Call to Order—The Chairperson called the regular meeting to order at 9:02 a.m. 2. Pledge of Allegiance— Kell Rowen led the flag salute. 3. Roll Call— Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 2— Kevin Shutty; Commissioner District 3— Sharon Trask. 4. Correspondence and Organizational Business 4.1 Correspondence 4.1.1 Washington State Liquor and Cannabis Board sent in a marijuana license due to expire and a marijuana license application for Madmatts Greenery LLC. 4.1.2 Department of Ecology sent in a letter regarding the Proposed Trust Water Creation Water Right Change Application No. CS2-14966C. 4.1.3 Economic Development Council of Mason County sent in the 3rd quarter report. 4.1.4 Wayne Nicholson sent in an application for the Historic Preservation Commission. 4.1.5 Chauffeurs,Teamsters &Helpers Union Local No. 252 sent in a Notice of Contract Opening in Mason County for the Juvenile Detention. 5. Open Forum for Citizen Input— No public comment received. 6. Adoption of Agenda — Cmmr. Neatherlin/Shutty moved and seconded to adopt the agenda as published. Motion carried unanimously. N-aye; S-aye;T-aye. 7. Approval of Minutes— Cmmr. Shutty/Neatherlin moved and seconded to adopt the October 19, 2020 and October 26, 2020 Briefing Minutes and October 20, 2020 Regular Meeting Minutes. Motion carried unanimously. N-aye; S-aye;T-aye. 8. Approval of Action Agenda: 8.1 Approval to set a Public Hearing on Monday, December 7,2020 at 9:00 a.m.to consider adoption of the 2021 budget for Mason County. Copies of the 2021 preliminary budget will be available to the public on November 23, 2020. 8.2 Approval to set a Public Hearing on Tuesday, November 24, 2020 at 9:15 a.m.to Certify to the County Assessor the amount of taxes levied for County purposes and the amount of taxes levied for Current Expense and Road for 2021. An increase to the Current Expense and Road property tax levies for 2021 may be considered. 8.3 Approval to reclassify the Senior Accounting Technician in Public Works Utilities and Waste Division to a Program Support Technician effective November 16, 2020 and place the incumbent in Step 1 of the 2020 Teamsters General Service Salary Scale. 8.4 Approval of the January 1, 2020—December 31, 2023 Collective Bargaining Agreement(CBA)for Teamsters Union Local No. 252 representing Mason County Community and Family Health staff with retro to January 1, 2020. 8.5 Approval to amend Resolution # 102-19 Determining the Teamsters General Services 2019 Health Insurance Contributions and the Teamsters General Services,Community and Family Health, and all Other County's PEBB Members 2020 Health Insurance Contributions. Effective January 1, 2020 for participants of the PEBB Medical program,which allocates through the pooling method, $963.08 per month County contribution for employees with single enrollments on medical,and $1,602.67 with dependent enrollments,for Teamsters BOARD OF MASON COUNTY COMMISSIONERS'PROCEEDINGS November 3, 2020 - PAGE 2 General Services and Community&Family Health,all Elected Officials, eligible Non-Represented,and Teamsters Probation and IWA Public Defenders and Deputy Prosecutors whose Collective Bargaining Agreements are in place and ratified on January 1, 2020. (Exhibit A) 8.6 Approval to amend Resolution # 102-19 Determining the County's 2021 Health Insurance Contributions effective January 1, 2021,for participants of the PEBB Medical program,which allocates through the pooling method, $1,071.99 per month County contribution for employees with single enrollments on medical; and $1,485.24 for employees with dependent enrollments per month for Teamsters Probation and IWA Public Defenders Collective Bargaining Agreements expired December 31, 2020 and have not been ratified by January 1, 2021; and $1,537.24 for Teamsters General Services,Community&Family Health, and IWA Deputy Prosecutors whose Collective Bargaining Agreements are in place and ratified on January 1, 2021, and Non-Represented and Elected Officials. (Exhibit B) 8.7 Approval of the State Homeland Security Program (SHSP) FY-20 Grant Contract# E21-064 for$20,441 from Washington State Military Department(EMD)and US Department of Homeland Security and to allow the Emergency Management Manager to sign the contract for Mason County to receive the funding. 8.8 Approval to purchase SmartGov software upgrades for Community Services staff. 8.9 Approval of amendment#2 to the Health Care Authority Contract# K3929 (Community Prevention and Wellness Initiative). 8.10 Approval of the contract with Pacific Security for Mason County Weapons Screening and campus security. 8.11 Approval to amend Resolution # 2020-76 to revise the Non-Represented Salary Scale Range Alignment by approving a 2%general wage increase effective January 1, 2021. (Exhibit C) 8.12 Approval to amend Resolution # 2020-28 Mason County Personnel Policy to amend chapter 4.3 Compensatory Time removing the ability to bank time earned and to require payout of any accrued within the year on December 25"' payroll and add additional language in Chapter 7.10 Holidays to include Christmas Eve. (Exhibit D) 8.13 Approval of Warrants&Treasure Electronic Remittances Claims Clearing Fund Warrant# 8075279-8075513 $851,245.05 Direct Deposit Fund Warrant#72288-72678 $753,895.00 Salary Clearing Fund Warrant# 7005504-7005530 $523,932.65 8.14 Approval for the Chair to sign the Colvos Construction, Building # 10 Contractor,Change Order# 004 in the amount of$58,209.43 for City Plumbing Updates, and Change Order# 014 in the amount of$62,225.33 for Permit Delay. 8.15 Approval for the Chair to sign the Agreement between Mason County and Economic Development Council of Mason County(EDC)for the CARES Act Grant—COVID-19 Response 2°d Round of Funding Project. 8.16 Approval of the 2021 contract extensions as follows: $38,500 to Northwest Event Organizers(NEO)for Concierge Handbook&Wild Side Guides Campaign and $276,250 for Tourism and Marketing,$48,750 for Local Festival Support and $48,750 for Unanticipated Services for a $378,750 total; $87,000 to Shelton Mason County Chamber of Commerce, $40,600 to North Mason Chamber and $15,800 to the Mason County Historical Society Museum for Visitor Information Center(VIC)services as recommended by the Lodging Tax Advisory Committee. 8.17 Approval of the annual Resolution establishing the load/lane limits for traffic control on seven (7) Mason County bridges. (Exhibit E) 8.18 Approval of the Resolution authorizing County Road Load/Speed Restrictions and Emergency Closing Orders for County roads. (Exhibit F) 8.19 Approval to authorize Public Works to use the County Vendor Roster to solicit and establish a 2021 Surfacing Materials unit pricing vendor list and purchase quantities as needed. 8.20 Approval to authorize Public Works/ER&R to use the County Vendor Roster to solicit for vehicle and equipment towing and tire repair services for the 2021 calendar year and to sign and award contracts. Mason County does not guarantee a minimum purchase of these services. 8.21 Approval to authorize Public Works to procure and enter into contract with contractor to replace the Eells Hill Transfer Station outbound scale with a concrete foundation type scale estimated to cost approximately $130,000 plus tax and allows the Chair to sign all pertinent documents for this project. 8.22 Approval to consider the Hearings Examiner recommendation to approve Road Vacation No.405 vacating a portion of Sharpe Street located West and adjacent of Block 92 as recorded in Union Hood Canal Land & Improvement Company's Plan of Union City. (Exhibit G) BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS November 3, 2020 - PAGE 3 8.23 Approval to authorize Public Works to advertise,set bid opening dates/times,award contracts and allow the Chair to sign all pertinent documents for call for bids for routine Paint Line,Asphalt Emulsion, Culvert Pipe and Lining, Manufacturing and Stockpiling of Chipseal Aggregate and Asphaltic Materials for 2021. Contract awards will be announced during a regular meeting of the Board. 8.24 Approval of the Private Line Occupancy Permit granting permission to run the utility lines under and across North Shore Road for parcel #32224-51-01010 and parcel # 32224-51-01011,address 9541 North Shore Road. 8.25 Approval to authorize Public Works to procure two F550 bucket trucks as special market value purchases. (Exhibit H) 8.26 Approval to set a hearing on Tuesday, November 24, 2020 at 9:15 a.m.to consider the sale of real property located at 2169 and 2179 Lake Boulevard in Shelton,WA; parcel # 32030-51-07010 and 32030-51-10001 for$42,500 to Habitat for Humanity. 8.27 Approval of the Resolution waiving public bidding requirements and approving a sole source procurement of two JAVS systems from Jefferson Audio Visual System,Inc for Building # 10 District Court and Superior Court. (Exhibit I) Cmmr. Neatherlin/Shutty moved and seconded to approve action items 8.2 through 8.13, items 8.16 through 8.21,and items 8.23 through 8.27. with the exception of items 8.1, 8.14, 8.15,and 8.22 which were removed for separate vote. Motion carried unanimously. N-aye; S-aye;T-aye. Item 8.1 Cmmr. Trask amended the action to read"Approval to set a Public Hearing on Monday, December 7, 2020 at 9:00 a.m. to consider adoption of the 2021 budget for Mason County. Motion carried unanimously. N-aye; S-aye;T-aye. Item 8.14 Cmmr. Shutty asked staff to brief this item further. Frank Pinter shared that this item should include a third cost for a building permit fee of$110,151.65. The permit from the City was issued on October 15, 2020 although it was hoped to be received by October 1, 2020. Due to this, there was a 15-day permit delay cost of$62,225.33 from the contractor. The delay included the review of modification to plans to include an ADA egress at the rear of the building for both employees and citizens, an ADA accessibility ramp from the level of the existing building to the grade of the sidewalk, and fire access communication allowing the fire department to communicate with individuals within the fire egress area. Those upgrades represent the $58,209.43 change order cost. Cmmr. Shutty/Neatherlin moved and seconded to approve action item 8.14,for the Chair to sign the Colvos Construction, Building # 10 Contractor,Change Order# 004 in the amount of$58,209.43 for City Plumbing Updates, and Change Order# 014 in the amount of $62,225.33 for Permit Delay,and to pay the City of Shelton building permit cost of $110,151.65. Motion carried unanimously. N-aye; S-aye;T-aye. Item 8.15 Cmmr.Trask asked staff to come forward with the changes to the contract. Jennifer Beierle shared the following changes to the contract: Pg. 2, B. Contractor Responsibilities, Principle Tasks, 2nd bullet— Provide COVID-19 Response assistance BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS November 3, 2020 - PAGE 4 in the form of emergency grant awards of up to $15,000 to qualifying business in Mason County with less than 20 employees, or up to $30,000 to qualifying businesses in Mason County with 21 or more employees. Pg. 2, B. Contractor Responsibilities, Principle Tasks, 3rd bullet— Provide the opportunity for each non- profit organization engaged in COVID-19 support activities to submit an application. Pg. 13, Scope of Work, Contractor will: 3rd paragraph — Provide grants of up to $15,000 each to eligible businesses with less than 20 employees; provide emergency grants of up to $30,000 to eligible businesses with 21 or more employees. Pg. 13, Scope of Work, Contractor will: 4th paragraph — Provide the opportunity for each non-profit organization engaged in COVID-19 support activities to submit an application. Cmmr. Neatherlin/Shutty moved and seconded to approve action item 8.15,for the Chair to sign the Agreement between Mason County and Economic Development Council of Mason County(EDC)for the CARES Act Grant—COVID-19 Response 2"d Round of Funding Project. Motion carried unanimously. N-aye; S-aye;T-aye. Item 8.22 Cmmr. Neatherlin commented that he does not see the public benefit or compensation from the road vacation. Cmmr.Trask/Shutty moved and seconded to approve action item 8.22, to consider the Hearings Examiner recommendation to approve Road Vacation No. 405 vacating a portion of Sharpe Street located West and adjacent of Block 92 as recorded in Union Hood Canal Land &Improvement Company's Plan of Union City. Other Business (Department Heads and Elected Officials) No other business. 10. 9:15 a.m. Public Hearings and Items set for a certain time— 10.1 Public Hearing to consider rezoning of a 0.2-acre parcel from Village Commercial (VC)to Residential 2 (R-2) within the Allyn Urban Growth Area (UGA). Staff: Kell Rowen (Exhibit]) Kell Rowen, Planning Manager, shared the Betsinger's are requesting to rezone parcel # 12220- 50-07008 from Village Commercial to Residential 2 to build a detached garage. Staff recommends approval of this rezone due to the small size of the parcel not being able to accommodate commercial development. The planning advisory commission also voted unanimously to approve. No public comment was received. Cmmr. Neatherlin/Shutty moved and seconded to approve the rezone of parcel # 12220-50-07008 from Village Commercial to Residential 2. Motion carried unanimously. BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS November 3, 2020 - PAGE 5 10.2 Public Hearing to consider rezoning of a 160-acre parcel from Rural Residential 20 (RR20) to Long Term Commercial Forest(LTCF) and rezoning of a 159.38-acre parcel from LTCF to RR20 within the Rural Area of Mason County. Staff: Kell Rowen (Exhibit K) Kell shared Port Blakely Tree Farms is requesting a rezone swap which will provide a net gain of less than an acre for LTCF. Code requires that there is no net loss regarding LTCF. There will be a change to future land use map and is considered a comprehensive land use change. Staff recommends approval and planning advisory commission unanimously approved. No public comment was received. Cmmr. Shutty/Neatherlin moved and seconded to approve the rezone of parcel # 41934-20-00010 and 41934-20-00000 from Rural Residential 20 to Long Term Commercial Forest and rezone parcel # 41927-14-00000, 51912-10-00010, 52008- 42-00000,and 52008-23-00000 from Long Term Commercial Forest to Rural Residential 20. Motion carried unanimously. N-aye; S-aye;T-aye. 10.3 Public Hearing to consider rezoning of a 21.6-acre parcel from Long Term Commercial Forest (LTCF)to In Holding (IH) lands and rezoning of a 35.6-acre parcel from IH to LTCF within the Rural Area of Mason County. Staff: Kell Rowen (Exhibit L) Kell shared Green Diamond Resource Company and the Scovill's wish to swap adjacent properties due to the Scovill's parcel being land-locked. This would give a net gain of about 14 acres and would change the future land use map considering it a comprehensive land use change. Both staff and planning advisory commission unanimously approve. No public comment was received. Cmmr. Shutty/Neatherlin moved and seconded to approve the rezone of parcel # 62009-00-00000 from Long Term Commercial Forest to Inholding lands and rezone parcel # 62008-11-00050 and western half of 62008-11-00010 from Inholding lands to Long Term Commercial Forest. Motion carried unanimously. N-aye; S-aye;T-aye. 10.4 Public Hearing to approve and execute the Resolution adopting the 2021 Annual Construction program. Staff: Mike Collins (Exhibit M) Mike Collins, County Engineer, shared updates for the 2021 Annual Construction program as recommended by the board and TIP-CAP. Highlighted issues include items 3, 4, 5 pertaining to gravel roads being changed to chip seal or asphalt; item 24, using Rasor Road as an alternate route; and item 25 added as an intersection feasibility study. No public comment was received. Cmmr. Neatherlin/Shutty moved and seconded to approve and execute the resolution adopting the 2021 Annual Construction program. Motion carried unanimously. N- aye; S-aye;T-aye. 10.5 Public Hearing to approve and execute the Resolution adopting the 2021-2026 Six-Year Transportation Improvement Program. Staff: Mike Collins (Exhibit N) Mike shared the first 25 items are similar to the Annual Construction program, item 27—Allyn BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS November 3, 2020 - PAGE 6 Access Circulation Easement Acquisition — is an issue. TIP-CAP voted this item to be removed and instead it was moved down the priority list. At the end of the sheet, additional gravel roads were added for conversion as well as some wish list items for the future. Cmmr. Shutty asked Mike to expand on TIP-CAP wanting to remove item 27. Mike responded during discussion about the Rasor Road alternate route and John's Prairie/Highway 3 intersection, if something needed to be removed it would be the Allyn Access Circulation Easement Acquisition. Cmmr. Shutty wanted to know if leaving that where it is, would it allow both of those items to be completed. Mike said that it is acting as a placeholder since it is 3-4 years out. Cmmr. Neatherlin added that previously the Commission acted to remove a bunch of village commercial from that section and did away with creating the road as considered earlier because it would be done for private residential instead of commercial core. However, he would like to still see it on the list. Cmmr. Shutty commented there are a couple of things that are really helpful for the Six-Year Transportation Improvement Program including the economic development opportunities in particular for Belfair and North Mason for the parking lot, log yard, port of Bremerton industrial loop connectivity to manage traffic flows and the union boat launch resurfacing. Cmmr. Shutty also mentioned the resignation from Pete Butkus who was a member of TIP-CAP for many years. No public comment was received. Cmmr. Shutty/Neatherlin moved and seconded to approve and execute the resolution adopting the 2021-2026 Six-Year Transportation Improvement Program. Motion carried unanimously. N-aye; S-aye;T-aye. 11. Board's Reports and Calendar-The Commissioners reported on meetings attended the past week and announced their upcoming weekly meetings. 12.
