When I received my house permit,I had exactly the same reaction. For example,as written,the provisions require the use of certain epoxy on foundation ties. Common sense says that you would only need to use epoxy on ties that are added to an existing,set foundation but that is not what the permit form requires. There are also other requirements that deal with geo-tech reviews etc which,as written,require geo-tech review of certain aspects of the project,even if the site/permit/engineering doesn't require any geo-tech work at all. I would suggest that you review his permit application(which I have not seen and know nothing of other than its a garage) and determine which of the sections he complains about in his letter even apply. Martin This letter is in response to your letter of 5 February, 2008 informing me of county refusal to issue my garage building permit because I signed some portions of the, "Conditions for Bld2007- 00053", with the statement, "under duress, without prejudice." In answer to your first concern, my signing Under Duress had nothing to do with the"Mason County staff or their Permit Center's customer service." My concerns are associated with thinking that after submitting all the engineering drawings and other associated paperwork, and writing a check for the fees, that I would be out the door and building a garage. I had no idea that the county would be asking me to enter into 26 contracts with j them over things I was not informed enough to make a decision on. I If you have been watching the news, you must realize that our country is in the midst of financial ruin because millions of people signed mortgages without thinking of the consequences of what they were signing. This disaster would not have been possible 30 years ago when people were taught to read and understand everything they signed before putting their signature on a document. Also, in those days, no one (or no organization) would even think they could push 26 contracts in front of someone and say, "sign Z papers" and expect the person to do so without reading and understanding what he is signing. Since receiving your letter, I have talked to an architect friend, my engineer(when he came back from vacation), and others - one of which is President of Kitsap Aliance of Property Owners (KAPO). He thought I should include in this letter a reminder that RCW 62A.1-207 and its Federal equivalent, make it clear that no one can be made to sign away a constitutional right in any contractual agreement that is demanded by another party. j I RCW 62A.1-207 states, "(1) A party who, with explicit reservation of rights performs or promises performance or assents to performance in a manner demanded or offered by the 1 other party does not thereby prejudice the rights reserved. Such words as "without prejudice", "under protest" or the like are sufficient." Therefore, State Law gives me the right to ensure my constitutional rights are not being signed away as a result of wanting to build a garage, and I should have been issued my permit a month ago. Both State and Federal statute tell me that if I want to ensure I am not signing away a right, then I simply write "under protest, without prejudice," and I plan to exercise this right, under the law. Some of the 26 contracts the county wanted me to sign were, in my opinion, partially or in whole asking me to sign away constitutional rights, which I will refuse to do. They should be reworded for my sake and the sake of all other Mason County residents. Others were in my opinion outside the authority of the county as it pertains to my garage, and I would like these things omitted or reworded. I have been informed that case law pertaining to UCC 62A.1-207 in Dolan vrs California Coastal Commission and Nolan vrs City of Tagert, has found that a building permit cannot be held back for reasons that the governing authority did not have the power to require apart from the building permit. With this background, I have grouped the 25 line items, plus the final signature paragraph (which I will call item 26 into three categories. Attachment One is a breakdown f h item under a o o each to u de each of g the following categories: CATEGORY ONE ITEMS I have no problem signing, they pertain to my building permit for a garage, do not ask me to sign away current or future constitutional rights and my engineer sees no problems CATEGORY TWO ITEMS I have a problem signing based on current wording as it applies to my permit, please reword or explain so that it can go to Category One. All construction must be in conformance with the international codes as amended and adopted by Mason County. ' X 7) All building permits shall have a final inspection performed and approved by the Mason County Building Department prior to permit expiration. X 8) The international code requires a fire apparatus access road for every facility, building, or portion of a building that is more than 150' from an approved access road. Roads are required to meet the minimum Mason County Fire Marshal standards for Fire Apparatus Access Roads up to the point where such roads connect with a county maintained public road or to another fire apparatus access road which connects to a county maintained public road. X 13) All approved plans are required to be on-site for inspection purposes. If an inspection is called for and plans are not available on site, then approval will not be granted. Mason County Building Department requires that this be completed prior to calling for any site inspections. A re-inspection fee based on rates as adopted by the jurisdiction and the international codes will be assessed if the owner and/or contractor fail to post the address on site prior to requesting inspections. Setbacks are measured from the furthest projection of the structure. X 21) The "approved" site plan is required to be on-site for inspection purposes. X i Attachement One to Kevin Lea Letter of March 10, 2008 2 CATEGORY TWO ITEMS I HAVE A PROBLEM SIGNING BASED ON CURRENT WORDING AS IT APPLIES TO MY PERMIT, PLEASE REWORD OR EXPLAIN 4) Strong tie epoxy shall be installed per manufacturer specifications and as specified in ICC evaluation report ESR-1772, attached to the approved building plans. Adhesive anchor installations require special inspection in accordance with the International Building Code, Section 1704. Special inspections shall be performed by the engineer of record, a WABO Certified special inspector, or a certified testing laboratory to verify that the installation is installed in accordance to manufacturer specifications. The special inspector shall complete a report in accordance to ESR- 1772, section 4.4 and submit the findings to the Mason County Building Department for review and approval prior to the framing inspection of the project. The special inspection report shall also be available on-site for the Mason County Building Inspector. X My engineer says that it is acceptable to put the strong ties in during the pouring of the foundation wall and may be less expensive. The wording of this note seems to imply that strong ties are required to be drilled and cemented with epoxy. Needs to be reworded to allow other methods accepted by engineering. 9) Provisions for surface/subsurface drainage control must be implemented with new construction or development on site and MUST NOT adversely impact adjacent parcels. Under the requirements of Mason County Stormwater Ordinance, either private ditches and drains will meet requirements of the stormwater ordinance or prior approval will be granted to use an existing utility and drainage easement dedicated for that specific purpose. For further information regarding this ordinance and the REQUIREMENT to obtain an ACCESS PERMIT for the installation/construction of a driveway or access connecting from a Mason County Road, Contact the Mason County Public Works Department prior to construction at Ext 450. For any construction which is proposed to be located within 25' of a Mason County road right of way, it is suggested to contact that office to review future planned work which may affect your project. X The geotechnical report does not require any extra Stormwater control (due to the type of soils that are on site). The engineering drawing for the garage does not stipulate any special Stormwater I requirements. Is the building permit approved without special storm water controls or not? If it is, then above should be deleted. When I walk out with a building permit I want to know that I have all the permits I need to build the garage, no surprises months from now. It is the responsibility of the applicant to make the corrections indicated on the plans. Once the plans are marked "APPROVED", they shall not be changed or altered without authorization from the Building Official. The permit holder is responsible to retain the complete approved set of plans on site for the duration of the project. Failure to comply and/or removal of approved documents will result in failure of required building inspections. X I haven't seen the "plan review check list and corrections." How can I be responsible to change the plans per this corrections sheet when I am not allowed to change the plans per 3 above? Seems like this should be deleted. 15) All property lines shall be clearly identified at the time of foundation inspection. X There are only two property lines that affect the garage construction—the North and the West. There is absolutely no reason to mark the East line or the South line. The North line is no problem to identify and will be. Marking the West line is not even remotely practical for my building site. It is a curved property line (because the road curves). Portions of the line are in the air because there is no ground there now or when excavation is completed for pouring the foundation. The property line and setback line on the plot map were computer generation by the surveyors after finding property stake corners. My engineer then positioning the garage with setbacks from the existing house. This ensured proper setback from the curved western line. Therefore, if the garage is located properly in relation to the existing house, then the setbacks from the property line will also be proper. Request that this be reworded to support my situation. I can have lines pulled off of the house so that the inspector can verify proper location of the garage in relation to the house, thus ensuring I am in compliance with the required setbacks. 19) Per 2003 IRC - SECTION 1609 - WIND LOADS - 1609.1 Applications. Buildings, structures and parts thereof shall be designed to withstand the minimum wind loads prescribed herein. Decreases in wind load shall not be made for the effect of shielding by other structures. Per FIGURE 1609 BASIC WIND SPEED (3-SECOND GUST)the wind speed for Mason County is 85 MPH. X My Engineer, per county requirements, has submitted his engineering calculations. Are they approved? If you are thinking that my engineer failed to engineer to this requirement, then why not tell me to have him fix it instead of asking me to sign a contract about something I don't know anything about, all the time knowing that my engineer was not in compliance? 24) An inspection performed by a representative of the geologist, their authorized representative, or engineer of record, shall be completed on-site prior to the footing pour to verify that earthwork and foundation installation activities comply with the Geotechnical report or assessment recommendations. The geotechnical report did not require a special inspection or assessment recommendations for footing pour. I respectfully request that this boiler-plate requirement be removed to prevent potential costs associated with delaying my concrete pour because of the need to get the Geotech out. What if he is on vacation or otherwise unavailable when the concrete guy is ready to pour? My ground guy might be removing about a foot of ground to prepare for footings. The soils are the same now as when we will be setting footings and the Geotech has seen that the soils are very suited for construction and previous excavation has completely removed any possibility of tree stumps etc. Also,why do I have to call the County Inspector out before the footing pour if I have to get a Geotech before the pour and before the inspection? If the Geotech says it is ok, then why call for the county? If the county inspector is capable of looking at dirt and making a determination it is ready for the pour, then why call the Geotech? Please consider what this double inspection requirement does to scheduling concerns and cost to the homeowner and the concrete contractors in the county. Bremerton shipyard doesn't double inspect nuclear engineering work; this is a garage! In addition a final inspection report, prepared by a representative of the geologist, their authorized representative, or engineer of record shall be required to verify that erosion control, drainage and final work is completed in accordance to the Geotechnical report or assessment recommendations. Reports shall be submitted to the Mason County Building Dept., PO Box 186, Shelton, WA 98584, prior to the footing and final inspections and available for inspection. X Respectfully request that this be dropped for nearly the same reason as above. There are no special erosion controls required. The only issue is that the downspouts are to empty on the ground on the south side of the garage. The inspector should be able to see that this is done,without having to hire the Geotech to come out again to see downspouts going to the ground. X I'm not getting occupancy for a garage/storage area. How can a permit be revoked during the building of something that doesn't even have occupancy? Is this saying that the permit lives on after final inspection? Is this saying I can't pull my car into the garage to change the oil until I get the final inspection? If it does mean this, but I do change my oil in the garage instead of the rain, will you revoke my permit? If you will, what does revoke mean, and what does it take to get un-revoked? 11) All permits expire 180 days after permit issuance, or 180 days after the last inspection activity is performed. The Building Official may extend the time for action for a period not exceeding 180 days, upon the receipt of a written extension request indicating that circumstances beyond the control of the permit holder have prevented action from being taken. No more than one extension may be granted. X In light of our current collapsing economy I will not sign this as written. The State has no compelling interest to make me sign this or to force its citizens into arbitrary time constraints that they don't even comply with when undergoing their own construction projects. In the last couple of weeks, hundreds-of-thousands of Americans have had their home equity lines frozen. Credit is drying up. Last week, the Fed Chairman told Congress that banks are going to be failing this year. Many contractors in the building business are going bankrupt, etc. I am sure these concerns are being discussed as they pertain to the county budget and how some projects may have to be delayed, maybe some in the middle of design or construction. I am planning on using cash and doing my own construction for some of the work, but I may have to borrow if things don't go as planned. If no one is lending in a few months, then what am I going to do if I am forced to delay my construction plans for my own personal financial reasons? If I go over the time limit the County wants to force me to agree to (without compelling interest), then how much of the permit process would I have to redo? I would not get equal protection under the law because I signed this contract. 17) Retaining walls, not attached to the proposed structure, supporting a surcharge shall require a separate building permit and approval prior to construction of retaining walls. X The garage has retaining walls that are attached to the proposed structure. There are no other retaining walls associated with this building permit. This has nothing to do with my garage. I will not sign. It needs to be deleted. I can build a retaining wall today (less than four feet)without a permit. Signing this makes me get a permit for a one-foot wall. About 2 weeps after new Critical .Areas Ordinance (December 27, 06) involves new requirements for slopes on April 4, 07 Receive letter from county(dated March 22) stating that the geotechnical report is inadequate because of the new requirements that were implemented on December 27, 2006. .April 5, 07 -Present Mr. Martig, my geotechnical engineer with 40 years of experience, informs me that the new ordinance and the way it is being implemented are problematic. 11/13/2007 15:01 36OB767407 CALVARY CHAPEL PO PO PAGE 04 In particular, he refused (out of professional integrity)to comply with Point 6, of the county letter dated March 22, which in part says: "The analysis should include the Simplified Bishop's Method of Circles." His refusal is based on the fact that he and other geotechnical engineers (including a college professor) contend that the Bishops Method should only be used in very specific instances, and should not be applied to my soils and should not be in an ordinance that would force it to be used in all instances where geotechnical reports are mandated. Mr. Martig also takes exception with Point 12, which says in part that his report should recommend "preparation of structural mitigation or details of other proposed mitigation---for the 63 percent slope." The 63 percent slope being discussed is the slope that the county cut Admiral road into decades ago and has maintained since then. Several houses(including mine) have been built on the slope above Admiral road. The building of a garage has nothing to do with this slope, It was the county road department cutting in the Admiral road decades ago that did have something to do with this slope, but they knew the type of soils did not require; "preparation of structural mitigation or details of other proposed mitigation---for the 63 percent slope." April 10, 07 Mr. Martig sent the county Addendum 1 to the Sept 06 Geotechnical report to provide stability equations and safety factors(without using the non-applicable- in his professional opinion-Bishop's Circles). To my knowledge, Mr. Martig did not receive a response to this addendum, and I , did not. April 07 Mr. Martig requested that the county provide documents pertaining to how the ordinance wording was changed. May 10, 07 Mr. Martig sent the county Addendum 2 to the Sept 06 Geotechnical report to again address Stability Calculations for Till type soils and provide technical engineering justification for not using Bishops Circles calculation algorithms. October 16, 07 My Geotechnical Report is still not approved, my Building Permit is not issued and I still can't build a garage for the same reason the owners of the Salmon hatchery couldn't put up a fence.
