EXECUTIVE SUMMARY: (If applicable,please include available options and potential solutions): ESHB 1054 enacted in the 2021 legislative session specifies,"Any law enforcement agency in possession of military equipment as of the effective date of this section shall return the equipment to the federal agency from which it was acquired, if applicable, or destroy the equipment by December 31,2022." ESHB1054 further defines military equipment as,""Military equipment"means firearms and ammunition of.50 caliber or greater,machine guns, armed helicopters, armed or armored drones,armed vessels,armed vehicles, armed aircraft,tanks, long range acoustic hailing devices,rockets,rocket launchers,bayonets,grenades,missiles,directed energy systems,and electromagnetic spectrum weapons."To meet this requirement,the MCSO pulled all less lethal shotguns with bean bag rounds in its inventory since they are larger than the caliber allowable. ESSHB1310 enacted in the same 2021 legislative session specifies the permissible uses of force by law enforcement. One of those specifications is to, "act with reasonable care when carrying out their duties, including using de- escalation tactics and alternatives to deadly force. Further,the legislature intends to address public safety concerns by limiting the use of deadly force to very narrow circumstances where there is an imminent threat of serious physical injury or death.It is the intent of the legislature that when practicable,peace officers will use the least amount of physical force necessary to overcome actual resistance under the circumstances.It is the fundamental duty of law enforcement to preserve and protect all human life."The assumed intent of this law is to ensure law enforcement continue to use less lethal responses.Another aspect of this law addresses de-escalation techniques. These tactics require the officer to be able to control situations and circumstances as much as possible using the least amount of force possible. During the 2022 legislative session the Attorney General's office issued an opinion and the legislature passed HB 1735 which made changes to clarify the use of less lethal rounds.The size of the rounds purchased will be smaller than is currently in inventory. The conclusion of the MCSO is to purchase 40 mm less-lethal bean bag rounds and the hardware to fire them. This acquisition should help to ensure Mason County Sheriff's Deputies have more tools required to address difficult circumstances,protect themselves, each other,and the public. BUDGET UvWACTS: Hardware, ammunition,holders,and targets not to exceed-$57,000 This line item was not foreseen for 2022.This is not in the MCSO budget. Johnson, Rule, Wicks, Bateman, Callan, Goodman, Macri, Orwall, Ramel, Ramos, Santos, Shewmake, Wylie, Simmons, and Stonier) READ FIRST TIME O1/25/22 . 1 AN ACT Relating to modifying the standard for use of force by 2 peace officers but only with respect to providing that physical force 3 may be used to the extent necessary, clarifying that deadly force may 4 be used in the face of an immediate threat, authorizing the use of 5 physical force to take a person into custody or provide assistance in 6 certain circumstances involving a civil or forensic commitment, 7 authorizing the use of physical force to take a minor into protective 8 custody, authorizing the use of physical force to execute or enforce 9 a court order, defining de-escalation tactics, clarifying when de- 10 escalation tactics and less lethal alternatives must be used by a 11 peace officer, specifying that the standard does not limit or 12 restrict a peace officer' s authority or responsibility to perform 13 lifesaving measures or perform community caretaking functions, and 14 specifying that the standard does not prevent a peace officer from 15 responding to requests for assistance or service; amending RCW 16 10 . 120. 010 and 10 . 120 . 020; creating a new section; and declaring an 17 emergency. 18 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON: 19 NEW SECTION. Sec. 1. (1) In 2021, the legislature passed 20 Engrossed Second Substitute House Bill No. 1310, codified as chapter 21 10 . 120 RCW, with the goal of establishing a uniform statewide P. 1 SHB 1735 .SL 1 standard for use of force by peace officers . The standard emphasizes 2 the importance of exercising reasonable care and preserving and 3 protecting human life. However, the complexities and nuances of 4 police practices and applicable laws, both in statute and common law, 5 have posed implementation challenges for some police agencies. For 6 that reason, the legislature hereby recognizes the urgent need to 7 provide clarification and guidance for police agencies and the 8 public. 9 (2) The legislature intends for peace officers to continue 10 performing the critical role of supporting those in crisis and 11 assisting vulnerable members of our communities. The legislature does 12 not intend to prevent or prohibit peace officers from protecting 13 citizens from danger. The legislature recognizes that peace officers 14 can and do perform these responsibilities while also maintaining the 15 highest standards of safety and reasonable care expressed in RCW 16 10. 120. 020. 17 (3) While the newly established civil standard in RCW 10. 120. 020 18 is unique insofar as it is codified in state law, it represents 19 national best practices developed by police leaders across the 20 nation. The legislature does not intend to abrogate the criminal 21 liability protections afforded to peace officers in chapter 9A. 16 22 RCW. Instead, the legislature hereby reaffirms its intent to 23 establish RCW 10. 120.020 as a distinct and more restrictive civil 24 standard to inform the policies and practices applicable to all peace 25 officers operating within state agencies and local governments . The 26 legislature recognizes the profoundly important role peace officers 27 have in protecting communities, and further recognizes that 28 implementing and enforcing these best practices will improve public 29 safety for all persons across the state. 30 Sec. 2. RCW 10. 120. 010 and 2021 c 324 s 2 are each amended to 31 read as follows: 32 The definitions in this section apply throughout this chapter 33 unless the context clearly requires otherwise. 34 (1) "De-escalation tactics" refer to actions used by a peace 35 officer that are intended to minimize the likelihood of the need to 36 use force durina an incident. Depending on the circumstances, "de- 37 escalation tactics" may include, but are not limited to: Using clear 38 instructions and verbal persuasion; attempting to slow down or 39 stabilize the situation so that more time, options, and resources are p. 2 SHB 1735.SL I available to resolve the incident; creating physical distance by 2 employing tactical repositioning to maintain the benefit of time, 3 distance, and cover; when there are multiple officers, designating 4 one officer to communicate in order to avoid competing commands; 5 requesting and using available support and resources, such as a 6 crisis intervention team, a designated crisis responder or other 7 behavioral health professional, or back-up officers . 8 (2) "Law enforcement agency" includes any "general authority 9 Washington law enforcement agency" and any "limited authority 10 Washington law enforcement agency" as those terms are defined in RCW 11 10 . 93 . 020 . 12 ( (4-2+) ) 3) "Less lethal alternatives" include, but are not 13 limited to, verbal warnings, de-escalation tactics, conducted energy 14 weapons, devices that deploy oleoresin capsicum, batons, and beanbag 15 rounds . 16 ( (+- +) ) (4) "Peace officer" includes any "general authority 17 Washington peace officer, " "limited authority Washington peace 18 officer, " and "specially commissioned Washington peace officer" as 19 those terms are defined in RCW 10 . 93 . 020; however, "peace officer" 20 does not include any corrections officer or other employee of a jail, 21 correctional, or detention facility, but does include any community 22 corrections officer. 23 Sec. 3. Except as otherwise provided under 26 this section, a peace officer may use physical force against a person 27 ( (men) ) to the extent necessary to: 28 (a) Protect against criminal conduct where there is probable 29 cause to make an arrest; ( (eat) ) 30 (b) Effect an arrest; ( (fit) ) 31 (c) Prevent an escape as defined under chapter 9A. 76 RCW; ( (ems 32 jai-etee ) ) 33 (d) Take a person into custody, transport a person for evaluation 34 or treatment, or provide other assistance under chapter 10 . 77, 71 . 05, 35 or 71 . 34 RCW; 36 (e) Take a minor into protective custody when authorized or 37 directed by statute; 38 (f) Execute or enforce a court order authorizincr or directing a 39 peace officer to take a person into custody; p. 3 SHB 1735 . SL 1 (a) Execute a search warrant; 2 (h) Execute or enforce an oral directive issued by a judicial 3 officer in the courtroom or a written order where -the court expressly 4 authorizes a peace officer to use physical force to execute or 5 enforce the directive or order; or 6 (i) Protect against an imminent threat of bodily injury to the 7 peace officer, another person, or the person against whom force is 8 being used. 9 ( ( (b) (2) DEADLY FORCE. Except as otherwise provided under 10 this section, a peace officer may use deadly force against another 11 person only when necessary to protect against an ( (Immi:nent) ) 12 immediate threat of serious physical injury or death to the officer 13 or another person. For purposes of this subsection 14 ( ( ( ) "I-Ffffnine t) ) "Immediate threat of serious physical injury or 15 death" means that, based on the totality of the circumstances, it is 16 objectively reasonable to believe that a person has the present and 17 apparent ability, opportunity, and intent to immediately cause death 18 or serious bodily injury to the peace officer or another person. 19 ( ({4}) ) "Necessary" means that, under the totality of the 20 circumstances, a reasonably effective alternative to the use of 21 deadly force does not exist, and that the amount of force used was a 22 reasonable and proportional response to the threat posed to the 23 officer and others. 24 ( ( (ill)) ) "Totality of the circumstances" means all facts known 25 to the peace officer leading up to and at the time of the use of 26 force, and includes the actions of the person against whom the peace 27 officer uses such force, and the actions of the peace officer. 28 ( (+2}) ) (3) REASONABLE CARE. A peace officer shall use reasonable 29 care when determining whether to use physical force or deadly force 30 and when using any physical force or deadly force against another 31 person. This 8 includes a consideration of the characteristics and conditions of a 9 person for the purposes of determining whether to use force against 10 that person and, if force is necessary, determining the appropriate 11 and least amount of force possible to effect a lawful purpose. Such 12 characteristics and conditions may include, for example, whether the 13 person: Is visibly pregnant, or states that they are pregnant; is 14 known to be a minor, objectively appears to be a minor, or states 15 that they are a minor; is known to be a vulnerable adult, or 16 objectively appears to be a vulnerable adult as defined in RCW 17 74 . 34 . 020; displays signs of mental, behavioral, or physical 18 impairments or disabilities; is experiencing perceptual or cognitive 19 impairments typically related to the use of alcohol, narcotics, 20 hallucinogens, or other drugs; is suicidal; has limited English 21 proficiency; or is in the presence of children; 22 (c) Terminate the use of physical force as soon as the necessity 23 for such force ends; 24 (d) When possible, use ( (avallabl ) ) less lethal 25 alternatives that are available and appropriate under the 26 circumstances before using deadly force; and 27 (e) Make less lethal alternatives issued to the officer 28 reasonably available for ( (di-) ) his or her use. 29 ( (+( }) ) _(4) A peace officer may not use any force tactics 30 prohibited by applicable departmental policy, this chapter, or 31 otherwise by law, except to protect his or her life or the life of 32 another person from an imminent threat. 33 ( (+4+) ) (5) Nothing in this section ( (pie) )_ 34 (a) Limits or restricts a peace officer's authority or 35 responsibility to perform lifesaving measures or perform community 36 caretaking functions to ensure health and safety including, but not 37 limited to, rendering medical assistance, performing welfare checks, 38 or assisting other first responders and medical professionals; 39 (b) Prevents a peace officer from responding to requests for 40 assistance or service from first responders, medical professionals, p. 5 SHB 1735 .SL 1 behavioral health professionals, social service providers, designated 2 crisis responders, shelter or housing providers, or any member of the 3 public; 4 (c) Permits a peace officer to use physical force or deadly force 5 in a manner or under such circumstances that would violate the United 6 States Constitution or state Constitution; or 7 (d) Prevents a law enforcement agency or political subdivision of 8 this state from adopting policies or standards with additional 9 requirements for de-escalation and greater restrictions on the use of 10 physical and deadly force than provided in this section. 11 NEW SECTION. Executive Summary: Mason County Parks & Trails fertilize four times a year—once in the spring, twice in the summer, and once in the fall. Commercial fertilizer production uses ammonia-nitrates produced in Russia and Ukraine. The cost of purchasing fertilizer has increased 10%and continues to increase. Parks&Trails currently has 80 bags on hand and requiring another 240 bags to be purchased to accommodate the four fertilizing applications this year. Budeet Impact• Each application consumes 80 commercial-size bags costing approximately $25.53 each totaling $18,000 and fertilizer is estimated at $4,000 of the total $18,000. Based on current prices,the budget shortfall is $4,170.92. The current shortfall could potentially be more than projected depending on the actual purchase date and increase in fertilizer costs. Once filed, his 10% lead pay would end on April 1, 2022. However, after careful consideration and consultation with leadership, the request is to continue Carl Olson's lead pay for the next 12 months. During this time, the manager is focused on writing/managing two RCO grants for parks projects at Union Community Park and Sandhill Park and Carl will be needed for day-to-day management of the 19 county-owned parks. Public Works has asked for approval to utilize the overflow parking at Latimer's Landing as an equipment staging area for the project contractor. In compliance with the Washington State Department of Transportation (WSDOT) requirements, the Mason County Parks & Trails manager issued a formal letter of approval to Public Works for WSDOT. Charges against the credit card that are not properly identified on the travel expense voucher or are found to be not allowed following the County's purchasing, contracting,vendor list, and other applicable policies, as well as the audit required under RCW 42.24.080, shall be paid by the official or employee by check or salary deduction. (RCW 42.24.115) (c) If, for any reason, disallowed charges are not repaid by the official or employee before the credit card billing is due and payable,the County shall have a prior lien against and a right to withhold any and all funds payable or to become payable to the official or employee,up to an amount of the disallowed charges and any interest and/or late fees incurred, as charged by the issuing credit card company. (f) Immediate surrender of a credit card(s)may be required if an elected official, employee, or department uses their credit card in a manner that is inconsistent with the County's code,policies, and procedures. The interest will be computed as simple interest on the outstanding balance. This penalty is payable to the County and is in addition to interest and penalty charges imposed by the credit card company. Departments may not use other bankcards. Charge Cards/Account Cards: Cards issued through specific vendors showing an established account. Not a credit card. No special permission is needed for these cards, except if a fee is charged. Charge cards'with fees require permission from the Board of County Commissioners. For example, Costco charges a fee for their cards, and they can only be used at Costco stores. Credit Card System Administrator: An individual within the Commissioners' Office is responsible for providing training, advice, direction, consultation and assistance to Approving Managers and-Card Custodians. Approving Manager: The Elected Official,Department Head or designee responsible for designating card custodians and requesting purchasing card limits. They will advise custodians of applicable limits and ensure that proper card usage,security, controls, timely bank statement reconciliation and approval,reception of transaction documentation and other related responsibilities are followed. Card Custodian:A Regular Employee,as defined in the Mason County Personnel Policy, within each office or department is responsible for card security and use. Custodians may designate employees within their office or department to use the credit card to purchase specific items or use a credit card for travel purposes. Designate a credit card custodian To designate a new credit card custodian,the Approving Manager completes the Mason County Credit Card Request Form(Exhibit A)and sends it to the Credit Card System Administrator in the Commissioners' Office, along with a signed Credit Card Custodian Agreement(Exhibit C). Custodians are responsible to: a. Pick up the credit cards from the Credit Card System Administrator in the Commissioners' Office. b. Keep all the credit cards safe and locked when not assigned to an employee. c. Maintain a log of credit cards checked out,to whom, date,purpose, date returned, sales slip returned,etc. d. Maintain the signed Mason County Credit Card Agreements (Exhibit B)from all authorized users of the department's credit card(s). Report Credit Card Fraud to the Credit Card System Administrator and file a claim with the credit card company.The credit card company will send a form to the department with reported fraud,which will be filled out and a copy submitted with the credit card statement to Financial Services. 3. Using the Credit Card(RCW 43.09.2855 (3)) a. The credit cards must be kept safe and secure at all times. When not in use by an individual,it is required that all credit cards be stored in a locked drawer or safe, with limited access. b. When needed for use,the custodian completes the information on the log and has the employee sign the log. If the custodian is the one to use the card,have another employee initial the log. c. The Approving Manager must set the boundaries for credit card use and must communicate this to the employee before they use the credit card. (Prohibited: meals, cash advances,and personal items.) Proof of communication may be done by a signature on a use agreement, etc. d. The card user must obtain and return all charge slips regardless what is purchased, to the custodian or departmental accountant. e. An itemized receipt must be obtained for all purchases when possible. £ Government officials and employees are expected to return the card to the card custodian promptly after each authorized us.Under no circumstances shall the card'information be stored by a government official or employee. g. To raise or lower a spending limit on a credit card, complete the Mason County Credit Card Request Form(Exhibit A) and send it to the Credit Card System Administrator in the Commissioners' Office. 4. Credit Card Billing Statements (R.CW 43.09.2855 (3)) a. The Credit Card Administrator will receive a master statement of all credit card accounts,for review and audit purposes only. b. The Credit Card Custodian in each department will receive a detailed bill each month for the cards they are responsible for. c. Required compensation is fifty percent of the appraised value. BACKGROUND: Daniel Hite owns Lot 7 of the Plat of Mading's Sunny Shore Addition No. 3 located at 4030 E Mason Lake Drive W, Grapeview, Washington. Mr. Hite has petitioned for the vacation of the deeded right of way that lies Northerly of, Lot 7 (Exhibit B). The requested area to be vacated is the original platted right of way and is approximately 86 x 60 feet in size (5160 sq. ft.). It has never been maintained or used as a public roadway as the existing roadway was constructed south of the platted right of way. Vacating this area would create more usable land north of the physical location of E. Mason Lake Drive W. Lots 8 and 9, which lie adjacent to Lot 7 on the West, have already vacated the platted right of way. These are noted as Vacations# 339 and #403. Public Works sees no value to opening the proposed vacation area at any point in the future given the existing road alignment and previously approved adjacent vacations. In compliance with RCW 36.87,40, at the Board of County Commissioners and County Engineer's direction, Public Works Department staff examined the portion of road right-of- way requested to be vacated and solicited cornments on the proposed vacation. Our findings are the following: 1 1. The road is presently in use by the public but not located within the platted right-of- way. 2. The road is classified as "Class A" per MCC 12.20.040 and per MCC 12.20.060 the compensation for fee simple interest is fifty percent of the appraised value and payment is due prior to recording the vacation. 3. As a condition of vacation approval, Mason County requires dedication of a 60-foot strip of land through Lot 7 with the centerline of said strip being the centerline of East Mason Lake Drive West road. 4. The required dedication is of similar land size to the proposed vacation and of similar value. Therefore, Public Works proposes no additional compensation other than dedication of the 60-foot strip. The proposed vacation area is deemed not necessary to preserve for the County road system for future use. 5. The public will benefit by this action, since it will add the vacated area to the tax rolls and relieve the county of liability. 6. The petitioners have paid in full the required administrative fee of$1000.00. Public Notice Public notice has been provided as required by RCW 36.87.050, both by posting at the site and by publishing in the county official newspaper. Recommendation Public Works recommends to swap easements by vacating a portion of the unopened right of way of E Mason Lake Drive West as platted in Mading's Sunny Shore Add. Per RCW 70A.205.160 and 35A.21.152. the County is required to provide seventy-five days' notice to collection companies before effective date of rate increase and least forty- five days to public rate payers. For the County to meet these requirements by the first of every year, staff is proposing the County change fee rates to increase each year by the amount of the August to August CPI for the Seattle - Tacoma - Bellevue area. RECOMMENDED OR REQUESTED ACTION: Recommend the Board approve and execute a resolution, replacing Resolution 61-13, updating the Solid Waste Utility Fees to increase each year by the amount of the August to August Consumer Price Index for the Seattle - Tacoma - Bellevue area.
