We are notifying you because some of these whales occur in state waters adjacent to your county, and we would like to invite comments from you on our proposed rule. On September 8, 2016, we published a final rule that revised the listing of humpback whales under the ESA. In that rule we removed the range-wide listing of the taxonomic species, listed four DPSs as endangered, and listed one DPS as threatened(81 FR 62260). The listing of multiple DPSs of humpback whales under the ESA triggered the requirement to designate critical habitat,to the maximum extent prudent and determinable, for those DPSs of humpback whales that occur in areas under U.S.jurisdiction—specifically, the Mexico, Central America, and Western North Pacific DPSs. Section 4(a)(3)(A) of the ESA requires that, to the maximum extent prudent and determinable, critical habitat is designated at the time of listing (16 U.S.C. 1533(a)(3)(A)). In the final rule to list the five DPSs of humpback whales,we concluded that critical habitat was not yet determinable and thereby extended by one year the statutory deadline for designating critical habitat (16 U.S.C. 1533(b)(6)(C)(ii)). The proposed critical habitats for the three DPSs of humpback whales are within coastal waters off Alaska, Washington, Oregon, and California. All areas included in the proposed designation serve as humpback whale feeding habitat and contain prey species essential to the conservation of the whales. Once critical habitat is designated through a final rule, Federal agencies would be required to comply with section 7 of the ESA to ensure that any actions they authorize,fb ad, or carry out will not result in the destruction or adverse modification of the critical habitat. While non-Federal entities that receive Federal funds, authorizations, or permits from a Federal agency may be indirectly affected by the designation of critical habitat, the legally binding duty to avoid the destruction or adverse modification of critical habitat rests squarely on the Federal agency. ® Printed on Recycled Paper OF For a detailed description of the proposed critical habitat,please refer to the enclosed proposed rule and associated maps. Public Works—Loretta Swanson Utilities&Waste Management Commissioners Shutty,Trask and Neatherlin were in attendance. • Private Line Occupancy permit for Vince and Lisa Van Parys.No questions or issues from the Board. • Loretta discussed franchise agreements,noting that they are working on changing language to allow up to three extensions with review.The Board was in favor of this change. • Loretta announced that Public Works was awarded around$800,000 for projects from the Highway Safety Improvement Program(HSIP). • It was requested to advertise for an administrative assistant with Public Works since Kathy Cary is retiring. She is asking to post early so training can be done with Kathy.Loretta also announced that a combined sewer water operation position is going to be opening as she received a letter of resignation. • Free Dump Day- 148 vouchers were redeemed and Loretta said she would be returning with additional information and suggestions for 2020 at a future briefing. • Cmmr.Neatherlin said he received a call from a constituent at Maggie Lake about dirt from the County being poured into a ravine,and asked Loretta to look into it. 9:30 A.M. Community Services—Dave Windom Commissioners Shutty,Trask and Neatherlin were in attendance. • Kell Rowen talked about Title 16 and the updates necessary to"clean"the language to comply with the law. She said she would like to set a hearing on October 22,2019 to consider these updates. Cmmr.Neatherlin voiced concern with the changes affecting land value and asked to have more discussion at another briefing to talk about concerns and possible remedies.Kell noted that in the last update a section was removed that directly impacted PUD #3.She asked to at least hold the hearing to add 16.36.010(b)(5)back in.The Board approved the hearing for this addition. • Public Benefit Rating System-Kell and Patti McLean talked about an assessment done on those in open space to determine if PBRS was a better option.Kell recommended keeping the Open Space program,suggesting that the Planning Department work closer with the Assessor's office.Patti noted that those in Open Space need to have their parcel re-examined every six years when the Assessor's go onto the property for valuation.She said that while assessing parcels,she found that there are a few parcels that are no longer compliant. • Michael MacSems asked for approval to sign a grant contract with the Washington Department of Archeology(DAHP)to send a minimum of three Historic Preservation Commission(HPC)members to the national HPC conference in Tacoma in July 2020. • Casey Bingham asked to place a contract between Public Health and the Health Care Authority contract through 2021 on the agenda for approval. • Todd Parker received a call from Steve at North Mason Resources regarding a funding appropriation request he made at the July 22,2019 briefing.He asked to have the allocation re-evaluated and asked where the Board was on this decision.Cmmr. Shutty noted the fact that they did have a discussion at briefings,but did not feel as though the Board agreed to move forward with an evaluation.No action will be done at this time. • Dave Windom said there is a very qualified candidate for the Fire Marshal position.He also noted that there are two resignations that were recently given to him from Public Health. • The All Staff meeting will be at the end of October and a news release will be put on the agenda to announce the date. Board of Mason County Commissioners'Briefing Meeting Minutes September 23,2019 10:00 A.M. Support Services—Frank Pinter Commissioners Shutty,Trask and Neatherlin were in attendance. • Jennifer Beierle spoke about the budget supplemental and amendment process,noting that per Cmmr.Neatherlin's previous request,the grand totals were listed instead of each item. She asked how to move forward on any future budget supplemental hearings.It was decided that staff should read each transfer as part of the presentation,and it should be available either via projection or via handout for those in attendance. • Ross McDowell discussed a Continuity of Government Planning for Rural Jurisdictions training being held Thursday,November 7,2019 at the Public Works Building.He talked about the importance of this training. • CTG service agreement for the Jail control panel and jail doors-Ross spoke about the difficulty of locating service providers in the northwest.He said due to the panel,they may need to do a sole source contract in order to have it repaired. This is an annual agreement and will be brought forward for approval. • Review of proposed County Vehicle Lease Request for Proposals which will be placed on next Tuesday's agenda. • Permission was granted to post and hire the Administrative Secretary position in Support Services that will be vacated. 10:30 A.M. State Auditor Office Exit Conference—Chelcie Robinson Commissioners Shutty,Trask and Neatherlin were in attendance. • Chelcie presented the 2018 Accountability and Financial Audits. Mason County continues to have a Finding for the Belfair and Rustlewood sewers due to their declining financial conditions putting the utilities at risk of not meeting their financial obligations. Chelcie then reviewed the exit items. Chair Shutty was authorized to sign the exit letter. Open Forum for Citizen Input— 5.1 Oliver Chapman spoke about unsafe driving practices done by the Sheriff's department when driving. He noted that this is not when they are responding to calls, but instead pulling out of the lot to do general travels. He asked to cut the Sheriff's budget in response to this issue. 5.2 Kathy McDowell spoke on behalf of the Lions Club who is holding a fundraiser to put in basketball hoops across from the civic center in the newly paved area. 5.3 Ken VanBuskirk talked about the most recent TIP-CAP meeting he attended regarding the 6-year plan. 5.4 Undersheriff Travis Adams spoke in response to Mr. Chapman's comments. He noted the accreditation received by the office stating that the accreditation takes driving records into account. The Undersheriff said that Mr. Chapman has not only sat out and watched staff but has also confronted staff in public locations including the grocery store. Other Business (Department Heads and Elected Officials)- 9.1 Undersheriff Adams thanked the Board for signing the contract for jail maintenance. 9.2 Dave Windom announced that Mike Six was hired as the new Mason County Fire Marshal. 10. 9:15 a.m. Public Hearings and Items set for a certain time— 10.1 Public Hearing to consider adoption of a Public Benefit Rating System (PBRS) in place of the current Open Space Program. This hearing is continued from July 16, 2019. Staff: Kell Rowen Kell gave a brief history of Open Space, noting that about half of the counties in Washington currently use this program. She spoke of the work done with the Assessor's office to audit those in the program. Kell discussed the findings of the audit and recommended that the Board keep the Open Space system in lieu of adopting the PBRS. She noted that the PBRS would not bring any added benefits to the County. An unknown gentleman asked if those who were audited knew. Kell said they were notified via letter and onsite visits. Tom Davis asked how many volunteered for the audit. Kell said 20 properties were volunteered. Another unknown gentleman questioned the dollar difference. Kell noted there was not a set answer as there are many differences in amounts due to the location of the property, district, and levies. He then asked how many hours were spent assessing the information. Kell did not have a specific answer, but estimated 20 hours of her own time. It was questioned why the county hasn't been assessing the parcels in the Open Space program in order to make sure they stay in compliance. Cmmr. Shutty said that they were waiting to determine which program the County would use and can now look at regular reviews and enforcement if necessary. Public Comment: Terry Hogan said he was happy with the recommendation to keep Open Space as is. Tom Davis, who is not enrolled in the program, spoke about the ease to meet the minimum requirements. He read from a report from Community Services (date unknown) about the fact that there is no value to the community and gives open space landowners an oversized discount. Tom said that those who have actual unimproved vacant land can be enrolled. If the land is improved and you live on it, the people are paying your property taxes, which is unfair. Nikki Zimmerow spoke in favor of leaving Open Space as is. She praised the work done by the Assessor's office.
