The original site exit is unstable with a lot of movement and landslides.No stairs could have been built at this exit site.Instead, we carve out from the closest stable ground and down the face of the bulkhead to the pier. We cut our pier length down to 16' to try to reduce any overage in overwater coverage(attachment 2). The original plans dated 02/16/17 (attachment 3) called for a pier length 25'. Despite this reduction, we still have exceeded the square footage over water. This additional coverage over water is only from the access point where we had no choice but to come down in that area. The referenced drawing identifies an unstable slide area is located in the same area as the original location of the staircase which was confirmed by this engineer. If the replacement staircase and landing were built in the same location, there could potentially be a slide issue during or after construction adding considerable cost to the project to repair and the damage and i to relocate the stairs to another location, As a result, the new staircase was relocated to its current location on the Left-hand side of the pier and dock as shown in the referenced engineering drawing. The new staircase location is completely outside the slide area as delineated in the reference above and, therefore, is considered stable and unyielding. It is the conclusion of this engineer that the present location of the stairs and landing at the top of the bulkhead and located at left hand side of the pier and dock is now stable and structurally sound. As you know, Tacoma Power's Cushman Hydroelectric Project area (Project) includes all lands located waterward of the 742-foot elevation Project boundary. All structures and uses located within the Project boundary require authorization from Tacoma Power and are subject to Tacoma Power's Shoreline Management Plan and supplemental Shoreline Use Specifications and Permitting Guidelines. The project that was presented to Tacoma Power for approval in 2017, and subsequently to the regulatory agencies for required permits, met the conditions of Tacoma Power's management plan and Mason County code, however, what was constructed does not. The letter and supporting documents from your contractor detail the rationale for changing the exit point of the stairs. The stairs are necessary to provide access from your development lot to the shoreline structures. The letter acknowledges that the total area of the new structures exceed Tacoma Power's 300 square-foot overwater maximum allowance, states that the dock structure was reduced in length to make up for the additional overwater coverage caused by the new stair exit point, and acknowledge that despite the reconfiguration, the overall square footage still exceeds the maximum limit. Tacoma Power has reviewed your contractors' variance request and supporting documents and has the following comments: Items reviewed: • "Latham Project Variance Request" letter from Integrated Northwest Construction, dated 1/13/2019, • "Latham- Relocation of Stairs" letter from Steven Morta, P.E., dated January 17, 2010 (? —year date is a typo) • As-built drawings (4 pages), by MET Engineering, stamp dated October 25, 2018, Stephan &Amy Latham March 26, 2019 Page 2 • Original approved plans (3 pages), by MET Engineering, stamp dated February 6, 2017, • Tacoma Power short-term license for construction No. 334, • Regulatory permits from Mason County, Washington State Department of Fish and Wildlife, and the US Army Corps of Engineers, and • Tacoma Power Records. 1. Square footage of stair extension and float is incorrect. The as-built drawings did not take into account the 3-foot by 3-foot stair landing which adds an additional 9 square feet of overwater coverage. Additionally, the as-built drawings miscalculated the float square footage by 7.28 square feet. Based on the measurements provided by the as-built drawings, Tacoma Power calculated the total overwater coverage of the structures to be 331.28 square feet. 2. Pre-approval of changes was not sought as required by the short-term License and regulatory permits. If the contractor had requested changes prior to construction, as required, then the size discrepancy would have been identified and the structures would have been required to be further reduced to stay within the 300-square-foot maximum limit. Failure to comply with basic short-term License and regulatory permit conditions is not cause for a variance. a. Short-term license No. 334, section 4, required that written consent be obtained from Tacoma Power before changing the Permitted Use. Tacoma Power was not contacted to discuss the plan changes or to request consent for proposed changes. b. Mason County building permit BLD2016-01198, condition 8, required the engineer of record to submit changes in writing prior to construction. Your engineer did not submit changes in writing to Mason County prior to construction. c. Washington Department of Fish and Wildlife Hydraulic Project Approval (HPA) No. 2017-6-97+01 required a modification of the permit prior to changes in construction. A permit modification was not sought. 3. Fixed pier was not built to approved specifications. The fixed pier section was engineered and approved by all parties to be 28 feet x 6 feet (168 square feet). The contractor stated in the Variance Request letter that the pier length was reduced to 16 feet, but failed to acknowledge that the pier was also widened to 8 feet 6-inches (136 square feet), which does not meet Mason County code requirements. New construction must comply with all applicable regulations and be approved by the regulatory agencies. Tacoma Power cannot grant a variance to a structure that will not be permitted by Mason County. a. Mason County code limits pier widths to 8 feet. b. No justification was provided as to why the pier was overbuilt. c. If the fixed pier had not been widened, then it would constitute 96 square feet of overwater coverage and the total overwater coverage would have remained within the 300 square foot maximum limit. Stephan &Amy Latham March 26, 2019 Page 3 Your variance request is denied given that the structure modifications were undertaken without prior communication to Tacoma Power, were done in violation of the terms of your short-term License and regulatory permits, and do not appear to meet Mason County's regulations. Next steps: 1. Provide reduction plan. Provide a plan to Tacoma Power showing how you intend to reduce the overwater coverage to meet Tacoma Power's requirements and Mason County's pier width code. As stated in #3 above, reduction of the width of the pier to that which had been approved and permitted (6 feet)will bring the entire structure into compliance with both Tacoma Power and Mason County but you may choose to present an alternative way to meet Mason County and Tacoma Power's requirements. 2. Regulatory Permits. Once Tacoma Power approves of the reduction plan, you must apply to the regulatory agencies for approval and any additional permits they may require. Copies of new permits and/or written approvals must cover the stair extension and any planned reductions. Copies of permits and/or approvals must be provided to Tacoma Power. 3. Short-term License. Once you have provided copies of all your regulatory permits, Tacoma Power will issue a temporary short-term license for the reconfiguration of the structures. 4. Shoreline Use Permit. Once you have fulfilled the terms and conditions of the short-term license, Tacoma Power will issue a 5-year Shoreline Use Permit for the reconfigured, i compliant structures. l Tacoma Power expects that you will immediately begin working with your contractor and engineer to rectify this situation. We expect to receive a plan from you for our review no later than April 30, 2019.
