that can be described by a legal subdivision of a section of not less than 1/128th of a section; (7) Any division for the purpose of leasing land for facilities providing personal wireless services while used for that purpose in accordance with 58.17.040(8) RCW. (8) Land divisions of record in the auditor's office on the effective date of this chapter; (9) Property line adjustments wherein the result does not adversely affect access or reduce the lot size below the minimum requirements; (10) Divisions which are solely for use as a private right-of-way; (11) Divisions of platted lots,which by deed restriction are made a part of an adjoining lot and which will not permit a separate building site for human occupancy or habitation, provided the divisions are approved in writing by the administrator on the legal conveyance. (a) Applications for approval of short subdivisions shall contain: (1) Three copies of a sketch of the entire contiguous tract of land owned or being purchased on contract by the applicant which shall show: (A) The owners of adjacent land and the names of any adjacent subdivision, (B) Lines marking the boundaries of proposed lots, (C) Location of road right-of-way within or adjacent to the tract,and easements within the tract which are to be used for ingress and egress for road and utility purposes; (2) Legal description of the original tract,and each lot's legal description certified by a registered land surveyor or a title company,containing any and all easements for access to the property(MCC 16.08.330); (3) The name and address of the owner or owners of the said tract; (4) Surveys by a registered land surveyor may be required by the administrator; (b) A short subdivision application shall expire if additional information is requested by the county that is necessary to process the application,and such information is not provided to the county within one hundred eighty days of the request. Applications for approval of large lot subdivisions shall contain: (a) Ten copies of the large lot plat showing the entire contiguous tract owned or being purchased by the applicant which shall show: (1) Names of any adjacent subdivision; (2) Lines marking the boundaries and dimensions of proposed lots; (3) Location of road right-of-way within or adjacent to the tract,and easements within the tract which are to be used for ingress and egress for road and utility purposes; (4) Contour lines of sufficient interval to show the topography of the entire tract may be required by the administrator,on a case-by-case basis, based on environmental and/or geologic conditions. Such contour lines shall include lines that extend at least one hundred feet beyond the tract boundaries; (5) All private roads and/or easements shall be designated private and printed on the face of the plat; (6) Date,scale and North arrow; (7) Vicinity map; (b) Legal description of the original tract held under single or unified ownership or which the owner holds controlling interest; (c) The name,address and phone number of the owner or owners of the said tract(s); (d) Survey by a registered land surveyor of the lots within the large lot subdivision.Survey can be submitted after administrators approval and prior to recording; (e) Title report; (f) Boundary closures for all lots; (g) Names and addresses of all landowners within three feet of the proposed large lot division boundaries. A division made for the purpose of adjusting boundary lines,which does not create any additional lot,tract, parcel,site,or division containing insufficient area and dimension to meet minimum requirements for width and area for a building site; provided that no boundary line adjustment shall be effective until: (1) The proponent has an approval for the boundary line adjustment from the planning department verifying that the proposed division conforms to the requirements of this subsection; (2) The proponent has paid the fee prescribed by the approved fee schedule for review and issuance of the approval; (3) The proponent has filed an application that includes: (A) A survey prepared by a registered land surveyor; (B) A notarized declaration signed by all property owners. (4) The proposal shall comply with all applicable Mason County Environmental Health requirements.An additional application for Environmental Health review may be required.The proponent may be charged a review fee according to the current Environmental Health Fee Schedule. (5) The planning department approval,survey and notarized declaration have been recorded with the county auditor by the applicant.The applicant has one year,from the date of approval,to record the boundary line adjustment or the boundary line adjustment will be considered invalid and will require re-approval,including fees, before recording. The review authority shall approve an application for a boundary line adjustment provided the following criteria are met: (1) The lots or parcels resulting after the boundary line adjustment shall meet all dimensional requirements specified for the applicable zone as set forth in the approved Title 17 and,if applicable, Chapter 8.52. (A) Boundary line adjustments in residentially zone property must meet the requirements of minimum and maximum lot sizes,as set forth in the approved Title 17. (2) No lot, use,or structure is made nonconforming or more nonconforming than that which existed at the time of application,and subject to the provisions of the approved Title 17 and,if applicable, Chapter 8.52. (3) Will not diminish or impair existing or future drainage,water supply,sanitary sewage disposal (including on-site sewage disposal)or legal access. (4) All boundary line adjustments shall not result in any of the following: (A) Shall not result in the creation of any additional lot,tract, parcel,site,or division. (B) Shall not be reconfigured or adjusted in a way in which would render access for vehicles,utilities, fire protection,or existing easements impractical to serve their purpose. When an applicant seeks only to combine two or more lots, parcels,or tracts into a single lot,and no other property boundary changes are proposed,such action shall not be effective until: (1) The proponent has an approval for the lot combination from the planning department,verifying that the proposed combination conforms to the requirements of this subsection; (2) The proponent has paid the fees prescribed by the approved fee schedule for review and and approval; (3) The planning department approval, legal description,scale drawing,and notarized declaration have been recorded with the county auditor by the applicant.The applicant has one year,from the date of approval,to record the lot combination or the lot combination will be considered invalid and will require re-approval,including fees, before recording.
