NEO's current contract allows unanticipated services up to $48,750. EXECUTIVE SUMMARY: The legislative body may choose to fund lodging tax as recommended by the local lodging tax advisory committee, pursuant to RCW 67.28.1816(2)(b)(ii). Attached is the Scope of Work, draft 5/4/21 LTAC meeting minutes and information on the Visitor Welcome Center. Lodging tax receipts have stayed on track in Mason County (2018 - $475K; 2019 - $562K; 2020 - $520K) and are increasing in 2021. The Lodging Tax Fund has a cash balance of approximately $800K and there is adequate funding for this contract. RECOMMENDED OR REQUESTED ACTION: Approval to place contract on the May 25 agenda as recommended by LTAC. VISITOR WELCOME CENTER STUDY Northwest Event Organizers, Inc. called "CONTRACTOR"will be responsible for providing a comprehensive report that includes the following information for a Visitor Welcome Center Study: 1) CONTRACTOR will identify potential locations for a Visitor Welcome Center in Mason County. Locations must allow for this type of service. If a rezone is required, the CONTRACTOR will research this process and include the rezone process information. 2) CONTRACTOR will provide a budget that includes the cost of property, construction and operating costs. 3) CONTRACTOR will identify funding sources for both capital and operating costs for a Visitor Welcome Center. 4) CONTRACTOR will identify potential stakeholders. 5) CONTRACTOR will submit the report to Mason County no later than July 9, 2021. 6) CONTRACTOR will fulfill reporting requirements as defined in Revised Code of Washington RCW 67.28.1816 (2)(c)(i). Data to fulfill these reporting requirements will be submitted to Mason County no later than February 15 after contract year. Invoices for this Visitor Welcome Center Study shall not exceed $48,750 unless additional awards are made. MASON COUNTY LODGING TAX ADVISORY COMMITTEE Meeting Minutes 411 North 51"Street,Shelton,WA 98584 Tuesday, May 4,2021 9:00 a.m. Members in attendance via Zoom: Chair Sharon Trask, Nathan Welch, Duane Wilson, Heidi McCutcheon, Pam Volz, and Liz Arbaugh. Shaun Tucker was absent. Also in attendance was Deidre Peterson and Rachel Hansen. Chair Trask called the meeting to order at 9:06 a.m. Approval of Minutes Pam/Duane moved and seconded to approve the April 21, 2021 meeting minutes. Motion carried. Funding Formula Diane noted the current formula used for distribution of lodging tax—68%to Tourism Development, of that 15%dedicated to small events/festivals and the Tourism Development contract includes 15%from Reserves to be used for unanticipated services; 30%to VIC's and 2%to reserves. Discussion—RFP Recommendations for 2022 Services Heidi stated she reached out to other Chambers of Commerce to see how they are funding VIC's. Some funding has increased and some decreased. Based on information she received from Olympic Tourism Group it appears the number of Mason County VIC visitors is similar to other areas. Some VIC's receive 100%of funding from lodging tax. Rachel Hansen has been reaching out for locations for the Wild Side Guide Books. She went to a diving event in Hoodsport this past weekend and they saw several out-of-state vehicles. She has distributed draft Guide Books and is ready to print the final version. Rachel has developed criteria for what makes a location eligible to host the Guide Books. Rachel pointed out the importance of making sure the Guide Books are kept current and continued funding is necessary to do that. Rachel brought up the concept of a Welcome Center which is a central location for visitor services that could also host events. She suggested other funding sources would support the Welcome Center. Her vision is building the visitor center first, locate with a view and have enough room to expand to include an event center, camping and other services. She sees this as a public/private partnership. Duane suggested a study be done to determine how a Welcome Center could be funded. Rachel suggested a request for proposals be issued and then determine how to fund. Heidi believes this a good time to explore this type of proposal and a great use of reserves. She noted WA State has budgeted $12M for tourism and believes Commerce will be bringing forward tourism funding. Rachel stated it is very difficult to plan events without a location. There needs to be a long-term management contract. She suggested a 10-year contract with maybe a buy-out option. Possibly include a County Park which could open up other funding sources. Heidi asked if Rachel's proposal would be a contract to figure out the process, identify grant writing, location and potential funding sources. LTAC Meeting Minutes—May 4, 2021 Rachel stated the location would have to have event zoning; there would have to be a coordination of the planning and getting buy-in from the various organizations (Chambers, EDC, Ports). She does not want to form a non-profit to own/operate the Welcome Center. Rachel believes the timing is right to think outside of the box. Diane pointed out that we would have to make sure the various funding can be used for a Welcome Center capital/operating and asked if lodging tax be used for feasibility study. Heidi noted loans could be obtained; believes the County has used lodging tax in past to study tourism. Duane supports exploring the Welcome Center concept. Discussion of contracting with Rachel using the 15%of unanticipated services which is up to $48,750. Heidi/Duane moved and seconded to extend the existing Tourism contract with NEO using the 15%for unanticipated services, up to$48,750, to explore the concept of a Visitor Welcome Center. Motion carried. There was discussion of what to include in the statement of work: identify potential locations; potential funding sources, identify potential stakeholders, budget-both capital and operating and review the proposal at the July 21, 2021 LTAC meeting. July 21,2021 Meeting Items Heidi suggested considering 2022 funding be split 49%to welcome center/VICs;49%to tourism development. LTAC needs to make a recommendation for 2022 services. The existing contracts will end 12/31/21 and cannot be extended. Diane stated it takes at least three months to RFP for services and then a contract needs to be approved. Even if LTAC recommends going forward with the Welcome Center concept, it will not be up and operating in 2022. Notice of Intent to Publish a Local Voters' Pamphlet (RCW 29A.32.220) The Auditor's office shall prepare a local voters' pamphlet for all primaries,general and special elections. 2. Inclusion in the Local Voters' Pamphlet(RCW 29A.32.220) All districts with a race or measure on the ballot in a primary or election in which a local voters' pamphlet is produced will participate in the local voters' pamphlet. Submissions from federal,state and judicial candidates with the exception of district court judges will not be published in the local voters' pamphlet. By statute, precinct committee officers are not eligible to submit statements. 3. Costs associated with the Local Voters' Pamphlet (RCW 29A.32.220, RCW 29A.32.270) The cost to produce,print and mail a local voters' pamphlet is an election cost that is included when districts with a race or measure on the ballot are billed for their portion of the cost of the election. If a district believes that the costs of inclusion in the voters' pamphlet would create an undue financial hardship,the district may petition the Board of County Commissioners to exclude the district's measures and candidates from the pamphlet. The petition must be submitted to the Commission at least 60 days prior to the publication of the next pamphlet and will include all elections for the following two years.A district receiving a waiver for local voters' pamphlet costs will continue to be responsible for their remaining portion of the cost of the election. If a district has been granted a waiver,the Auditor's Office will note in the pamphlet that the district is not included at their request. 4. Local Voters' Pamphlet Content (RCW 29A.32.241) The local voters' pamphlet shall include at a minimum: a. A cover page containing the words "Official Local Voters' Pamphlet," "Mason County," the county seal,and the date of the primary or election; Local Voters'Pamphlet Administrative Rules Page 1 of 6 b. A list of districts that have measures or candidates in the pamphlet.This may be in the form of a Table of Contents or Index. c. Information on how a person may register to vote and obtain a ballot. d. The text of each measure accompanied by an explanatory statement prepared by the prosecuting attorney for any county measure(s) or by the attorney for the local district submitting the measure(s). e. Arguments for and against each measure submitted by committees pursuant to RCW 29A.32.280. Note that it is the legal responsibility of the district placing a measure on the ballot to prepare the arguments in accordance with the above statute. f. Statements and photos submitted by eligible candidates in races on the ballot. District Submissions 1. Deadlines - The Auditor's Office will establish deadlines at least 30 calendar days before filing deadlines. a. The Auditor's Office will notify districts of information on district submissions including word limits, due dates,submission requirements at least 30 days calendar days before filing deadlines. b. Mason County will publish submissions in reference to measures from the Elma or McCleary School Districts as approved by the Grays Harbor County Auditor. 2. Formatting Rules a. Ballot Measure Explanatory Statements (RCW 29A.32.230, RCW 29A.32.241) An explanatory statement addresses the anticipated effect of a measure if passed into law. The statement may be no more than 200 words and must be prepared by the attorney for the district submitting the proposition or measure.A letter from the district's attorney confirming they prepared and approve the explanatory statement is required. Local Voters'Pamphlet Administrative Rules Page 2 of 6 If there is no letter from the district's attorney or if a district does not retain legal counsel for the review,the statement will be submitted to the Mason County Prosecuting Attorney's Office for review and final discretion on language. 4. Ballot Measure Argument(For/Against) Committees (RCW 29A.32.280) a. Appointed by District- The legislative authority of a district submitting a measure has the responsibility of appointing members to a committee that will write the statement for the measure and to a committee that will write the statement against the measure. Each committee is allowed up to 3 members,but can ask the advice of any number of individuals. All committee appointments shall be submitted by the deadline to submit measures and resolutions. Each committee shall identify a chair who will serve as the primary contact for the Auditor's Office. b. Appointed by Auditor- In the event a district does not submit appointments for either committee,the Auditor's Office will issue a media release announcing the opportunity to be on the committee.The auditor shall make appointments on a first-come, first-serve basis if qualified committee members contact the auditor by the appropriate deadline. The auditor shall not make any appointments after the first deadline for ballot measure arguments. If a committee has been appointed by the auditor less than 3 days before the argument deadline their deadline will be three business days after the appointment. 5. Ballot Measure Arguments (For&Against) a. Ballot Measure Argument(For&Against) are written to support or oppose a ballot measure. The word limit for an argument for or against a measure is 250 words. The Auditor's Office will not edit or advise committees on statements. Arguments will be shared by the Auditor's Office with the opposing committee once both arguments have been received. b. Arguments must be signed or otherwise approved by all members of the committee. It is not the role of the Auditor's Office to coordinate between committee members. Once submitted,arguments cannot be withdrawn or changed. If committee members cannot agree on an argument,no argument will be published in the voters'pamphlet. Biography- Candidates may provide a 100 word biography. a. If a candidate submits their statement online,they will be prompted to respond with information on the following topics: Elected Experience, Other Professional Experience, Education,and Community Service. The sum total of the information in these categories must not exceed 100 words. b. If the biography is submitted via email to elections 0co.mason.wa.us, it can be in a paragraph that does not exceed 100 words or with information on the following topics: Elected Experience, Other Professional Experience, Education,and Community Service; the sum total of the information in these categories must not exceed 100 words. Statements can be submitted via the online candidate portal or by email to electionsOco.mason.wa.us b. Candidate statements should only address campaign issues,plans,and ideas of the candidate. Statements shall not contain obscene, inappropriate or libelous language. Candidate statements shall not comment on or make any judgments about opponents or incumbents. The Auditor has the authority to reject statements that are deemed inappropriate per RCW 29A.32.230. c. Candidates not submitting a statement will have "No statement submitted" printed in the pamphlet. 6. Candidate Photo a. A photo may be submitted by an eligible candidate on the ballot for a primary or election. b. The photo may not be more than 5 years old. The photo can include only the head or head and shoulders of the candidate. c. The photo may not be an informal candid photo, cartoon, caricature or any other image that does not accurately portray the candidate. d. The photo cannot show the candidate wearing a uniform,judicial robe,hat, anything bearing an insignia or otherwise suggest holding of a public office. e. The Auditor's Office will adjust and/or crop photos as necessary. Photos are published in a black and white format. Photos should reflect the candidate in a professional and tasteful manner. Candid/casual social media style photos are not recommended and may be rejected at the discretion of the Auditor. f. Candidates not submitting a photo will have a"No photo submitted"statement printed in the pamphlet. 7. Public Inspection of Candidate Submissions Candidate submissions that have been submitted for publication in the local voters' pamphlet shall not be available for release to the public until all submissions pertaining to the race have been received. Requests for public inspection shall be made in the same manner as requests for public records. 8. Rejection of Arguments or Statements (RCW 29A.32.230) a. The Auditor's Office reserves the right to reject any argument or statement if it does not meet requirements or if a statement or argument is deemed to be obscene, Local Voters'Pamphlet Administrative Rules Page 5 of 6 I libelous or otherwise inappropriate. If it contains matter not limited to the measure or comments on other candidates or incumbents. If it doesn't follow formatting guidelines or was received after the submittal deadline. b. If a statement is rejected,the candidate or committee chair will be notified by email and given 48 hours from the time of notification to submit an adjusted statement.The time of notification will be the time the email was sent to the candidate or committee. c. If the adjusted statement does not meet requirements, a"No statement submitted" notation will be printed for the candidate or measure. d. Candidates or committee chairs may appeal the rejection of the statement by submitting a written appeal to the Mason County Prosecuting Attorney within 48 hours of notification.The Prosecuting Attorney's decision on the appeal will be final. 9. Format and distribution of the Local Voters'Pamphlet The Auditor's Office retains complete control over content and format of the pamphlet and may print the pamphlet in combination with the Secretary of State Voters' Pamphlet. Our findings are the following: 1. Neither of the requested easements are presently in use by the public and are not maintained by the county road department. 2. W. Walnut is fenced off from the public, has a hot tub and propane tank located on it along with various landscaping. W. Walnut is currently being used as a parking area for the house that Mary owns. See photo Exhibit C-6 3. Fourth Street easement is heavily forested and has steep terrain. See photo Exhibit C-7 4. The easements are classified as "Class A" per MCC 12.20.040 and compensation is due for the vacating of these county rights of way prior to vacation. The calculated compensation value is $9,933.22. See Calcs. Exhibit D-1, 2. 5. The proposed vacation areas are not deemed necessary to preserve for the County road system for the future. 6. PUD #3 has utility poles located within the requested vacation area and an easement must be retained for utility purposes. 7. The public will benefit by this action, since it will clear title, add the vacated area to the tax rolls and relieve the county of liability. 8. In order to approve the requested vacation areas, Mason County Public Works requires the relocation of the existing board fence that stands in both the W. Walnut and Third St. easements. This fence obstructs the line of sight from the adjacent private road approach to the north of W. Walnut. In addition, the existing fence reduces the ability of the County to improve Third Street. Walnut St. between 3`d St. and 4"St. Mason County: 30 foot section of 41h St.off of Northcliff Rd. I purchased the property at 121 W. Walnut St. in 2016. Upon inspection of the property, I knew I needed to replace the existing cedar fencing that was rotting, a deterioration that takes between twenty and forty years. I had no reason to question the placement of those fences as representing the long-term definition of the recognized property lines for this property I was purchasing. Subsequently, I learned that there are irregularities in this area that create an anomaly in how the properties and streets are defined. The property at 121 W. Walnut St. is a part of a plat, with lots and blocks, that adjoins property that is measured in acres. As a result, the section of W. Walnut St. between developed 3"St. and undeveloped 4"' St., and the length of undeveloped 41h St. that adjoin this property, are only 30 feet wide—as contributed from the plat side—with no street allocation for these streets contributed from the acreage side. W. Walnut St. past developed 3`d St is 60 feet wide, with 30 feet contributed to the street from both the plat and the acreage sides. In July of 2019, a survey by Holman &Associates, (Exhibit 1), revealed that this 30 foot section of W. Walnut St., between developed 3rd St. and undeveloped 4`h St., was not located where it had previously been believed to be. This survey placed this roadway thirty feet over and into the front of the garage and the corner of the house at 121 W. Walnut St. An additional survey was done, as directed by Phil Franklin of Mason County Public Works Department, in February of 2020 that confirmed the placement of this roadway into the garage and house at this location. (Information regarding this survey can be obtained from Phil Franklin.) According to the Mason County Taxsifter, the buildings at 121 W. Walnut St. were originally constructed in 1973 and a twenty-five-foot setback from the property line was required. This property has changed hands several times and permits have subsequently been issued for additional building projects. In addition, inspections have been made by personnel representing Mason County that show in county documents that the proper setback existed at this property. (This information can be provided if required.) Two surveys have now confirmed that this is not the case. Apparently, this error was never caught, nor corrected, over the past forty-eight years. Development of this roadway in the future would require an additional 30 feet of property to make this currently undeveloped section of W. Walnut St., and the length of undeveloped 4`h St., into 60 foot wide roadways, as is required by Mason County. This would result in the destruction of the buildings, both house and garage, at 121 W. Walnut St. This would leave the remaining four lots at approximately 70 feet wide and 200 feet long, with 60-foot roadways on all four sides of this now narrow strip of property. The other alternative would be to take the 30 feet from the acreage side, placing the roadway at the front window of the adjacent property owner's house, and would still require the destruction of the house and garage at 121 W.Walnut St. A 30 foot wide section of W. Walnut St. runs through the front of the garage and the corner of the house at 121 W. Walnut St. This has a significant effect on the value of this property. Development of roadways on this section of W.Walnut St. and 4'h St. would require adding an additional 30 feet at both of these locations, reducing the property to a strip 70 feet wide and 200 feet long, with 60 foot roadways on all four sides,and would require the condemnation and destruction of the buildings on the property. Essentially, this is an ongoing threat of condemnation of this property as a residence, certainly having a negative effect on the valuation and taxation of this property by Mason County. In terms of compensation for these strips of undeveloped roadways at issue in this vacation request, county codes and statutes indicate that this can be discretionary,depending on specific circumstances. In this light, Mason County has expended no funds on these roadways, so no compensation is necessary. In addition, Mason County has been compensated every year in terms of excessive taxes collected from the owners of the property at 121 W.Walnut St.since 1973. Property owners have been paying taxes on this strip of land, because they thought they owned it,for almost fifty years. If the taxes had been properly calculated, the taxes would have been much lower—because there is a road running through the house and the garage, negatively affecting value and marketability. This problem would also need to be disclosed to any potential buyer of this property, making selling this property impossible with a road running through the garage and house. These roadways could never be developed without condemning the buildings on this property and creating a narrow strip of remaining land that would have no suitable building purpose, and therefore no value. In addition to these issues related to compensation, as a resident of Mason County, I have spent countless hours over the last three years engaging in all of the activities that Mason County has informed me that I am required to do to get a fair and equitable resolution to this problem. I am paying a thousand dollars to file this petition, after paying five hundred dollars for the previous vacation petition. I have had to hire an attorney to assist me with seeking a resolution to this problem and am incurring those ongoing legal expenses. I believe Mason County has already been compensated adequately for these small strips of undeveloped roadway and there should be no further charges levied against me. Leaving the status of the sections of W. Walnut St. and 41h St. at issue in this vacation petition as they are, is making a decision to condemn my home at 121 W.Walnut St. Having a road running through my garage and home has significant negative consequences to the value and use of this property. I am asking that you approve this petition to vacate these unneeded and undeveloped sections of roadways,with no further compensation due, as the most equitable solution to this problem that has existed for almost fifty years.
