Public Defense—Peter Jones Commissioners Trask,Neatherlin and Shutty were in attendance • Updated contracts with Taschner Law Office are on the January 28 agenda and were briefed during the 2020 budget process. • Peter also presented an ILA with TMBHO for services provided for those individuals involuntarily detained in Mason County. This will be placed on agenda for approval. • Peter reported that Seattle University has expressed interest in providing Mason County two interns to work in the Public Defense Office and Peter will move forward with this. 9:50 A.M. Treasurer—Lisa Frazier Commissioners Trask,Neatherlin and Shutty were in attendance • Lisa presented the Treasurer's Annual Refund Report which will be placed on agenda for the Commissioners to sign the Acknowledgment of Receipt. • Lisa also presented the 2020 Uncollectible Personal Property Taxes report that will be placed on the agenda. 10:00 A.M. WSU Extension Office—Dan Teuteberg Commissioners Trask,Neatherlin and Shutty were in attendance • The 2020 Washington State University Extension—Mason County Memorandum of Agreement was presented that provides$71,684 from Mason County to the Extension Office. This will be place on the agenda. • Dan provided an update on Master Program classes and the 4-H program that have had an increase in participation. 10:10 A.M. Audit Committee Update—Leo Kim Commissioners Trask,Neatherlin and Shutty were in attendance • Leo updated the Board on Audit Committee activities that include Internal Controls,work on the 2018 SAO Audit Findings;samples of SAO Audit Findings;2019 CPA work summary;Sheriff Special Funds update for Fund 140;information on Cybersecurity and a draft sample of Financial Reporting package. • Lisa Frazier noted there is potential legislation that could impact the Auditor and Treasurer's Office regarding small districts that are not meeting State Audit requirements. 10:20 A.M. Sheriff's Office—Sheryl Hilt Commissioners Trask,Neatherlin and Shutty were in attendance • Resolution to delete the Perishable Property Trust Fund that is obsolete. This will be placed on the agenda for approval. Board of Mason County Commissioners' Briefing Meeting Minutes January 27,2020 10:35 A.M. Public Works—Loretta Swanson Utilities&Waste Management Commissioners Trask,Neatherlin and Shutty were in attendance • 2020 Road Levy Certification will be placed on agenda for approval. • Resolution for CRP 2027 Clear Zone Improvement Projects will move forward for approval. • 2020 call for bids for paint line,asphalt emulsion and manufacturing and stockpiling of chipseal aggregate will move forward for approval. • Skokomish Valley update was provided. Roads are currently open although there is still some water flowing over the road in certain areas. • Road Operator position is being vacated and permission to fill position was approved. • TIPCAP will be holding community outreach meetings and attend service organization meetings and the Commissioners intend to hold the meeting in their district. • Utilities reported on a sewer spill in Belfair due to pump failure. Cmmr.Neatherlin asked that the local residents be contacted. • Richard reviewed sewer plant violations that are reviewed by Ecology and the plan of action to improve. • Review of utility rate structure and what it will take to create reserves. Staff will bring back additional information on impact to actual rates. • Review of implementing a solid waste voucher program. They are having issues with the scale t the transfer station. 11:00 A.M. Assessor—Vicki King Commissioners Trask,Neatherlin and Shutty were in attendance • Request to amend Resolution 42-17 to change the language to$500 per parcel for the Current Use and Designated Forest Land Programs. Approved to move forward. 11:10 A.M. Community Services—Dave Windom Commissioners Trask,Neatherlin and Shutty were in attendance • Miles Nowlin,Housing Co-op Development Specialist/ROC Northwest,is requesting a letter of support to submit with a loan application for the Evergreen Mobile Park to buy the property under the mobile homes so it would be a resident-controlled co-op. The goal is to fix infrastructure, improve home quality and maintain low rents. The Commissioners asked staff to discuss with the City of Shelton about the possibility of hooking up to City utilities. There is concern if there is enough room to improve the septic system. The Commissioners are supportive of the letter. • The Housing and Behavioral Health Board's Annual Report was provided and this will be posted on the County's website. Cmmr. Shutty asked that a news release also be issued. • Request for County to sign JARPA and APPS forms for the Haven Lake Fish Passage Improvement Project. The Board okayed moving this forward and Cmmr.Neatherlin asked that the local residents be notified of the project. • Consolidated Contract Amendment 12 increasing the funding will be moved to the agenda. • The Commissioners requested staff move forward an RFP for EIS. • Weekly building permit report was submitted. 11:30 A.M. Superior Court -Judge Goodell Commissioners Trask,Neatherlin and Shutty were in attendance • ILA with TMBHO for involuntary treatment court will be moved forward. • Response to the salary reclassification request of the Juvenile Court Administrator. The Human Resources has recommended that a reclassification be denied based on the determination that it's more of the same work. No additional information has been submitted. The Commissioners need additional time. Commissioner Discussion • Cmmr.Neatherlin discussed his observations of the permitting process and why he supports the recommendation of moving the Permit Manager office to the front. He is also supportive of empowering front counter staff to have limited approval power for certain permits to expedite the process. Cmmr. Shutty shared his concerns with the permitting process and he noted that at the previous briefing,the Commissioners did support allowing additional approval authority of certain Board of Mason County Commissioners' Briefing Meeting Minutes January 27,2020 staff to expedite the permitting process. There was also discussion of implementing a LEAN process. Commissioners Shutty and Trask would like an update on the status of various items that have been presented and approved. Cmmr.Neatherlin will contact Community Development and a briefing with that department may be scheduled in a couple of weeks. The briefing meeting recessed at 12:40 p.m. 2:30 P.M. Support Services/Enterprise 4 Equity Commissioners Trask,Neatherlin and Shutty were in attendance • Frank provided information on the CDBG Microenterprise Loan Program which staff has recommended the County not move forward with the$200K grant from Department of Commerce to create a revolving loan program because there is too great a risk from an internal control perspective. • Lisa Smith,E4E,provided information on those participants in the training program who could be eligible for a microloan. Lisa stated E4E has been managing USDA microloans for a number of years by using a loan committee and they provide technical assistance. Lisa stated this funding is a grant from the State and the County doesn't have to pay it back,if the lenders default. Cmmr.Neatherlin stated there is concern with county staff has the capacity to manage this program and there is risk to the County. It was noted that this is a revolving loan so the management would go on for years and the County doesn't have the staff capacity. Lisa asked the County to reconsider and accept this funding for a microloan program for the two- year period and see what the impact is to staff. The Commissioners stated there has been a lot of consideration of this issue and will move forward with terminating this grant. Lisa asked if we can move forward with continuing the Technical Assistance and can the$75K be issued as grants. Staff will have to check with Department of Commerce. 2:45 P.M. Support Services—Frank Pinter Commissioners Trask,Neatherlin and Shutty were in attendance • Review of proposed changes to Courthouse. Kelly Frazier has met with the Judges to discuss minor changes that will improve the function and security of the courtroom. The estimated cost is $10,000 and can be paid from the REET fund. The Commissioners approved moving this forward. • REET 2 improvements to MCRA Park Host House were presented by Ross and the Commissioners approved moving this forward. • Letter of Support for PUD I grant application will be placed on the January 27 agenda. • Cmmr. Shutty would like to establish a Standardized Employee Performance Evaluation Process which reduces workplace liability. Staff will bring back additional information and this may come before the Audit Committee so it can be implemented county-wide. 3:15 P.M. Briefing Summary 1/29/2020 RELEASE OF ALL CLAIMS For and in consideration of the sum of Thirty Thousand Dollars ($30,000.00), Bradley Carey and the foregoing person's heirs, executors, administrators, successors and assigns (hereinafter collectively referred to as "releasors"), do hereby release and forever discharge Mason County, Washington, a municipal corporation, and its officers, representatives, insurers, attorneys, agents, employees, representatives, departments, and assigns, (hereinafter collectively referred to as "releasees"), from all claims, demands, damages, costs, expenses, liens, actions or causes of action, regardless of the nature of damage or injury, growing out of or in any way related to the injuries or damage claimed to have been received as a result of the matters alleged or which could have been alleged under Thurston County Cause 20-2-00081-34, including but not limited to all future damages, lawsuits, injuries and expenses related to such matters. PURPOSE The purpose of this Agreement is to define and fund judicial services provided by Superior Court for those individuals involuntarily detained to Mason County due to their mental disorder per chapters 71.05 and 71.24 RCW. 2. DURATION OF AGREEMENT This Agreement shall become effective on date signed by both parties to this Agreement, and shall terminate on December 31, 2020, unless otherwise amended. 3. SERVICES Services to be provided are those defined in chapters 71.05 and 71.24 RCW. Location of Involuntary Treatment Court will be at the Mason County Evaluation and Treatment Facility in addition to those judicial services provided at the Mason County Courthouse. This location is: a. Mason County Evaluation and Treatment Facility 307 West Cota St, Shelton, WA 98584 The Court shall operate two to three days a week or as necessary to meet the statutory requirements. Days and hours shall be determined by TMBHO, the Treatment Provider at the Court location and Superior Court. Additionally, at this site, the judges of the Mason County Superior Court by majority vote may authorize mental health commissioners, appointed pursuant to RCW 71.05.135, to perform any or all of the following duties: a. Receive all applications, petitions, and proceedings filed in the Superior Court for the purpose of disposing of them pursuant to this chapter; TMBHO &Superior Court Interlocal Agreement draft One 21 , , b. Investigate the facts upon which to base warrants, subpoenas, orders to directions in actions, or proceedings filed pursuant to this chapter; c. Provide such supervision in connection with the exercise of its jurisdiction as may be ordered by the presiding judge; and f. Funding Funding for these court services shall be based on the cost of direct services as described in chapter 71.05 and 71.24 RCW provided by Superior Court and any additional staff support necessary to perform these services. Direct service staff time shall be documented and submitted with each invoice. Total amount shall not exceed $50,000 annually based on historical actual court costs. Thurston Mason BHO reserves the right to withhold payment until such time that adequate back up documentation is provided to support the invoice. Funding level and capacity will be reviewed every six months to adjust for actual cost. If necessary, $25,000 is approved for actual costs including costs associated with supplies, equipment, trials, jury expenses and other actual expenses, and these expenses shall be verified through documentation. 5. NONDISCRIMINATION TMBHO, its assignees, delegates or subcontractors shall not discriminate against any person in the performance of any of its obligations hereunder on the basis of race, color, creed, ethnicity, religion, national origin, age, sex, marital status, veteran status, sexual orientation or the presence of any disability. Implementation of this provision shall be consistent with RCW 49.60.400. 6. WITHDRAWAL Any party hereto shall have the right to withdraw from this Agreement at any time, PROVIDED that the remaining party to this Agreement shall have received written notification of the other party's intention to withdraw at least 120 days prior to the proposed effective date of such withdrawal; and PROVIDED FURTHER, that such notification is received at least 120 days prior to the expiration of the current fiscal year period. PROHIBITION AGAINST ASSIGNMENT The obligations and duties under this Agreement shall not be assigned, delegated, or subcontracted to any other person, firm or entity without the prior express written consent of the TMBHO. 8. This Contract has been and shall be construed as having been made and delivered within the State of Washington, and it is agreed by each party hereto that this Contract shall be governed by the laws of the State of Washington, both as to its interpretation and performance. b. Any action at law, suit in equity, or judicial proceeding arising out of this Contract shall be instituted and maintained only in any of the courts of competent jurisdiction in Thurston County. 9. SEVERABILITY a. If a court of competent jurisdiction holds any part, term or provision of this Agreement to be illegal, or invalid in whole or in part, the validity of the remaining provisions shall not be affected, and the parties' rights and obligations shall be construed and enforced as if the Agreement did not contain the particular provision held to be invalid. b. If any provision of this Agreement is in direct conflict with any statutory provision of the State of Washington, that provision which may conflict shall be deemed inoperative and null and void insofar as it may conflict, and shall be deemed modified to conform to such statutory provision. 10. COUNTERPARTS This Agreement may be signed in counterpart or duplicate copies, and any signed counterpart or duplicate copy shall be equivalent to a signed original for all purposes. This Agreement shall be effective upon its execution by the two named Parties. 11. FILING OF AGREEMENT A copy of this Agreement shall be filed with the County Auditor of Mason County or, alternatively, listed by subject on a public agency's web site or other electronically retrievable Public source, as required by RCW 39.34.040. 12. The initial contact was to inquire if any permitting was required through the County. She contacted the department again in January to indicate that the design process had progressed significantly and that she was in the process of getting the project approved and sponsored by the Habitat Program at WDFW as a Fish Habitat Enhancement Project (FHEP). In order for her and her colleagues to move forward they need to complete the JARPA and APPS forms. Mason County is the property owner and thus the signature(s) they require to proceed. Project: The Washington Department of Fish and Wildlife has a concrete and wood structure at the outlet of Haven Lake that has been in place since the mid 1950's, this structure controlled the lake levels and restricted fish movement. This structure is located on County land that allows public access to the lake.The overall project WDFW is proposing is to replace the old concrete and wood structure with a channel to allow fish passage. The substrate of the channel will be sized to remain stable at high flows as the current culvert near and under NE Haven Way is listed as a barrier to upstream fish movement. The project will eliminate an aging structure and restore full fish passage in and out of the lake. Further construction details are outlined in the JARPA and drawings. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Mason County Board of Commissioners the Perishable Property Trust Fund is dissolved and the Treasurer is hereby directed to close all accounts associated to this fund and Mason County Code Chapter 3.68 be rescinded.
