The purpose of this letter is to inform the county about the proposal and public hearing process, and to seek comments and/or questions from the board. I am also reaching out as part of the Washington Recreation and Conservation Office's (RCO) county conferral process to inform you of DNR's intent to apply for an RCO grant through their Washington Wildlife and Recreation Program. Please find the map of the proposed expansion area, initial acquisition parcel, and factsheet attached for your reference. A preserve boundary designation does not give DNR any regulatory or other land use authority over private landowners. The boundary designation is an administrative action that allows DNR to seek funding for purchase of private lands only from willing sellers, at market value that is established by independent appraisal. Landowners are under no obligation, at any time, to sell their lands to DNR. No lands within the boundary are considered to be part of the natural area unless they are either acquired by DNR or are otherwise registered as such by the landowner. The proposed expansion area is located adjacent to the existing 165 acre Skookum Inlet NAP boundary. The preserve was approved by the Natural Heritage Advisory Council in 1985 to protect three salt-marsh ecosystem types: low intertidal, high salinity, silty marsh; high intertidal, high salinity marsh; and high intertidal, low salinity marsh, along with their associated plant communities. These are important examples of wetland ecosystems in the southern Puget Sound. The preserve also protects tideflats, and includes second growth forest habitat. The purpose of the expansion is to incorporate an additional 290 acres of upland, shoreline, and tideland protection for the existing preserve. The intent is to provide long-term protection for ecological functions important to the preserve's primary features and for the populations of chum and coho salmon and resident cutthroat trout that spawn in Elson Creek, the small tributary protected within the preserve. DNR will hold a public hearing to provide information and receive testimony on the proposed boundary expansion on April 20, 2022. An informational session will begin at 6:00 p.m. and the public hearing will begin at 6:30 p.m., concluding following public testimony. The hearing will be located at the Mason County Fire Hall District#4, at 2970 SE Arcadia Road Shelton, WA 98584. The Washington State RESOURCES Natural Heritage Advisory Council approved the original 165 acre preserve boundary in the 1980s and recommended a 290 acre boundary expansion in 2022. The current preserve includes 143 acres of conservation lands owned and managed by the Washington State Department of Natural Resources(DNR). Protecting Rare Features The preserve protects three salt-marsh ecosystem types along with their associated plant communities, which are important high-quality examples of wetland ecosystems in southern Puget Sound: 1) Low intertidal, high salinity, silty marsh, 2) High intertidal, high salinity marsh, and 3)High intertidal, low salinity marsh. Proposed NAP Boundary Expansion The purpose of the expanded boundary, which is the design for the ultimate extent of the preserve,is to enhance upland, shoreline and tideland protection for the existing conservation lands. The intent is to provide long-term protection for ecological functions important to the preserve's primary features,as well as to buffer it from threats such as invasive weed species and potential future development. The expansion area is adjacent to the existing 165 acre preserve boundary and includes roughly 290 acres of intact shoreline and estuarine mudflats as well as upland forests situated on and above steep slopes that extend to the shoreline. The proposed boundary also includes areas of salt marsh and pasture. Threats and Site Condition Human activities such as alterations to water quality and hydrology or introduction of non-native and invasive plant species, pose a significant threat to the natural area.Residential development, with the associated leaching of septic fields, yard fertilizers and chemicals,reduces water quality and changes the species composition of the ecosystem. Background In the 2021 legislative session there were bills passed that limited the size and type of hardware and ammunition that could be used by law enforcement.In the 2022 legislative session some of those bills were modified and others passed to loosen those restrictions.Additionally,the Attorney General's office issued an opinion on the bills that had passed in 2021. House Bills 1735 and 1719 clarify the earlier bills and maintain some of the restrictions but allow law enforcement to purchase smaller gauge and less lethal hardware. After consideration of the options the Sheriff s Office has decided the best way to keep everyone as safe as possible is to add 40-millimeter less lethal hardware to its inventory.This acquisition should help to ensure Mason County Sheriffs Deputies have more tools required to address difficult circumstances,protect themselves,each other,and the public. Budget Impact(s): Hardware, ammunition,holders,and targets not to exceed-$57,000 This line item was not foreseen for 2022.This is not in the MCSO budget. Referred to Committee on Public Safety. 1 AN ACT Relating to modifying the restrictions on the use and 2 acquisition of military equipment by law enforcement agencies as it 3 pertains to firearms and ammunition but only with respect to removing 4 the restriction on ammunition, narrowing the restriction on firearms 5 to include only rifles of . 50 caliber or greater, and clarifying that 6 the restrictions do not apply to shotguns, devices designed or used 7 to deploy less lethal munitions, and less lethal equipment; amending 8 RCW 10 . 116 . 040; and declaring an emergency. 9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON: 10 Sec. 1. RCW 10. 116. 040 and 2021 c 320 s 5 are each amended to 11 read as follows : 12 (1) A law enforcement agency may not acquire or use any military 13 equipment. Any law enforcement agency in possession of military 14 equipment as of July 25, 2021, shall return the equipment to the 15 federal agency from which it was acquired, if applicable, or destroy 16 the equipment by December 31, 2022 . 17 (2) (a) Each law enforcement agency shall compile an inventory of 18 military equipment possessed by the agency, including the proposed 19 use of the equipment, estimated number of times the equipment has 20 been used in the prior year, and whether such use is necessary for 21 the operation and safety of the agency or some other public safety P. 1 HB 1719 .SL 1 purpose. The agency shall provide the inventory to the Washington 2 association of sheriffs and police chiefs no later than November 1, 3 2021 . 4 (b) The Washington association of sheriffs and police chiefs 5 shall summarize the inventory information from each law enforcement 6 agency and provide a report to the governor and the appropriate 7 committees of the legislature no later than December 31, 2021 . 8 (3) For the purposes of this section: 9 (a) "Military equipment" means ( (fi-L-ear-ffts--anel -affffftid3it=en) ) rifles 10 of . 50 caliber or greater, machine guns, armed helicopters, armed or 11 armored drones, armed vessels, armed vehicles, armed aircraft, tanks, 12 long range acoustic hailing devices, rockets, rocket launchers, 13 bayonets, grenades, missiles, directed energy systems, and 14 electromagnetic spectrum weapons . 15 (b) "Grenade" refers to any explosive grenade designed to injure 16 or kill subjects, such as a fragmentation grenade or antitank 17 grenade, or any incendiary grenade designed to produce intense heat 18 or fire. "Grenade" does not include other nonexplosive grenades 19 designed to temporarily incapacitate or disorient subjects without 20 causing permanent injury, such as a stun grenade, sting grenade, 21 smoke grenade, tear gas grenade, or blast ball. 22 (c) "Rifle" has the same meaning as provided under RCW 9. 41 . 010, 23 except "rifle" does not include: Any shotgun, as defined under RCW 24 9 . 41 . 010; any device designed or used to deploy less lethal munitions 25 including, but not limited to, rubber, bean bag, soft nose, sponge, 26 or other nonpenetrating impact rounds; or any less lethal equipment. 27 (4) This section does not prohibit a law enforcement agency from 28 participating in a federal military equipment surplus program, 29 provided that any equipment acquired through the program does not 30 constitute military equipment . This may include, for example: Medical 31 supplies; hospital and health care equipment; office supplies, 32 furniture, and equipment; school supplies; warehousing equipment; 33 unarmed vehicles and vessels; conducted energy weapons; public 34 address systems; scientific equipment; and protective gear and 35 weather gear. 36 NEW SECTION. Sec. 1. (1) In 2021, the legislature passed 20 Engrossed Second Substitute House Bill No. 1310, codified as chapter 21 10 . 120 RCW, with the goal of establishing a uniform statewide P. 1 SHB 1735 . SL 1 standard for use of force by peace officers . The standard emphasizes 2 the importance of exercising reasonable care and preserving and 3 protecting human life. However, the complexities and nuances of 4 police practices and applicable laws, both in statute and common law, 5 have posed implementation challenges for some police agencies. For 6 that reason, the legislature hereby recognizes the urgent need to 7 provide clarification and guidance for police agencies and the 8 public. 9 (2) The legislature intends for peace officers to continue 10 performing the critical role of supporting those in crisis and 11 assisting vulnerable members of our communities . The legislature does 12 not intend to prevent or prohibit peace officers from protecting 13 citizens from danger. The legislature recognizes that peace officers 14 can and do perform these responsibilities while also maintaining the 15 highest standards of safety and reasonable care expressed in RCW 16 10 . 120. 020 . 17 (3) While the newly established civil standard in RCW 10 . 120 . 020 18 is unique insofar as it is codified in state law, it represents 19 national best practices developed by police leaders across the 20 nation. The legislature does not intend to abrogate the criminal 21 liability protections afforded to peace officers in chapter 9A. 16 22 RCW. Instead, the legislature hereby reaffirms its intent to 23 establish RCW 10 . 120 . 020 as a distinct and more restrictive civil 24 standard to inform the policies and practices applicable to all peace 25 officers operating within state agencies and local governments . The 26 legislature recognizes the profoundly important role peace officers 27 have in protecting communities, and further recognizes that 28 implementing and enforcing these best practices will improve public 29 safety for all persons across the state . 30 Sec. 2. RCW 10 . 120 . 010 and 2021 c 324 s 2 are each amended to 31 read as follows : 32 The definitions in this section apply throughout this chapter 33 unless the context clearly requires otherwise. 34 (1) "De-escalation tactics" refer to actions used by a peace 35 officer that are intended to minimize the likelihood of the need to 36 use force during an incident. Depending on the circumstances, "de- 37 escalation tactics" may include, but are not limited to: Using clear 38 instructions and verbal persuasion; attempting to slow down or 39 stabilize the situation so that more time, options, and resources are p. 2 SHB 1735 .SL 1 available to resolve the incident; creating physical distance by 2 employing tactical repositioning to maintain the benefit of time, 3 distance, and cover; when there are multiple officers, designating 4 one officer to communicate in order to avoid competing commands; 5 requesting and using available support and resources, such as a 6 crisis intervention team, a designated crisis responder or other 7 behavioral health professional, or back-up officers . 8 (2) "Law enforcement agency" includes any "general authority 9 Washington law enforcement agency" and any "limited authority 10 Washington law enforcement agency" as those terms are defined in RCW 11 10 . 93 . 020 . 12 ( (+2+) ) (3) "Less lethal alternatives" include, but are not 13 limited to, verbal warnings, de-escalation tactics, conducted energy 14 weapons, devices that deploy oleoresin capsicum, batons, and beanbag 15 rounds . 16 ( (-{g+) ) (4) "Peace officer" includes any "general authority 17 Washington peace officer, " "limited authority Washington peace 18 officer, " and "specially commissioned Washington peace officer" as 19 those terms are defined in RCW 10 . 93 . 020; however, "peace officer" 20 does not include any corrections officer or other employee of a jail, 21 correctional, or detention facility, but does include any community 22 corrections officer. 23 Sec. 3. Except as otherwise provided under 26 this section, a peace officer may use physical force against a person 27 ( (when) ) to the extent necessary to: 28 (a) Protect against criminal conduct where there is probable 29 cause to make an arrest; ( (effeet=) ) 30 (b) Effect an arrest; ( (it-) ) 31 (c) Prevent an escape as defined under chapter 9A. 76 RCW; ( (e-r- 32 pretee ) ) 33 (d) Take a person into custody, transport a person for evaluation 34 or treatment, or provide other assistance under chapter 10 . 77, 71 . 05, 35 or 71 . 34 RCW; 36 (e) Take a minor into protective custody when authorized or 37 directed by statute; 38 (f) Execute or enforce a court order authorizing or directing a 39 peace officer to take a person into custody; p. 3 SHB 1735 .SL 1 (a) Execute a search warrant; 2 (h) Execute or enforce an oral directive issued by a Judicial 3 officer in the courtroom or a written order where the court expressly 4 authorizes a peace officer to use physical force to execute or 5 enforce the directive or order; or 6 (i) Protect against an imminent threat of bodily injury to the 7 peace officer, another person, or the person against whom force is 8 being used. 9 ( ( (19) Ir) ) (2) DEADLY FORCE. Except as otherwise provided under 10 this section, a peace officer may use deadly force against another 11 person only when necessary to protect against an ( (4:ffffftinent-) ) 12 immediate threat of serious physical injury or death to the officer 13 or another person. For purposes of this subsection 14 ( ( (4:) "!R~ffl nent-) ) "Immediate threat of serious physical injury or 15 death" means that, based on the totality of the circumstances, it is 16 objectively reasonable to believe that a person has the present and 17 apparent ability, opportunity, and intent to immediately cause death 18 or serious bodily injury to the peace officer or another person. 19 "Necessary" means that, under the totality of the 20 circumstances, a reasonably effective alternative to the use of 21 deadly force does not exist, and that the amount of force used was a 22 reasonable and proportional response to the threat posed to the 23 officer and others . 24 ( ( (4:44)) ) "Totality of the circumstances" means all facts known 25 to the peace officer leading up to and at the time of the use of 26 force, and includes the actions of the person against whom the peace 27 officer uses such force, and the actions of the peace officer. 28 ( (+2+) ) (3) REASONABLE CARE. A peace officer shall use reasonable 29 care when determining whether to use physical force or deadly force 30 and when using any physical force or deadly force against another 31 person. This 8 includes a consideration of the characteristics and conditions of a 9 person for the purposes of determining whether to use force against 10 that person and, if force is necessary, determining the appropriate 11 and least amount of force possible to effect a lawful purpose . (1) Local governments, including counties, cities, towns, special purpose districts, municipal and quasi-municipal corporations, and political subdivisions, are authorized to use credit cards for official government purchases and acquisitions. (2)A local government may contract for issuance of the credit cards. (3)The legislative body shall adopt a system for: (a)The distribution of the credit cards; (b)The authorization and control of the use of credit card funds; I (c)The credit limits available on the credit cards; (d) Payment of the bills; and (e)Any other rule necessary to implement or administer the system under this section. (RCW 43.09.2855 (1)) To provide opportunities for cost savings available only with the use of credit cards. To provide an economical business practice that will increase efficiency. 1.Issuance and Inventory of Credit Cards (a) The County authorizes the issuance of credit cards to departments for the purpose of covering authorized travel expenses incurred by government officials and employees as well as for official authorized government purchases or acquisitions. (RCW 43.09.2855) (b) Elected officials, department heads,and County administrators who feel their department's operations would benefit from having a credit card shall make a formal request to the County Commissioners, or their designee. The formal review of these requests implements a systems of controls, and allows for better tracking of the number of cards issued County-wide and by department, authorized credit and single purchase limits, and to ensure that bills are paid in accordance with the RCWs pertaining to credit card usage and County policy(RCW 42.24.080,RCW 42.24.115, RCW 43.09.2855). All requests for new credit cards will be submitted using the Mason County Credit Card Request Form(Exhibit A)and will include the following documents: a. A list detailing the specific types of transactions the department anticipates for the credit card. (RCW 43.09.2855 (3a)) b. A list of authorized users of the card. The decision as to whom will be authorized to use the card will be at the discretion of the elected official or department head. (RCW 43.09.2855 (3b)) c. A signed Mason County Credit Card Use Agreement(Exhibit B)by the authorized user(s) acknowledging that they have read the County's credit card policy and procedures and that they will use the card in accordance with this policy. A request for the credit limit of each card that is being requested. (RCW 43.09.2855 (3c)) (c) The Commissioner's Office shall maintain an active listing of credit card users,cards issued, and credit limits. (RCW 43.09.2855 (3c)) (d) Departments that have credit cards with retailers (charge card/account cards)must adhere to the same credit-card policies and procedures as with a bank credit card.No special permission is needed for these cards, except if a fee is charged to obtain the card. The Board of County Commissioners has approved vendor specific credit cards with no fees for use in all offices and departments. Charge cards with fees require permission from the Board of County Commissioners.A list of all active retailer credit cards and an active listing of authorized users must be on file with the County's Commissioner's office. (RCW 43.09.2855 (3e)) (e) Each Elected Official or Department Head is responsible for the distribution, retrieval, and tracking of each card issued within their office or department.Monthly reconciliations are the responsibility of the department that holds the-credit card and is required for each department. (RCW 43.09.2855 (3e)) 2.Use of Credit Cards (a) All purchases made with these cards must be in compliance with the County's purchasing, contracting,vendor list and other applicable policies. (RCW 43.09.2855 (3e)) (b) When a County credit card is used for the purpose of covering expenses related to authorized travel,the government official or employee must submit a fully itemized travel expense voucher with original receipts attached.This is to be submitted within five (5) days of authorized travel. Charges against the credit card that are not properly identified on the travel expense voucher or are found to be not allowed following the County's purchasing, contracting,vendor list, and other applicable policies, as well as the audit required under RCW 42.24.080, shall be paid by the official or employee by check or salary deduction. (RCW 42.24.115) (c) If,for any reason, disallowed charges are not repaid by the official or employee before the credit card billing is due and payable,the County shall have a prior lien against and a right to withhold any and all funds payable or to become payable to the official or employee,up to an amount of the disallowed charges and any interest and/or late fees incurred, as charged by the issuing credit card company. (RCW 43.09.2855 (3e)) (e) The County's Financial Services Auditors shall establish and implement a written procedure for the payment of all credit card bills.All departments must adhere to this written procedure in order to maintain efficiency,timeliness, consistency, and accuracy of the County's credit card payments. (RCW 42.24.080) See Exhibit E for the current credit card voucher procedures established by Financial Services. (f) Immediate surrender of a credit card(s)may be required if an elected official, employee, or department uses their credit card in a manner that is inconsistent with the County's code,policies, and procedures. (RCW 43.09.2855 (3e)) 3. Liability (a) The individual office or department is responsible for the liability incurred by the use of their credit cards. Payment is due immediately upon receipt of monthly statement. Balances on all cards must be paid so no late fee is incurred. (RCW 43.09.2855 (3d)) See Exhibit E 4. Spending Limits (a) Each Elected Official or Department Head will seek approval by the Board of Commissioners for their department's spending limits, and/or pre-authorization for credit cards issued in their office or department. Such limits will be consistent with office or department spending levels established by the Board of County Commissioners in the annual budget process. The Elected Official or Department Head is responsible for communicating the limit to each user. $ubsequent requests for credit limit increases must be submitted to the Board of Commissioners, or their designee,via the Mason County Credit Card Request Form(Exhibit A). (RCW 43.09.2855 (3c)) 5. Unauthorized uses (a) Under no circumstances may an employee or elected official use a government credit card for personal expenses, even if they reimburse the County before the bill is due. (RCW 43.09.2855) (b) Cash advances on all County credit cards are prohibited. (RCW 43.09.2855 (6)) (c) Money orders/Travelers Checks/Gift Cards purchased with County credit cards are prohibited. (RCW 43.09.2855 (3e)) Issue Date: Page 3 of 7 Mason County Credit Card Policy & Procedures Resolution No. (d) Meal and beverage purchases on all County credit cards are prohibited, except under special circumstances as defined by the Mason County Travel Policy. (Exhibit F) (RCW 43,09.2855 (3e)) (e) If an authorized departmental official or employee has charges that are disallowed and are not repaid prior to the credit card billing date,the office or department shall have a prior lien on the employee's wages,including final pay. (RCW 42.24.115 (3)) (f) Failure to repay disallowed charges shall result in a penalty of ten percent per annum from the date of default until repaid. The interest will be computed as simple interest on the outstanding balance. This penalty is payable to the County and is in addition to interest and penalty charges imposed by the credit card company. (RCW 43.09.2855 (3e)) Mason County Credit Card Procedures Definitions: Credit Cards (Bank Cards): Mason County uses the credit card offered through the State of Washington contract. Departments may not use other bankcards. Charge Cards/Account Cards: Cards issued through specific vendors showing an established account. Not a credit card. No special permission is needed for these cards, except if a fee is charged. Charge cards with fees require permission from the Board of County Commissioners. For example, Costco charges a fee for their cards, and they can only be used at Costco stores. Credit Card System Administrator: An individual within the Commissioners' Office is responsible for providing training, advice, direction, consultation and assistance to Approving Managers and Card Custodians. Approving Manager: The Elected Official,Department Head or designee responsible for designating card custodians and requesting purchasing card limits. They will advise custodians of applicable limits and ensure that proper card usage,security, controls, timely bank statement reconciliation and approval,reception of transaction documentation and other related responsibilities are followed. Card Custodian:A Regular Employee, as defined in the Mason County Personnel Policy,within each office or department is responsible for card security and use. Custodians may designate employees within their office or department to use the credit card to purchase specific items or use a credit card for travel purposes. Elected Official or Department Heads make arrangements with individual vendors for charge or vendor specific cards. 2. If a fee is charged for the card,prior permission must be obtained from the Board of Commissioners. Please contact the Commissioners' office. 3. Keep all cards and account numbers safe. 4. Report inventory of all charge and/or vendor specific cards to the Board of Commissioners' annually. A form,provided by the Commissioners' Office,will be submitted annually by each department, listing the inventory and custodian(s) of all charge and/or vendor credit cards (Exhibit D). H. Credit Cards Bank Cards) 1. Contact credit card system administrator Contact the Credit Card System Administrator in the Commissioners' Office. That person will help your office/department complete the Implementation Form and Letter of Request. The Administrator will establish an account through the Procurement Card contact through the State of Washington. 2. Designate a credit card custodian To designate a new credit card custodian,the Approving Manager completes the Mason County Credit Card Request Form(Exhibit A) and sends it to the Credit Card System Administrator in the Commissioners' Office, along with a signed Credit Card Custodian Agreement(Exhibit Q. Custodians are responsible to: a. Pick up the credit cards from the Credit Card System Administrator in the Commissioners' Office. b. Keep all the credit cards safe and locked when not assigned to an employee. c. Maintain a log of credit cards checked out, to whom, date,purpose, date returned, sales slip returned, etc. d. Maintain the signed Mason County Credit Card Agreements(Exhibit B) from all authorized users of the department's credit card(s). Issue Date: Page 5 of 7 Mason County Credit Card Policy & Procedures Resolution No. e. Report Credit Card Fraud to the Credit Card System Administrator and file a claim with the credit card company. The credit card company will send a form to the department with reported fraud,which will be filled out and a copy submitted with the credit card statement to Financial Services. 3. Using the Credit Card(RCW 43.09.2855 (3)) a. The credit cards must be kept safe and secure at all times. When not in use by an individual, it is required that all credit cards be stored in a locked drawer or safe, with limited access. b. When needed for use,the custodian completes the information on the log and has the employee sign the log. If the custodian is the one to use the card,have another employee initial the 169. c. The Approving Manager must set the boundaries for credit card use and must communicate this to the employee before they use the credit card. (Prohibited: meals,cash advances, and personal items.) Proof of communication may be done by a signature on a use agreement, etc. d. The card user must obtain and return all charge slips regardless what is purchased, to the custodian or departmental accountant. e. An itemized receipt must be obtained for all purchases when possible. f. Government officials and employees are expected to return the card to the card custodian promptly after each authorized us.Under no circumstances shall the card information be stored by a government official or employee. g. To raise or lower a spending limit on a credit card, complete the Mason County Credit Card Request Form(Exhibit A) and send it to the Credit Card System Administrator in the Commissioners' Office. 4. Credit Card Billing Statements (RCW 43.09.2855 (3)) a. The Credit Card Administrator will receive a master statement of all credit card accounts,for review and audit purposes only. b. The Credit Card Custodian in each department will receive a detailed bill each month for the cards they are responsible for. c. Labor/Employment Consultant will provide opinions, consultation and coordination with staff, legal counsel and the Board of County Commissioners. Labor/Employment Consultant will provide verbal and written advice and interpretation of labor and employment law as it applies to Mason County. Other Insurance Provision. Any insurance, self-insurance, or insurance pool coverage maintained by the COUNTY shall be excess of the CONSULTANT's insurance and shall not contribute with it. 4. Acceptability of Insurers. Failure on the part of the CONSULTANT to maintain the insurance as required shall constitute a material breach of contract, upon which the COUNTY may, after giving five business days' notice to the CONSULTANT to correct the breach, immediately terminate the contract or, at its discretion, procure or renew such insurance and pay any and all premiums in connection therewith, with any sums so expended to be repaid to the COUNTY on demand, or at the sole discretion of the COUNTY,offset against funds due the CONSULTANT from the COUNTY. 8. Waiver of subrogation. All insurance coverage maintained or procured pursuant to this agreement shall be endorsed to waive subrogation against COUNTY, its elected or appointed officers, agents, officials, employees and volunteers or shall specifically allow CONSULTANT or others providing insurance evidence in compliance with these specifications to waive their right of recovery prior to a loss. To move forward in the process of approval, a public hearing will need to be held. The Planning department is requesting a hearing for May 10, 2022. Common theme: Removal of the word 'contiguous'from all sections as listed below. Short subdivisions 16.36.010 Application of regulations.: UGAs are allowed up to nine (9) lots when subdividing. Clarification of what is meant by 'Land"through reference to Mason County Code. 16.36.024 Procedure —Application content.: We removed the definition of"Land"from the language and clarified the intention through reference to Mason County Code. We also removed the requirements for phone number of owner(s) with application material and certification of associated land ownership. Large lot subdivisions Action Item Summary Form Title 16 Amendements 16.38.015 Procedure — Application content.: Removed requirement for adjacent land owners, with the exception of adjacent subdivision names. Boundary line adjustment 16.40.040 Boundary line adjustment.: Alteration of issuance of certificate, to that of an approval from the planning department, and language from certificate to approval thereafter. A survey will now be required as prepared by a registered land surveyor, which will have the legal description and show the proposed boundary changes. We also removed the requirement of a scale drawing since a survey is now required and would be drawn to scale and cover the affected lots. The proponent will need to provide a notarized declaration of Boundary Line Adjustment signed by all owners of affected lots. Added language to ensure compliance with MC Environmental Health (EH) requirements for BLAB. This was already a requirement, but this section assists in notifying the proponent of the requirement, and that is necessary, review and payment of fees for EH review. Responsibility for recordation of BLA is being transferred from the planning department to the applicant. To assist in timely processing, a one-year expiration of approval will render the approval invalid if not recorded with the county auditor within that window of time. 16.40.041 Decision criteria.: Added language to clarify criteria in decision determination from the planning department to consider approval. Requirements were determined by reviewing current allowances and requirements when reviewed. Lot combinations 16.40.045 Lot combinations.: Language correction from division to combination. Responsibility for recordation of lot combinations is being transferred from the planning department to the applicant. To assist in timely processing, a one-year expiration of approval will render the approval invalid if not recorded with the county auditor within that window of time. Vacating this area would create more usable land north of the physical location of E. Mason Lake Drive W. Lots 8 and 9, which lie adjacent to Lot 7 on the West, have already vacated the platted right of way. These are noted as Vacations# 339 and #403. Public Works sees no value to opening the proposed vacation area at any point in the future given the existing road alignment and previously approved adjacent vacations. In compliance with RCW 36.87.40, at the Board of County Commissioners and County Engineer's direction, Public Works Department staff examined the portion of road right-of- way requested to be vacated and solicited cornments on the proposed vacation. Our findings are the following: 1 1. The road is presently in use by the public but not located within the platted right-of- way. 2. The road is classified as "Class A" per MCC 12.20.040 and per MCC 12.20.060 the compensation for fee simple interest is fifty percent of the appraised value and payment is due prior to recording the vacation. 3. As a condition of vacation approval, Mason County requires dedication of a 60-foot strip of land through Lot 7 with the centerline of said strip being the centerline of East Mason Lake Drive West road. 4. The required dedication is of similar land size to the proposed vacation and of similar value. Therefore, Public Works proposes no additional compensation other than dedication of the 60-foot strip. The proposed vacation area is deemed not necessary to preserve for the County road system for future use. 5. The public will benefit by this action, since it will add the vacated area to the tax rolls and relieve the county of liability. 6. The petitioners have paid in full the required administrative fee of$1000.00. Public Notice Public notice has been provided as required by RCW 36.87.050, both by posting at the site and by publishing in the county official newspaper. Kamin Properties, LLC owns the two adjacent parcels. The shape and size of the property makes it not much use to the County but beneficial to the adjacent property owner. The County purchased the property in 1990 for $1,742.24. I have consulted with the Public Works and Planning Departments on this for any potential problems or conflicts, and both departments concur that there are none. Richard Beckman has weighed in on the value of the land: If buildable, the FMV is approximately $35-$45,000, if not buildable or cost prohibitive to build, the FMV is more in line with $3-$5,000. The Planning Department has expressed that based on the size of the land it is not developable for commercial development, therefore the value would fall in the range of $3-$5,000. The 2022 County Assessor's market value for this property is $3,690. Per Mason County Code, Chapter 3.40.300, and confirmed by Chief DPA, Tim Whitehead, an appraisal from a state-licensed appraiser is not necessary if the currently assessed value is less than $100,000. For sale of property assessed at less than $100,000, an appraisal may be provided by the county assessor. The Board has agreed to set a public hearing to surplus the property on April 12, 2022.
