During my last site visit on Friday, July 17th we discussed the submittal of a letter of intent
and a site plan showing the location of water lines and risers. I also requested a plan
illustrating the mitigation work to be done in the stream and wetland. To date this
department has not received the above mentioned materials. We appreciate your attention and
cooperation in this matter.

Dear Mr. Marshall:
It would appear that, by the number of water lines and risers on the site there is the potential
to convey water to many units. If you have not already applied for a Washington State Water
Rights, it would be advisable to do so at this time. Granting of water rights may take as long
as two years. If it is your intention to build a mobile home park, it would be advisable to start
the permitting process now. That process will require a building permit, Mobile Home Park
Permit, applicable Plumbing and Mechanical permit and appropriate septic system permits
and certifications, which you do not have. This Department may condition approval of a
Mobile Home Park Permit and/or R.V. Park contingent upon the States'granting of water rights.
Any development within a designated shoreline or areas that fall under the jurisdiction of the
Mason County Shoreline Master Program must fully comply with the regulations therein.

CONSTRUCTION NOTES
------------------
1 . Check the moisture content of the soil at 7"-8" deep. If it is
too wet , smearing and compacting will result, thus reducing the
infiltration capacity of the soil . Soil moisture can be determined
by rolling a soil sample between- the hands . If it rolls into a
ribbon, the site is too wet to prepare. If it crumbles , site
preparation can proceed. If the site is too wet to prepare, do
not proceed until it dries out. The soil must be properly dry
before the installation. can proceed. Do not install the drain
field while the soils are wet.
2 . Use extreme care in site prep. Remove "no" top soils . Use care
in tree and stump removal. Leave root systems intact .
3 . Trench bottoms must be level, which means the drain field must
be installed following the contours of the slopes .
4 . If a "D" box is used, speed levelers must be used.
5 . Brush piles and debris is not to be burnt on top of the proposed
drain field sites .
6 . Do not deviate from this design with-out permission from the de-
signer .
7 . Drain field sites are to be roped off , for protection of the sites ,
prior to and during the construction of the home. No traffic of
any type is allowed on top of the drain field sites . Soils can
be damaged easily and the infiltration rate can be lost, making
the proposed sites unusable for a drain field. Care must be used .
8 . Maintain a minimum of 10 ' separation from drain fields to any
water supply line under pressure .
9 . Maintain a minimum of 100 ' from any standing water unless other-
wise OK ' ed by the designer and the County Health Department . If
you cannot maintain the 100 ' from the drain fields to surface
water, stop work and notify the designer at once .
10 .The curtain drain( if required by . designer or health dept ) is to
be installed a minimum of 8" into compaction and tight-lined to
day-light, meeting all county codes . See attached sheet for de-
sign of a curtain drain, if required.
11 . Wheels and tracks of equipment are not to come in contact with
infiltrative surfaces .
12 .The side-walls of the excavated trenches are to be raked to open
the infiltrative surfaces . The bottom and side-walls must be left
with a rough open surface.
13 . Filter screens are to be used on the outlet side of the septic
tank . These screens are to be used to screen the fine solids
from the effluent prior to final disposal into the soils . These
screens must be made accessible for cleaning purposes .

1 ) No vehicular traffic is allowed on the septic tanks . Sleeve the
pump line where it is driven upon.
2 ) Where the pump line crosses the seasonal stream, the line must
be protected and sleeved following the specs as laid down by
WAC 246-272-09501 .
3 ) A pretreatment system is required that meets or exceeds treat-
ment standard 2. In this case a Multi-Flow ( 500 gal ) preceded
by a trash trap.
4 ) The drain field can be installed on a gravity feed type system
using a D-box with rubber grommets and speed levelers . Main-
tain a minimum of 12" of vertical separation.
5 ) Once the drain field has been installed and inspected by the
County Health Dept. , it is to be covered with a minimum of 18"
of a good off site sandy cover. The cover is then to be seeded
with grass or sod grass used, and its growth maintained.
The cover must extend a minimum of 6 ' below the lowest trench.
6 ) This system must be installed for future operation and mainten-
ance.
7 ) The effluents will be pumped to a easement area on Lot C. The
easement is to be recorded by the property owner, Tom Marshall,
who is the current owner of both Lots C and D.
8 ) The owner of this septic system is to establish a operation and
maintenance contract with someone that is certified for this
type of system.

Dear Mr. Marshall:
This Department's (Community Development) main concerns were the: 1) injection of slash and
fill dirt into the wetlands present on the project site. 2) the proximity of fill to surface water and
adjoining wetlands.
In a letter from Steve Nichols dated January 16, 1992 the Department required you to perform
two actions: "...remove the slash and debris (fill)from the wetland site(s) as soon as conditions
allow (...no later than May of 1992)." As of my visit to the site on July 8, 1992 you had not
complied with this requirement. Secondly the Department "... asked that you bury the bottom
of the silt screen fencing as soon as possible (... no later than January 20, 1992)." You have
complied with this mitigation measure.
In Mr. Nichols'January 16 letter he noted that, "Progress will be monitored and further
(mitigation) measures may be required at a later date."
This Department will require that you remove all slash and fill dirt from the wetlands
present on the site. You have(30)thirty days to comply with this request. The Thirty days
will commence upon your receipt of this letter. At the end of the 30 day period, if you
have not complied with the above mitigation measures and agreed mitigation methods
hereafter, the Department will turn this matter over to the Mason County Prosecuting
Attorney and appropriate State agencies for further enforcement action.

We request that you provide the Department with a location map showing a suitable upland
area to deposit the removed wetland debris and fill material. The building department or this
department will contact you regarding the possible relocation of water line, located in the
northeast quarter of lot D.

Dear Mr. Marshall :
The direction of your case was agreed upon at a meeting on January
15, 1992 . At this meeting we discussed the planning department' s
concerns regarding the lack of mention on your FPA of the creek
drainage or the wetlands present on the site. This omission
circumvented environmental review (Mason County Environmental
Policy Ordinance 99-84) and led to an incomplete review of the
project . It also led to a lack of protection for the
environmentally sensitive areas on the site and the corresponding
injection of undesirable slash into the wetland area (see diagram) .
Therefore, we ask that you remove the slash and debris from the
wetland site as soon as conditions will allow (. . . no later than
May of 1992) .
Also at this meeting we discussed the excavation and fill work done
near the wetlands on the south side of the property and the feeder
creek. It was my belief that the work done would constitute over
50 cubic yards of material and would therefore require a Mason
County Chapter 70 "Clearing and Grading" permit . But I also
mentioned that the final determination was the responsibility of
the Building Department. Don Fawver, a building inspector, has
received the complaint and will be out to the site in the near
future.
This department' s concerns regarding the excavation and fill work
include the vertical cuts (6-9 ft) left unsupported along the
adjacent property lines, as well as the proximity of the fill to
surface waters and the resultant degradation of the wetland (see
diagram) . Because of the latter, we ask that you bury the bottom
of the existing silt screen fencing as soon as possible ( . . . no
later than January 20, 1992) . * Progress will be monitored and
further measures may be required at a later date.
In regards to the unsupported cuts, I will wait for the Building
Department's comments and recommendations.

During the meeting you also mentioned that you need to do some more
work (stump removal) on your property. The intent of the posted
"Stop Work" order was to halt any further activity that may worsen
any of the situations which I have mentioned above, including
further degradation of wetlands, and any further unpermitted
filling and/or excavating. The order does not apply to work
covered under the approved FPA that will not disturb the creek
drainage or the wetlands on the site.

RE: Violation of the Hydraulics Code of the State of Washington
RCW 75 . 20 . 100 ,and 75_ 20 . 103 .
Dear Mr. Marshall :
The Hydraulics Code of the State of Washington RCW 75 . 20 . 100 states
that "In the event that any person or government agency desires to
construct any form of hydraulics project or perform other work that
will use, divert , obstruct , or change the natural flow or bed of
any of the salt or freshwaters of the state , such person or
government agency shall , before commencing construction or work
thereon and to ensure the proper protection of fish life , secure
the written approval of the department of fisheries or the
department of game as to the adequacy of the means proposed for the
protection of fish life. "
Your construction of ford on the Type 5 stream on your property
at SE, SE, Sec . 5 , T. 23N, R. 01W. is subject to approval of the
Department of Wildlife and required a Hydraulics Project Approval
from this agency. As this project was constructed without a
Hydraulics Project Approval , it is in violation of this law.
The following steps need to be taken to bring this project into
compliance with the law.
1 . A hydraulics Project Approval will be required before taking
corrective action. Enclosed is a blank form for your use.
Please complete and return to me ASAP.
2 . Per our conversation at the site on Friday July 17 , 1992 the
ford is to be removed, the stream banks returned to their
original grade , and the slopes and shoreline are to be planted
with grass preferably a wildlife or range mix.
