8. Approval of Action Agenda: All items listed under the"Action Agenda"may be enacted
by one motion unless a Commissioner or citizen requests an item be removed from the
Action Agenda and considered as a separate item.
8.1 Approval to set a hearing for Tuesday, February 5, 2019 to receive public
comment on establishing an Honorary Road Sign Program allowing the County
and community the opportunity to honor individuals or organizations that have
made significant contributions to the County.
8.2 Approval to accept a resignation from James Pharris effective June 26, 2018
and to approve the Release and Hold Harmless Agreement to release and
forever discharge Mason County, its officers, agents, employees, agencies,
and departments from any and all existing and future claims, damages and
causes of action foreseen and unforeseen of any nature whatsoever arising
out of Pharris' employment with Mason County and to pay the sum of$40,000
as agreed.

Rocky Mountain Elk Foundation Olympia Chapter Big Game Banquet on January 19, 2019
at Little Creek Casino 91 W. State Route 108, Shelton WA 98584, and approval to
authorize the Chair to sign the letter of no objection to the WA State Liquor Control
Board.

Dear Randy Neatherlin,Terri Drexler, Kevin Shutty,
South Mason County Youth Soccer would like to acknowledge and recognize the
assistance that we have received from the outstanding team at Mason County Parks,
Facilities and Trails. We have recently embarked on a park improvement plan at South
Mason Youth Soccer Park. The project calls for the construction of an irrigation shed,
purchase and installation of a large booster pump and purchase and installation of an
irrigation system to support six soccer fields for our community's youth. All of the work is to
be accomplished with volunteer labor and donated equipment. As we worked through the
beginning of this project we had many questions about how to proceed as efficiently as
possible. The Mason County Parks, Facilities and Trails staff consisting of Ross McDowell,
Carl Olson, Bill Ells, Joseph Glaser and Anne Voice have been supportive and willing to give
advice and expertise as requested on design, construction, installation and maintenance.
We have constructed the irrigation shed and installed the first irrigation system and are
waiting on the arrival of the booster pump. The park improvement plan is proceeding and
we feel we would not have been able to get to this point without the efforts and support of
Mason County Parks, Facilities and Trails Staff. Please convey our sincere appreciation to
this fine group.

National Forest is accepting project proposals for funding through Title 11(Special Projects on Federal
Lands)of the Secure Rural Schools and Community Self-Determination Act.
The purposes of this Act are—
(1) to stabilize and transition payments to counties to provide funding for schools and roads that
supplements other available funds;
(2) to make additional investments in,and create additional employment opportunities through,
projects that—
(A)
(i) improve the maintenance of existing infrastructure;
(ii) implement stewardship objectives that enhance forest ecosystems;and
(iii) restore and improve land health and water quality;
(B) enjoy broad-based support;and
(C) have objectives that may include—
(i) road,trail,and infrastructure maintenance or obliteration;
(ii) soil productivity improvement;
(iii) improvements in forest ecosystem health;
(iv) watershed restoration and maintenance;
(v) the restoration,maintenance,and improvement of wildlife and fish habitat;
(vi) the control of noxious and exotic weeds;and
(vii) the reestablishment of native species;and
(3) to improve cooperative relationships among—
(A) the people that use and care for Federal land;
(B) and the agencies that manage the Federal land.
Funds available by County are: Clallam$121,602.20;Grays Harbor$52,575.73;Jefferson$109,245.90;
and Mason$42,427.75. Funds are also available for the Quinault Special Management Area: $1,980.90.
Proposed projects should be designed for completion or obligation of funds by September 2021,including
planning and environmental clearances. Only shovel-ready projects should be proposed for field
implementation in 2019. Title 11 Project Submission Forms are available at this office and on our website

Dear Mr.Neatherlin:
This is to formally notify you of the final flood hazard determination for the Unincorporated Areas of
Mason County,Washington, in compliance with Title 44,Chapter I,Part 67, Section 67.11, Code of
Federal Regulations(CFR). This section requires that notice of final flood hazards shall be sent to the
Chief Executive Officer of the community,all individual appellants,and the State Coordinating Agency,
and shall be published in the Federal Register.
On December 8, 1998,the Department of Homeland Security's Federal Emergency Management Agency
(FEMA)issued a Flood Insurance Rate Map(FIRM)that identified the Special Flood Hazard Areas
(SFHAs),the areas that would be inundated by the flood having a 1-percent chance of being equaled or
exceeded in any given year(base flood), in your community. Recently,FEMA completed a re-evaluation
of flood hazards in your community. On August 30,2016,FEMA provided you with Preliminary copies
of the Flood Insurance Study(FIS)report and FIRM that identify existing flood hazards in your
community, including Base Flood Elevations(BFEs)and revised Preliminary copies of the FIS report and
FIRM on May 31,2018. The proposed flood hazard determinations(FHDs)for your community were
published in the Shelton-Mason County Journal on July 27,2017 and August 3,2017,and in the Federal
Register, at Part 67,Volume 82,Page 23036,on May 19,2017.
The statutory 90-day appeal period,which was initiated on the second newspaper publication date cited
above,has ended. The proposed FHDs for your community were appealed during that time. All technical
data submitted in support of the appeal have been evaluated, and the appeal has been resolved. Therefore,
the FHDs for your community are considered final. The final notice for FHDs will be published in the
Federal Register as soon as possible. The FIRM for your community will become effective on June 20,
2019. Before the effective date,FEMA will send you final printed copies of the FIS report and FIRM.
Because the FIS establishing the BFEs for your community has been completed,certain additional
requirements must be met under Section 1361 of the National Flood Insurance Act of 1968,as amended,
within 6 months from the date of this letter. Prior to June 20,2019,your community is required,as a
condition of continued eligibility in the National Flood Insurance Program(NFIP),to adopt or show
evidence of adoption of floodplain management regulations that meet the standards of Paragraph 60.3(d
and e)of the enclosed NFIP regulations(44 CFR 59, etc.)by the effective date of the FIRM. These
standards are the minimum requirements and do not supersede any State or local requirements of a more
stringent nature.
It must be emphasized that all the standards specified in Paragraph 60.3(d and e)of the NFIP regulations

must be enacted in a legally enforceable document. This includes adoption of the current effective FIS and
FIRM to which-the regulations apply and other modifications made by this map revision. Some of the
standards should already have been enacted by your community in order to establish initial eligibility in the
NFIP. Your community can meet any additional requirements by taking one of the following actions:
• Amending existing regulations to incorporate any additional requirements of Paragraph 60.3(d and
e);
• Adopting all the standards of Paragraph 60.3(d and e) into one new,comprehensive set of
regulations;or
• Showing evidence that regulations have previously been adopted that meet or exceed the minimum
requirements of Paragraph 60.3(d and e).
Communities that fail to enact the necessary floodplain management regulations will be suspended from
participation in the NFIP and subject to the prohibitions contained in Section 202(a)of the Flood Disaster
Protection Act of 1973 (Public Law 93-234)as amended.
In addition to your community using the FIS to manage development in the floodplain,FEMA will use the
FIS to establish appropriate flood insurance rates. On the effective date of the revised FIRM, actuarial
rates for flood insurance will be charged for all new structures and substantial improvements to existing
structures located in the identified Special Flood Hazard Areas,the areas subject to inundation by the base
flood. These rates may be higher if structures are not built in compliance with the floodplain management
standards of the NFIP. The actuarial flood insurance rates increase as the lowest elevations(including
basement)of new structures decrease in relation to the BFEs established for your community. This is an
important consideration for new construction because building at a higher elevation can greatly reduce the
cost of flood insurance.
To assist your community in maintaining the FIRM,we have enclosed a Summary of Map Actions to
document previous Letter of Map Change(LOMC)actions(i.e.,Letters of Map Amendment,Letters of
Map Revision)that will be superseded when the revised FIRM panels referenced above become effective.
Information on LOMCs is presented in the following four categories: (1)LOMCs for which results have
been included on the revised FIRM panels; (2)LOMCs for which results could not be shown on the
revised FIRM panels because of scale limitations or because the LOMC issued had determined that the lots
or structures involved were outside the SFHA as shown on the FIRM;(3)LOMCs for which results have
not been included on the revised FIRM panels because the flood hazard information on which the original
determinations were based are being superseded by new flood hazard information;and(4)LOMCs issued
for multiple lots or structures where the determination for one or more of the lots or structures cannot be
revalidated through an administrative process like the LOMCs in Category 2 above. LOMCs in Category 2
will be revalidated through a single letter that reaffirms the validity of a previously issued LOMC;the letter
will be sent to your community shortly before the effective date of the revised FIRM and will become
effective 1 day after the revised FIRM becomes effective. For the LOMCs listed in Category 4,we will
review the data previously submitted for the LOMA or LOMR request and issue a new determination for
the affected properties after the revised FIRM becomes effective.
The FIRM and FIS report for your community have been prepared in our countywide format,which means
that flood hazard information for all jurisdictions within Mason County has been combined into one FIRM
and FIS report. When the FIRM and FIS report are printed and distributed,your community will receive
only those panels that present flood hazard information for your community. We will provide complete
sets of the FIRM panels to county officials,where they will be available for review by your community

The FIRM panels have been computer-generated. Once the FIRM and FIS report are printed and
distributed,the digital files containing the flood hazard data for the entire county can be provided to your
community for use in a computer mapping system. These files can be used in conjunction with other
thematic data for floodplain management purposes, insurance purchase and rating requirements, and many
other planning applications. Copies of the digital files or paper copies of the FIRM panels may be
obtained by calling our FEMA Map Information eXchange(FMIX),toll free,at 1-877-FEMA-MAP(1-
877-336-2627). In addition,your community may be eligible for additional credits under our Community
Rating System if you implement your activities using digital mapping files.
If your community is encountering difficulties in enacting the necessary floodplain management measures
required to continue participation in the NFIP,we urge you to call the Director,Federal Insurance and

Dear Sirs;
I have owned the subject property for about 2 years now and have been making repairs on the double
wide and minor improvements to the property. In the meantime,the address is not occupied.
My neighbor,Mr.Vitaliy Bondarchuk,who resides at 41 Pine Tree Ln.,Tahuya, WA. recently
purchased his property and is in the process of making major changes.
I am concerned some of those changes may be very ill advised or dangerous.As examples, he dug out
a space for a full sized swimming pool/fish pond without any apparent permits/consideration for
wildlife, cut down his trees and is in the process of adding multiple loads of sand(more than 20 truck
loads)to change the slope of the property.
Those activities have contributed to the water hazard at the corner of Pine Tree and Collins Lake and
other water run off issues including flooding of my front yard and possible flooding of down hill
neighbors.
I have mentioned my concerns,but he doesn't care.
Please look into the matter.

BACKGROUND:
On November 9, 2018 Tammi Wright received her certificate of achievement for
Advanced Professional Series in Emergency Management from FEMA. Tammi
previously completed the Professional Development Series consisting of 7 fundamental
training classes and now has completed the Advanced Professional Development
Series consisting of 10 training classes.
Tammi is dedicated to assist County staff, agency partners and citizens in productive
and realistic planning efforts for emergency and hazardous situations.

RE: Park Host needed for Mason County, Mason Lake Park
Mason County Parks Department is recruiting an on-site Park Host/Caretaker for Mason
Lake Park. The successful candidate must provide their own RV and the County provides
water, power, and septic at no charge. Caretakers are responsible for opening and closing
the park, site security, customer service, cleaning restrooms, and light maintenance duties in
return for utilities. There is no salary or pay associated with this opportunity.
Mason County Parks and Trails is looking for a person(s) who are willing to work nights,
weekends and holidays, can physically make rounds of the park and have good
communication and customer service skills including the ability to remain calm and friendly
when confronted with problems.
Mason Lake Park is located in Grapeview Washington and consists of 17.36 acres. The
park has a dock & boat launch, boat trailer parking, nature areas and restrooms. The
caretakers need to be present in the evenings Monday-Friday and all day on weekends
during boating season.

8.5 Tom Davis voiced concern over Mr. Bakken being solicited for the committee. He alluded to
Mr. Bakken having special interests in volunteering due to the possible expansion of his fire
district. Tom said those that volunteer for these boards should do so on their own instead of
being asked.
Cmmr. Shutty and Drexler spoke to Mr. Bakken's experience and leadership and how it will
benefit the Housing and behavioral Health Advisory Board.

10.1 Public hearing to consider the 2018 Open Space applications and consider an
amendment to a 2017 Current Use application from Kim &John Oliver.

Diane briefed the two 2018 applications noting the following recommendations:
• Richard & Marguerite Hassett- 7.25 acres into Open Space
• Robert &Angela Barnes- no more than seven acres be approved for transfer into
Open Space.
• In regards to the 2017 amendment, the request is to reduce the acreage from 1.97
acres to 1.32 acres.
Cmmr. Shutty/Drexler moved to approve the 2018 applications and the amended
2017 application in the Open Space Program as recommended by the Assessor's
office for the following parcels: 22029-41-00020, 42125-12-00010, 42123-76-
90161. Motion carried unanimously. N-aye; S-aye; D-aye.
10.2 Public hearing to consider amendments to Title 15- Development Code: Section
15.13, reinstating Hearing Examiner procedures for Code Enforcement Cases. Staff:

Kell said that though the Code Enforcement team has been successful, some cases would
benefit from going before the Hearings Examiner. The Planning Advisory Commission (PAC)
did unanimously approve adding the section back into the code.
Diane noted that one comment was received in support of the applications via email from
Ken VanBuskirk. No other public comment received.

10.3 Public hearing to consider code amendments to Title 17- Zoning: Section 17.12,
adding "Duplex", "Triplex"and "Residential" as permitted uses in the Village
Commercial (VC) District in the Allyn Urban Growth Area (UGA) Staff: Kell Rowen
Kell said that currently, the Allyn UGA allows multifamily units with a minimum of 4 units.
This amendment would allow duplexes on parcels that are one half acre or less, triplexes on
parcels three-quarter acres or less, and residential one or more attached to any other
permitted non-residential use. She said the PAC did approve the addition of these uses.
Vicki Betsinger questioned if these changes would allow residential without commercial being
attached. Kell said yes, as long as a single family residential unit is not built. There must be a
duplex, triplex or 4-plex.
Jeff Carey asked about the minimum lot size requirements as most lots off of North Lakeland
Drive are 4,800 sq ft lots. Kell noted that the creation of new lots would need to meet the
minimum lot size. Those lots already in place would be considered legal non-conforming.
Public Testimony:
Jeff Carey spoke about zoning and lot sizes in Allyn. He said the direction Allyn is headed
with these changes is positive.
Vicki Betsinger owns two lots, one of which has a residence built on it. She said her hope was
to build a garage on the vacant lot and spoke in favor of the amendments.

10.4 Two public hearings to consider the following:

Microenterprise Assistance Program of$269,210 which ended September 30,
2018;
Lisa Smith, from Enterprise for Equity, spoke in place of Justin Smith. She spoke about the
program and spoke about the graduates of the program. Of those who completed the
program, 65% were start up. 21 received tech assistance from the Chamber of Commerce,
WSU Extension, and the Economic Development Council. Two of the businesses were able to
expand their enterprises in larger spaces.
Cmmr. Shutty thanked Lisa for speaking and asked the difference between completing the
program and graduating the program. Lisa explained that in order to actually graduate, you
need to write a comprehensive business plan, and if you're a startup you need one year of
cash flow projections.
More discussion was had about the need to continue this program and the positive effects for
Mason County.

Development Block Grant (CDBG) for the Microenterprise Assistance Program of

These hearings are to inform citizens of the grants past performance and
availability of funds and eligible uses of the state CDBG and receive comments
on proposed activities, specifically a Local Microenterprise Assistance Program.

Lisa said they are applying due to demand and because graduates of the program are getting
ready for microloans to begin the next phase of their business.
Cmmr. Shutty asked about some of the partnerships she has. She named County Staff, North
Mason chamber of commerce, EDC, and WSU extension as the main partners.
Cmmr. Drexler asked how much of the $200,000 would be seed money for loans. Lisa said
$75,000 would be made available. Cmmr. Drexler and Lisa had a discussion about future
outreach goals for the program.

Washington State Department of Commerce and sign the resolutions and
certifications of compliance for up to $200,000 to extend the CDBG economic
opportunity grant for the local and microenterprise assistance program. Motion

8.8 Approval to amend Resolution 90-18 to revise the Non-represented Salary Scale Range
Alignment by approving the reclassification request for the Permit Assistance Center Manager to

following budget transfer request to the 2018 budget:

assume the loan on the Olsen Building.
Cheryl questioned why item 8.15 showed"budget transfer" instead of"budget supplement"on
the agenda. Cmmr. Shutty explained it was changed to"budget supplement" per
recommendation from the State Auditor.

9.1 Cmmr. Neatherlin called Jerry Hauth to introduce Diane Sheesley. Diane came from City of
Tacoma, and before that Thurston County. She voiced her excitement to be back in County
Government.

Jennifer Beierle first noted, per the Commissioners question on November 27th, that there is
no bank capacity for roads or current expense. The recommended action is to certify the
resolution.

Cmmr. Drexler invited questions about dollar amounts for specific areas which she read
aloud.
Bob Allen said there is heavy consideration to create an industry and development tax within
the Port of Grapeview.
Cmmr. Shutty/Drexler moved and seconded to adopt the resolution certifying to the County
Assessor the amount of taxes levied for county purposes and amount of taxes levied for
collection in 2019.
10.2 Public hearing to consider adopting a Public Benefit Rating System in place of the
current Open Space Program. Staff: Kell Rowen
Kell first gave a brief history on how the Public Benefit Rating System (PBRS) went through
the Planning Advisory Commission (PAC) to the Board. She then read through the staff report
and recommended approval of the November 20, 2018 draft of the PBRS.
An unknown gentleman questioned how those in the Open Space program will be affected by
the change to PBRS. Kell explained that those currently in Open Space will be re-evaluated
under the PBRS system.
Ken VanBuskirk questioned the preliminary re-evaluated parcels. Cmmr. Drexler read that of
the nine parcels reviewed, only one did not qualify for tax reduction, three qualified for 40%
of assessed value, and five qualified for 60% of the assessed value. It was questioned how
this compared to their current status within Open Space. Cmmr. Drexler stated that all nine
parcels qualified for 95% tax reduction. Kell said not all parcels qualify for the same
reduction.
Another unknown gentleman questioned how this program change can be justified, especially
after paying to be in the program. He said this seems like a breach of contract. Kell stated
that if properties don't qualify for PBRS, and you have not been enrolled for ten years, you
can opt out without paying the back taxes due to this change being the choice of the County.
The question of having to reapply was brought up. Kell explained that those in Open Space
would not need to reapply and discussed possible points within the new system.
Ken VanBuskirk and Kell held a discussion about how the parcels will be reviewed.
A time frame for the reevaluation of those in Open Space was questioned. Kell said it could
happen as early as 2020 (for the 2021 tax year).
The lack of an appeal process was questioned by an unknown citizen. Cmmr. Drexler read
section 17.18.060 (B) aloud.
Patricia Vandehey submitted a sheet of questions to Kell.
Public Testimony
Bob Allen went through the draft page by page noting grammatical/clerical errors and the
following:

Page 7- section 17.18.090—"Upon adoption, application fees shall be set at five hundred
(500) dollars." He noted that this expense could be burdensome and questioned if
this fee would be applicable to those already in Open Space. Kell noted that this fee
is only for new applicants.
Page 9- section 17.18.160 (A)— He voiced concern with the lack of a timeline. Kell stated the
applicants have a 30 day response time.
John Zimmaro spoke about the difficulties faced while building a house as there is a creek on
his property. He voiced concern about the inability to know what will happen to his property
and land status if the PBRS is adopted. Cmmr. Neatherlin and John then had a short
discussion about tax allocations and shifts.
Ed HefFliger agreed with the Mr. Zimmaro's statements. He said he feels as though entering
Open Space was signing a contract with the County which is now being violated and that
changing the program is a breach of contract. Ed noted the complexity of the PBRS and
voiced concern over the decision of the Board. He ended by asking the commissioners to
reconsider changing programs.
Mary Jean Hrbacek first pointed out that there is no legal requirement by the state to change
programs. She then questioned what the total assessed value of the 300 parcels affected by
Open Space/PBRS and also the reduced amount of the same parcels. Kell did not have those
numbers available. It was then questioned if the program status is lost once a property is
sold. Cmmr. Drexler read from 17.18.220 which states that a new owner would need to sign
a notice of continuance.
Alfred Jones who is currently enrolled in Open Space spoke about how much the program
has saved his farm. Under PBRS, his taxes may go up between 300-600%. This would cause
him to have to sell sections of his farm in order to keep it.
Nicki Zimmaro asked what drove the need for the change, and then also questioned why the
board is moving forward with possible adoption. Cmmr. Neatherlin explained that this could
be stopped depending on the vote which is unknown at this time. He said more information
would be brought forward during commissioner deliberation.
George Wiggins owns 28 acres of forest land and agreed with all former comments regarding
the need to grandfather those in Open Space.
Ken VanBuskirk submitted comments and asked to have the comments submitted to Tim
Whitehead, Deputy Prosecuting Attorney. He asked to continue the hearing into the new year
in order to research the comments received today. Ken said that if this is accepted today, he
would like to see the September version adopted instead of the November 20, 2018 version.
Larry Gruber voiced concern with this program change and the lack of possible
grandfathering.
Bill Wagner, who owns several open space properties, agreed with the breach of contract
statements made earlier in public testimony.
Bob Allen spoke once again, this time about Page 8, section 17.18.140. He gave suggestions
for language regarding a quorum.

Cmmr. Shutty thanked everyone for their testimony and for being at the meeting. He said
that most comments were in favor of requiring PBRS for new applicants, but not for those
enrolled. In regards to grandfathering, he noted that he had not gotten a satisfactory answer
regarding how long current Open Space members can be considered "grandfathered". Cmmr.
Shutty suggested continuing the hearing until January.
Cmmr. Drexler thanked all who attended. She voiced her support of PBRS, noting that the
law does state everyone should be taxed equally except in special circumstances. Because of
a lack of information regarding grandfathering, she also voiced her support to table the
meeting.
Cmmr. Neatherlin asked if it was truly fair to have someone else pay your taxes. He then
spoke in regards to"signing a contract"as discussed by several people in Open Space, noting
the verbiage that allows the County to end contracts. He asked all those against the program
change to consider if they would still be angry if the tax increase didn't affect them. Cmmr.
Neatherlin then voiced his support to table the meeting.
Cmmr. Shutty/Drexler moved and seconded to continue the hearing to January
15, 2018 with Cmmr. Drexler's proposed amendments alongside the current draft.
Cmmr. Drexler suggested the following and explained her reasoning for each:
17.18.030 (A)(6) strike wetlands.
17.18.030 (A)(9) remove private lands within designated federal lands.
17.18.030 (A)(10)- Strike Farm and agricultural conservation lands and move to medium
priority.
17.18.030 (B)(4)-Rural open space. She asked to strike this as an eligible land altogether
because there is not an issue with rural open space availability in Mason
County.
17.18.035 (A)(6)- Regulated wetlands.
17.18.035 (B)(4)- Consistent with the removal of 17.18.030
17.18.035 (C)(1)- Restored lands- have a 10 acre minimum added to the first line.
She agreed with testimony received on 17.18.040 to say"a quorum of three commissioners"

ITEM: Honorary Road Sign Program
BACKGROUND: The Board of Commissioners have expressed a desire to recognize and
honor Kerry Schuffenhauer for the many years of public service in the Mason County Public
Works U&W Management division and suggested naming a county road after her. After
reviewing options, Public Works recommends adopting an Honorary Road Sign Program.
An Honorary Road Sign Program allows the installation of a road sign without an official
road name change. The road name remains the same for addressing purposes and a new
honorary road name sign is added. This option takes out the complexity of the addressing
issues and the process of changing a road name.
The program gives the community the opportunity to honor citizens or organizations that
have made significant contributions to the County. The program will be administered by
the Public Works Department and designations approved by resolution on a case by case
basis by the Board of County Commissioners. Honorary Road Signs will be displayed for a
five year period.
BUDGET IMPACTS: The program allows for a maximum of four honorary road sign name
designations each year. The cost to produce and install the honorary signs is estimated to
be less than $200.
RECOMMENDED ACTION: Recommend the Board approve to set a hearing for
Tuesday, February 5, 2019, to receive public comment on establishing an Honorary Road
Sign Program allowing the County and community the opportunity to honor individuals or
organizations that have made significant contributions to the County.

significant contributions by or importance of certain individuals and organizations to Mason
County by naming sections of public county roads in their honor for a specific period of time;
and
WHEREAS, it is appropriate to establish criteria and a procedure for conferring honorary road
naming and the design standards for the signage.
WHEREAS, the honorary road titles do not change or affect the official name of those public
county roads or the official address of residences and businesses on the road, and
NOW THEREFORE, BE IT HEREBY ORDAINED, that the Mason County Board of
Commissioners, after due deliberation and in the best interest of the public, does hereby
approve the Honorary Road Sign Program as set forth in the attached Exhibit "A".
BE IT FURTHER ORDAINED, that Mason County Code be amended to include section
12.14 — Honorary Sign Program.

12.14.020 Purpose. To establish a county policy for an Honorary Road Sign Program allowing
the opportunity to honor those that have made significant contributions to the community or the
County. An honorary road sign is a subsidiary designation for a road or a portion of a road that
does not replace the legal name of the road. The honorary road sign shall be denoted by signs
that augment but do not replace signs for the legal road name required for emergency service
access.
12.14.030 Eligibility Criteria. Recognition with an honorary road sign shall be reserved for
those individuals and organizations that have performed an exemplary act or achievement of
lasting interest to their community, which reflects positively on Mason County as a whole, and:
a) if an individual is a resident or a native of the County or is of particular importance to the
County; or b) if an organization has been in operation for a minimum of 25 consecutive years
and has its base of operations in the County or is of particular importance to the County.
12.14.040 Procedure. Honorary road signs shall be conferred by resolution. The resolution
submission shall state the name of the individual or organization intended to be honored and the
road or portion of road to receive the designation intended and a statement as to why the
County is honoring the individual or organization with a location map.
12.14.050 Application/Cost. Applications will be reviewed by the Public Works Department and
recommendations brought forward to the Board of Commissioners.
Actual cost of manufacturing, designing and installing of the sign shall be paid by the Public
Works Department. Public Works will be reimbursed for the sign manufacturing and material
cost if at the end of five years the honoree wishes to keep the sign.
12.14.60 Requirements and Restrictions. 1) When a road has received a designation, no other
proposals for that road shall be considered while it has that designation. 2) No more than four
honorary street titles may be conferred per year. 3) Proposals shall not be for names that could
be considered derogatory, pejorative, obscene or blasphemous. 4) The proposed designation
may not duplicate an official road name.
12.14.070 Designation Duration. Honorary Road Signs shall expire five years after the date of
resolution passage, unless specifically specified by the Board in the approval resolution. The
Public Works Department shall remove the signs once the five years has expired.
12.14.080. Signage Design. Honorary road signs shall meet the standard road sign criteria for
size and shape. Honorary signs will have the term "Honorary" listed on the top of the sign with a
brown background and white lettering and border, and design standards are set forth in the
most current Manual on Uniform Traffic Control Devices (MUTCD).
12.14.090. Location and Records. Honorary signs placed on a current sign post and shall be
placed underneath signs designating the legal road name. Only one sign is erected for each
honoree. If a road or a portion of a road, except intersecting roads, has been designated with an
honorary road sign, no other honorary sign shall be given to the road or section of a road.
Records of the honorary road signs are maintained by the Public Works Department.

Releasee deny liability therefor, and further that such shall not be a basis for claims for
indemnity, contribution or breach of any Federal, state, local law.

RELEASE AND HOLD HARMLESS AGREEMENT
FOR AND IN CONSIDERATION of the sum of Forty Thousand Dollars($40,000),this Release and Hold
Harmless Agreement is made and entered thisa-f th day of Nv ,2018 by and between Mason County
and James Pharris(including his successors,assigns,heirs and estate collectively referred to as"Pharris")does
hereby release and forever discharge Mason County and its officers,agents,employees,agencies and departments
from any and all existing and future claims,damages and causes of action of any nature whatsoever arising out of
James's employment,employment resignation and public records requests submitted before the execution of this
Agreement.
Recitals:
Whereas James Pharris served Mason County in the position of Truck Driver II from the year December 6, 2000
until June 26,2018.
Mason County and James Pharris wish to resolve their differences and fully settle and resolve any and all known and
unknown,foreseen and unforeseen claims or potential claims.
Accordingly,it is hereby agreed as follows:
a) James Pharris shall provide the County with a letter of resignation indicating that his/her last day of
employment shall be June 26,2018.
b) Mason County agrees that unless required by law, the only information provided to prospective
employers shall be the dates of Mr.Pharris employment with employed at Mason County.
c) Mason County agrees that all inquiries regarding James Pharris or his employment with Mason County
shall be directed exclusively to the Human Resources Manager.
d) Mr.Pharris agrees that in the future,he will not seek employment with Mason County.
Release:
In exchange for entering this agreement,James Pharris forever releases and discharges Mason County,
its past, present and future Commissioners, elected officials, officers, employees, agents, affiliates,
assigns and successors from any and all claims, related to his employment with Mason County, his
separation therefrom, previously submitted public records requests, or for any issues, or disputes
arising before the date of this agreement. This release shall include any claims arising under Federal,
state, or local law prohibiting discrimination, harassment, retaliation in employment, public records,
claims or wrongful discharge, claims of constructive discharge, breach of contract, defamation,
constitutional violations, unpaid wages, salary, or other sums, emotional distress, personal injury,
attorneys' fees,or other statutory or common law claims.
James Pharris agrees not to pursue any legal action against Mason County as the result of the signed
letter of resignation and Settlement Agreement. Specifically, in addition to general releases and
waivers, and agrees not to institute a law suit under Title VII of the Civil Rights Act of 1964, as
amended,(Title VII),the Public Records Act,or any other unmentioned Federal,state,or local law.

James Pharris knowingly and voluntarily waives all rights under the Federal law, which provides that
the appellant(James Pharris) may have 21 days from receipt of the agreement to review and consider
this agreement before signing it.The employee further understands that he may use as much of this 21-
day period as he wishes prior to signing and delivering this agreement. Federal law further provides
that James may revoke this agreement within seven (7) days of the signing and delivering it to the
County.
Within 20 days after full execution of this Agreement, Mason County will deliver the monetary
settlement to James Pharris.
Federal law also requires Mason County to advise James Pharos to consult with an attorney before
signing this agreement. Having been informed of these rights, and after consultation with his counsel,
he voluntarily waives these rights.
The parties agree that the content of this agreement are contractual and not mere recitals, Mason
County understands that this release does not work to bar claims of breach of this agreement nor does
it work to bar claims related to actions taken by Mason County or its officers,agents,or employees in
the future which would contradict in any way the settlement reached herein.
This agreement is to be construed under the laws of the state of Washington. The parties further agree
that in the event of a dispute as to the content of this agreement that the proper jurisdiction and venue
shall be Mason County Superior Court,Mason County,Washington.

Item:
Hold a Public Hearing on January 8, 2019 at 9:30 a.m. to consider approval of a special budget
supplemental appropriation request to the 2018 budget.
Background:
Budget supplemental appropriation request for REET 1 Funds in order to record the purchase and
assume the loan on the Olsen Building in the 2018 budget year. The last public hearing for budget
transfers and amendments was scheduled and carried out on December 11, 2018, and the building
purchase approved by the BOCC the same day. There is not adequate time to include an additional
public hearing in 2018, and the State Auditor's Office has agreed that this is a special circumstance in
which a public hearing to amend the 2018 budget is appropriate to complete in 2019.
Budget Impacts:
The net impact is zero dollars.
Recommended Action:
Request to set a public hearing for January 8th at 9:30 a.m. in order to consider the approval of
the following budget supplemental appropriation to the 2018 Budget:
