EXECUTIVE SUMMARY : Annually, the County Engineer reports the current
status of all county bridges to the Board of Mason County Commissioners, as a
requirement of Washington Administrative Code (WAC) 136 - 20-060 , and
recommends the Board update the Resolution on Bridge Limits .
An inspection of the 64 bridges in Mason County has been completed . It has
been determined that bridge 1 needs to be posted with maximum load limits and
2 through 6 as one lane travel bridges .

the Resolution establishing load/ lane limits for traffic control on six ( 6) Mason
County bridges .

RESOLUTION NO. 49
BRIDGE LIMITS
WHEREAS, RCW 36.75.270 gives the Board of Mason County Commissioners the authority by resolution
to limit or prohibit classes or types of vehicles on any county bridge and may limit the weight of vehicles which may
travel thereon.
WHEREAS, In compliance with the requirements of the Federal Highway Administration's National
Bridge Inspection Standards (NBIS) for specialized haul vehicle regulations, updated bridge load ratings have been
completed as required; and
WHEREAS, load ratings have determined that one (1) of Mason County's sixty-four (64) bridges shall be
posted with a maximum load limits, and
WHEREAS, five (5) of Mason County's Sixty-four (64) bridges shall continue to be posted as one lane.
NOW, THEREFORE, BE IT RESOLVED, that these restrictions be posted, as listed below, for the 2019
calendar year, unless the Board shall modify or remove such restrictions based upon the recommendation of the
County Engineer.

EXECUTIVE SUMMARY: The Mason County Fire Marshall is proposing amendments
to the Mason County Code Title 14, Chapter 14 . 17 , to include regulations relating to
Fire Apparatus Access Roads consistent with the International Fire Code ( IFC) .
The Planning Advisory Commission held a public hearing to consider this request on
January 28, 2019 . They recommended approval to the BOCC . This briefing is for the
Notice of Hearing to be published in the Journal .
BUDGET IMPACTS : None
RECOMMENDED OR REQUESTED ACTION : Approval to set a Public Hearing for
March 12, 2019 to consider amendments to Title 14 .

14. 17.0 10 - This Ordinance shall apply to roads, driveways, or other means of access serving structure,
facilities, buildings or portions of buildings hereafter constructed, altered, moved into or within the jurisdiction
and
developed under permit from Mason County.

14. 17.020 - Plans for fire apparatus access roads shall be submitted to the fire marshal for review and approval
prior to construction.
14. 17.025 - Before issuing a permit, the Fire Marshal is authorized to, and may examine, or cause to be
examined buildings, structures and sites for which an application has been filed to determine compliance
requirements for the purpose ofproviding a reasonable level of life safety and property protection front hazards
of fire, explosion, or dangerous conditions in new and existing buildings, structures, and premises, and to
provide safety to fire fighters and emergency responders during emergency operations. The inspection fee will
be as set forth in the adopted fee schedule by Mason County for site inspections/site investigations.
14. 17.030 - When required by the Fire Marshal, approved signs or other approved notices shall be provided and
maintained for fire apparatus access roads to identify such roads and prohibit the obstruction thereof.
14 . 17.040 - Roadways shall be constructed/designed with an all-weather driving surface (gravel, crashed rock,
concrete or asphalt) and the ability to support the imposed load requirements of fire apparatus.
14. 17.050 - Fire apparatus access roads shall extend to within 15041. of all portions of the exterior wall of any
residential or commercial structure, and within 50-ft. of at least 25% of the exterior wall of any commercial
structure,
14 . 17.060 - A fire apparatus access road shall be a minimum unobstructed width of 20-ft. for commercial
structures, or 4 or more parcels or building sites. Tile access road may be reduced to 12-ft. of unobstructed
width with a minimum I0-ft.wide driving surface for 1 -3 parcels or building sites on approval of the Fire
Marshal.
14. 17.070 - A fire apparatus access road shall have an unobstructed vertical clearance of not less than thirteen
feet and six-inches (13 '6") for the fill width of the road.
14. 17.080 - A 10-ft.wide fire apparatus access road exceeding 300-ft. in length will be required to make
provisions for ilre passing of fire apparatus by providing approved pullouts. Pullouts shall be reasonably
located, based on sight distance, road curvature, and grade; and shall be a minimum size of 8-ft.wide and 30-ft.
long with tapered ends.
14. 17.090 - A dead end fire apparatus access road longer than 3004 is required to provide provisions for the
turning around of fire apparatus within 15041ofany facility or structure. See exldbit A — Hammer_Head Tum
Around, B — Modified Hmumuer Head, C- Cul De Sac Turn Around, D & E — Pullouts, for examples of accepted
turnarounds and pullouts. _
14. 17. 100 - The turning radius of afire apparatus access road shall be a minimum of 25-4.imterior, 45-fl.exterior
centerline radius.
14. 17. 110 - A fire apparatus access road, which is newly constructed or existing, and which is in excess of 14%
grade, and which is greater lbnn 15044. from a primary access point intersecting with a County or Slate road
Right of Way, to newresidential or commuercial structures will require an automatic fire sprinkler system to be
installed.
14. 17. 120 - Where more than 50 units are designed in a residential development, either single family,
multifamily, retirement or similar, there shall be a minimum of two access points to (lie county road system.
Such access points shall be located so as to provide for general circulation, alternate emergency vehicle access
routes, through access, and general transportation design considerations. One of these access points may be for
emergency vehicle use only where the number of units does not exceed 100. Design of an "emergency vehicle
use only" access must be approved by the local fire district and Fire Marshal.
14. 17. 130 - When buildings are completely protected with an automatic fire sprinkler system, the provisions of
these standards maybe modified by the Fire Marshal.
14. 17. 140 - When a bridge is required as part of a fire apparatus access road, it is to be constructed and
maintained in accordance with nationally recognized standard. It shall have designed live loading capacity
sufficient to carry the Imposed load of fire apparatus. An evaluation by a professional engineer will be required
to determine the imposed load rating for all of the responding fire districts fire apparatus and shall be approved
by the Fire District and Fire Marshal. The load riling of flue bridge shall ba posted in an approved location with
an approved weather resistant designed sign.
14. 17. 150 - When access roads cannot be installed to these standards due to topography, waterways,
nonnegotiable grades or other similar conditions, the Fire Marshal is authorized to require additional fire
protection or mitigation as specified in Section 1001 .9 of the UFC (See 2006 IFC 901 .4.3). The Fire Marshal
may also approve access roads that do not meet these requirements if flue road provides reasonable access under
the individual facts of the case.
14.17. 160 - Approved numbers or addresses pertaining to any and all new commercial or residential buildings
shall be placed consistent with Chapter 14.28, Addressing Ordinance.
14. 17. 170 — Traffic calming measures on fire apparatus roads (speed bumps, etc-etc.) shall be approved by the
Fire Marshal before installation.

Situation
Last week I presented a proposal to develop a process by which permits could be expedited .
While presenting this at staff round table it was noted that the plan relied on a voluntary
overtime element which may not be practicable . We are looking at two maternity leaves
happening this spring/early summer and EH has only one technician reviewing building permits .
We do not have staffing levels right now to allow timely processing of permits so adding an
expedite service may not be possible .
Background
Current building review times are as much as six weeks at winter time volumes and we foresee
times becoming longer as the building season starts . The building division currently has no
dedicated plans examiner, building inspectors are expected to review plans and conduct field
inspections . Our last lead plans examiner was laid off in either 2008 or 2009 and has not been
replaced in the intervening time period .
Environmental health has one person working permit review . Last year when we moved Alex to
management, we did not replace his position though it is still on the books and in the budget .
Planning is able to keep up with current volume but we' ll be losing one staff member to
maternity leave just as the building season gets underway .
Analysis
Environmental health is probably the easiest to address . We have the position on the books and
just need to open and fill . We have around $ 20, 000 in the budget available to support this
position . Part of the funds that supported this position were moved to support a partially grant
supported water quality position .
The lead plans examiner is in the union contract but not on the books, so to speak . This would
give us some time to fully determine the duties of plans examiner and to re -write the job
classification . An option would be to hire a building inspector 3 or 4 with the job assignment of
plans examiner . We are currently lookfng at how far the recent fee increase will go to covering
the additional cost .

ITEM : Update on the Mason County Parks & Recreation Advisory Board
EXECUTIVE SUMMARY : ( If applicable, please include available options and
potential solutions) :
On January 24, 2019 there was a meeting for the MC Parks & Recreation Advisory
Board with a quorum to have a meeting . Prior to that, the last meeting with a quorum
was July 26, 2018 .
The 2019 election was conducted and the Chair is Mary Miller and Vice Chair is Mendy
Harlow . A discussion about meeting attendance occurred and I was asked to send a
letter of inquiry to 2 members that lacked attendance asking them of their
membership status . The advisory board stated that they will come to the BOCC with
recommendations for removal if the 2 member do not respond positively to the
inquiry .
The Parks & Recreation Advisory Board asked if a conference call option was available
at MCRA for meeting , which it is on our new phone system . They are going to bring
this topic up at the next meeting asking to change their by- laws to include the option
of a conference call option for the meeting attendance .
At the July meeting , the Parks & Recreation Advisory Board was asked to review the
Parks & Trails Comp Plan and pick out their top three parks/trails projects that they
would like to see prioritized for 2019 . The board 's suggestions were unanimous ;
1 . Coutler Creek Park — improve the trails & a boardwalk
2 . Oakland Bay Park — expand the trails & bird watching area
3 . Foothills Park — general maintenance overhaul of the park
The board also suggested that they perform a " park tour" of all of the Mason County
parks to get a better feel for what is here . The first of three " park tours" will be
conducted on Saturday, March 30th starting out at MCRA and will cover Shelton ,
Matlock and Hoodsport areas . The second tour date is still TBD .

The next meeting of the Parks & Recreation Advisory Board will be March 7th taking
place at the Salmon Center in Belfair by vote of the members . This will give the
members from the north end of the county a break from the long drive . The meeting
will start at 6 : 00 PM . A notice will be sent out to the public of the change of meeting
venue and time for this meeting .
BUDGET IMPACTS :
Ross will be securing a van from the County fleet to perform these " park tours " and
will charged it to Parks & Trails budget — no need for a supplement .

ITEM : Seasonal Maintenance Help positions for Mason County Parks & Trails
Department
EXECUTIVE SUMMARY : ( If applicable, please include available options and

Annually, the Parks and Trails Department recruits seasonal maintenance help during
their busy season in the summer . The seasonal help will provide assistance with
grounds maintenance, field_ set ups and general assistance to citizens using the parks .
The seasonal helpers work schedule will be flexible with an emphasis on evenings and
weekends to extend the coverage of a county staff member in the parks . Seasonal
Maintenance help positions have staggered starting dates, March 16, April 1 and April
16 and therefore have staged ending dates of July 31 , August 15 and August 31 .
The Human Resources Department will handle job announcement and the job
applications for these temporary positions .
BUDGET IMPACTS :
The 2019 Parks & Trails budget ( 146 ) has $ 30, 000 in salaries for extra help which will
be used to fund these three positions .

EXECUTIVE SUMMARY : The department is asking the BOCC to support the Clerk' s
office restructuring in order to implement solutions to fix the findings levied on this
office . The finding identified two systemic problems , one , not enough training and
second not enough staff to manage responsibilities . The solution is already being
implement which is :
The Jury / Records Manager is being trained to perform the duties of the Chief Deputy
Clerk until her retirement on June 30 , 2019 . This will take a Working Out of Class
Salary adjustment . A Judicial Support Specialist I will take on some of the
responsibilities of the Jury / Records Manager during this same time period and will
need a Working Out of Class Salary adjustment , as well .
Promote from within from a Judicial Support Specialist I to a Judicial Support Specialist
II a qualified candidate to address more technical responsibilities regarding internal
controls implementation .
Request a . 5 FTE to be permanently added to our staff as a Judicial Support Specialist
I to be responsible to learn all functions of that position but most importantly to be able
to catch up on ALL the filing that has been unable to be performed given our current
staffing and volume levels .

Dear Commissioners :
We are pleased to present this Letter of Intent to the Board of Commissioners for Mason County.
It is our intent to develop a Fair Grounds and event center in Mason County. We envision a
facility that would attract people to Mason County, while providing a community-building center
and have a collaborative economic effect on the entire community.
As a Mason County homeowner, I have owned a home on North Shore for over 20 years . I feel
the community need, and I feel the timing and market is ready for a multifaceted facility that will
only add to the continued creation of Mason County as a premier recreational destination .
Recitals :
It is understood by both parties that following are the driving forces in facilitating this
transaction :
-Whereas, Mason County has suffered economically over the recent years, and
-Whereas, Mason County currently does not have a common gathering area or fairgrounds to
hold community events, and,
-Whereas, Mason County needs a rehabilitation and resurgence in outside community service
organizations i. e . Grange,4H, FFA, Historical Society and more, and
-Whereas, Mason County seeks to bring an entity to the community to enhance the community
and foster economic growth, and,
-Whereas, the potential Lessee has the knowledge, experience, and financial capability of
developing a community facility, and
-Whereas the potential Lessee understands that the requested parcels would be subject to the
receiving a conditional use permit from Mason County, then,
On behalf of AF investments , LLC and/or assigns ("Lessee"), we are pleased to submit this
Letter of Intent ("LOI") to Mason County (Lessor") to Lease the real property commonly
known as Tax parcel # 420043060000 and acquire an easement on Tax Parcel # 420044060000
("Property") , including but not limited to all related rights and . interests further described herein.
Any lease of the Property by Lessee will be pursuant to a formal written Lease agreement
("lease ") , which would, among other things, contain the following salient terms and conditions :
• Pro e : The Property known as 420043060000 and an easement on the southern
portion of parcel number 420044060000, consisting of approximately 14 acres .
• Lease Price : $ 1 . 00 per month for 30 years.
• Payment Terms : Entire Lease payment will be payable at the removal of all lease
contingencies .
Contract Preparation: Within Thirty (30) Days after execution of this LOI, Lessee will
provide the Board of Commissioners a draft business plan for the development of the
Mason County fairgrounds . Lessor will have 15 days to review the draft business plan
and notify the Lessee of acceptance . Within 30 days following busimess plan
acceptance, Lessee will provide Lessor a draft LEASE . Each party shall work
diligently to negotiate in good faith and sign the LEASE within thirty (3 0) days of
Lessor ' s receipt of the LEASE. To assist in preparing the draft LEASE, Lessor shall
furnish copies of the following preliminary due diligence documentation :
• Most recently obtained boundary and/or as-built survey;
Most recently obtained as -built and/or architectural drawings ;
• Most recently obtained Phase I & 2 environmental site assessment;
• Most recently obtained physical inspection report;
• Any other agreements that run with the land.
Due Diligence: Lessee will have a ninety (90) day Due Diligence Period starting upon
receipt and delivery of a fully executed LEASE and written receipt and approval of all
Due Diligence material requested by Lessee .
• Due Diligence Extension: Lessee will have the ability to extend Lessee ' s due-
diligence for two periods of thirty (30) days each.
• Lease Execution: Lease execution shall occur no later than thirty (30) days after
Lessee ' s satisfaction and waiver of Lessee ' s Due Diligence
•
Closing Costs Responsibility: Lessee to pay the cost of its legal counsel and third-
party consultants . Lessor to pay the costs of its legal counsel, if needed.
• Parking: Mason County will be granted one Dollar ($ 1 . 00) for every paid parking spot
on the facility during special events . These proceeds are to be designated for
maintenance and Fair Grounds expansion
• In order to facilitate the construction and development of the Property, Lessee will
have all rights to selectively harvest the timber needed to open and improve the
facility, as well as the right to any materials, including the aggregate on-site to
facilitate the improvements .
• Lessee, over a time period to be established under the terms and conditions of the
lease, shall construct all improvements including clearing and grading, septic and
water systems, electrical systems, storm drainage systems, buildings, event centers,
concessions and grandstands, offices, maintamence and operation centers .
• Lessor shall appoint an ombudsman to work as the point person of contact to facilitate
and assist Lessee with the conditional -use process and permitting processes .
• Proposed Fairgrounds facility buildings shall consist of Event Pavilion, Horse Arena,
Horse barn, Cattle/Sheep barn, Goat/Swine barn, Grange Building/ Safety Building,
Fowl Building, horse warm-up area, necessary sanitation facilities, concession areas
and parking areas . Other proposed building could include Mason County Historical
Society and other community oriented buildings .
• Facility will contain a 1 /4-mile dragstrip to facilitate investors financial return and be
the driving force bringing participants and spectators to Mason County, generating
county-wide taxable revenues .
Exclusivity: Upon execution of this LOI, Lessor grants Lessee the exclusive right to negotiate
the LEASE for the acquisition of the Property.
With the exception of the Exclusivity provision above, it is expressly understood that this LOI
does not constitute a legally binding contract between the parties hereto but is intended only to
outline the terms and conditions under which both parties would negotiate in good faith to enter
into a LEASE for the Property. No binding contract or obligation between the parties shall exist
until the parties have executed and delivered the LEASE, which will be drafted promptly by

Commissioners Neatherlin, Drexler and Shutty were in attendance.
• Tim Pavolka presented a proposal to develop a fair grounds and event center on county parcel
42004 30 60000 . The request is to sign a non-binding Letter of Intent to explore the proposal.
The intent of the meeting is to discuss the proposal.
Cmmr. Neatherlin pointed out the county has no mineral rights on the proposed property; the
county does have timber rights .
Cmmr. Drexler stated that for any type of lease agreement, the county would need to go out for a
request for proposals . Tim Whitehead stated there would be a competitive process to obtain the
highest and best benefit to the public of this parcel.
This property is Public Works owned.
Cmmr. Shutty asked why they don't build a drag strip somewhere . His concern is how does this
pencil out on the county side; the county financially struggles and to potentially start a fair, how is
it run and financed.
Mr. Pavolka stated they are proposing a joint public/private venture; it' s hard to justify having
only a drag strip . The proposal is for a combination of a drag strip, fairgrounds, camp grounds and
the ability to use the site for a variety of uses . Mason County is becoming more of a recreational
area. This would be a non-profit fairgrounds; there are a number of fairgrounds that also include
some type of racing.
Rahn Redman expressed support of the proposal to improve the community and provide
something for the youth to do by participating in 4-11 at the fairgrounds .
Walt Austin stated by developing a combined facility, it is financially feasible. This could end up
being the only drag strip in Washington.
This differs from The Ridge because it' s a multi use facility that includes accommodating
spectators .
Mr. Pavolka stated there is a multitude of issues that will need to be explored and believes it is a
viable location for this type of proposal.
Cmmr. Neatherlin stated he has a desire to explore this proposal and stressed that he has no desire
for the county to run a fairgrounds or invest any money into this proposal. He noted there is a
latecomer process with the City of Shelton that is extremely expensive to hook up to the water
system.
Cmmr. Shutty stated they need to have a conversation with legal staff.
Cmmr. Drexler stated they need to explore all potential uses of the property. Questions she has -
How much of the property could be disturbed since it' s adjacent to the landfill; Why not just
surplus the property and sale the property.
Mr. Pavolka responded the property could be surplused and sold but their proposal is a long term
lease . They are developing a 5010 nonprofit. They would ask for a county ombudsman to work
with. They would need a title search and find out who has the mineral rights .
Mr. Austin stated this proposal would bring a hotel.
Cmmr. Drexler pointed out this area would need a rezone. There would be a public weigh-in on
whether to go forward with a rezone.
Mr. Redman stated this parcel is long term commercial forest and he has contacted a property
owner to swap another parcel that is long term commercial forest.
Cmmr. Neatherlin stated next steps will be for the County to look at other options; discuss the
proposal and then contact them for further discussion.
Cmmr. Neatherlin questioned if this would be considered spot zoning if zoned the same as Ridge
Motorsports and would that zone allow this type of proposal.
Cmmr. Drexler confirmed they have they talked to the Port of Shelton and the Port is not
interested. The abandoned runway is long enough for a drag strip .
Mr. Pavolka stated they are interested in locating in Mason County, not necessarily at this location
but feels it would work.
The Commissioners expressed interest in further exploration of the proposal.

SUBJECT: Mason County Public Works Eells Hill Property — Tax Parcel 420043060000
During the past 3-4 years different individuals have expressed interest in leasing or acquiring property
owned by Mason County Public Works south of Eelis Hill Road and the Ridge Motorsports Park, and west
of the Eells Hill Transfer station . The purpose of this memo is to summarize parcel information to
facilitate Board conversations about the potential future use of the property.
The property was originally acquired from Simpson Timber Company per Resolution No . 516- 91 and
purchased out of the Road Fund budget . ' Acquisition was based on an appraisal to determine fair
market value, which at the time was $ 1, 600 per acre x 98 . 18 acres = $ 157,088 . The intended purpose
was for an additional gravel source, although mineral rights were reserved by the State of Washington .
(See attached Statutory Warranty Deed . )
The Mason County Assessor information indicates a current market value of $ 247,415 or $ 2, 520 per
acre . The Department of Natural Resources provided a recent ballpark timber valuation of $500, 000 -
$ 1, 000, 000. It is unknown what it may cost to acquire mineral rights .
Public Works has no current plans to use the parcel for a gravel source or other purposes, other than
managing the timber for future sale. This future timber revenue will be needed as maintenance and
planned construction needs grow and outpace projected traditional revenue sources . For this reason ,
Public Works is hesitant to consider this as potential surplus property at this time .
If it is determined to be in the best interest of the County, however, to lease or surplus the property, an
appraisal report will be prepared to determine the "highest and best use" property valuation . Any lease
or sale agreement less than the appraisal report valuation is considered a gifting of public funds .
Any party wishing to lease or acquire the property should schedule a Pre-Application meeting with the
Department of Community Services . This meeting will inform the applicant of potential changes in land
use needed, permits, fees, and timelines associated with future development .
A 300400t buffer was acquired for the solid waste transfer station during the same time period per Resolution No . 51A-91 .

determine if the development will impact the southern end of the landfill and
any buffers that might be needed for the landfill .
In summary, the proposed lease amount does not adequately cover the fair market
value for an easement and timber rights to this property. There are also concerns
about the impacts on gas probes for the landfill . It is possible the land could be sold
outright to the proponent provided the concerns about the gas probes and landfill
are addressed . But the land would need to be sold at a fair market value that
includes the marketable timber value .
Attached with this letter is a map of monitoring wells and gas probes for the landfill
and a map of the transfer station property that shows the potential 14 acres in
question .
