Dear Mr. Garcia,
As you are aware, our office received and investigated a
complaint regarding the operation of an illegal painting business
in February, 2000 . In addition, another complaint was forwarded
to our office on August, 28, 2000 .
To remind you of the conversation that took place on 2 7/00 ,
you stated to the inspector that you did not do any painting at
that site and that you only painted at Airport Auto Wrecking on
Hwy 3 in Kitsap County. You were informed of the requirements
for a commercial business at that time but insisted that it did
not apply.
The complaint which was received on 8/28/00, which resulted
from a visit from the Mason County Sheriff' s Department, again
alleges that a "commercial painting business" is in operation at
this site .
Mason County has adopted by ordinance, various codes which
pertain to this type of operation. These codes assure that
life/safety measures are met for the occupants or employees of
the business and surrounding adjacent parcels who may be affected
by the activity and that the appropriate environmental protection
is in place. It is necessary to obtain permits from both Mason
County and other regulatory agencies within the State of
Washington to conduct this type of business . I have included a
copy of the Violations and Penalties section of Mason County
Ordinance 45-99 .
If the activities on site continue and are deemed to he in
violation, I will proceed to request citations of Public Nuisance
with each separate day that it continues to be considered
separate offense .
At this time, please cease and desist all commercial
activities occuring at 110 NE Ponderosa Rd. , Belfair, WA un-it
all applicable permits from the State and County have been
obtained. Further activity which is deemed to be illegal w' ll
result in enforcement action as authorized under Mason Coun y
Ordinance 45-99, Section 14 . 12 . 030 . Referrals have also be n
made to these other agencies regarding the most recent comp aint .

towards your proposal .
