FACTORS CONSIDERED 1) Landowners goals were considered through a review of the septic permit application and site development plans. A site visit was conducted to the property and various phone conversations were held with the landowners. 2) Bald eagle habitat use was considered by analysis of territory integrity through time, current surrounding habitat conditions, review of the previous draft plan written for the territory, current status of the population, and scientific literature concerning bald eagle habitat protection. BACKGROUND The Union Bald Eagle Territory is located in Mason County approximately 1 .2 miles southwest of Union (Figure 1) . The Washington Department of Fish and Wildlife (WDFW) has been monitoring the territory since 1980. A total of four nest trees have been identified within the territory .(Figure 2) . All nest trees are located on a ridge, east of Highway 106, that overlooks the Skokomish Flats area within Anna' s Bay. The area to the east of the top of the ridgeline above the nests has been subdivided into multiple lots . The installation of some roads and residential development has occurred in this area. Significant bald eagle habitat continues to exist below the ridgeline. A mature conifer stand with remnant old growth trees is present within the nesting site. An access road has, however, been constructed along the lower portion of the ridge and a home is presently located approximately 70 feet north of Nest #1. The Union Bald Eagle Territory has exhibited very low productivity since efforts were initiated to monitor the site. The WDFW has only documented the eagle pair to have successfully produced two eaglets since 1981 . The exact cause of the low reproductive success of the Union eagle pair is not known. Human disturbance during the nesting season may have contributed to the nesting failures . An on-going study is presently being conducted and will hopefully provide more information about the low bald eagle productivity documented within the Hood Canal. During the aerial survey conducted by the WDFW for the 1995 season all nests were observed but no bald eagle nesting activity was documented. A single adult was observed perching on Nest #1 during the productivity survey conducted. on June 13, 1995 . A general draft Bald Eagle Management Plan for the Union Territory was written by WDFW Area Biologist Greg Schirato in 1991 . This plan defined a Core Protection Zone around the nest trees inwhich no tree removal or development was to occur. A Secondary Protection Zone extended from the ridge line to 1300 feet from the nest trees (Figure 2) . Home construction and minimal habitat removal were allowed within this zone outside of the bald eagle breeding and nesting season. In late 1992 Mark and Joan Corley purchased 23 lots, approximately 30 acres, of the Vuecrest Estates Development within the Union Bald Eagle Territory (Figure 3) . Seven of the lots (Lot lA - 7A) have most of their property over the ridgeline, within the Core Protection Zone. Part of these lots, as well as part of seven other lots (Lot 1B - 7B) are within the Secondary Conditioned Zone (Figure 4) . All lots east of the ridgeline have previously been logged and presently contain a young mixed stand of conifer and deciduous trees . Large mature and old growth conifer trees are located below the ridgeline on the western lots . The landowners are presently proposing development on four of the lots (Figure 5) . They have submitted an application to install a septic system on Lots 7A-B as soon as possible. In the future they intend to construct a multi-level residence of approximately 3000 square feet on Lot 7A. They also intend to construct a four stall horse barn on Lot 6A and a covered 60 ' X 100 ' riding arena with open sides on Lot 6B (Figure 6) . All proposed site development is within the Secondary Conditioned Zone defined in the previous plan. An access road and driveway had previously been cleared on the property. Understory vegetation and small trees have been removed on parts of Lots 6A and 7A. The remainder of all other lots, except Lot 9C which has been sold, have been reclassified from residential to timber land for tax purposes . The goal of the landowners is " the development of a vital and healthy forest that protects wildlife, provides recreation, and produces income from selective timber harvesting The concern of the WDFW is that residential development may remove important eagle habitat . Construction activities and future human activity could cause nest failure or abandonment. The purpose of this management plan is to allow for development while protecting the long term integrity of the eagle territory by protecting existing habitat. Timing restrictions are implemented to minimize disturbance during the bald eagle breeding and nesting season. CONDITIONS The following conditions apply to protect bald eagles and their habitat: 1) All trees > 6 inches in diameter at breast height (DBH) shall be retained on the property except for trees in the path of the driveway, home foundation, septic system, horse barn, and riding arena. * Exception - All danger trees within 15. feet of the barn may be removed. 2) Future danger trees may be removed if trees are identified as hazardous by a professional forester. A written report from the forester must be submitted to the Washington Department of Fish and Wildlife (WDFW) before approval to remove the hazard trees is granted. 3) The removal of deciduous trees/understory vegetation shall be allowed to maintain water views from the homesite. Conifer trees may be limbed but no more than 50 percent of the live crown of any tree shall be removed. 4) No tree cutting, clearing, heavy equipment operation, septic system installation, road or outside home/barn construction shall occur from February 1 - July 15 of any given year. 5) The discharge of firearms, fireworks, and explosives is prohibited during the bald eagle breeding and nesting period February 1 - July 15 of any given year. 6) This plan was developed specifically for proposed development activity on four lots . If further development or the harvest of trees > 6 inches DBH is proposed for any lots within the Core or Secondary Protection Zones a new Bald Eagle Management Plan will need to be obtained by the landowners . REVIEW AND AMENDMENT This plan will be subject to the following review and amendment procedures . The plan may be reviewed periodically by the Washington Department of Fish and Wildlife (WDFW) to determine whether: 1) the plan requires amendment in response to changing eagle and landowner circumstances; or, 2) the terms of the plan comply with applicable laws and regulations; or, 3) the parties to the plan are complying with its terms . APPEAL PROCEDURE In addition to the provisions of WAC 232-12-292 (7 . 1) = (7 . 3) , the landowner may request a formal appeal of WDFW actions according to the Administrative Procedures Act, Chapter 34 . 05 RCW, and the Model Rules of Procedure, Chapter 10. 08 WAC. Such a request shall be filed with the Department within 20 days of receipt of the contested WDFW decision. The appeal request shall clearly state the relief sought and the grounds for the appeal. COMPLIANCE Failure to comply with this plan constitutes a misdemeanor as set forth in RCW 77 .21. 010. This plan applies only to the proposed land use listed above. Any other proposals may be subject to a different set of conditions . It is the landowner' s responsibility to notify the Washington Department of Fish and Wildlife (WDFW) of any new proposed land use activities .
