RE: HOUSING AND BEHAVIORAL HEALTH ADVISORY BOARD UPDATES
On January 2211, 2019, the Housing and Behavioral Health Advisory Board met to
finalize their annual report to the Board of County Commissioners for funding priorities in
2020. The Housing and Behavioral Health Advisory Board began in August of 2018, with
the purpose of strategically aligning housing, homelessness, mental health and chemical
dependency grant awards to improve the health of Mason County residents. The Board's
actions for 2019 and recommendations for 2020 are compiled in an annual report that
can be accessed by visiting:

Some actions from 2019 to highlight include:
• Recommended awarding $1,402,861 in funding to six local agencies for the
Homeless Crisis Response system through a request for proposal process
using funding was from the Consolidated Homeless Grant and 2163 Local
Document Recording Fees.
• Recommended the resolution to adopt HB 1406 tax retention for affordable
housing.
• Recommended awarding $340,000 between the Housing Authority for
building repairs and Quixote Communities toward the veteran tiny home
village from the 2060 Local Document Recording Fee fund.
• Supported funding allocation to have an adult emergency shelter open daily
for 7 continuous months (the maximum allowed by the special use permit)
Some recommendations to highlight from the report include:
• Prioritizing future funding for affordable housing options for single adults and
ways to increase availability.
• Evaluate Coordinated Entry program outcomes and work with the agencies to
maintain areas of success and improve any underperforming areas.
• Consider setting aside funding for research projects such as program return
on investment (program effectiveness) and current housing vacancy rate.
• Recognizes the need for Treatment Sales Tax funds to help pay for housing
for people that are part of a coordinated mental health or substance use
disorder treatment program.

Attorney Mike Dorcy and Chief Deputy Prosecuting Attorney Tim Whitehead from 9:00
a.m.9:55 a.m.also present were Nichole Wilston,and two representatives from the
Washington Risk Pool.

Commissioners Trask,Neatherlin and Shutty met in Executive Session with Frank Pinter

10:55 A.M. Support Services—Frank Pinter
Commissioners Shutty,Trask and Neatherlin were in attendance.
• Mason Transit Authority Board Appointment-Frank said Matt Jewett was interested in
filling the spot to represent Commissioner District 3.The Board was in support of Matt
filling that position.
• Frank asked to approve an agreement with Stop Claims Corporation in place of the
current agreement with Professional Claims Intervention(PCI)Services.He noted the
issues being had with PCI and said Stop Claims has had issues,and has had a change in
management several times,which is creating more issues.The Board approved moving
forward with Stop Claims Corporation.
11:00 A.M. Community Services—Dave Windom
Commissioners Shutty,Trask and Neatherlin were in attendance.
• Kell first talked about the Belfair Area EIS request for proposals.Cmmr. Shutty noted
that many questions were received about the plan,and asked Kell to address those issues.
The Board asked to review the RFP's that do come in.Further discussion was had about
what is expected from the entity that wins the RFP.Cmmr. Shutty asked that the Mason
County Code be updated as changes are done to keep the County in compliance.
• Public Hearing to be scheduled March 3,2020.Kell notified the Board that the
application to change Village commercial parcels to Multifamily Medium Density
Residential R-2.The Board approved moving forward.
• Kell informed the Board that the property owner asking to change parcels from RR5 to
Rural Commercial on Pickering Road has postponed his request. She is unsure if he will
ask to continue this application process at a later date.
• Dave Windom gave a brief look into his calendar over the next two weeks.
• Cmmr. Shutty said he was approached by Beau Bakken who is suggesting changes to
burn permits depending on the time of year.
• Cmmr. Shutty asked about flavored vaping products.Dave said the current discussion is
to permanently prohibit flavored vaping products with the exception of menthol.
11:35 A.M. Public Works—Loretta Swanson
Utilities&Waste Management
Commissioners Shutty,Trask and Neatherlin were in attendance.
• Loretta asked to move forward an item to sell land to Port of Hoodsport.It was approved
to move forward to the February 111 agenda.
• Alan(last name unknown listen to names at beginning)from the Naval Engineer
Committee,briefly touched on trestle and seismic repairs being done near Mason Lake.
Brian Smith,President of Lake Limerick HOA voiced concern over the lack of
information available,noting that if relocation of utilities is necessary,it will be
problematic due to budget.
11:46 A.M. Finance Committee
Commissioners Shutty,Trask and Neatherlin were in attendance.
• Treasurer Lisa Frazier presented the fourth quarter report from 2019.The cash balance
was$12,076,000,and the general fund was at 37%of 2018 expenditures.She said 2019
was a good year,and is cautious of 2020 because many investments are being called.
• Lisa then discussed the Public Disclosure Commission Annual Statement that requires
signatures stating the Finance Committee did not hold any stake in any account. She said
signatures are due by April 151 and asked Paddy and Cmmr.Trask to sign.
• The Mason County Investment policy was addressed.Lisa said she would like to have an
up to date draft ready by the April Finance Committee meeting.
• Jennifer Beierle passed out a copy of the Cash Reserve Balances as of December 31,
2019.Lisa asked if the Board would like to increase or decrease the reserve policy or if it
should stand as is.Jennifer and Lisa agreed that the current policy seems to be working
well.
12:03 P.M. Economic Development Council—Jennifer Baria
• Jennifer said the focus of 2019 was business retention and expansion. 175 businesses
were worked with and 79 of those businesses needed immediate assistance with
everything from permitting to simple phone calls. She talked about an upcoming event at
The Ridge which is expected to draw over 15,000 people.Jennifer said she is hoping to
have a name of an incoming hotelier that is being worked with.Final information is
coming out on Opportunity Zones.Jennifer said she would forward that information to
the Commissioners.
Wednesday,February 5,2020
1:00 P.M. Criminal Justice Study Presentation—KMB Architects
Commissioners Trask and Neatherlin were in attendance. Commissioner Shutty arrived
at 2:20 p.m. Others in attendance included Undersheriff Adams and Chief Hansen.
KMB Architect staff presented final outcomes of the Criminal Justice Assessment and
population projections. Information included demographic trends;crime and arrest
trends;court trends;District Court Probation did not provide data on case load;jail trends
and information on jail operations.
Superior Court criminal case completions decreased after a 3'judge was brought on and
Cmmr.Neatherlin questioned why there is a drop. There was discussion of the possible
reasons.
The jail design capacity was originally built for 68 inmates;functional capacity is 80;
emergency operational capacity is 93 and alternatives capacity is 18. It was pointed out
that the jail wasn't designed for how it's used today that includes alternative programs
and dealing with inmates that have behavioral health issues.The 2018 average daily
population is 118 offenders with a$115 per diem.
Also provided was 2018 comparative jail data with other counties and forecasts of jail
population through 2040.
Discussion of how many beds are needed today which Chief Hansen believes is 135 and
based on forecasts,200 beds in 20 years. He noted if a facility is built with 200 beds,
there is an opportunity to rent those beds.
Undersheriff Adams questioned when the decision of an independent facility versus a
joint location would be decided.Discussion was had about data and the factors that will
determine that decision.It was estimated that a suggestion would be given by June.

8.5 Approval of the resolution increasing the hourly rate for District Court Judge Pro Tempore and
District Court Commissioner to $75 effective January 1, 2020. (Ex. B—Res. 20-05)
8.6 Approval to authorize Public works to advertise Construction Project Inspector, Contract and Fee
Appraisers, Construction Materials Testing and Timber Management Services for the 2020
calendar year and authorize the County Engineer to enter into agreements for these services.
Cmmr. Shutty asked to remove item 8.3 for separate discussion and vote.
Cmmr. Neatherlin/Shutty moved and seconded to approve action items 8.1 through 8.6
with the exception of item 8.3. Motion carried unanimously. N-aye; S-aye; T-aye.
8.3 Frank Pinter spoke about the cost of ER&R versus changing to the leasing program with
Enterprise. He said that pursuit vehicles for the Sheriff's Office, along with vehicles for various
departments will be leased. He noted that there is a large cost reduction in capital costs.
Tom Davis questioned upfront costs of the vehicles mainly asking who would be financing it.
Frank said upfront costs will be handled by the County.

the franchise agreement application between Mason county and Erickson Lake Homeowners
Association to run water lines and appurtenances under and across county road right of way.
8.11 Approval to have the Board authorize Public Works to advertise a Request for Qualifications
for Hydraulic/Hydrologic Analysis consultant services for North Shore Road-Cady Creek Culvert
Replacement (CRP 1995), North Island Drive Culvert Replacement (CRP 2011) and North
Shore Road-Great Bend Creek Culvert Replacement (CRP 2021) and approval to enter into and
sign contracts.
8.12 Approval to have the Board authorize the following for county Road Project 2026 (CRP 2026),

• County Engineer to advertise, set bid date/time and award contract;
• County Engineer to announce Request for Qualifications as needed for consultant services

• County Engineer and/or the Chair to sign all pertinent documents for project and Federally
funded Local Bridge Program grant.
8.13 Approval to appoint Dave Smith as the acting County Engineer for Mason County for a period
not to exceed six months beginning January 23, 2020. (Ex. F—Res. 20-11)
8.14 Approval to amend Resolution No. 101-19 to revise the Non-Represented Salary Scale Range
Alignment by adding a County Surveyor at Salary Range 38, a Project Support Services
Manager at A Salary Range 32, an Engineering &Construction Assistant Manager at Salary
Range 30, a Senior Deputy Coroner at Salary Range 11, eliminating the Technical Services
Manager and reducing one Engineer full time equivalent position allotted on the non-
Represented Salary Scale; and approving the reclassification of the Deputy Administrator,
Probation Services from Salary Range 33 to Juvenile Court Services Deputy Administrator at
Salary Range 35 and placing the incumbent at Salary Step 5, effective February 1, 2020, and
reclassify the Chief Deputy at Salary Range 27 to a Chief Deputy Clerk at Salary Range 29,
and placing the incumbent at Salary Step 1, effective February 1, 2020. (Ex. G—Res. 20-12)

8.16 Approval to change an existing Maintenance III position to Maintenance IV and change an
existing .5FTE Maintenance position to a FTE Maintenance II position, and approval to post
and fill these positions in the Facilities Department.
Mary Leighton asked for item 8.6 to be removed; tom Davis request item 8.13 be removed for
discussion.
Cmmr. Neatherlin/Shutty moved and seconded to approve action items 8.1 through 8.16
with the exception of item 8.6 and 8.13. Motion carried unanimously. N-aye; S-aye; T-
aye.
8.6 Diane Sheesley explained that the owner of the parcel in question asked for this vacation, then
said the City, County, and Hearings Examiner all agree that this petition should be denied.
Mary Leighton, owner of the above parcel read a statement aloud, supporting her request.
Bryan Clevenger owns the parcel next to Mary Leighton voiced his concerns with the request
and supported denial of the petition due to access issues.

Cmmr. Neatherlin spoke to the reasons the request is being denied, and suggested some
contacts for Mary to discuss this issue further.
Cmmr. Shutty/Neatherlin moved and seconded to deny the petition for vacation of
the South half of W. Walnut Street laying North of 121 W. Walnut Street in the Plat
of Moore's Addition to Shelton Block 4, lots 1-4, based on the request from the City
of Shelton and the lack of alternative access routes to the general area in the
future. Motion carried unanimously. N-aye; S-aye; T-aye.
8.13 Loretta Swanson said that Diane Sheesley is leaving her position as of Thursday. She said for
an interim basis, she would like to have Dave named Engineer while they seek a replacement
for Diane.
Tom Davis questioned what happens if a replacement isn't found by the end of the six month
period. Loretta explained she would come forward to ask for an extension. She then spoke to
his qualifications.
Tom then spoke about the open positions within the County, noting that one position was
posted in March of 2019 and has yet to be filled. He stated that the turnover rate of Mason
County is concerning.
Cmmr. Neatherlin/Shutty moved and seconded to appoint Dave Smith as the acting
County Engineer for Mason County for a period not to exceed six months beginning
January 23, 2020. Motion carried unanimously. N-aye; S-aye; T-aye.

9.1 Sheriff Salisbury thanked various shop employees for their work on the Sheriff Fleet over the
yea rs.
9.2 Diane Sheesley spoke to Dave Smith taking over the interim Engineer position. She then thanked
the Board for her exit interview, and for considering changes and suggestions from staff.

ITEM: Approval to appoint Matt Jewett to the Mason Transit Authority Board to
complete a vacated elected official term that ends December 2021.
Background:
The Mason County Public Transportation Benefit Area (Mason Transit Authority) Board
composition is as follows:
Three (3) Mason County Commissioners;
One (1) City of Shelton Council member;
Five (5) members who shall be elected officials selected by the Mason County
Commissioners with the goal of seeking equal voting representation among the County
commission districts.
One of the elected official positions has been vacated and this appointment will fill all
positions on the MTA Board.
Budget Impacts: None to Mason County.
RECOMMENDED ACTION: Approval to appoint Matt Jewett to the Mason Transit
Authority Board to complete a vacated elected official term that ends December 2021.

ITEM: Approval of a service agreement with Stop Claims Corporation to provide worker's
compensation claim management services for a monthly service fee of$5,650 per month, and
authorization to send Professional Claims Intervention Services (PCI) notice to end Mason
County's current contract with them.
Background: Currently Mason County is engaged in a contract with Professional Claims
Intervention Services (PCI)for worker's compensation services management.The current
contractor has been non-responsive to the needs of Mason County. It was also found through
an audit that several of our claims should have been denied based on the notes in the files, or
at the very least appealed to pursue a denial. PCI has had a change in management several
times in the past couple of years and the service level has deteriorated.
STOP Claims Corporation met with myself,the Risk Manager, and the Support Services
Director and presented us with an audit of our current claims and a proposal of the services
they have available. It is recommended to move forward with the Service Fee Schedule
Addendum B for$5,650 per month flat fee as an all-inclusive service.This service will include
filing, notice of appearance & mediation services, representation at BIIA hearings wit legal
counsel representing Mason Count,third party expert witness fees, private investigators (if
needed), and safety services.
RECOMMENDED ACTION: Approval of a service agreement with Stop Claims
Corporation to provide worker's compensation claim management services for a monthly
service fee of$5,650 per month, and authorization to send Professional Claims Intervention
Services (PCI) notice to end Mason County's current contract with them.

Professional Services Agreement
STOP Claims Corp. (SCC)
and
Mason County
STOP Claims Corp. (SCC), hereinafter called Contractor, and Mason County, hereinafter called County,
agrees as set forth in this Agreement, including: General Conditions; Exhibit A(Scope of Work); Exhibit B
(Compensation); Exhibit C (Proof of Insurance) copies of which are attached hereto and incorporated
herein by this reference as fully as if set forth herein.
The term of this Agreement shall commence on the 11th day of February, 2020, and continue until either
party terminates by giving 30 days notice in writing either personally delivered or mailed postage
prepaid by certified mail, return receipt requested,to the party's last known address for the purposes of
giving notice under this paragraph.
Scope of Services:
The Contractor agrees to provide to the County services and any materials as set forth in the project
narrative identified as Exhibit "A", during the agreement period. No material, labor, or facilities will be
furnished by the County, unless otherwise provided for in the Agreement.
Accounting and Payment for Contractor Services:
Payment to the Contractor for services rendered under this Agreement shall be as set forth in Exhibit
"B." Where Exhibit "B" requires payments by the County, payment shall be based upon billings,
supported unless otherwise provided in Exhibit "B," by documentation of units of work actually
performed and amounts earned, including, where appropriate,the actual number of days worked each
month, total number of hours for the month, and the total dollar payment requested. Unless specifically
stated in Exhibit "B" or approved in writing in advance by the Mason County Board of Commissioners,
the County will not reimburse the Contractor for any costs or expenses incurred by the Contractor in the
performance of this contract.
Where required,the County shall, upon receipt of appropriate documentation, compensate the
Contractor, no more often than monthly, in accordance with the County's voucher system,for the
Contractor's service pursuant to the fee schedule set forth in Exhibit "B."
Assignment of Subcontracting:
No portion of this contract may be assigned or subcontracted to any other individual,firm or entity
without the express and prior written approval of the County.
Independent Contractor:
The Contractor's services shall be furnished by the Contractor as an independent contractor, and
nothing herein contained shall be construed to create a relationship of employer-employee or master-
servant, but all payments made hereunder and all services performed shall be made and performed
pursuant to this Agreement by the Contractor as an independent contractor.
The Contractor acknowledges that the entire compensation for this Agreement is specified in Exhibit "B"
and the Contractor is not entitled to any benefits including, but not limited to:vacation pay, holiday pay,

sick leave pay, medical, dental, or other insurance benefits, or any other rights or privileges afforded to
Mason County employees.
Contractor will defend, indemnify and hold harmless the County, its officers, agents or employees from
any loss or expense, including, but not limited to, settlements,judgments, setoffs, attorneys' fees or
costs incurred by reason of claims or demands because of breach of the provisions of this paragraph.
Certificate of insurance shall be primary. Any insurance or self-insurance maintained by the County, its
officers, officials, employees or volunteers shall be excess of Contractor's insurance and shall not
contribute to it.
No Guarantee of Employment:
The performance of all or part of this contract by the Contractor shall not operate to vest any
employment rights whatsoever and shall not be deemed to guarantee any employment of the
Contractor or any employee of the Contractor or any subcontractor or any employee of any
subcontractor by the County at the present time or in the future.
Insurance:
The Contractor shall obtain and keep in force, from the execution date of the Contract until the date of
acceptance, Commercial General Liability Insurance written under ISO Form CG 0001 or its equivalent
with minimum limits of$1,000,000 per occurrence and in the aggregate for each one year policy period.
The Contractor shall name Mason County, its officers, officials and employees as additional insured.
Contractors insurance shall be primary and noncontributory.
Taxes:
The Contractor understands and acknowledges that the County will not withhold Federal or State
income taxes. Where required by State or Federal law, the Contractor authorizes the County to
withhold for any taxes other than income taxes (i.e., Medicare). All compensation received by the
Contractor will be reported to the Internal Revenue Service at the end of the calendar year in
accordance with the applicable IRS regulations. It is the responsibility of the Contractor to make the
necessary estimated tax payments throughout the year, if any, and the Contractor is solely liable for any
tax obligation arising from the Contractor's performance of this Agreement. The Contractor hereby
agrees to indemnify the County against any demand to pay taxes arising from the Contractor's failure to
pay taxes on compensation earned pursuant to this Agreement.
The County will pay sales and use taxes imposed on goods or services acquired hereunder as required by
law. The Contractor must pay all other taxes, including, but not limited to, Business and Occupation Tax,
taxes based on the Contractor's gross or net income, or personal property to which the County does not
hold title. The County is exempt from Federal Excise Tax.
Regulations and Requirement:
This agreement shall be subject to all laws, rules and regulations of the United States of America, and
State of Washington, and political subdivisions of the State of Washington and to any other provisions
set forth herein or in the attached exhibits.
Right to Review:
This contract is subject to review by any Federal, State or County auditor. The County or its designee
shall have the right to review and monitor the financial and service components of this program by
whatever means are deemed expedient by the Administrative Officer or by the County Auditor's Office.

Such review may occur with or without notice and may include, but is not limited to, on-site inspection
by County agents or employees, inspection of all records or other materials which the County deems
pertinent to the Agreement and its performance, and any and all communications with or evaluations by
service recipients under this Agreement. The Contractor shall preserve and maintain all financial
records and records relating to the performance of work under this Agreement for three (3)years after
contract termination, and shall make them available for such review, within Mason County, State of
Washington, upon request.
Modifications:
Either party may request changes in the Agreement. Any and all agreed modifications,to be valid and
binding upon either party, shall be in writing and signed by both of the parties.
Termination for Default:
If the Contractor defaults by failing to perform any of the obligations of the contract or becomes
insolvent or is declared bankrupt or commits any act of bankruptcy or insolvency or makes an
assignment for the benefit of creditors, the County may, by depositing written notice to the Contractor
in the U.S. mail, first class postage prepaid, terminate the contract, and at the County's option, obtain
performance of the work elsewhere. If the contract is terminated for default, the Contractor shall not
be entitled to receive any further payments under the contract until all work called for has been fully
performed. Any extra cost or damage to the County resulting from such defaults) shall be deducted
from any money due or coming due to the Contractor. The Contractor shall bear any extra expenses
incurred by the County in completing the work, including all increased costs for completing the work,
and all damage sustained,or which may be sustained by the County by reason of such default.
If a notice of termination for default has been issued and it is later determined for any reason that the
Contractor was not in default, the rights and obligations of the parties shall be the same as if the notice
of termination had been issued pursuant to the Termination for Public Convenience paragraph hereof.
Termination for Public Convenience:
The County may terminate the Agreement in whole or in part whenever the County determines, in its
sole discretion that such termination is in the interests of the County. Whenever the contract is
terminated in accordance with this paragraph,the Contractor shall be entitled to payment for actual
work performed at unit contract prices for completed items of work. An equitable adjustment in the
contract price for partially completed items of work will be made, but such adjustment shall not include
provision for loss of anticipated profit on deleted or uncompleted work. Termination of this Agreement
by the County at any time during the term, whether for default or convenience, shall not constitute
breach of contract by the County.
Defense & Indemnity Agreement:
The Contractor agrees to defend, indemnify and save harmless the County, its appointed and elective
officers and employees, from and against all loss or expense, including, but not limited to,judgments,
settlements, attorneys'fees and costs by reason of any and all claims and demands upon the County, its
elected or appointed officials or employees for damages because of personal or bodily injury, including
death at any time resulting therefrom, sustained by any person or persons and on account of damage to
property, including loss of use thereof, whether such injury to persons or damage to property is due to
the negligence of the Contractor, its subcontractors, its successor or assigns, or its agents, servants, or
employees, the County, its appointed or elected officers, employees or their agents, except only such

injury or damage as shall have been occasioned by the sole negligence of the County or its appointed or
elected officials or employees.
It is further provided that no liability shall attach to the County by reason of entering into this contract,
except as expressly provided herein. Contractor's insurance shall be primary and noncontributory. Any
insurance or self-insurance maintained by the County, its officers, officials, employees or volunteers
shall be excess of Contractor's insurance and shall not contribute to it.
Contractor's initials acknowledging indemnity terms:
Survival of Indemnity Obligations:
The parties agree all indemnity obligations shall survive the completion, expiration or termination of this
Agreement.
Participation by County—No Waiver:
The County reserves the right, but not obligation,to participate in the defense of any claim, damages,
losses or expenses and such participation shall not constitute a waiver of Contractor's indemnity
obligations under this Agreement.
Indemnity by Subcontractors:
In the event the Contractor enters into subcontracts to the extent allowed under this Agreement,the
Contractor's subcontractors shall indemnify the County on a basis equal to or exceeding Contractor's
indemnity obligations to the County.
Industrial Insurance Waiver:
With respect to the performance of this agreement and as to claims against the County, its officers,
agents and employees,the Contractor expressly waives its immunity under Title 51 of the Revised Code
of Washington,the Industrial Insurance Act, for injuries to its employees and agrees that the obligations
to indemnify, defend and hold harmless provided in this agreement extend to any claim brought by or
on behalf of any employee of the Contractor. This waiver is mutually negotiated by the parties to this
agreement.
Venue and Choice of Law:
In the event that any litigation should arise concerning the construction or interpretation of any of the
terms of this Agreement,the venue of such action of litigation shall be in the courts of the State of
Washington in and for the County of Mason. This Agreement shall be governed by the laws of the State
of Washington.
Withholding Payment:
In the event the Contractor has failed to perform any obligation under this Agreement within the times
set forth in this Agreement, then the County may, upon written notice,withhold all monies due and
payable to Contractor, without penalty, until such failure to perform is cured or otherwise adjudicated.
Future of Non-Allocation of Funds:
If sufficient funds are not appropriated or allocated for payment under this contract for any future fiscal
period,the County will not be obligated to make payments for services or amounts incurred after the
end of the current fiscal period. No penalty or expense shall accrue to the county in the event this
provision applies.

Contractor Commitments Warranties and Representations:
Any written commitment received from the Contractor concerning this Agreement shall be binding upon
the Contractor, unless otherwise specifically provided herein with reference to this paragraph. Failure
of the Contractor to fulfill such a commitment shall render the Contractor liable for damages to the
County. A commitment includes, but is not limited to any representation made prior to execution of this
Agreement, whether or not incorporated elsewhere herein by reference, as to performance of services
or equipment, prices or options for future acquisition to remain in effect for a fixed period, or
warranties.
Patent/Copyright Infringement:
Contractor will defend and indemnify the County from any claimed action, cause or demand brought
against the County;to the extent such action is based on the claim that information supplied by the
Contractor infringes any patent or copyright. The Contractor will pay those costs and damages
attributable to any such claims that are finally awarded against the County in any action. Such defense
and payments are conditioned upon the following:
a. Contractor shall be notified promptly in writing by County of any notice of such claim.
b. Contractor shall have the right, hereunder, at its option and expense,to obtain for the
County the right to continue using the information, in the event such claim of infringement
is made, provided no reduction in performance or loss results to the County.
Disputes:
a. General
Differences between the Contractor and the County, arising under and by virtue of the
Contract Documents, shall be brought to the attention of the County at the earliest possible
time in order that such matters may be settled or other appropriate action promptly taken.
Except for such objections as are made of record in the manner hereinafter specified and
within the time limits stated,the records, orders, rulings, instructions, and decisions of the
Mason County Commissioners shall be final and conclusive.
b. Notice of Potential Claims
The Contractor shall not be entitled to additional compensation which otherwise may be
payable, or to extension of time for(1) any act or failure to act by the County, or(2)the
happening of any event or occurrence, unless the Contractor has given the County a written
Notice of Potential Claim within ten (10) days of the commencement of the act,failure, or
event giving rise to the claim, and before final payment by the County. The written Notice
of Potential Claim shall set forth the reasons for which the Contractor believes additional
compensation or extension of time is due,the nature of the cost involved, and insofar as
possible, the amount of the potential claim. Contractor shall keep full and complete daily
records of the work performed, labor and material used, and all costs and additional time
claimed to be additional.
c. Detailed Claim
The Contractor shall not be entitled to claim any such additional compensation, or extension
of time, unless within thirty(30) days of the completion of the portion of the work from
which the claim arose, and before final payment by the County,the Contractor has given the
County a detailed written statement of each element of cost or other compensation

requested and of all elements of additional time required, and copies of any supporting
documents evidencing the amount or the extension of time claimed to be due.
Ownership of Items Produced:
All writings, programs, data, public records or other materials prepared by the Contractor and/or hits
consultants or subcontractors, in connection with performance of this Agreement shall be the sole and
absolute property of the County.
Confidentiality:
The Contractor, its employees, subcontractors, and their employees shall maintain the confidentiality of
all information provided by the County or acquired by the Contractor in performance of this Agreement,
except upon the prior written consent of the Mason County Prosecuting Attorney or an order entered
by a court after having acquired jurisdiction over the county. Contractor shall immediately give to the
County notice of any judicial proceedings seeking disclosure of such information. Contractor shall
indemnify and hold harmless the County, its officials, agents or employees from all loss or expense,
including, but not limited to settlements,judgments,setoffs, attorneys'fees and costs resulting from
Contractor's breach of this provision.
Notice:
Except as set forth elsewhere in the Agreement,for all purposes under this Agreement except service of
process, notice shall be given by the Contractor to the Support Services department for whom services
are rendered, and to the Mason County Commissioners, 411 N 5th Street, Shelton, WA 98584. Notice to
the Contractor for all purposes under this Agreement shall be given to the address reflected on the
signature page. Notice may be given by delivery or by depositing in the US Mail,first class, postage
prepaid.
Severability:
If any term or condition of this contract or the application thereof to any person(s) or circumstances is
held invalid, such invalidity shall not affect other terms, conditions or applications which can be given
effect without the invalid term, condition or application. To this end,the terms and conditions of this
contract are declared severable.
Waiver:
Waiver of any breach or condition of this contract shall not be deemed a waiver of any prior or
subsequent breach. No term or condition of this contract shall be held to be waived, modified or
deleted except by an instrument, in writing, signed by the parties hereto.
Survival:
The provisions of this contract, shall survive, notwithstanding the termination or invalidity of this
Agreement for any reason.
Entire Agreement:
This written contract represents the entire Agreement between the parties and supersedes any prior
oral statements, discussions or understandings between the parties.

SCOPE OF WORK
Stop Claims Corp provides an aggressive approach for all workers' compensation claims on behalf of the
employer. We review every claim decision through the course of a claim, contain costs, and reduce
overall premiums paid to L& I Industrial Insurance and remove the administrative burden.This includes
but is not limited to the following:
I.Stop Claims unique strategy employs a combination of medical and legal case management,to
advocate, manage and mitigate worker's compensation claims;
II.Stop Claims will represent Skagit County on all worker's compensation claims, including submissions
of petitions, protests, and appeals with the Washington Department of Labor Industries (LNI) and Board
of Industrial Insurance Appeals (BIIA). We provide our designated legal counsel for all hearings;
III. Establish light or modified job options where applicable and any Stay-At-Work reimbursements.Stop
Claims would facilitate early return to work solutions;
IV. Negotiate vocational services being included within a claim, including but not limited to on site job
analysis, ability to work assessments and retraining plan options to reduce impact to Mason County's
experience rating;
V. Negotiate all open reserves currently affecting Mason County and any future case settings,to reduce
impact to experience rating;
VI. Negotiate permanent partial disability ratings and payments, structured settlements and/or pensions
to reduce impact to experience rating;
VII. Facilitate all communication to L&I by communicating with all parties as appropriate; including
receiving all claims mail electronically. Mason County would still have access to all claims data on the L&I
website;
VIII.Assist with Washington Industrial Insurance internal audits, and reclassifications;
IX. Provide certified VRC, on-site job analysis and job descriptions on all positions and for its' workers.
This will assist in streamlining the process for early return to the job of injury. Includes all
documentation required for injured worker, their physicians, and the L&I claims manager, and follow up;
X.Secure third- party professional services when necessary for expert peer review, expert testimony for
BIIA appeals.
XI. Stop Claims is a Washington state licensed private investigations agency. (License#4219) We
routinely conduct fraud investigations and surveillance when there is suspicions of abuse and fraud;
XII. Stop Claims safety services include accident prevention, policy development,code interpretations,
site visits, audits, safety inspections, accident investigations,safety training;
XIII. Provide status reports for Mason County on a monthly, quarterly, and annual basis.

EXHIBIT"A"
SCOPE OF WORK CONTINUED
SCC will assist Mason County in the enrollment of Individual Retrospective Refund and/or
Group Filing:
I. Employers must adopt a Safety Policy and require training of its employees.
II. Employer must have good claim performance and low experience rating, so premium
impact and risk of assessment is minimal.
III. Employer must have premiums within six figures; however, with the 2014 rule changes
the risk is too high for employers under premiums of $300k annually.
IV. Employers are required to enroll for a 12-month period.
V. An employer may enroll as an individual employer in Retro at the beginning of any
quarter.
VI. Employers will receive refunds and/or assessments directly from L&I Industrial
Insurance.
VII. Employer has full transparency on actual loss run, refunds, and assessments.
VIII. Employers with negative claim performance, results in an assessment payable to L&I
Industrial Insurance and an increase to experience rate and premiums.

COMPENSATION
SCC will provide comprehensive claim management services along with the following services for an all-
inclusive amount of$5,650 per month flat fee.

The Contractor shall provide proof of insurance for Commercial General Liability in the amount

insurance coverage shall be primary. Any insurance proceeds in excess of the limits and
coverage required in this agreement and which is applicable to a given loss will be available to
the County. Proof of insurance shall be in a form acceptable and approved by the County.
Insurance is a condition of Payment. Payments due to the Contractor under this Agreement are
expressly conditioned upon the Contractor's strict compliance with all insurance requirements
under this Agreement. Payment to the Contractor shall be suspended in the event of non-
compliance. Upon receipt of evidence of full compliance, payments not otherwise subject to
withholding or set- off will be released to the Contractor.

ITEM: Transfer of Real Property— Set Hearing
BACKGROUND:
The Port of Hoodsport has expressed interest in a parcel owned by Mason County Public Works on
North Old Mill Hill Road (at the end of the portion maintained by the county) to utilize the parcel as
a septic drain field for community restrooms. Mason County Public Works foresees no use of the
parcel and is agreeable to an intergovernmental transfer of real property. Such a transfer may take
place between two public agencies under any terms deemed appropriate and mutually agreeable by
the agencies under RCW 39.33.010.
This parcel was purchased for $3,301.11 in August of 1996 by Public Works for potential future road
use as a vehicle turnaround area. There are no plans to improve the property and the County would
be relieved burden to the road fund by transferring ownership. Additionally, transferring ownership
to the Port of Hoodsport benefits the county by improving the community of Hoodsport and
protecting water quality.
BUDGET IMPACT: N/A
RECOMMENDED ACTION:
Recommend the Board set a hearing on Tuesday, March 17, 2020 at 9:15am for public comment on
the surplus of parcel 42212-51-48008 as a intergovernmental exchange to the Port of Hoodsport for
use as septic drain field for community restrooms that benefits the county by improving the
community of Hoodsport and protecting water quality.

Request for Proposals
Planned Action Environmental Impact Statement (EIS)
for the Belfair Urban Growth Area (UGA)
1. Project Overview:
Mason County intends to develop a Planned Action EIS for the Belfair UGA.
Unincorporated Belfair is a small but thriving commercial center in north Mason County.
Belfair is situated at the crossroads of key corridors that connect rural Mason County to
urban centers in Kitsap and Pierce Counties and beyond. Since the recent completion
of the State Route 3 widening project and the anticipation of a new state bypass, Belfair
is on the verge of a growth boom.
It is anticipated that the Belfair UGA Plan, adopted in December 2004, will be updated
as part of the process. Mason County Department of Community Services (Planning
Department) is the assigned coordinator for this project.
2. Project Purpose and Description:
Mason County is seeking consultant services to assist in the preparation of a Planned
Action EIS consistent with RCW 43.21C.440 and WAC 197-11-164 through WAC 197-
11-172, along with an update to the Belfair UGA Plan. This planning effort is expected
to be consistent with the Washington State Department of Transportation's (WSDOT)
SR 3 — Freight Corridor — New Alignment project that is currently underway.
3. Required Qualifications:
• Demonstrated experience and expertise in preparation of Planned Action EISs
including environmental documents.
• Experience and expertise in preparation of GMA compliant Comprehensive Plans
and/or Sub Area Plans.
• Experience working in small urban (growth) areas relating to long-range planning
and zoning.
• Experience in community outreach and facilitation.
4. Project Scope-of-Work:
• Determine project area (may include all, or a portion of, Belfair UGA). See
attached map for DRAFT inclusion area.
• Scoping of appropriate environmental documentation.
• Public Outreach plan and efforts.
• Utilization of the Draft Belfair Mobility Plan (Transportation Supplement to the
2004 Belfair UGA Plan) and coordination with WSDOT for impacts of the Belfair
Transportation Corridor.
• Analyze existing land use/zoning designations and propose necessary changes.
• Analyze population and employment growth projections and their distribution into
Belfair area subplan.
5. Project Timeline:
The Proposal shall provide a timeline for the project including the anticipated start date,
milestone dates and project completion date.
6. Costs/Budget:
The Proposal shall explain what is included for each budget item. Describe exactly what
is included in the pricing for the proposal broken down by Phase and Tasks. The County
is interested in considering a range of Tasks within each Phase that can be included or
excluded depending on budget constraints and/or timing. The Planned Action EIS shall
include, at a minimum, the area within the yellow boundary as depicted on the attached
map.
7. Proposal Requirements:
The Proposal must be submitted on letter size paper with a minimum 11-point font, not
to exceed 10 pages in length and contain the following components:
1. Contact name, address, telephone number and e-mail address.
2. Detailed description of skills, experience and ability to prepare a Planned Action
EIS with all necessary supporting documents and required public outreach.
3. Identification and designation of roles/responsibilities of key project staff.
4. Minimum of three, maximum of five client references including project type,
dates, contact information and description.
5. Proposed Scope of Work in Phases that leads to a Final Planned Action EIS
(County will be responsible for drafting and adopting the Planned Action
Ordinance).
6. Proposed budget per Phase and Tasks including time (salary and benefit costs
or hourly fee), travel, supplies and other expenses as allowed.
7. Anticipated timeline of proposed activities based on the stated performance start
and end date.
8. Statement of acceptance, ability and willingness to enter into a Professional
Services Contract.
9. Statement as to whether the Proposer is a minority- and/or women-owned firm.
Note-Proposers are to refrain from submitting proposals that will not be easily
duplicated such as those with spiral binding, photos or over-sized paper.
8. Proposal Submission:
Interested firms should submit five (5) copies their proposal pursuant to this RFP. The
proposal coversheet should include the following information: firm name, address,
phone numbers; and name of Principal-in-Charge and Project Manager. The submittal
shall also include resumes of key personnel who will perform the work, including
descriptions of similar projects they have been involved with, their role in each project,
and professional certifications. Resumes are in addition to the 10-page maximum.
Mason County will review all proposals and may request interviews. The County will
select the qualified applicant in a priority ranking and will negotiate the estimated
professional services based on the general scope of work outlined in the proposal. If
agreement with the top-ranking applicant is not reached, the County may negotiate with
the next ranked applicant, or reopen the RFP process.
Mason County encourages disadvantaged, minority, and women-owned consulting
firms to respond.
Please note that information obtained from sources other than the Project Manager or
with respect to this project may not be accurate. Notices related to revisions or updates
to the RFP will be provided via e-mail, unless the Applicant requests to receive it by
regular mail. Regular mail will be post marked the same date any e-mails are sent. All
costs for proposal preparation and negotiation incurred by the proposer, whether they
lead to execution of a contract and agreement with Mason County or not must be borne
entirely and exclusively by the proposer. Mason County reserves the following rights for
acceptance, modification, and/or rejection of submitted proposals such as:
• Rejection of any or all proposals.
• Rejection of any proposal not in compliance with proposal requirements.
• Providing of addenda, amendments, supplementary material or other
modifications to the proposal specifications.
• Cancellation of this Request for Proposals without issuance of another Request
for Proposals.
• Issuance of subsequent requests for new proposals.
• Request for submission of further information by the proposer in order to
complete evaluation by Mason County.
• Determination to select one or more proposers for attempted negotiation of a
final contract(s). Decisions made by Mason County will be final. Mason County
further reserves the sole right to determine which proposal best serves the
County's interest or to reject any or all proposals.
