ATTACHMENTS: - Professional Services Contract Agreement, 10, 000 Year Institute's All Lands Forest Restoration Project, Exhibits A, B & C Briefing Summary 9/29/2021 PROFESSIONAL SERVICES CONTRACT AGREEMENT BETWEEN 10,000 YEARS INSTITUTE AND MASON COUNTY NOXIOUS WEED CONTROL BOARD FOR 10,000 YEARS INSTITUTE' S ALL LANDS FOREST RESTORATION PROJECT THIS AGREEMENT is between 10,000 Years Institute, located at 341 North Forks Avenue, Forks, WA 98331, and Mason County Noxious Weed Control Board (Consultant), with an address of 303 North 4th Street, Building 4, Shelton, WA 98584 and is made effective as of the date signed below by 10KYI. 10KYI and Contractor are also referred to as the "Parties" and each as a "Party. " This Agreement relates only to work funded by the 10KYI All Lands Forest Restoration Project, funded through Washington Department of Natural Resources Forest Health Program on behalf of the Olympic Forest Collaborative . The Parties to this Agreement agree as follows: 1) DEFINITIONS . -- For purposes of this Agreement, the term — a) "10,000 Years Institute" means 10,000 Years Institute, a Washington 501 (c) (3) Non-Profit Corporation, and its directors, officers, employees and agents also referred to herein as "10KYI' b) "Contractor" means the Mason County Noxious Weed Control Board and its employees, agents and subcontractors; and c) "Project Manager" means the person designated below and incorporated by reference, to serve as representative of 10KYI and the Consultant for purposes of administration of this Agreement. 2) SERVICES TO BE PERFORMED AND DELIVERABLES . -- The Contractor agrees to provide services to 10KYI, in accordance with applicable professional standards, as described in Exhibit A appended to this contract. No work shall commence tinder this Agreement until it is fully executed by both Parties. 10KYI Professional Services Agreement with Mason County Noxious Weed Control Board Page 1 3) COMPENSATION. - a) The parties have estimated that the cost of accomplishing the work herein will not exceed Fourteen Thousand, and No / 100ths Dollars ($14,000.00) . b) Except as provided herein, 10KYI agrees to pay Consultant quarterly following receipt of an invoice documenting services rendered and costs incurred, in a manner and amount stipulated in Exhibit A. i) 10KYI may, at its sole discretion, retain up to 10 percent of the amount otherwise due and owing under each invoice until Consultant completes all work described in Exhibit A, or otherwise authorized by 10KYL 10KYI shall notify Consultant of the amount retained and deposit the retained amount in an interest-bearing account. 10KYI shall release the amount retained, together with earned interest, not later than 30 days after receipt of a final invoice and acceptance of 10KYI of all work authorized. ii) 10KYI may, at its sole discretion, retain an amount otherwise due and owing under each invoice until Consultant provides 10KYI with evidence that the Consultant has paid industrial insurance premiums for its employees and /or is in compliance with state industrial insurance requirements . c) Allowable Costs . - i) Travel Expenses. -- 10KYI agrees to reimburse Consultant up to the amount stipulated in Exhibit A for travel expenses (including per diem at current government rate) from Consultant's home or principal place of business to work and meeting sites . 10KYI shall reimburse Consultant for travel expenses in accordance with federal travel regulations . Payment for expenses over the category amount will not be honored without prior approval of 10KYI's Project Manager. ii) Other Expenses. - Payment for miscellaneous expenses will be specified in Exhibit A. Any request over the category amount will not be honored without prior approval by 10KYI's Project Manager. d) Unallowable Costs. -- i) Management fees or similar charges in excess of the direct costs are not allowable. ii) If Consultant expends more than the amount of its approved budget in anticipation of receiving additional funds, it does so at its own risk. 10KY1 is not legally obligated to reimburse Consultant for costs incurred in excess of the approved budget. e) Invoice . -- Consultant's invoice shall indicate dates of service, a description 10KYI Professional Services Agreement with Mason County Noxious Weed Control Board Page 2 of work performed by sites as outlined in Exhibit A, , and time spent on that date in providing service tinder this Agreement. The invoice shall include travel claims for travel expenses incurred by Consultant in connection with performance under this Agreement. Invoices should be sent to the 10KYI Project Manager at the 10KY1 address listed below by email. 4) TERM. -- The term of this Agreement commences on the effective date, the date the agreement is signed by the 10KYI Executive Director below, and continues until June 15, 2022 as stipulated in Exhibit A, or until terminated by the Parties. 5) TRAINING. -- Consultant acknowledges that no training will be provided to Consultant under this Agreement. Consultant warrants and represents that its personnel are fully trained to perform services required under this Agreement and that additional training provided by 10KYI will be unnecessary. 6) BUSINESS LICENSES AND TAXES . — a) Consultant shall, at its own expense, secure and maintain in full force and effect during the term of this Agreement all required licenses, permits, and similar legal authorization, and comply with all applicable Federal, State and local regulations. b) Consultant shall be responsible for payment of taxes, insurance and other obligations relating to its performance of services under this Agreement. Consultant shall provide 10KYI with verification of its — 1) Unified business identifier number from the State of Washington and that its business license is in good standing; ii) Washington State Department of Revenue account and that the account is in good standing; iu) Washington State Labor and Industries account and that the account is in good standing or that the Consultant is exempt from the state's industrial insurance requirements; c) All other necessary licenses and permits to perform the work specified in Exhibit C . 7) INDEPENDENT CONSULTANT STATUS. - Consultant shall act as an independent Consultant, and in no way shall be considered an employee of 10KYI. Consultant is not required to report to 10KYI's offices at any specific time, except as requested for occasional consultations. 10KYI does not have the right to assign any additional projects to Consultant. 101KYI Professional Services Agreement with Mason County Noxious Weed Control Board Page 3 Consultant shall choose the time and mamler for performing each part of the services described in Exhibit A according to its own routines and schedules, independent from 10KYI's normal business operations. a) Consultant acknowledges that Consultant will not qualify for benefits which may be available if classified as an employee. In the event that the Internal Revenue Service (IRS) successfully asserts that Consultant is not or was not an independent Consultant for any period during the term of this Agreement and reclassifies Consultant as an employee, Consultant agrees to complete, sign and deliver IRS Form 4669 (Employee Wage Statement) to 10KYI for any tax period affected. 10KYI shall then file the Form 4669 with the IRS (along with IRS Form 4670 "Request for Relief From Payment of Income Tax Withholding") to offset against 10KYI's withholding obligation. b) Consultant acknowledges that it will be liable to 10KYI for any industrial insurance premiums or any other premiums or fees that 10KYI is required to pay on its behalf under RCW 51 . 12 . 070, or any other applicable statute, regulation or ordinance, to the State of Washington or local jurisdiction. 8) NON-EXCLUSIVE CONTRACT. -- This Agreement is non-exclusive . Consultant reserves the right to perform services for others during the term of the Agreement. 9) MATERIALS AND EQUIPMENT. -- Consultant shall provide all materials and equipment necessary to perform its obligations tinder this Agreement: Provided, however, that Consultant may use office equipment located in the offices of 10KYI, as available, and provided however, that if "Other Expenses" have been awarded as part of this agreement, 10KYI may purchase said supplies and services on behalf of the Consultant as part of this Agreement. 10) INSURANCE. — Consultant shall provide 10KYI with a certificate of insurance for each insurance provision required in this section. The certificate of insurance shall be effective during the duration of this agreement. 10KYI may require that the certificate of insurance name 10KYI as an additional insured party. Consultant shall also require all of its subcontractors to maintain the same type and level of insurance as required in this section and provide certificates of insurance to 10KYI as required in this section. Consultant shall, at its own expense, acquire and maintain the following insurance throughout the term of the Agreement: a) Commercial Automobile Liability Insurance covering all owned, non-owned and hired automobiles, trucks and trailers . Such insured shall provide the Standard Comprehensive Automobile Liability policy in limits not less than $1,000,000 Combined Single Limit; 10KYI Professional Services Agreement with Mason County Noxious Weed Control Board Page 4 b) Commercial General Liability Coverage Insurance, with not less than the following limits: $1,000,000 for each occurrence limit, $1,000,000 for personal injury limit, $2,000,000 general aggregate limit; c) Professional Liability Insurance in an amount not less than $1,000,000 per claim and in the aggregate; and d) Workers' Compensation and Employer Defense Insurance as required by statute and employer liability coverage, with not less than the following limits : $1,000,000 each accident for bodily injury by accident, $1,000,000 each employee for bodily injury by disease and $1,000,000 policy limit for bodily injury by disease. 11) PUBLICITY AND ACKNOWLEDGEMENT OF SUPPORT. "- Consultant gives 10KYI the right and authority to publicize 10KYI's financial support for this Agreement and the Project in press releases, publications and other public communications. Consultant agrees to not publicize its work under this Agreement without 10KYI's express written approval. 12) INSPECTION AND RETENTION OF RECORDS . --The Consultant shall make all applicable financial records, supporting documents, and all other pertinent records related to this Project, available to 10KYI or any of its duly authorized representatives, for inspection. Records shall be retained until the Term date of this Agreement and then submitted to the Project Manager for retention according to law. 13) APPLICABLE LAW. -- This Agreement shall be construed and enforced tinder the laws of the State of Washington, irrespective of the fact that any one of the Parties is now or may become a resident of another state. Venue for any action under this Agreement shall lie in Mason County, Washington. 14) MODIFICATION. -- This Agreement may not be waived, discharged or modified in any manner other than by written agreement of the Parties. 15) SEVERABILITY. -- No provision of this Agreement is severable from any and all other provisions of this Agreement. Should any provision or provisions of this Agreement be unenforceable for any reason, the party finding itself unable to enforce said provision(s) may, at its sole discretion, declare this entire Agreement to be null and void. 16) TERMINATION. -- Either party may terminate this Agreement with 30 days written notification to the other party. If this Agreement is so terminated, the Parties shall be liable only for performance rendered or costs incurred in accordance with the terms of this Agreement prior to the effective date of termination. If for any cause, either party does not fulfill in a timely and proper manner its obligations tinder this Agreement, or if either party violates any of these terms and conditions, the aggrieved party will give the other party written 10KYI Professional Services Agreement with Mason County Noxious Weed Control Board Page 5 notice of such failure or violation. The responsible party will be given the opportunity to correct the violation or failure within 15 working days. If the failure or violation is not corrected, this Agreement may be terminated immediately by written notice of the aggrieved party to the other . 10KYI shall have the right to terminate this Agreement in whole or in part at any time, if the Funding Source issues an early termination under the funding agreement(s) covering all or part of the Project at issue hereunder. 17) WAIVER. -- If either party fails to exercise its rights under this Agreement, it shall not be precluded from subsequent exercise of its rights . A failure to exercise rights shall not constitute a waiver of any other rights under this Agreement, unless stated in a letter signed by authorized representative of the party and attached to the original agreement. 18) COSTS AND ATTORNEYS' FEES . -- If either party brings any action against the other for relief, declaratory or otherwise, arising out of this Agreement, the prevailing party shall recover against the other party all costs and reasonable attorneys' fees, including costs and reasonable attorneys' fees incurred to enforce any judgment rendered pursuant to this Agreement. 19) DEBARMENT. By signing this Agreement, Consultant warrants and represents its initial and continued compliance that it is not listed on the Washington State Department of Labor and Industries state-wide Debarred Contractors List (or debarred in another state in which the Consultant's business resides) . 20) COUNTERPARTS AND ELECTRONIC SIGNATURE. — This Agreement may be executed in counterparts, after execution by all Parties hereto, shall together constitute the Agreement. The cost is approximately $ 2, 000 for each laptop or $ 1500 for each desktop . For the time being , the plan presumes that each computer or laptop will be replaced with a laptop . The actual replacement item will be analyzed on a case - by- case basis when it comes time to order the computers . PURPOSE The purpose of this Agreement is to provide reimbursements to assist Counties with extraordinary judicial , prosecutorial , or defense - related costs of resentencing and vacating the sentences of defendants whose convictions or sentences in Superior Court and District Court are affected by the State v. Blake decision and to provide reimbursements to assist Counties who have reimbursed or will reimburse LFOs to defendants whose convictions or sentences in Superior Court and District Court are affected by the State v. Blake decision . 2 . REIMBURSEMENT A . Extraordinary Expenses Reimbursement . AOC shall reimburse the County up to a maximum of $ 702 , 300 for extraordinary judicial , prosecutorial , or defense - related costs of resentencing and vacating the sentences of defendants whose convictions or sentences are affected by the State v. Blake decision incurred during the period of February 25 , 2021 to June 30 , 2022 . No reimbursement will be made under this Agreement for resentencing or vacation costs incurred after June 30 , 2022 , and any reimbursement requests in excess of this amount will be denied . If additional funding is appropriated by the Legislature for these purposes , the amount of reimbursement under this Agreement may be increased by agreement of the parties . B . LFO Reimbursement . AOC will reimburse the County up to a maximum of $ 324 , 217 for payments made by the County during the period February 25 , 2021 to June 30 , 2022 pursuant to court order which required reimbursement by the State of Washington of legal and financial obligations . No reimbursement will be made under this Agreement for resentencing or vacation costs incurred after June 30 , 2022 , and any reimbursement requests in excess of this amount stated in this Section 2 ( b ) will be denied . A breakdown of expenses by judicial , prosecutorial , and defense - related costs ; c . The amount of LFOs reimbursed , with the case number associated with that amount . d . Any positions supported by these funds , broken down by judicial , prosecutorial , and defense - related positions ; and e . EXECUTIVE SUMMARY: The County made these CDBG-CV1 funds available to the Community Action Council of Lewis, Mason and Thurston Counties (CAC) as grant subrecipient. These funds will result in new and increased CDBG eligible public services for the Mason and Lewis Counties CDBG-CV1 consortium service area. The project is to provide essential assistance to help stabilize eligible households impacted by COVID-19. Originally, the project was to benefit approximately 342 households over the two- year term of the contract and target services to limited clientele with principally low-and moderate-incomes, based on the LMI household qualification process. After reviewing the long-term impact of this pandemic, it is being proposed to provide up to $6,000 per household to benefit approximately 83 households, instead of the estimated $1,000 per household to 342 households as originally established. Households need of so much more assistance than originally thought when this grant was set up. This will enable CAC to get the money out to the community faster and will have a better impact on stabilizing housing in the community. Also, verifying fewer households for eligibility will decrease CAC's budgeted administration costs by $159,625, therefore, more funds can go directly to households. Commerce has given their approval to these changes without requiring a contract amendment. See attached draft changes. Background RCW 70.05.060 directs the local board of health to enact local rules and regulations as are necessary in order to preserve, promote, and improve public health and provide for the enforcement thereof. Chapter 6.76 was implemented in 2009 due to increasing changes in state codes and requirements surrounding the administration and oversight of onsite sewage systems. Since 2009, staff has found various gaps between state and local codes. In addition, time and experience have prompted changes in processing of permits, code enforcement cases, and certification of contractors. The proposed amendments were compiled by staff and presented to the Onsite Sewage Advisory Committee on July 13t", 2021. After discussion, the committee members voted unanimously to approve recommendations to adopt the proposed code amendments. See timeline below for more information on steps taken and status. Purpose The purpose of chapter 6.76 are to assure protection of public health by: 1. Minimizing the public health effects of on-site sewage systems on surface water and groundwater. 2. Minimizing the potential for public exposure to sewage. 3. Establishing design, installation, and management requirements for on-site sewage systems to accommodate effective treatment and disposal of sewage on a long-term basis. 4. Require a known level of treatment for sewage disposed in Mason County. 5. Enhance protection of environmentally sensitive areas within Mason County. Summary of changes 6.76.040 Definitions. Addition of"Pit Toilets" to list of definitions. More information within 6.76.065 6.76.060 Minimum standards and adoption by reference. • Adds adoption and reference to building permit policies originally approved by Board of Health in 1996. • Adds support to health officers ability to restrict permit time of validity or time to install to one year on failing sewage components. Staff has found providing a 3-year time frame on repair of failing components sends a confusing message to applicants. Many times these repair/replacement permits are in response to surfacing sewage situations that can or are affecting public health. Staff already restrict permit timelines based on state code allowances, however adding the proposed language provides more clarity to applicants on current practices. 6.76.065 Adequate sewage disposal required. (added section) • Clarifies requirements for adequate and approved sewage disposal throughout Mason County. Addition of this section will assist with code enforcement efforts on varying situations related to surfacing sewage and water pollution. • Washington State provides recommended standards and guidance on permitting a Pit Toilet. Staff has concerns with use of such system due to the amount of surface water, streams, wetlands, and shellfish harvest area within Mason County. Requirements of increased soil depth and surface water setbacks already eliminates a big portion of Mason County. Recommendation is to prohibit use of such system in all of Mason County. 6.76.070 —Operation and maintenance of on-site sewage system • Reference to use of management service (currently OnlineRME) in reporting inspections of an Onsite Sewage System. • Revises requirements around property sales and onsite sewage system maintenance. Previously code allowed a pumping to satisfy a property sale. Staff have received complaints from the public, realtors, and septic contractors around pumpers not satisfying a complete inspection of all septic components. Current proposed amendments to WAC 246-272A include requiring an inspection from an operations and maintenance specialist. Lack of a complete inspection has resulted in purchases of systems with failing components unknown to the purchaser. Requiring an inspection by an O/M Specialist (inspector) would resolve these concerns. Proposal will simplify property sale requirements throughout the county, provide more information to buyers, and align with future probable state code requirements. • Adds requirements for an up-to-date service inspection prior to additional development permitting. This requirement has been in place since 1996 when Board of Health adopted the building permit policies. Adding to code, helps with transparency to applicants and provides legal backing to disputes or appeals. Overall intent behind requiring an inspection is to be sure additional development is not being permitted on failing sewage components. 6.76.080 Certified pumper requirements. • Removes administrative enforcement on certified pumpers by Contractor Review Board, replaced by updated text under section 6.76.130. Most contractor complaints reach resolution without needs of a dedicated board. Maintaining a board with little work is not efficient use of staff time or the members serving. Recommend replacing contractor board with board of health. In the event enforcement actions or hearings are necessary, BOH can be utilized. See added sections under 6.76.130. 6.76.130 Enforcement. • Adds supporting language to the condemnation of an establishment for lack of proper sewage disposal. Staff currently utilizes the existing language, but find it lacks some clarification. Sheriffs' office and the public has requested more clarifying information on how this condemnation is being interpreted by health dept. staff. Also adds language on how the county shall issue and serve these notices to provide uniformity. • Adds language around suspension and revocation of a certified contractor. Much of this language is already in place under the specified professional sections, this is a reorganization of existing requirements and replacement of the contractor review board with health officer and board of health. 6.76.140 Appeals. • Small adjustment to language around contractor review board, replaces with board of health and adds time period to appeal similar to surrounding counties and other Title 6 chapters. 6.76.150 Waivers. (Added section) • Waiver of regulations are allowed under state code WAC 246-272A. Mason County regularly approves waivers to state and local code in the onsite sewage program, however there is no local code that addresses this program function. These waivers can become important for various development requests. Staff recommends addition of this section to provide legal backing to current practices and align with other chapters under Title 6. Recommendations Mason County Board of Health completed their review and approval of the proposed amendments. If no changes requested, recommend setting a public hearing date of October 26th. "Surface water"shall mean any body of water,whether fresh or marine,flowing or contained in a natural or artificial unlined depressions for a significant periods of the year, including natural and artificial lakes, ponds, springs, rivers,streams,swamps, marshes and tidal waters. These regulations shall apply to all on-site sewage systems except the following: (1) New construction for which a permit was issued prior to adoption of these regulations and which is still valid. (3) Facilities constructed or operated in accordance with a permit or approval issued by the Washington State Department of Health.Where these regulations are in conflict with 246-272B WAC. (54) Permits shall be required prior to any construction, alteration, extension, relocation,or repair of any on-site sewage system. Permits shall be valid for three years from the signature date of the site inspection. Permits proposing repair of failed components shall be valid for one year from the signature date of the site inspection. Permit fees shall be charged according to the"Mason County P, blie Environmental Health Fee Schedule." (1) Every residence, place of business,or other building or place where people congregate, reside or are employed shall be connected to an permitted public sewer or Large Onsite Sewage System approved by Washington State Department of Health or Onsite Sewage System approved by the health officer. (2) Any unit/facility with the protentional to generate wastewater by virtue of being equipped with a toilet,sink, shower or other plumbing fixtures shall be connected to an permitted public sewer or Large Onsite Sewage System approved by Washington State Department of Health or Onsite Sewage System approved by the health officer. (3) Installation and use of Pit Toilets for sewage disposal shall not be permitted nor considered an adequate form of sewage disposal in Mason County. 6.76.070 Operation and maintenance of on-site sewage systems. (1) On-site sewage systems shall be inspected as prescribed in 246-272A WAC and the Mason County Public Health On-Site Standards. (2) The homeowner or person contracted by the homeowner to perform the inspection service shall report fully on the status of the on-site sewage system, using the form and/or management service prescribed by the director. (3) The homeowner or person contracted by the homeowner to perform the inspection service shall report immediately any identified on-site sewage system failure to the department. (4) The system owner shall take necessary corrective action,as identified by the director,to correct deficiencies in system design and operation,when such deficiencies are documented through operation and maintenance inspections. (5) When a property contains and/or is served by an on-site sewage system,an inspection service report by a certified operations and maintenance specialist is required within 12 months: (a) Prior to the sale of property or transfer of ownership. The pump tank shall be of at least one thousand gallons in capacity, in good repair, and of cleanable construction. 2. All outer contact surfaces and fittings shall be kept in a clean and sanitary condition while stored or in transit,and all premises served and equipment used shall be left in a clean and sanitary condition. 3. All discharge valves shall be in good repair,free from leaks and fitted with watertight caps. 4. The name of the operating firm shall be prominently displayed on the sides of any pump tank vehicle. (3) The initial certificate fee shall be in accordance with the adopted fee schedule.At the end of each calendar year all certificates shall expire. (c) The initial certification fee shall be in accordance with the adopted fee schedule.At the end of each calendar year all certificates shall expire.Certificates may be renewed for a fee established by the adopted fee schedule.An installer's certificate shall not be transferable. (2) The advisory committee shall meet a minimum of once each year to evaluate department policies and procedures pertaining to the on-site sewage program, "Mason County Public Health Standards"and all relevant local ordinances and codes.The committee will present findings and make recommendations to the director and the board of health. (3) The advisory committee shall act under by-laws adopted by the Board.Copies of said document shall be kept on file and made available to the public at the Mason County Public Health office. (Ord. No. 32-09, § 12,4-7-2009) 6.76.130 Enforcement. (1) It shall be unlawful to discharge sewage from any on-site sewage system, including septic tank wastes and greywater to surface water or upon the surface of the ground. (2) It shall be unlawful to use or maintain a malfunctioning on-site sewage system. Upon the discovery of the existence of such a system,written notice of violation shall be given to the recorded owner and/or occupant of the premises. Upon failure to adequately repair and restore the sewage system to proper working order within the time frame stipulated on the written notice or thereafter amended,the premises may be vacated. Failure to so vacate shall constitute an additional violation. (3) No person shall discharge waste products other than domestic sewage into an on-site sewage system(s), except where it has been adequately demonstrated to the director that the nondomestic waste discharge would be consistent with the system design,good sanitary waste treatment and disposal practice,and not cause a water quality violation or violate hazardous waste materials disposal law. (4) No person shall use and maintain an on-site sewage system except in a manner that is appropriate to the design of the system. (5) The director may condemn and issue a Notice of Non-Occupancy,according to law,any residence or other establishment which is accumulating or disposing of sewage in a manner contrary to the requirements of these regulations.The Notice of Non-Occupancy shall be served to the owner of the property,either personally or by mailing a copy of the notice by regular and certified mail to the owner at his or her last known address. A copy of the Notice shall also be posted on the property where the alleged violation(s) occurred or is occurring. No person shall remain in or enter any building structure,or property which has been so posted, except that entry may be made to repair or correct any conditions causing or contributing to the threat to public health. No person shall remove or deface any such notice after it is posted until the required corrective action has been completed and approved. (6) All violations of these regulations are determined to be unlawful and declared to be detrimental to the public health,safety and welfare,and are public nuisances.All conditions which render any building,structure, premises, land use or portion thereof to be used or maintained in violation of these regulations shall be abated if provisions for their continuance made pursuant to these regulations are not satisfied. Created: 2021-03-16 10:16:48 [EST] (Supp. No.55,Update 1,5-21) Page 8 of 10 (7) In addition to or as an alternative to any other judicial or administrative remedy provided herein,or bylaw, any person or establishment who violates these regulations or by each act of commission or omission procures, aids or abets such violation, may be assessed a civil penalty not to exceed two hundred fifty dollars for each day of continuous violation to be directly assessed by the health officer until such violation is corrected.The per diem penalty shall double for the second separate violation and triple for the third and subsequent separate violations of the same regulation within any five-year period. (8) In addition to or as an alternative to any other judicial or administrative remedy provided herein, or by law, any person who violates these regulations or by each act of commission or omission procures,aids or abets such violation,shall, upon conviction, be guilty of a misdemeanor. For purposes of these regulations,each section violated shall constitute a separate and distinct offense,and each day's violation shall constitute a separate and distinct offense. Penalty, upon conviction,shall be punishable by a fine of not more than five hundred dollars,or by imprisonment for not more than ninety days,or both such fine and imprisonment. (9) Suspension of Certificate (a) soeei^k-AA certificate may be suspended,after a hearing between the health officer and certificate holder, when the holder has performed with negligence, incompetence, misrepresentation or failure to comply with the applicable rules, regulations,guidelines, policies or practices which pertain to water supply and waste water disposal,to have made fraudulent misrepresentation in making application for a certificate or authorization or to have made fraudulent misrepresentation in making application for a permit to install an on-site sewage system,either existing at the time of certification or as thereafter enacted. (b) The health officer shall give written notice of the hearing to any person aggrieved who has filed a written complaint with the health officer and the affected certificate holder(s). (c) For the first confirmed violation under this subsection by certificate holders,the suspension period shall not exceed 30 days; and the second violation in any three-year period shall result in a suspension of the certificate for a period not less than 15 days and not to exceed 180 days. (d) If the health officer suspends a certificate,the holder shall not proceed with any further work in connection with the activity covered by the certificate. (e) The certificate holder shall be notified by certified mail of suspension of the certificate upon determination of a finding that a violation has occurred requiring suspension. (10) Revocation of Certificate (a) A certificate may be revoked for repeated violation of any of the requirements of these regulations or any other applicable regulation or if,after a hearing with the board of health,the holder of such certificate shall be found grossly incompetent of negligent,or to have made fraudulent misrepresentations in making application for a certificate or for a permit to install an on-site sewage system,or should the bond or insurance required herein be canceled. (b) The health officer shall give written notice of the hearing to any person aggrieved who has filed a written complaint with the health officer and the affected certificate holder(s). (c) The third notice of violation issued within any 12-month period shall be considered as repeated violations and result in certificate revocation (d) If the board of health revokes a certificate,the holder shall not proceed with any further work in connection with the activity covered by the certificate. (e) The certificate holder shall be notified by certified mail of revocation of the certificate upon determination of a finding that a violation has occurred requiring revocation. (4) Departmental orders and determinations shall be stayed for the period the appeal is pending, provided no surfacing sewage or public health hazard results from said stay. (5) Any variations from these regulations resulting in requirements less stringent than those found in Chapter 246-272A WAC shall have concurrence from the Washington State Department of Health. (6) Administrative hearings shall be conducted in accordance with Mason County Office of Environmental Health Variance and Appeal Procedure.Copies of said document shall be maintained and made available to the public at the Mason County Public Health office. The last bridge inspection determined that bridge number 1 and 2 needs to be posted with maximum load limits and 3 through 7 as one lane travel bridges. 1. Resolution RESOLUTION NO. 2021- BRIDGE LIMITS WHEREAS,RCW 36.75.270 gives the Board of Mason County Commissioners the authority by resolution to limit or prohibit classes or types of vehicles on any county bridge and may limit the weight of vehicles which may travel thereon. WHEREAS,in compliance with the requirements of the Federal Highway Administration's National Bridge Inspection Standards(NBIS)for specialized haul vehicle regulations,updated bridge load ratings have been completed as required;and WHEREAS,load ratings have determined that two(2)of Mason County's sixty-four(64)bridges shall be posted with a maximum load limit,and WHEREAS,five(5)of Mason County's Sixty-four(64)bridges shall continue to be posted as one lane. NOW,THEREFORE,BE IT RESOLVED,that these restrictions be posted,as listed below until resolution is rescinded to modify or remove such restrictions based upon the recommendation of the County Engineer. Primitive Road status provides for lower liability for warning signing on low volume unpaved access roads. Roads eligible for Primitive Road status are unpaved access roads with 100 vehicles per day or fewer. As County roads are improved and traffic counts are updated, the list of roads eligible for Primitive Road designation changes. Public Works staff has reviewed the current list (Resolution 33-08) and with the recently upgraded road surfaces of Snider and Boyer Road, with BST surface (also known as chip seal), both roads have been removed from the primitive road list. Public Works recommends the updated roads list be designated Primitive Roads. RECOMMENDED ACTION: Recommend the Board approve a resolution designating certain low volume unpaved county access roads as Primitive Roads. ATTACHMENT: 1. Current Resolution 2. Updated Resolution Briefing Summary RESOLUTION NO. -08 WHEREAS, WAC 136-468-95-290, pursuant to RCW 36.75 .300, provides regulation pertaining to the designation and signing of county roads as Primitive Roads, and WHEREAS, the legislative authority of each county may, by resolution, classify and designate portions of the county road as primitive roads where the designated road portion: (1 ) is not classified as part of the county primary system, as provided for in RCW 36.86.070; (2) has a gravel or earth driving surface; and (3) has an average annual daily traffic of one hundred or fewer vehicles; and WHEREAS, WAC 468-95-090 states that any road designated as a primitive road shall be marked with a "PRI IITIVE ROAD" sign at all places where the primitive road portion begins or connects with a highway other th a primit ive tive road, and WHEREAS, Mason County first designated primitive roads in Resolution 62-82, and has updated the list of designated primitive roads as changes were made to our road system that affect primitive road status; and WHEREAS, the County Engineer has reviewed the county road system and determined which roads are appropriate to be classified as primitive roads.
