BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS Mason County Commission Chambers,411 North St'Street, Shelton,WA July 14, 2020 1. Call to Order—The Chairperson called the regular meeting to order at 9:01 a.m. 2. Pledge of Allegiance—Mike Collins led the flag salute. 3. Roll Call—Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 3—Sharon Trask; Commissioner District 2—Kevin Shutty was absent. 4. Correspondence and Organizational Business 4.1 Correspondence 4.1.1 The Secretary of the Interior sent in a letter re: 2020 payment in Lieu of Tax amount. 4.1.2 The North Mason Recreational Youth Sports Leagues sent in a letter re: access to the county parks. 4.1.3 Arlene Army, Bill and Bobbie Stady, Sherri Dysart, and Cheryl Williams sent in a letter on the Home Rule Charter. 4.2 Cmmr. Neatherlin read the news release regarding the hours of operation at Solid Waste Facilities 5. Open Forum for Citizen Input— 5.1 Bob Pastore requested a letter of support for a Port of Grapeview grant application. This will be placed on the briefing schedule for consideration. 6. Adoption of Agenda - Cmmr. Neatherlin/Trask moved and seconded to adopt the agenda as published. Motion carried unanimously. N-aye; S-absent;T-aye. 7. Approval of Minutes—July 6, 2020 Briefing Minutes; July 7, 2020 Regular Meeting Minutes Cmmr. Neatherlin/Trask moved and seconded to approve the July 6, 2020 Briefing Minutes;July 7, 2020 regular meeting minutes as published. Motion carried unanimously. N-aye; S-absent;T-aye 8. Approval of Action Agenda: 8.1 Approval of grant#20-46108-20 between Mason County Public Health and the Department of Commerce for the Housing and Essential Needs Program. 8.2 Approval of the 2020 Oath of Credit Card Inventory per RCW 43.09.2855 8.3 Approval of the Private Line Occupancy Permit granting permission to run utility lines under and across North Shore Road for 11451 North Shore Road, Parcel #32224-50-00104. 8.4 Approval to authorize the County Engineer to execute an agreement with Washington State Association of Counties (WSAC) for the purpose of conducting fish passage assessments with Mason County road rights-of-way and to develop and execute agreements with Mason Conservation District and Hood Canal salmon Enhancement Group as necessary to complete the scope of work. 8.5 Approval to authorize the County Engineer to execute the Project Review Reimbursable Agreement, WSDOT Agreement#J1455, to reimburse WSDOT for the purchase, labor, equipment and all associated incidental costs to install radar speed signs on US 101 in Hoodsport, and approval to authorize the County Engineer to execute the Maintenance and Operation Agreement after equipment is installed to reimburse WSDOT for all future costs associated with yearly preventative maintenance and/or repair/replacement costs due to damage, vandalism and/or failure of equipment. 8.6 Approval of Warrants &Treasure Electronic Remittances a. Treasurer Electronic Remittance for June 2020 $ 1,341,757.41 8.7 Approval of a Resolution amending Resolution No. 79-17 for the Tidelands Lease Agreement with Seattle Shellfish and approval to have the Board sign Tidelands Lease Agreement Amendment No. 2. Resolution No. 2020-57 (Exhibit A) 8.8 Approval of contract amendment #2 to contract#K2751 between Mason County Public Health and Washington Health Care Authority. 8.9 Approval of contract#SA1, Amendment#1 between Mason County Public Health and Family Education Support Services. 8.10 Approval of Amendment #3 to contract #CH:2019-2021.4 between Crossroads Housing and Mason County for coordinated entry services, and approval to discontinue the contract with North Mason Resources. 8.11 Approval to reschedule the July 28, 2020 Commission meeting to 9 a.m. and reschedule the public hearing to consider the rezone of several adjacent parcels from Multi-Family Residential (R-10) to Mixed Use (MU) within the Belfair Urban Growth Area to 9:15 a.m. on July 28. Other Business (Department Heads and Elected Officials) 9.1 Cmmr.Trask presented the official certificate from the Guinness World Record for setting the record of most lit Christmas trees. 10. 9:15 a.m. Public Hearings and Items set for a certain time— 10.1 Mike Collins presented the franchise agreement applications between Mason County and the following for consideration: • Aquarius Utilities, LLC • Island Shores Water, LLC • Detroit Water Service Association • Oak Park Water Company, LLC • Mission Creek Tracts Water System • Mason County Public Works U&W Mgmt. • Little Mission Creek Water System Cmmr. Neatherlin/Trask moved and seconded to approve the franchise agreement applications between Mason County and Aquarius Utilities LLC, Detroit Water Service Association; Mission Creek Tracts Water System; Little Mission Creek Water System; Island Shores Water, LLC; Oak Park Water Company, LLC and Mason County Public Works U&W Mgmt. Motion carried unanimously. Waye; S-absent;T-aye. 10.2 Diane Zoren presented the request from Baidha Dominique Wallace Public hearing to consider the 2019 Open Space application from Baidha Dominique Wallace. Staff: Diane Zoren Tom Davis emailed comments opposing this Open Space application Cmmr. Neatherlin/Trask moved and seconded to table this hearing to July 28, 2020 to consider the Open Space application. Motion carried unanimously. N-aye; S-absent;T-aye. 11. Board's Reports and Calendar-The Commissioners reported on meetings attended the past week and announced their upcoming weekly meetings. 12. Adjournment—The meeting adjourned at 9:25 a.m. BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS July 14, 2020 - PAGE 3 BOARD OF COUNTY COMMISSIONERS ATTEST: MASON COUNTY, WASHINGTON n Diane Zoren, Cler the Board Sharon Trask, Chair :VRe47�1 Kevin Shutty, ommissioner Ran Neat er' , Commissioner Exhibit A RESOLUTION NO. ©�o~61 AMENDING RESOLUTION 79-17, LEASE OF COUNTY OWNED TIDELANDS WHEREAS, Mason County owns tideland adjacent to Harstine Island, parcel#22001-44- 60570; and WHEREAS,this parcel is 19.14 acres and the County entered into a lease agreement with Seattle Shellfish, LLC on April 1, 2014; WHEREAS, Seattle Shellfish has requested the lease agreement be modified to reduce the amount of rent the County receives from the lessee to $1,000 per year for each acre actively farmed by the lessee plus 14.17%of gross proceeds realized by Seattle Shellfish upon each harvest of geoduck clams and other shellfish species to be paid by percentage at the time of sale in lieu of an annual fee; WHEREAS,Seattle-Shellfish agrees to pay to the County any leasehold excise tax due at the time of payment of rent to the County as required by RCW 82.29A; NOW,THEREFORE, BE IT FURTHER RESOLVED by the Mason County Board of County Commissioners the County will amend the lease agreement with Seattle Shellfish for the lease of the County owned tidelands, parcel#22001-44-60570 for a minimum duration of 16 years and a renewal clause.to be determined by negotiation with Mason County receiving$1,000 per year for each acre actively being farmed by the lessee plus 14.17%of gross proceeds realized by Seattle Shellfish upon each harvest of geoduck clams and other shellfish species will be paid by percentage at the time of sale in lieu of an annual fee; and BE IT FURTHER RESOLVED,that Seattle Shellfish will pay to the County any leasehold excise tax due at the time of payment of rent to the County as required by RCW 82.29A;and BE IT FURTHER RESOLVED,that the proceeds from this lease are to be dedicated first to any expenses incurred by Mason County Current Expense to create and administer the lease and finally to County Government as the Board of County Commissioners desire; and BE IT FURTHER RESOLVED,that the chairperson of the Commission is authorized to sign the amended lease agreement with the lessee.
