Sincerely, Kell McAbov Land Use Planner Mason County Planning Department 12/14/2006 Page 1 of 3 SP12006-00314 Site Inspection 12/14/2006 Case No.: SP12006-00314 Comments: Pre-inspection for Patrick Wheat for the purpose of determining planning regulations related to the proposed remodel and/or expansion of an existing Accessory Dwelling Unit (ADU) located on the south shore of Hood Canal. The existing ADU is approximately 10' from the edge of the rock face bulkhead (a.k.a. the Ordinary High Water Mark-OHWM) at its closest point. Current regulations under the Resource Ordinance require a minimum 35' building setback from the OHWM on saltwater shorelines. Therefore, the ADU is considered a legal non-conforming structure, as it does not conform to the current setbacks. Remodel and/or repair of a non-conforming structure is allowed per the Mason County Resource Ordinance (MCRO) 17.01.110 F.1.a. plus a 10% expansion, as long as the modification does not increase any intrusion into the Fish and Wildlife Habitat Conservation Area (FWHCA) or its buffer. The current footprint of the ADU is 1,336 square feet. This footprint includes all covered porches and roof eves. A 10% expansion of the footprint allows for a maximum of 1,470 square feet (including all covered porches, roof eves, etc). Per the Mason County Development Regulations (MCDR) 1.03.029 ADUs shall not exceed 1,000 square feet. The current amount of living space in the ADU is 847 square feet. The living space of the ADU can increase by 153 square feet. In summary, the ADU can increase in overall footprint by 134 square feet, as long as the expansion does not get any closer to Hood Canal. The living space of the ADU can increase by 153 square feet. Decreasing the amount of outdoor covered areas can do this. The proposal also includes raising the floor of the structure by 3' for the purpose of flood protection. Stairs/landings needed for ingress/egress are allowed in addition to the 10% expansion as long as they are the minimum size necessary per the building department for safety. Height limit per Mason County Development Regulations 1.04.224.0 is 35 feet. Mr. Rozon• At your request planning department staff conducted a site inspection of the above referenced residence (Wheat cabin, east side of property) to determine applicable shoreline regulations. Development of this site is regulated by the Shoreline Master Program (SMP) . This stretch of shoreline is "urban residential" . You had asked us to consider both a remodel of the cabin and construction of a new residence. Remodeling of the existing cabin would be allowed, both within the existing footprint and landward (17 feet or more from the face of the bulkhead, which is the nearest current wall to the shoreline) . Applicable codes would apply to all new development, including the minimum 5 foot setback to the property line (the residence currently encroaches on this setback) . The setback is measured to the drip line of the structure. If repair work to the structure is evaluated by our Building Department as consisting of greater than 60 percent repair (based on separate evaluations of the current status of each component of the residence, i.e. , foundation, walls, plumbing, electrical, roof, etc. ) , then the development is considered new construction and must meet all current codes, including shoreline regulations . The same current regulations apply if you decide to remove the existing cabin and build a new residence. This lot poses a particular problem in that regard due to the fact that there are two residences on one lot . The SMP only allows one primary residence per lot . To build a secondary residence (considered "accessory living quarters" ) requires a shoreline substantial development permit (a public process requiring approval by the county commissioners) and one of the limitations is that the maximum allowable size is 1, 000 square feet. An alternative would be to short subdivide the property into two lots . The location of the new residence would be determined by averaging the setback of the residence to the east (33 feet) with the minimum default setback (15 feet) on the west for an average setback of 24 feet . All portions of the structure exceeding 30 inches in height would have to be located behind this setback. Were the property short subdivided, this evaluation would change in that the McConkey residence would then affect the setback on the Wheat property. All applicable environmental health (on-site septic system, water adequacy) and building (uniform building code) codes apply. Patrick Wheat Substantial Development Permit #94-26 Issued 10/25/94 by Mason County Expires 10/25/99 This Shoreline Permit for Substantial Development was approved by the County Commissioners and issued to Patrick Wheat on October 25, 1994 with the 5 conditions recommended by staff, and Commissioners added condition #6 . The Mason County Commissioners adopted the staff report written by Jason Manassee and dated October 17, 1994 as their Findings and Conclusions and Order. The following conditions are hereby attached to permit . Conditions 1 . The float structure shall not exceed an overall length of 100 feet . 2 . No more than 20 percent of the total area of the float structure shall ground out on the beach. The grounded portions of the structure shall run parallel to the shore and shall either be attached to the float or be molded into the float. The remainder of the bottom of the float structure shall be maintained at a minimum of eight (8) inches above the substrate. 3 . The floats, and associated moorings shall be located to avoid shading of eelgrass and other aquatic vegetation. 4 . If styrofoam float logs are to be used, they shall be fully encased in wood or other method of encasement to prevent the breakup of Styrofoam. Other methods subject to Dept. of Community Development approval . 5 . As per plans, the structure shall be maintained a minimum of 10, from the adjacent east property line for the entire length of the structure. 6 . Alternative untreated wood piling can be used.
