Call to Order—The Chairperson called the regular meeting to order at 9:04 a.m. 2. Pledge of Allegiance—Dan Teuteberg led the flag salute. 3. Roll Call — Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 2— Kevin Shutty; Commissioner District 3—Sharon Trask. 4. Correspondence and Organizational Business 4.1 Correspondence 4.1.1 Washington State Liquor and Cannabis Board sent in the following: a marijuana license application for New Sussex Farm, a marijuana producer license for The Dab Lab, change of location application for Blacksmith Farms, and marijuana and liquor licenses due to expire. 4.1.2 Port of Allyn sent in an Amended CARES Act Funding request. 4.1.3 Tom Davis sent in suggested language for inclusion in the Commissioners Operating Guidelines: There is no greater duty of any governing board of elected officials than to hear the views, opinions, and concerns of the people they represent in an open public forum and on the public record. Private conversation between individual members of a governing board and private citizens, while helpful, are wrought with communications that may move a matter forward before public has been made aware of its existence. For that reason, I am asking that the principals involved in any conversation between a citizen and any member of the Mason County Board of Commissioners that is likely to result in future action by that governing board be required to appear before the board in an open public meeting, before the request, proposal, or suggestion is given any consideration. 4.1.4 Phil Franklin sent in a letter regarding the Mason County Board of Equalization Hearing # 154-2020. 4.1.5 Edgar Huber sent in an application for the Mason County Historic Preservation Commission. 4.2 Dan Teuteberg presented the National 4-H Week Proclamation. 4.3 Cmmr.Trask presented the Certificate of Good Practice from the County Road Administration Board. 5. Open Forum for Citizen Input— 5.1 Tom Davis: brought up aforementioned inclusion to Commissioner's Operating Guidelines and his continued support of building trust between the Commissioners and the people. 6. Adoption of Agenda - Cmmr. Shutty/Neatherlin moved and seconded to adopt the agenda as published. Motion carried unanimously. N-aye; S-aye;T-aye. 7. Approval of Minutes—September 8, 2020 Regular Meeting Minutes; Briefing Meeting Minutes for August 3, 2020; August 10, 2020; August 24, 2020; and August 31, 2020 Cmmr. Neatherlin/Shutty moved and seconded to adopt the September 8, 2020 Regular Meeting Minutes; Briefing Meeting Minutes for August 3, 2020;August 10, 2020;August 24, 2020; and August 31, 2020. Motion carried unanimously. N-aye; S-aye;T-aye. 8. Approval of Action Agenda: 8.1 Approval of the contract with Economic Development Council of Mason County (EDC)to fund two emergency grants of$10,000 each with CARES Act Funds to Shelton Mason County Journal and iFiber One LLC to respond to COVID-19 crisis. BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS September 22, 2020- Page 2 8.2 Approval to amend the Washington State Department of Commerce Coronavirus Relief Funds for Local Governments/CARES Act Funds for Local Governments in Washington State contract # 20- 6541C-023 which increases the awarded funds to $5,211,000 from $3,821,400 and pushes the contract end date to November 30th, 2020 from October 31st, 2020. 8.3 Approval of Warrants &Treasure Electronic Remittances Claims Clearing Fund Warrant # 8074316-8074715 $ 1,438,207.37 Direct Deposit Fund Warrant # 71118-71505 $ 712,401.39 Salary Clearing Fund Warrant# 7005403-7005438 $ 995,169.86 8.4 Approval to amend Resolution # 04-19— Mason County Financial Policies and Procedures. Resolution No. 2020-72 (Exhibit A) 8.5 Approval of Road Vacation No. 400 vacating the south 10 feet of an unused road, once called Gray Road, that lays north of Tracts 5 and 6 in the plat of Will-Char addition to Phillips Lake. (Exhibit B) 8.6 Approval of Road Vacation No. 402 vacating a portion of an unused road in Lakewood Plat A, once named Alder Street, currently known as E Ellinor Peak Place between Block 1 Lots 1-8 and Block 2 Lots 1-4 and 5-8. (Exhibit C) 8.7 Approval of Road Vacation No. 403 vacating a portion of an unused portion of E Mason Lake Drive W in the plat of Mading's Sunny Shores addition no. 3. (Exhibit D) 8.8 Approval to amend resolution 2020-62 updating the vacation area and keep the same hearing date with the Hearings Examiner for Wednesday, October 14th, 2020 at 1:00 p.m. to vacate a portion of the north half of Fir Street and the south half of an unnamed alley adjacent to Block 8 Lots 21-28 in the plan of Grays Harbor and Union City Railroad addition to Union City, Road Vacation No. 406. Resolution No. 2020-69 (Exhibit E) 8.9 Approval to authorize the County Engineer to procure and execute the agreements for Structural, Geotechnical, Hydraulic, and Engineering and Construction services as needed for the 2021-2022 calendar years from the County MRSC Consultant Roster. The maximum pay-out for each service agreement is not to exceed $200,000. 8.10 Approval of the contract between Mason County and Mason County Fire District 11 for fire protection, emergency medical, inspections, and fire suppression services to the County Public Work's property/buildings located at 100 W Public Works Drive. 8.11 Approval of Outreach Grant for Elections from Center for Technology and Civic Life (CTCL) for $32,903.50. This is a no local match, pre-paid, spend-down grant. Cmmr. Neatherlin/Shutty moved and seconded to approve action items 8.3, 8.5,and 8.8 through 8.11 with the exception of items 8.1, 8.2,8.4, 8.5, and 8.7 which were removed for separate vote. Motion carried unanimously. N-aye; S-aye; T-aye. Item 8.1 Tom Davis shared his concerns about funding the two $10,000 emergency grants to Shelton Mason County Journal and iFiber One LLC. Cmmr. Trask shared her support of the grant and being able to help sustain the two media outlets. Cmmr. Shutty shared his understanding of both sides and feels that, ultimately, it is an appropriate use of the CARES Act funding. Cmmr. Neatherlin commented that he wants to help the businesses. Cmmr. Neatherlin/Shutty moved and seconded to approve action item 8.1,contract with Economic Development Council of Mason County(EDC) to fund two emergency grants of $10,000 each with CARES Act Funds to Shelton Mason County Journal and !Fiber One LLC to respond to COVID-19 crisis. Motion carried unanimously. N-aye; S-aye; T-aye. Item 8.2 BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS September 22, 2020 - Page 3 Cmmr. Shutty wanted to note that we had more CARES Act dollars released from the state and asked staff to expand on that. Frank Pinter shared a brief history on why the funding and contract end date was increased. Cmmr. Shutty/Neatherlin moved and seconded to approve action item 8.2,amend the Washington State Department of Commerce Coronavirus Relief Funds for Local Governments/CARES Act Funds for Local Governments in Washington State contract# 20- 6541C-023 which increases the awarded funds to $5,211,000 from $3,821,400 and pushes the contract end date to November 30"', 2020 from October 31st, 2020. Motion carried unanimously. N-aye; S-aye;T-aye. Item 8.4 Staff Jennifer Beierle shared the specific amendments to the Mason County Financial Policies and Procedures. Tom Davis asked that the changes be stricken or emphasized but that the questions he had were answered. Cmmr. Neatherlin/Shutty moved and seconded to approve action item 8.4, amend Resolution # 04-19—Mason County Financial Policies and Procedures. Motion carried unanimously. N-aye; S-aye;T-aye. Item 8.5 Staff Loretta Swanson shared that the Hearing's Examiner recommended action is to approve. She also mentioned that the Commissioners previously brought up concerns regarding compensation for vacating easements. There is a proposed revision to Mason County Code Chapter 12.2—future road vacations of this nature will require payment of 50% of the appraised value of property. However, compensation is not required for 8.5 or 8.7 because these requests were already in process. Cmmr. Shutty/Trask moved and seconded to approve action item 8.5, Road Vacation No. 400 vacating the south 10 feet of an unused road, once called Gray Road,that lays north of Tracts 5 and 6 in the plat of Will-Char addition to Phillips Lake. Motion carried. N-nay; S- aye;T-aye. Cmmr. Shutty reiterated that we are honoring the,previous policy for items 8.5 and 8.7. Cmmr. Neatherlin shared that he has historically stood against road vacations and that he will vote against both 8.5 and 8.7. Item 8.7 Staff Loretta Swanson shared that the Hearing's Examiner recommended action is to approve. Cmmr. Shutty/Trask moved and seconded to approve action item 8.7, Road Vacation No. 403 vacating a portion of an unused portion of E Mason Lake Drive W in the plat of Mading's Sunny Shores addition no. 3. Motion carried. N-nay; S-aye; T-aye. 9. Other Business (Department Heads and Elected Officials) 9.1 Cmmr.Trask asked for a moment of silence for Tom Connell who passed away on September 13t'. Tom had worked for the county for almost 30 years. Tom and his wife Sandy were married for 15 years. He is survived by his daughter Gina and son Tommy. 10. 9:15 a.m. Public Hearings and Items set for a certain time— 10.1 Public Hearing to sell parcel # 32021-59-03008, 410 E Hillcrest Drive in Shelton, WA for the amount of$7,500. Shutty moved and seconded to approve the sale of parcel # 32021-59-03008,410 E Hillcrest Drive in Shelton,WA for the amount of$7,500. Motion carried unanimously. N-aye; S-aye;T-aye. Cmmr. Neatherlin wanted to note to the public that this property went up for sale at the end of May and was sold at asking price. 10.2 Public Hearing to sell parcel # 32021-56-02030, 580 E Wood Lane in Shelton, WA for the amount of$5,500. Staff: Frank Pinter (Exhibit G) Cmmr. Neatherlin/Cmmr. Shutty moved and seconded to approve the sale of parcel # 32021-56-02030, 580 E Wood Lane in Shelton, WA for the amount of$5,500. Motion carried unanimously. N-aye; S-aye;T-aye. Cmmr. Neatherlin noted that this property also went up for sale at the end of May and was sold at asking price. 11. Board's Reports and Calendar-The Commissioners reported on meetings attended the past week and announced their upcoming weekly meetings. 12. Tax Title Parcels can be sold by direct negotiation for twelve months after an attempted auction; and WHEREAS, the Board of County Commissioners, upon the recommendation of the Property Manager, has determined that the property is surplus to the needs of the County; and WHEREAS, Mason County has received an offer to purchase the property in the amount of$7,500 from Craig Larsen and Christine Poole and a public hearing was held on September 22, 2020 to consider the offer; NOW, THEREFORE, BE IT FURTHER RESOLVED by the Mason County Board of County Commissioners that sale of the property described above (parcel#32021-59-03008) is approved at the price of$7,500; and BE IT FURTHER RESOLVED, that the proceeds of the sale of said property are to be dedicated first to any delinquent property tax obligations and related penalties, expenses and assessments; and next to reimbursement of the Property Management expenses; and finally, to the Current Expense Fund; and BE IT FURTHER RESOLVED, that the Vice-Chair is authorized to sign the related closing documents and the Property Manager initiate payment of 8%fee of sale price to the County's real estate agent.
