Call to Order—The Chairperson called the regular meeting to order at 6:00 p.m. 2. Pledge of Allegiance— Pat McCullough led the flag salute. 3. Roll Call — Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 2— Kevin Shutty; Absent: Commissioner District 3 —Terri Drexler. 4. Correspondence and Organizational Business 4.1 Correspondence 4.1.1 Washington State Department of Transportation sent in a sixty day notice of disposition for parcel number 12106-22-60020. 4.1.2 Washington Department of Natural Resources (DNR) sent in notice of a proposal to designate a Natural Resources Conservation Area (NRCA) in portions of the Dewatto River Watershed. 5. Open Forum for Citizen Input— 5.1 Pat McCullough spoke to the proposed gravel pit on North Shore and the permit has now been withdrawn. He submitted a petition requesting any such large project would go through a public process. 5.2 Mr. McCullough then brought up a proposal for a paved trail from Belfair State Park to Theler Wetland Trail and submitted a drawing. He suggested the County, Port and Salmon Enhancement Group team together to create this trail. 5.3 Bruce Carter also spoke to the proposed gravel pit on North Shore. He believes the County's administration of the permit request was not handled well and was not transparent. 5.4 Steve Love also expressed dismay that the gravel pit project may have happened on Hood Canal. 5.5 Brad Carey stated there needs to be a fact checking process for permits such as the gravel pit. He thanked Cmmr. Neatherlin for his work on the project. 5.6 Ken VanBuskirk is happy the gravel pit project permit was pulled. He then brought up the Dewatto River NRCA proposal and encouraged the Commissioners to adopt a resolution in opposition to the project. 6. Adoption of Agenda - Cmmr. Shutty/Neatherlin moved and seconded to adopt the agenda as published. Motion carried unanimously. N-aye; S-aye; D-absent. 7. Approval of Minutes—July 2"d, July 9th and July 16, 2018 Briefing Minutes; June 26 and July 3, 2018 Regular Meeting Minutes. Cmmr. Shutty/Neatherlin moved and seconded to approve July 2,July 9 and July 16, 2018 Briefing Minutes; June 26 and July 3, 2018. Motion carried unanimously. N-aye; S- aye; D-absent. 8. Approval of Action Agenda: 8.1 Approval to rescind Resolution 05-14, Salary Plan for Sheriff Command Staff. The Jail Lieutenant, Chiefs and Undersheriff will be incorporated into the Mason County Non-Represented Salary Range Alignment by adoption of a separate resolution. Resolution No. 51-18 (Exhibit A) 8.2 Approval to authorize the submittal of Watershed Pathway Grant Program applications for three culvert replacement projects. 8.3 Approval to authorize Public Works to utilize the County MRSC Roster to select Construction Project Inspectors and enter into agreements. 8.4 Approval of amendment three to contract CLH18253 between Mason County Public Health and the State of Washington Department of Health. BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS July 24, 2018 - PAGE 2 8.5 Approval of Warrants Claims Clearing Fund Warrant #s 8057475-8057910 $ 1,078,849.85 Direct Deposit Fund Warrant #s $ Salary Clearing Fund Warrant #s $ Total $ 1,078,849.85 8.6 Approval to accept an additional $43,690 from the Consolidated Homeless Grant issued by the Department of Commerce and pass through to subgrantee, Crossroads Housing, amending contract CH-2018.4. 8.7 Approval to sign a letter of support on behalf of Mason Transit Authority to be included with a grant application to the Washington State Department of Transportation. 8.8 Approval to amend Resolution 28-18 revising the Non-Represented Salary Scale Range Alignment. The revisions include adding the Therapeutic Courts Caseworker, Salary Range 10; correct the Chief Finance Manager title to Chief Finance Officer; remove several unused classifications; reclassify the Personal Health Manager, Environmental Health Manager and Planning Manager to Salary Range 33; set the number of unclassified position appointments under the Sheriffs Office to no more than five; incorporate the following Sheriffs Office Positions: Undersheriff, Salary Range 46; Chief Criminal Deputy, Salary Range 43; Chief Civil Deputy, Salary Range 38; Chief Jail, Salary Range 43; Chief Administrative Deputy, Salary Range 37; and Corrections Lieutenant, Salary Range 35. These changes shall be effective August 1, 2018, Resolution No. 52-18 (Exhibit B) 8.9 Approval to sign letter of support for the Mason Conservation District grant proposal reducing flood risks and restoring natural functions within the Skokomish River floodplain. 8.10 Approval to award $111,000 from the Treatment Sales Tax fund and enter into contract with Peninsula Community Health Services for an 18-monthh term with a start date of July 1, 2018. Item 8.8 was removed for a separate vote. Cmmr. Shutty/Neatherlin moved and seconded to approve action items 8.1 through 8.10 with exception of item 8.8. Motion carried unanimously. N-aye; S-aye; D-absent. Item 8.8 was explained by Frank Pinter which is a resolution revising the Non-Represented Salary Scale Range Alignment. Chief Hanson spoke to the Corrections Deputy salaries and the salary range for the Jail Lt. creates a salary compression between line staff and management. Frank stated the salary range selected (35) is a mid-range of comparator counties. Sheriff Salisbury expressed concern with salary parity between county departments and requested the Commissioners use county comparables for all positions. Cmmr. Shutty appreciates the comments and salary compression has to be addressed. Cmmr. Shutty/Neatherlin moved and seconded to approve item 8.8 amending Resolution 28- 18 revising the Non-Represented Salary Scale Range Alignment. Other Business (Department Heads and Elected Officials) 10. 9:30 a.m. Public Hearings and Items set for a certain time 10.1 Public Hearing to hear objections to the roll of rates and charges for Lake Management #2 for Mason Lake, and consideration of the roll of rates and charges. Diane Zoren reported that seven objections were received and the majority is not actually to the rates but that a day use charge is established for public use of the lake. Public Testimony: Greg Cearly testified that the residents have spent countless hours to pass this LMD. He expressed concern with Green Diamond owned property that is used as a park that is assessed at a lower value and questions if the property qualifies for the timber designation. He supports a boat launch fee at the Mason County Park. He has been monitoring the park and it is heavily used. He believes it's the visiting boats that bring the aquatic weeds to the lake and the highest public users are Green Diamond and Mason County. More boats on the lake also bring a safety concern. Peter Rydell supports a boat launch fee however he asked how would those that can't afford the fee use the lake. Gary Brownfield stated the cost of the county park caretaker position could be funded with a boat launch fee. Cmmr. Shutty/ Neatherlin moved and seconded to approve the resolutions confirming and approving the roll of rates and charges and prescribing interest and penalties for late payments for the Lake Management District #2 for Mason Lake. Board's Reports and Calendar -The Commissioners reported on meetings attended the past week and announced their upcoming weekly meetings. 12. In all cases where the duties of any county office are greater than can be performed by the person elected to fill it, the officer may employ deputies and other necessary employees with the consent of the board of county commissioners.The board shall fix their compensation .... WHEREAS,the Board wishes to no longer have a separate salary plan for the Mason County Sheriff's commissioned and non-commissioned command staff that includes Jail Lieutenant, Chiefs and Undersheriff and will incorporate these non-represented positions into the Mason County Non- Represented Salary Scale Range Alignment. WHEREAS,the Board wishes to acknowledge the elimination of the Patrol Lieutenant. NOW,THEREFORE BE IT RESOLVED that the Board of County Commissioners does hereby rescind Resolution 05-14, eliminate the Patrol Lieutenant, and by separate resolution will incorporate the Mason County Sheriff commissioned and non-commissioned command staff including Jail Lieutenant, Chiefs and Undersheriff into the Non-Represented Salary Scale Range Alignment. JSD-19 AMENDING RESOLUTION NO. 28-18 TO REVISE THE NON-REPRESENTED SALARY SCALE RANGE ALIGNMENT. WHEREAS, RCW 36.16.070 states that ... The Board shall fix their compensation .... WHEREAS, Mason County Personnel Policy Chapter 5.1, Salary Classification and Ranges designates each regular job title within the County classified into one of the County's Range classifications for salary purposes. Each job classification is designated a particular salary range shown on the County's Non-Represented Salary Range Alignment, which is modified periodically by the Board of County Commissioners. WHEREAS, the Board has determined it is in the best interest of the county to add the Therapeutic Courts Caseworker and reclassify the Sheriff Command Staff; WHEREAS, the Board has determined it is in the best interest of the county to add the Therapeutic Courts Caseworker position to the Non-Represented Salary Range at a Range 10 and place the incumbent at Step 0 (Entry); WHEREAS, the Board has determined the need to correct a Scrivener's error, the Chief Finance Manager should have been titled Chief Finance Officer per Resolution 05-17 and to also remove classifications no longer used in the Non-Represented Salary Range Alignment; WHEREAS, Resolution 71-15 added Chapter 5.3 Reclassification to the Personnel Policy effective January 1, 2016. Upon adoption of the reclassification policy and process, a reclassification downgrade is the result of a decrease in the level of responsibilities, tasks, and duties of a position, which changes areas of emphasis, and the level of skill required in the current position. Based on the updated job descriptions supplied by the Community Services Director, Dave Windom, the Personal Health Manager and Environmental Health Manager positions meet the criteria for a reclassification downgrade. Therefore, the Board wishes to realign the Personal Health Manager and Environmental Health Manager classifications from Range 34 to Range 33 on the Non-Represented Salary Scale Range. The incumbent's will be Y rated at their current salary level until such time as the range shall catch up to that salary level or said incumbent vacates the position, whichever shall occur first, at which time the salary shall be consistent with the then-existing Non-Represented Salary Scale Range Alignment. WHEREAS, Resolution 71-15 added Chapter 5.3 Reclassification to the Personnel Policy effective January 1, 2016. Upon adoption of the reclassification policy and process, a reclassification upgrade is the result of an increase in the level of responsibilities, tasks, and duties of a position, which changes areas of emphasis and the level of skill required in the current position. Based on the updated Planning Manager job description supplied by the Community Services Director, Dave Windom, the Planning Manager classification meets the criteria for a reclassification upgrade. Therefore, the Board wishes to realign the Planning Manager classification from Range 32 to Range 33, Step 3 on the Non-Represented Salary Scale Range. WHEREAS, pursuant to RCW 41.14.070 there are 93 classified full-time equivalency positions funded in the Mason County Sheriff's Office and these positions are filled with 96 employees (full-time and part-time). WHEREAS, pursuant to RCW 41.14.070, no more than 5 unclassified position appointments are authorized for the Mason County Sheriff's Office. Therefore the Sheriff is required to reduce the number of unclassified position appointments to no more than five (5). The unclassified position appointments authorized by this section must comply with RCW 41.14.070. WHEREAS, the Board rescinds Resolution 05-14 and wishes to return the Sheriff's Command Staff to the Non-Represented Salary Scale. Each job classification is designated a particular salary or salary range shown on the County's salary range alignment, which is modified periodically by the Board of County Commissioners. The Board sets the Undersheriff at Salary Range 46, Step 3, Chief Criminal Deputy at Salary Range 43, Chief Civil Deputy at Salary Range 38, Chief Jail at Salary Range 43, Chief Administrative Deputy at Salary Range 37, and Corrections Lieutenant at Salary Range 35, Step 3. The Board determines certain incumbents' (Chief Criminal Deputy, Chief Civil Deputy, Chief Jail, and Chief Administrative Deputy) in an Unclassified Position Appointment shall be Y rated until the incumbents' current salary meets the new Salary Range. WHEREAS, RCW 41.14.070 states ... "Subsequent changes in the designation of which positions are to be exempt may be made only with the concurrence of the sheriff and the civil service commission, and then only after the civil service commission has heard the issue in open meeting. Should the position or positions initially selected by the sheriff to be exempt (unclassified) pursuant to this section be under the classified civil service at the time of such selection, and should it (or they) be occupied, the employee(s) occupying said position(s) shall have the right to return to the next highest position or a like position under classified civil service." The position elected, by agreement between the Sheriff and the Civil Service Commission, to revert back to classified, under civil service, shall be paid at the rate of pay listed on the Non-Represented Salary Scale or the appropriate Collective Bargaining Agreement. NOW, THEREFORE BE IT RESOLVED, that the Board of County Commissioners does hereby amend the Non-Represented Salary Scale Range Alignment (Attachment) to reflect the following: add the Therapeutic Courts Caseworker at Salary Range 10 and place the incumbent at Step 0 (Entry), correct Scrivener's error, changing Chief Finance Manager to Chief Finance Officer, remove unused classifications, reclassify the Personal Health Manager and Environmental Health Managers to Salary Range 33, and Y rate incumbents' at their current salary level until such time as the range shall catch up to that salary level or said incumbent vacates the position, reclassify the Planning Manager to Salary Range 33, Step 3, reclassify and set the number of unclassified position appointments under the Sheriff's Office at no more than five (5), set the Undersheriff at Salary Range 46, Step 3, Chief Criminal Deputy at Salary Range 43, Chief Civil Deputy at Salary Range 38, Chief Jail at Salary Range 43, Chief Administrative Deputy at Salary Range 37, Corrections Lieutenant at Salary Range 35, Step 3, and Y rate incumbents (Chief Criminal Deputy, Chief Jail, Chief Civil Deputy, and Chief Administrative Deputy), in the remaining unclassified position appointments at their current salary level until such time as the range shall catch up to that salary level or said incumbent vacates the position, whichever shall occur first, at which time the salary shall be consistent with the then-existing Non-Represented Salary Scale Range Alignment. A RESOLUTION confirming and approving the roll of rates and charges for Mason County Lake Management District No. 2 (LMD #2) Mason Lake pursuant to RCW 36.61.120 WHEREAS, Mason County Lake Management District #2 for Mason Lake, was established on June 26, 2018, by adoption of Ordinance No.44-18; and WHEREAS, the notice and hearing requirements for establishing the roll of rates and charges for the Lake Management District pursuant to RCW 36.61.120 and RCW 36.61.140 have been satisfied; and WHEREAS, a public hearing was held on July 24, 2018 to hear objections to the roll of rates and charges; NOW, THEREFORE, the Mason County Board of Commissioners does resolve as follows: The Board of Mason County Commissioners makes the following findings and determinations: 1. Seven timely filed objections to the proposed final roll of rates and charges were received. A list of objections received is attached as Exhibit A. 2. LMD #2 will perform the following activities: • Manage noxious aquatic plants in Mason Lake to meet recreational and aesthetic needs, fishery and wildlife habitat requirement, and ecosystem and groundwater concerns; • Employ proven lake management techniques based on sound environmental practices; • Conduct water quality monitoring to assure non-degradation of lake water quality; • Investigate and promote the use of best management practices and environmentally friendly shoreline enhancement techniques; • Monitor for recurrence of Eurasian Water Milfoil, Slender Arrowhead and Yellow Flag Iris or emergence of other lake plants that could adversely impact the freshwater system and recommend and implement adaptive action to control these unanticipated occurrences; • Maintain an advisory committee of neighborhood representatives to direct the efforts and expenditures of funds of the LMD #2. 3. LMD #2 will protect Mason Lake's beneficial uses and water quality and is in the public interest based on the following: a. The duration of the LMD #2 shall be ten (10) years, commencing in 2019. b. The Management Plan for Mason Lake takes appropriate measures to protect and enhance fish and wildlife. c. The financing of Lake Management activities is feasible and the level of funding is sufficient to conduct the contemplated activities. d. The proposed annual rates and charges set forth on the attached roll bear a reasonable relationship to the benefits to property within LMD #2 for protecting for the lake's water quality, recreational and aesthetic values. NOW, THEREFORE BE IT RESOLVED by the Board of Mason County Commissioners that the roll and charges for Mason County Lake Management District #2 for Mason Lake shall be confirmed and approved as follows: 1. Based on the findings in this Resolution and Resolution No. 15-18 (Resolution of Intention), the cost of lake management activities and maximum total annual charges to property as stipulated in Ordinance No.44-18 (Ordinance creating the Lake Management District) and Resolution No.29-18, the Board establishes the total estimated amount to be collected over ten years is $452,802.00. 2. Proposed annual rates and charges to property within Lake Management District #2 are as follows: • The estimated amount in 2019 is $36,000, commencing in 2019 and continuing through 2028, and will include a maximum 5% annual increase for inflation. 3. Method of collection (from Ordinance No. 44-18.) Resolution No. 63-I q Confirming and approving the roll of rates &charges for LMD #2. a. Rates and charges for LMD #2 shall be included in Mason County's annual property tax statements. Properties, which do not receive a property tax statement, will separate billing statements for these rates and charges. b. The total amount of the LMD #2 annual rate and charge shall be due and payable on or before the 30th day of April of each year, commencing April 30, 2019, and shall be delinquent after that date; however, if one-half of such rate and charge is paid on or before the said 301 of April, the remainder shall be due and payable on or before the 311 day of October and shall be delinquent after that date. c. If a payment is received in conjunction with a combined property tax and LMD #2 rate and charge and the payment is less than the amount due, the payment shall be applied first to the annual property tax of the parcel and any remaining amount to the LMD No.2 rate and charge. 3. The of rates and charges for Mason County LMD #2 for Mason Lake, attached hereto as Exhibit B and incorporated by reference, is hereby approved and confirmed. 4. The funds collected from LMD # 2 will be rolled into Fund No. 194-100-000 of the Mason County Treasurer's office. WHEREAS, The citizens surrounding Mason Lake have petitioned and voted to form a lake management district as proscribed by state of Washington code, and WHEREAS, RCW 36.61.270 stipulates that the county legislative authority has full authority to fix rates and charges imposed by a lake management district; and WHEREAS, RCW 36.61.270 further stipulates that the method of foreclosing on liens for delinquent rates and charges shall be subject to the provisions of Chapter 36.94 RCW; and WHEREAS, RCW 36.94.150 stipulates that liens for rates and charges shall be foreclosed in the same manner as foreclosure of real property tax liens; NOW THEREFORE BE IT HEREBY RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS for Mason County as follows: 1.
