1. Call to Order—The Chairperson called the regular meeting to order at 9:01 a.m.
2. Pledge of Allegiance—Art(last name?) led the flag salute.
3. Roll Call — Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 2 — Kevin
Shutty; Commissioner District 3 —Terri Drexler.
4. Correspondence and Organizational Business
4.1 Correspondence
4.1.1 United States Department of Commerce, Economic and Statistics Administration sent a
letter in regards to the 2020 Census.
4.2 Presentation of 2019 Preliminary Budget—Auditor Karen Herr&Chief Finance Manager Leo
Kim
Auditor, Karen Herr thanked all departments for submitting their preliminary budgets on time
in the manner requested. Leo Kim thanked all departments for working together and thanked
the staff in the Financial Services office for their work. He walked through copies of the
budget given to the Board and announced the reports will be posted on the Auditor's website
this week.
4.3 Proclamation: National Assisted Living Week Staff: Cmmr. Drexler
5. Open Forum for Citizen Input— No comments.
6. Adoption of Agenda - Cmmr. Drexler/Shutty moved and seconded to approve the agenda
with an amendment to remove item 8.4. Motion carried unanimously. N-aye; S-aye; D-
aye.
7. Approval of Minutes—August 6 and August 13, 2018 briefing minutes.
Cmmr. moved and seconded to approve . Motion carried unanimously. N-aye; S-aye; D-
aye.
8. Approval of Action Agenda:
8.1 Approval to create, post, and fill a full time program coordinator position for the Opioid
Program and eliminate the full time Community Health Program Assistant position.
8.2 Approval to increase the part-time position of Community Health Program Assistant for the
Prescription Drug Overdose Program to full-time for the duration of the grant ending August
2019.
8.3 Approval to authorize ER&R to declare the Volvo L45 Wheel Loader from the Utilities and
Waste Management division, and the Cat M140 Grader from the Road Operations and
Maintenance division as surplus and allow ER&R to dispose of said equipment pursuant to
Mason County Code and state laws.

8.5 Approval to sign the Class Action Opt-In Notice Form to the United States Court of Federal
Claims to participate in the Kane County, Utah v. United States lawsuit as a Class member
regarding Payments In Lieu of Taxes Act (PILT Act) for fiscal years 2015, 2016 and 2017.

8.6 Approval of the Memorandum of Understanding between North Mason School District and
Mason County Parks &Trails Department for water service at Sandhill Sports Complex.
8.7 Approval to appoint Christina Lee Williams to the Mason County Historic Preservation
Commission to fill the balance of a term ending November, 2020.
8.8 Approval of two Summer 2018 Mason County Heritage Grants, totaling $5,150 for the
following:
• Mason County Genealogical Society- $400 for website development hours.
• McReavy House of Hood Canal- $4,750 request for emergency repair and
stabilization of the McReavy House roof.
8.9 Approval of the Memorandum of Understanding between North Mason School District and the
Mason County Sheriff's Office for a School Resource Deputy.
8.10 Approval to amend Resolution 54-18 stating interest and penalties for late payments for Lake
Management Districts will be treated in the same manner as delinquent real property taxes.

8.11 Approval to set a public hearing on Tuesday, September 25, 2018 at 6:30 p.m. to consider
proposed amendments to the Motorboat Regulations, Mason County Code Chapter 9.04.
Proposed amendments include, but may not be limited to, changing language regarding buoy
placement from shoreline to mark the minimum water skiing distance on fresh water.
8.12 Approval to set a public hearing on Tuesday, September 25, 2018 at 6:30 p.m. to consider
approval of the following supplemental appropriations and budget transfer requests to the
2018 budget: (Ex. B-Res.59-18)

the exception of 8.4. Motion carried unanimously. N-aye; S-aye; D-aye.
9. Other Business (Department Heads and Elected Officials)-
9.1 Kristopher Nelsen handed out a copy of the 2018 Building Valuation Data. He explained that this
data will cause a slight increase in permit fees.
10. 9:30 a.m. Public Hearings and Items set for a certain time
10.1 Public Hearing to consider rezone requests and one map correction for parcels 42002-10-
00020, 32031-14-00010,32232-55-00040,32332-55-00041,12329-12-90011,and 61908-23-
00010. Staff: Kell Rowen
Kell announced she would go through each request, noting that the Planning Advisory
Commission has approved all requests.
42002-10-00020: Kell explained this property is south of the Public Works Building on Hwy
101. This parcel is 35 acres in size and is currently zoned Public Institutional; the request is to
rezone the area to General Commercial. A Boundary Line Adjustment (BLA) has been done and
a subdivision will happen for the creation of six lots. This property is located in the Shelton
UGA.
32031-14-00010: RR5 to RC3 also on hwy 101 across from Cole Road Park and Ride.
WADOT had no concerns regarding access to property.
32232-55-00040 &32332-55-00041: downzone from Rural Commercial 3 (RC3) to Rural
Residential 2.5 (RR 2.5) along SR 106. Previously there was a 6,000 sq ft storage bldg on
property which has been removed. Commercial development has not been successful.
Shoreline variance would be necessary for this property if developed.
12329-12-90011: This parcel is located in the Belfair Urban Growth Area and is zoned Low
Density Residential (R4) and the request is to rezone to Mixed Use. This request would bring
the existing use into compliance.

61908-23-00010: This request is for a map correction. The parcel is zoned as in-holding land
but is shown on the County maps as Long Term Commercial Forest. The maps just need to be
corrected to reflect In-holding.
No public testimony received.
Cmmr. Shutty/Drexler moved to approve rezone requests and one map correction
for parcels 42002-10-00020, 32031-14-00010,32232-55-00040,32332-55-
00041,12329-12-90011,and 61908-23-00010. Motion carried unanimously. N-aye;

RESOLUTION NO.
A Resolution Amending Resolution No. 54-18
A RESOLUTION prescribing interest and penalties for late payments of rates and charges set
under RCW 36.61.270 for Lake Management Districts created pursuant to Chapter 36.61 RCW.
WHEREAS, The citizens surrounding Mason Lake have petitioned and voted to form a lake
management district as proscribed by state of Washington code, and
WHEREAS, RCW 36.61.270 stipulates that the county legislative authority has full authority to
fix rates and charges imposed by a lake management district; and
WHEREAS, RCW 36.61.270 further stipulates that the method of foreclosing on liens for
delinquent rates and charges shall be subject to the provisions of Chapter 36.94 RCW; and
WHEREAS, RCW 36.94.150 stipulates that liens for rates and charges shall be foreclosed in the
same manner as foreclosure of real property tax liens;
WHEREAS, penalties and interest on delinquent rates and charges are treated in the same
manner as delinquent real property taxes and are not credited to the individual district.
NOW THEREFORE BE IT HEREBY RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS for
Mason County as follows:
1. Delinquent rates and charges for Lake Management districts shall be treated in
the same manner as delinquent real property taxes. This includes but is not
limited to interest, penalties, additional costs for collection and foreclosure
proceedings.

county, including Mason County, to take legislative action to review and revise its
comprehensive plan and development regulations to ensure that the plan and regulations
continue to comply with the requirements of the Act; and
WHEREAS, the County needs to address certain requests for comprehensive plan and zoning
changes to meet the goals and requirements of Chapter 36.70A RCW (Growth Management

WHEREAS, on July 16, 2018 and again on August 20, 2018 the Mason County Planning
Advisory Commission held a public hearing to consider the amendment and passed a motion
to recommend approval of said rezone; and
WHEREAS, the Commissioners considered the requested rezone at a duly advertised public
hearing on September 4, 2018; and
WHEREAS, the Board of County Commissioners took public testimony from interested
parties, considered all the written and oral arguments, testimony and comments presented;
and
WHEREAS, the Board of County Commissioners also considered the Staff Report and
recommendations of the Mason County Planning Advisory Commission; and
WHEREAS, the Board of County Commissioners finds that the proposed amendment to the
Development Areas Map complies with all applicable requirements of the Growth
Management Act, the Comprehensive Plan, and the Mason County Code, and that it is in the

CORRECTION TO MASON COUNTY FUTURE LAND USE MAP AND
DEVELOPMENT AREAS MAP PANEL 7 OF 10 FROM LONG TERM
COMMERCIAL FOREST TO INHOLDING LANDS
ORDINANCE Mason County Future Land Use Map and Development Areas Map
(correction)under the authority of RCW 36.7oA.
WHEREAS, the Washington State Growth Management Act (RCW 36.7oA.130) requires
each county, including Mason County, to take legislative action to review and revise its
comprehensive plan and development regulations to ensure that the plan and regulations
continue to comply with the requirements of the Act;and
«'F{ERE-AS, in May 2018 the Mason County Planning Department discovered a mapping
error on the Future Land Use Map and the Development Areas Map Panel 7 of 10;and
WHERFAS, the Planning Department concluded through research that parcel number
61908-23-00010 was designated and adopted as Inholding Lands for the June 2000
Comprehensive Plan document; and
NVI-IEREAS,the same parcel was incorrectly mapped as Long Term Commercial Forest; and
XVI IFREAS, on July 16, 2018, the Mason County Planning Advisory Commission held a
public hearing to consider the correction and passed a motion to recommend approval of
said correction, and
\V1 IERFAS, the Commissioners considered the requested correction at a duly advertised
public hearing on September 4, 2018; and
XN1IE:REAS, the Board of County Commissioners took public testimony from interested
parties, considered all the written and oral arguments and testimony, and considered all the
comments presented; and
«'HIRI".AS, the Board of County Commissioners also considered the Staff Report and
recommendations of the Mason County Planning Advisory Commission, and
BVI-IEREAS, the Board of County Commissioners finds that the correction to the Future
Land Use Map and the Development Areas Map Panel 7 of 10 complies with all applicable
requirements of the Growth Management Act, the Comprehensive Plan, and the Mason
County Code,and that it is in the best public interest;and
BE IT HEREBY ORDAINFI),the Mason County Board of Commissioners hereby approves
and ADOPTS correction to the Mason County Future Land Use map and Development
Areas Map Panel 7 of 10 for parcel 61go8-23-00010 from Long Term Commercial Forest to
Inholding Lands.
