Call to Order—The Chairperson called the regular meeting to order at 9:02 a.m. 2. Pledge of Allegiance—Jeremiah Welder led the flag salute. 3. Roll Call — Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 2— Kevin Shutty; Commissioner District 3 —Terri Drexler. 4. Correspondence and Organizational Business 4.1 Correspondence 4.1.1 Washington State Liquor and Cannabis Board sent a liquor license application for Eldon Store 36870 N US Highway 101, Lilliwaup, WA. 4.1.2 Washington State Liquor and Cannabis Board sent in two marijuana license applications, the first for Bayshore Cannabis Co. 3831 Highway 3, Shelton, WA.; the second for I502 Gardens 1069 West Kamilche Lane, Shelton, WA. 4.2 Jeremiah Welder, Drug Court Participant 4.3 Public Notice: Spring application of herbicides for vegetation control along county roads on or after Wednesday, March 7, 2018. 5. Open Forum for Citizen Input— 5.1 James Manlay spoke about a meeting at Spencer Lake with the Sheriff's office. He said the topic of available space in the jail was discussed and asked the Board about the Comprehensive Plan. Cmmr. Neatherlin said there is a facility Comprehensive Plan that he can refer to. 6. Adoption of Agenda - Cmmr. Shutty/Drexler moved and seconded to adopt the agenda as published. Motion carried unanimously. N-aye; S-aye; D-aye. 7. Approval of Minutes— February 23, 2016 Regular Meeting Minutes; February 6, February 20 and February 27, 2018 Regular Meeting Minutes. Cmmr. Drexler/Shutty moved and seconded to approve the February 23, 2016 Regular Meeting Minutes and the February 6, February 20 and February 27, 2018 Regular Meeting Minutes. Motion carried unanimously. N-aye; S-aye; D-aye. 8. Approval of Action Agenda: 8.1 Approval of the Public Safety Testing to provide Corrections Corporal and Sergeant promotional written and assessment center testing in the amount of $7,675 plus associated travel expenses as outlined in the agreement. 8.2 Approval to appoint Patricia Jerrells and Lorilyn F. Rogers to the Mason County Historic Preservation Commission to fill the balance of terms ending in November 2019. 8.3 Approval of Warrants &Treasure Electronic Remittances Claims Clearing Fund Warrant #s $ Direct Deposit Fund Warrant #s 47913-48275 $ 669,009.33 Salary Clearing Fund Warrant #s 7003438-7003466 $ 475,843.44 Total $ 1,144,852.77 8.4 Approval to appoint Tamara Cowles to the Noxious Weed Control Board representing Weed Control District 3 for a term ending March 6, 2022. 8.5 Approval to appoint Joel Harper to the Lewis-Mason-Thurston Area Agency on Aging for terms ending March 6, 2020. BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS March 6, 2018 - PAGE 2 8.6 Approval to authorize Public Works to procure a consultant to assist with collecting roadway data and creating the County Road Safety Plan, as well as authorize the Chair to sign all pertinent documents. 8.7 Approval to authorize Public Works to sole source the purchased services/parts from Huber Technology, the manufacturer of the screen units used at the Belfair Water Reclamation Facility. 8.8 Approval to authorize the County Engineer to execute the Federal Lands Access Program Proposal for a road realignment project on Skokomish Valley Road, as well as approval to authorize the Chair to sign all pertinent documents for the project. 8.9 Approval to authorize Public Works to purchase a used 2016 Caterpillar CS54B Vibratory Soil Compactor from NC Machinery, as a special market condition purchase, in the amount of$97,584.90. (Ex.A-Res. 14-18) 8.10 Approval to set a public hearing on Tuesday, March 27, 2018 at 6:30 p.m. to inform citizens of the availability of funds and eligible uses of the state Community Development Block Grant (CDBG) and receive comments on proposed activities, specifically, funding the Community Action Council of Lewis, Mason &Thurston Counties, as well as receive comments on the 2017 program. 8.11 Approval of the following Mason County Officers, Employees, and Volunteer(s) request for Defense and Indemnification coverage as named defendant's in the Megan Elliot, Civil Action 3:17-cv-06067 RJB United States District Court Case served upon them on January 9, 2018: Joel Nault, George Albertson, Alfonso Mercado, William Philpott, Casey Salisbury, Jeff Rhoades, Jim Barrett, Matthew Gray, Nathan Smith, Russ Osterhout, Ryan Spurling, Tim Ripp, and Trevor Severance. 8.12 Approval of two winter 2018 Mason County Heritage Grants. The first to the Mason County Historical Society in the amount of $4,500; the second to Pickering Community Club in the amount of $3,049.29 for a grand total of$7,549.29. 8.13 Approval to sign a letter to Governor Inslee regarding the Economic Opportunity Zone (EOZ) program created by the Tax Cuts and Jobs Act passed by Congress in 2017. 8.14 Approval to have the Board sign a one year Mason County Park Host contract with Clayton Casto for Sandhill Park, with a provision for extending additional years upon agreement from both parties. Cmmr. moved and seconded to approve action items 8.1 through 8.14 with the removal of item 8.3. Motion carried unanimously. N-aye; S-aye; D-aye. 8.3 This item was removed due to an incorrect total. Cmmr. Drexler said the total should read $1,122,852.77 Cmmr. Drexler/Shutty moved and seconded to approve the warrants and electronic remittances in the amount of$1,122,852.77. Motion carried unanimously. N-aye; S-aye; D-aye. 9. Other Business (Department Heads and Elected Officials)-None. 10. 9:30 a.m. Public Hearings and Items set for a certain time- No hearings. 11. Board's Reports and Calendar -The Commissioners reported on meetings attended the past week and announced their upcoming weekly meetings. Adjournment—The meeting adjourned at 10:07 a.m. BOARD OF COUNTY COMMISSIONERS ATTEST: MASON COUNTY, WASHINGTON Mel' sa ry, Clerk f the Board Randy Neatherlin, dair Terri Drexler, Corhmissioner iws4v,:�- Kevin Shd y, Commissioner Exhibit A RESOLUTION NO. j4-1 A RESOLUTION WAIVING PUBLIC BIDDING REQUIREMENTS AND APPROVING A SPECIAL MARKET CONDITION PROCURMENT OF CATERPILLAR VIBRATORY SOIL COMPACTOR FROM NC MACHINERY WHEREAS, RCW 39.04.280 (1) (b), allows for exceptions from standard bidding procedures based on special market conditions and sole source findings for qualifying purchases; and WHEREAS, the Board of County Commissioners approved the purchase of a vibratory soil compactor in the 2018 budget; and WHEREAS, the County Purchasing Policy requires a resolution to waive bidding requirements over $25,000. WHEREAS, the used equipment has been identified that fits the specific needs of the County at a very favorable price and may be sold before the County could complete a formal bidding process; NOW, THEREFORE, BE IT RESOLVED by the Board of Mason County Commissioners as follows: Section 1. RCW 39.04.280 authorizes the Board to waive standard competitive bidding requirements for the purchase of equipment where "special market conditions"exist for procurement of the equipment. To the extent any bidding requirements apply to the purchase of the equipment, in light of findings of fact set forth herein, the Board finds that special market conditions under RCW 39.04.280(b) exist and that all bidding requirements (if any) are hereby waived for the purchase of the specified vibratory soil compactor. Section 2. Special market conditions include: a) The vibratory soil compactor is being offered at a very favorable price to Mason County. b) The compactor may be sold by the provider before the County could complete a formai bid process. c) The equipment is needed for a specific purpose and is suitable to the unique needs of the Public Works Department. No other equipment has been found at the price that meets the needs and budget at this time. Section 3. The purchase of(1) 2016 used caterpillar vibratory soil compactor CS54B in the amount of $97,584.90 from NC Machinery, is hereby approved.
