An environmental impact statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the quality of the environment. The purpose of this checklist is to provide information to help you and the agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be done) and to help the agency decide whether an EIS is required. Instructions for Applicants: This environmental checklist asks you to describe some basic information about your proposal. Governmental agencies use this checklist to determine whether the environmental impacts of your proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise information known, or give the best description you can. You must answer each question accurately and carefully, to the best of your knowledge. In most cases, you should be able to answer the questions from your own observations or project plans without the need to hire experts. If you really do not know the answer, or if a question does not apply to your proposal, write "do not know" or"does not apply". Complete answers to the questions now may avoid unnecessary delays later. Some questions ask about governmental regulations, such as zoning, shoreline, and landmark designations. Answer these questions if you can. If you have problems, the governmental agencies can assist you. 'J The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of time or on different parcels of land. Attach any additional information that will help describe your proposal or its environmental effects. The agency to which you submit this checklist may ask you to explain your answers or provide additional information reasonably related to determining if there may be significant adverse impact. Use of Checklist for Non-project Proposals: I Complete this checklist for non-project proposals, even though questions may be answered "does not apply". IN ADDITION, complete the SUPPLEMENTAL ACTIONS (part D). There is a fee required, for the processing of the checklist, see above for the appropriate fee. Please make your check payable to "Mason County Treasurer'. For non-project actions, the references in the checklist to the works "project", "applicant", and "property or site" should be read as "proposal", "proposer", and "affected geographic area", respectively. Salmonids are salmon, trout and chars, e.g. bull trout. For our purposes, "ESA Listed Salmonids" is defined as fish species listed as endangered, threatened or being considered for listing. If ESA listed species are present or ever were present in the water shed where your project will be located, your project has the potential for affecting them, and you need to comply with the ESA. The questions in this section will help determine if the ESA listings will impact your project. The Fish Program Manager at the appropriate Department of Fish and Wildlife (DFW) regional office can provide information for the following two questions. 1. Tacoma, Washington 98499 Re: Tveten property Gr-eat Bend Waterfront tracts Mason County Ken: Enclosed is a memo from the Prosecuting Attorney' s office explaining the exemption from the short subdivision requirements when a parcel is divided by a county road. This exemption allows the Tveten property to be divided so that the upland lots can be permitted separately from the lower area now permitted for the RV park. Please be advised that because of the division of property, the waterfront lots become legal non-conforming parcels because they do not meet the minimum 12500 square foot size requirement . In the event that a septic system should fail a new system could not be installed because of the required set-backs and area criteria. Therefore, I would encourage you to discuss with your client the possibility of an easement across the road to a parcel that would accomodate drainfields for the lower parcel . Also, it should be understood that any expansion of the existing RV permit would not be allowed under current regulations . I hope this information will be helpful in resolving your clients permit process . A recurring problem is the situation :There land in single or common ownership is divided by a county road. If the owner chooses to sell a Portion of the tract separated by the roadway, is he required to apply for county approval of a short-subdivision under Chapter 16.36 of the Mason County Code before the sale? Our andwer is Section 16.36.010 of the code requires county short sub-division approval In "(e)very division of land, for lease, sale or transfer of ownership", where the land is divided into two or more but less than five pieces. Buz the effect of section 16.36.010 is limited by section 16.08.310 of tfte code which defines "land" as: "A11 property or parcels of property in a single or unified ownership *** that are contiguous or abutting upon each other *** chat are noc separated from each other by oublic roads *** A fundamental rule of statutory construction requires that a word or phrase ins a wriccea Law be given it's plain and ordinary meaning unless the lord ar phrase is given .a specific meaning elsewhere is the same lair. This rule applies in :his instance. While the word "land" is noc specifically defined by the state statute dealing with Plats--Subdivisions--Dedications (See Ch. 58.17 RCti) , it is specifically defined in the Plats and Subdivisions chapter of the %ftson County Code. Section 16.08.310, defining "land," excludes from it's definition of "Land" all property or parcels of property "separated from each ocher by public roads." In ocher words, Land separated by a public road--in this case a county road--is noc included within the county code definition of "land." 4 Since land separated by a county road is not considered "Land" by code definition, the requirecencs of Chapter 16.36 (Shore-Subdivisions) of the Mason County Code do not apply. Compare section 16.08.310 with section 16.36.OLO.
