Notice is hereby given that the Kevin and Juanita Lea, who are the owners of the described property below, has filed an application for a Special Use Permit for the development of: Conversion of a second-floor heated storage area (768 sq. ft.) to an accessory dwelling unit in an existing garage on a property zoned Rural Residential 5 zone. To finalize this conversion, the applicant must receive approval through a Special Use Permit public review and hearing by the County Hearings Examiner. Parcel Number: 12330-54-00029 (0.42 ac.) Site Address: 41 NE Jolly Rogers Lane, Belfair WA. Location of Project: Near the corner of Jolly Rogers Lane and Larson Lake Road in Beard's Cove Subdivision; within the northeast 1/4 of Section 30, Township 23 N., Range 1 W. in Mason County Washington. Said proposed development is subject to Special Use Permit review(M.C.C. 17.05.040) and associated Mason County Development Regulations standards. First of all, thank you for letting us send in our comments. I did make the trip down to the 1pm Public Hearing on May it and arrived by 12:50 but the receptionist gave us the wrong information asking us to take a seat in the waiting area, not realizing we should go directly inside the room. n l i To begin, my husband and I reside o of 3 and own the her half of lot 30 e of that this storage unit has been built on. Years ago, Mr. Lea asked us to co- purchase lot 30 with him so no one could build a house between us. We purchased lot 30 together and the county divided the land and added each half to our existing lots 31 and 29 receptively, therefore eliminating lot 30, it's utility and drainage (please look at letter marked "COPY"to the Mason County Department of Community Development). At the time we purchased the divided lot, Mr. Lea indicated he would like to build a garage and we had no problem with him building one. Now ten years later, he decided he wanted more then a garage and that a heated storage unit would be nice. Here is our problem and concerns, Mr. Lea never intended to have a storage unit. When he started building 2 years ago he had a separate septic put in (why would he do that if it's just a garage and heated storage unit). Our concern in Mr. Lea's application for Special Use he states it is currently our desire to convert a permitted storage area into an ADU. Mr. Lea deceived the county by never intending this "house"to be a heated storage unit. His original plans were for this `house". No conversion necessary, he had already put in his electrical outlets, walls for a one bedroom, one bathroom, kitchen, and living room with big windows viewing Mt. Rainer. Mr. Lea reconnected to water (which had been removed from lot 30). We are pretty sure, since he is hooked up to water that all his plumbing is done as well. We know for sure his fixtures are all in because you can see them through the windows. If Mr. Lea and his wife wanted to build an additional dwelling for care of their parents it should have been on his other full lot (28) located next to his existing house. Or Mr. Lea should have purchased lot 30 himself and not involved us. Now he has built a house on half a lot (30). These lots were not intended for more then one house. Once again I would like to thank you for taking our comments into consideration and ask that you rule against turning this heated storage (house) into an additional dwelling. We each own one of the lots bordering this property (lricksons - Division 7, Lot 31; Leas - Division 7, Lot 29). We want to remove the existing property lines between our individual parcels and Lot 30 and replace them with one line that equally separates lot 31 between the Ericksons and Leas as shown on the attached copy of the parcels of interest. This letter requests that the appropriate Mason County authority send a signed letter to the above address which states that the water departmci,t relinquishes interest in the utility and drainage easement currently stipulated as a covenant in the a.fFcctcd plot (see attached). This relinquishment should include the waiving of any water department utility easement interest in the new property line as well as the two lines being adjusted.
