We observed that you mechanically land cleared 0 . 02 of an acre, and placed fill in 0 .03 of an acre of wetlands (inspector' s drawing enclosed) . Department of the Army regulations dated November 22, 1991, authorize certain activities under nationwide permits, provided certain conditions are met. Nationwide Permit 26 (33 CFR Part 330, Appendix A) authorizes discharges of dredged or fill material into nontidal rivers, streams, and their lakes and impoundments, including adjacent wetlands located above the headwaters (definitions enclosed) . Based on our investigation, we have determined that the existing work adversely impacts no more than 1 acre of wetlands located above the headwaters and appears to meet the enclosed nationwide and regional conditions; therefore, the existing work is authorized by Nationwide Permit 26, and there is no violation. The area on either side of the drainage way appears to meet the definition of wetlands. You should contact the Corps of Engineers before doing any more work in this area. The Corps of Engineers has the responsibility for determining whether a specific wetland area is within Section 404 jurisdiction. The term "adjacent" means bordering, contiguous, or neighboring. Wetlands separated from other waters of the United States by manmade dikes or barriers, natural river berms, beach dunes, and the like are "adjacent wetlands. " The term "discharge of dredged material" means the addition, including redeposition, of dredged material, runoff from a contained land or water disposal area, and any addition, f including redeposition, of excavated material . Excavation activities can include mechanized landclearing, ditching, channelization, and other excavation activities that destroy or degrade waters of the United States, including wetlands . The term "discharge of fill material" means the addition of any material used for the primary purpose of replacing with dryland or of changing the elevation of a water of the United States, including wetlands . The placement of pilings constitutes a discharge of fill material when such placement has or would have the effect of a discharge of fill material . The term "above the headwaters" means the point on a non- tidal stream above which the average annual flow is less than five cubic feet per second (cfs) . For streams that are dry for long periods of the year, the "headwaters" is the point on the stream where a flow of five cfs is equaled or exceeded 50 percent of the time . 26. For the purposes of this nationwide permit, the acreage of loss of waters of the United states includes the filled area plus waters of the United States that are adversely affected by flooding, excavation or drainage as a result of the project. The ten-acre and one-acre limits of IW 26 are absolute, and cannot be increased by any mitigation plan offered by the applicant or required by the DE. subdivisions: For any real estate subdivision created or subdivided after October 3, 1984, a notification pursuant to subsection (b) of this nationwide permit is required for any discharge which would cause the aggregate total loss of waters of the United states for the entire subdivision to exceed one (1) acre. Any discharge in any real estate subdivision which would cause the aggregate total loss of waters of the United States in the subdivision to exceed ten (10) acres is not authorised by this nationwide permits unless the DE exempts a particular subdivision or parcel by making a written determination that: (1) the individual and cumulative adverse environmental effects would be minimal and the property owner had, after October 5, 1964, but prior to January 21, 1992, committed substantial resources in reliance on Uwp 26 with regard to a subdivision, in circumstances where it would be inequitable to frustrate his investment-backed expectations, or (2) that the individual and cumulative adverse environmental effects would be minimal, high quality wetlands would not be adversely affected, and there would be an overall benefit to the aquatic environment. Once the exemption is established for a subdivision, subsequent lot development by individual property owners may proceed using MP 26. for purposes of WP 26, the term •real estate subdivision' shall be interpreted to include aireumstances where a landowner or developer divides a tract of land into smaller parcels for the purpose of selling, conveying, transferring, leasing, or developing •aid parcels. This would include the entire area of a residential, commercial or other real estate subdivision, including all paresis and parts thereof. (Section 406) i R"i0nat CondM= 1. NATIONWIDE PERMIT CONDITIONS General Regional Condition for the State of Washington applicable to all na onw de permits (NWP) : Any activity or work authorized under these NWP shall not adversely impact onsite mitigation or restoration efforts. 33 CFR Part 330, Appendix A. Section C. GENERAL CONDITIONS: The following general conditions must be followed in order for any authorization by a NWP to be valid: 1. Navigation. No activity may cause more than a minimal adverse effect on navigation. 2. Proper maintenance. Any structure or fill authorized shall be properly maintained, including maintenance to ensure public safety. 3. Erosion and siltation controls. Appropriate erosion and siltation controls must be used and maintained in effective operating condition during construction, and all exposed soil and other fills must be permanently stabilized at the earliest practicable date. 4. Aquatic life movements. No activity may substantially disrupt the movement of those species of aquatic life indigenous to the waterbody, . including those species which normally migrate through the area, unless the activity's primary purpose is to impound water. 5. Equipment. Heavy equipment working in wetlands must be placed on mats or other measures must be taken to minimize soil disturbance. 6. Regional and case-by-case conditions. The activity must comply with any regional conditions which may have been added by the Division Engineer (see 33 CFR 330.4(e)) and any case specific conditions added by the Corps of Engineers (Corps). 7. Wild and scenic rivers. No activity may occur in a component of the National Wild and Scenic River System; or in a river officially designated by Congress as a "study river" for possible inclusion in the system, while the river is in an official study status. Information on Wild and Scenic Rivers may be obtained from the National Park Service and the U.S. Forest Service. 8. Tribal rights. No activity or its operation may impair reserved tribal rights, including, but not limited to, reserved water rights and treaty j fishing and hunting riots. 9. Water quality certification. In certain States, an individual State water quality certification must be obtained or waived (see 33 CFR 330.a(c)). J (b) The notification must be in writing and include the following information and any required fees: (1) Name, address, and telephone number of the prospective permittee; (2) Location of the proposed project; (3) Brief description of the proposed project; the project's purpose; direct and indirect adverse environmental effects the project would cause; any other NWP(s), regional general permit(s), or individual permit(s) used or intended to be used to authorize any part of the proposed project or any related activity; (4) Where required by the terms of the NWP, a delineation of affected special aquatic sites, including wetlands; and (5) A statement that the prospective permittee has contacted: (i) The USFWS/NMFS regarding the presence of any federally listed (or proposed for listing) endangered or threatened species or critical habitat in the permit area that may be affected by the proposed project; and any available information provided by those agencies. (The prospective permittee may contact Corps District Offices for USFWS/NWS agency contacts and lists of critical habitat.) (ii) The SHPO regarding the presence of any historic properties in the permit area that may be affected by the proposed project; and the available information, if any, provided by that agency. (c) The standard individual permit application form (Form ENG 4345) may by used as the notification but must clearly indicate that it is a predischarge notification (PDN) and must include all of the information required in (b)(1)-(5) of General Condition 13. (d) In reviewing an activity under the notification procedure, the District Engineer will first determine whether the activity will result in more than minimal individual or cumulative adverse environmental effects or will be j contrary to the public interest. The prospective permittee may, at his option, submit a proposed mitigation plan with the predischarge notification to expedite the process and the District Engineer will consider any optional mitigation the applicant has included in the proposal in determining whether the net adverse environmental effects of the proposed work are minimal. The District Engineer will consider any comments from Federal and State agencies concerning the proposed activity's compliance with the terms and conditions of the NWP and the need for mitigation to reduce the project-s adverse environ- mental effects to a minimal level. The District Engineer will upon receipt of a notification provide immediately (e.g-, facsimile transmission, overnight mail, or other expeditious manner) a copy to the appropriate offices of the USFWS, State natural resource or water quality agency, EPA, and, if appropri- ate, the NMFS. With the exception of NWP 37, these agencies will then have 5 calendar days from the date the material is transmitted to telephone the 3 -�rr�wirrar....n.mr.,.�.r --- rrrrr.rrr. w�wrr used to offset the acreage of wetland losses that would occur in order to meet the acreage limits of some of the NWP's (e.g., 5 acres of wetlands cannot be created to change a 6-acre loss of wetlands to a 1-acre loss; however, the 5 created acres can be used to reduce the impacts of the 6-acre loss). SECTION 404 ONLY CONDITIONS: In addition to the general conditions, the following conditions apply only to activities that involve the discharge of dredged or fill material and must be followed in order for authorization by the NWP's to be valid: 1. Water supply intakes. No discharge of dredged or fill material may occur in the proximity of a public water supply intake except where the discharge is for repair of the public water supply intake structures or adjacent bank stabilization. 2. Shellfish production. No discharge of dredged or fill material may occur in areas of concentrated shellfish production, unless the discharge is directly related to a shellfish harvesting activity authorized by NWP 4. 3. Suitable material. No discharge of dredged or fill material may consist of unsuitable material (e.q., trash, debris, car bodies, etc.) and material discharged must be free from toxic pollutants in toxic amounts (see Section 307 of the Clean Water Act) . 4. Mitigation. Discharges of dredged or fill material into waters of the United States must be minimized or avoided to the maximum extent practicable at the project site (i.e. , onsite) 9 unless the District Engineer has approved a compensation mitigation plan for the specific regulated activity. 5. Spawning areas. Discharges in spawning areas during spawning seasons must be avoided to the maximum extent practicable. 6. Obstruction of high flows. To the maximum extent practicable, discharges sflows not or causetthe restrict relocation of impede the water passage (unlessft a normal rimoary expected high purpose of the fill is to impound waters) . 7. June 25, 2001 Jim Roundtree :: .,_...., Roundtree Development, LLC. PO Box 2730 Belfair, WA 98528 Re: Wetland Delineation for Lots 13 and 14 on Laurel Road, Tiger Lake, Mason County, Washington. These dots are located in the SE 1/4 of the NW '/a of Section 5, Township 23 N, Range 1 W. WM. Dear Jim: This delineation was conducted on June 18, 2001 using the Washington State Wetlands Identification and Delineation Manual developed by the Department of Ecology, in accordance with the Mason County Ordinance NO. 77-93, Interim Resource Ordinance. The manual uses the three-wetland parameter methodology when determining the presence or absence of wetlands and all three parameters of hydric soil, wetland hydrology, and hydrophytic vegetation must be present for an area to be considered wetland under normal circumstances. These lots are situated within a rural housing development west of Tiger Lake and will be combined to construct one single family home on what is currently platted as Lot 14. This delineation was completed at the west side of parcel 13 to determine the size, category and extent of wetlands and the associated buffers as well as determining the need for buffer reduction or averaging to accommodate the proposed home. The on-site wetland consists of a mixed coniferous deciduous forest with moderate shrub vegetation and a moderate to dense herbaceous layer. It is a part of a larger wetland system that has been dissected by roads and culverts as well homes within this housing development. The buffers on the west side of the wetland have been clear-cut and have not recovered yet while the east side of the wetland has good forested and shrub areas that are surrounded by a road and several single family homes. The on-site wetland meets the criteria for a Category III system according to 1015 S.W.Harper Road,Port Orchard,Washington 98367 (360)876-2403 Fax(360)876-2053 `� Roundtree June 25, 2001 page 2 the Department of Ecology Wetland Rating System,because the wetland is a small heavily disturbed wetland system that is divided by a series of road fill and culverts that have altered the hydrology. The buffers are also minimal and there does not appear to be a continuous corridor between potential habitat areas. This letter has been prepared as a requirement of the Interim Resource Ordinance to provide information concerning the delineation methodology, the categorization of the on-site wetland and the required buffers. Included in the letter are 'descriptions of the three parameters as they appear in the wetland and non-wetland areas. The determination of the wetland boundary also required the use of the Mason County Soil Survey to characterize the on-site soils and the National Wetlands Inventory, both of which identify any possible wetlands on or in the vicinity of the site. A The on-site soils are mapped as Ab Alderwood gravelly sandy loam, 5-15% slopes, 0-6% slopes, according to the Soil Conservation Service, Soil Survey for Mason County Area, Washington, September 1960. There is also a linear soil mapping west of Tiger Lake and south of these lots that is mapped as Mg Mukilteo peat, 0-2% slopes. Alderwood soils are not classified as hydric and do not contain inclusions of hydric soil but the Mg soil Mukilteo peat is classified as hydric. See enclosed map for site located on soil survey and the enclosed ` description of the on-site soils. The US Fish and Wildlife Service, National Wetlands Inventory (NWI), Wildcat Lake Quadrangle maps a linear wetland system west of Tiger Lake south of the project site several hundred feet and there is a possibility that this wetland extends southerly and is part of the mapped system. This wetland area is classified as Palustrine, Scrub/Shrub, Seasonally flooded with a smaller area of Palustrine, Open Water, Permanently flooded area at its south end. There are several small Palustrine, Scrub/Shrub, Seasonally flooded north of the site and Tiger Lake Road. See enclosed map for site located on the NWI. The on-site portion of wetland is forested and dominated by a mixture of deciduous and coniferous trees. The upland portion of these lots was clear-cut several years ago and is now dominated by young red alder seedlings and saplings as well as other volunteer species. The Roundtree June 25, 2001 page 3 west boundary of the on-site wetland was delineated on Lot 13 to establish the building site and required buffer for the proposed home on Lot 14. The west boundary of the on-site wetland was delineated using 15 orange colored flags with WB (Wetland Boundary) and numbered consecutively (see enclosed rough drawing). Two test holes were established in the wetland to verify the presence of all three wetland parameters and two test holes were established outside the wetland boundary and other areas of the site to verify the absence of the three parameters. At each test hole, the soils were examined for the presence of hydric soil conditions and evidence of hydrologic conditions occurring either in the hole or on the y surface of the soil. In addition, the percent cover of the dominant plant species within a 15 foot radius of the soil hole was recorded at each of the plots. A summary of the data findings are provided in this letter and include the general conditions of the soil, any evidence of hydrology seen in the test sites, and the dominant plant species. See attached data forms for additional information concerning the individual test holes. Test Holes 1 and 3 are situated within the delineated wetland, with Test Hole 1 situated at the south end and Test Hole 3 situated in a point at the north end. The vegetation in these areas is dominated by red alder (Alnus rubra) FAC; western red cedar (Thuja plicata) FAC; hardhack (Spiraea douglasii) FACW; salmonberry (Rubus spectabilis) FAC; and slough sedge (Carex obnupta) OBL with lower percentages of Pacific willow (Salix lasiandra) FACW; cascara (Rhamnus purshiana) FAC-; skunk cabbage (Lysichitum americanum) OBL; lady fern (Athyrium filix femina) FAC; sword fern (Polystichum munitum) FACU; and salal (Gaultheria shallon) FACU. A soil test hole was not conducted at Test Hole 1 because of the standing water and it was therefore assumed to be hydric. The soil hole at Test Hole 3 revealed a single layer profile consisting of muck and having a matrix chroma of 10 YR 2/1. It is assumed the same soil profile would have been observed at Test Hole 1. Hydrology was present at Test Hole 1 as standing water to a depth of 10 inches with water lines on trees and shrubs as well as along the wetland edge indicating the presence of higher water levels during the winter and earl spring. Hydrology was resent at Test Hole 3 as saturation within 2 Y P g• Y gY P Roundtree June 25, 2001 Page 4 i inches of the soil profile with water lines on the trees and shrubs and debris deposition along the upper edge of the wetland indicating the presence of standing water for a portion of the winter and spring growing season. The source of water appears to be surface water that has become dammed up by the roads that cross the wetland and the build up of woody debris. Water mainly evaporates in the latter portion of the growing season and/or is transpired by the dominant vegetation with southerly water flow during periods of heavy rain. These areas were determined to be wetland because there are positive indicators present for all three wetland parameters. Test Hole 2 was completed in the upland immediately adjacent to the delineated wetland boundary, while Test Hole 4 was completed in the proposed homesite on Lot 14. The vegetation in these upland areas is mostly dominated by red alder saplings and seedlings with varying percentages of western red cedar, cascara and western hemlock (Tsuga heterophylla) x FACU. There is a developing shrub layer at Test Hole 2 that is dominated by evergreen blackberry (Rubus laciniatus) FACU and salal with lower percentages of evergreen huckleberry (Vaccinium ovatum) FACU and red huckleberry (Vaccinium parvifolium) UPL and bracken fern (Pteridium aquilinum) FACU in the herbaceous understory. There is no shrub layer at Test Hole 4 and the ground is dominated by herbaceous weedy volunteers including hairy cat's ear (Hypochaeris radicata) FACU and crowned vetch (Coronilla vaira) NL with lower percentages of velvet grass (Holcus lanatus) FAC; foxglove (Digitalis purpurea) FACU; and tall fescue (Festuca arundinacea) FACW. The soil test holes in the upland areas revealed a two layer gravelly sandy loam at Test Hole 2 with a single layer compacted gravelly sandy loam that was only dug to 10 inches at Test Hole 4. The profile at Test Hole 2 consists of a 2-inch duff/gravelly sandy loam surface horizon having a matrix chroma of 10 YR 2/2, without mottling and a subsurface horizon f having a matrix chroma of 10 YR 3/6. Because of the compacted rocky nature of the soil at i Roundtree June 25, 2001 page 5 Test Hole 4, the hole was only dug to a depth of 10 inches and the soil has a high matrix chroma of 10 YR 3/6. Hydrology was not present at either of these test holes and there is no evidence of hydrology for any portion of the growing season. 1 The Mason County Interim Resource Ordinance specifies the use of the Department of Ecology Wetland Rating System for Western Washington, Second Edition to determine the appropriate wetland category. Use of this rating form indicates that the wetland on this parcel a meets the criteria for a Category III wetland because it has been somewhat dissected and k impacted by road crossing, clearing of buffers and increasing construction of single family homes within this development. The wetland consists of a single vegetative community that does not appear to be associated with a formal stream system and provides a dissected corridor between potential habitat areas. The buffer has been cleared on most lots and homes constructed on a few of the lots, so much of the buffer no longer provides significant protection for the wetland system. The Interim Resource Ordinance requires a 50-foot Wetland Vegetation Area for Category III wetlands with a 15-foot building setback from the edge of the buffer. It appears that by combining Lots 13 and 14 and proposing the home on Lot 14, the required 50-foot vegetation area can be easily accommodated without reduction or averaging. There should be no impact to the wetland by constructing a home on these two lots and in fact the density is lower and minimizes the overall impact on the wetland by not constructing a second home on Lot 13. In summary, this delineation was completed on Lot 13 for the proposed single-family home construction on combined Lots 13 and 14 on Laurel Drive west of Tiger Lake. The wetland lies entirely on Lot 13 and extends off-site to the north and south and meets the criteria for a Category III system because it consists of a single vegetative community, it does not appear to have a formal stream association and roads and houses have dissected the corridor between ' habitats. The wetland is dominated by red alder, western red cedar, salmonberry, hardhack, skunk cabbage and slough sedge and its hydrologic source is mainly surface water runoff that ponds up on this parcel in during the winter months due to blockage by culverts, roads, and Roundtree June 25, 2001 page 6 woody debris. Category III wetlands require 50 foot Wetland Vegetation Areas established from the delineated wetland boundary and a 15 foot building/buffer setback according to the Mason County Interim Resource Ordinance. By combining these lots and constructing a single home, no buffer reduction or averaging is required and the impacts often associated with single-family homes is minimized. For further information, see page 16 of the soil survey. Information listed below for Alderwood soils was collected between 1951 and 1960 and uses for the individual soils have probably changed since that time. ALDERWOOD SERIES The Alderwood series consists of brown, well drained, upland soils. They have developed from mixed gravelly glacial till dominated by acid igneous rock. The imbedded gravel is mainly granite and quartzite. Rainfall is 45 to 60 inches a year. The native vegetation is a dense forest consisting almost entirely of Douglas fir and a dense understo ryof salal Oregon grape, vine maple, and huckleberry. Northeast of the Hood Canal the understory is mainly rhododendron. Alderwood soils j occupy the extensive rolling glacial moraines, and they are the dominant soils of the eastern part of the county. The Alderwood soils are associated with the somewhat excessively drained Everett and Indianola soils and with the moderately well drained Kitsap soils. Shelton and Hoodsport soils differ from the Alderwood soils in that they have developed under high rainfall and from glacial till having a much higher content of the basic igneous rock. The Shelton and Hoodsport soils are more reddish throughout the profile. The Shelton soils are usually deeper to the cemented till than the Alderwood soils. Ab-Alderwood gravelly sandy loam, 5-15% slopes. This is the most extensive soil of the Alderwood series. It occupies undulating to rolling moraines. In undisturbed areas, a 1 to 2 inch mat of very dark brown, acid organic matter is on the surface. This grades to a thin, dark grayish- brown, highly organic mineral soil. The surface soil consists of a friable, brown medium acid gravelly sandy loam 8 to 13 inches deep. Below the surface soil, to depths ranging from 18 to 24 inches, is a pale-brown gravelly sandy loam that is very friable. Between this layer and the cemented till, is a 3 to 10 inch layer of very pale brown gravelly sandy loam. The cemented till consists of light gray, gravelly sandy loam, and it normally occurs at depths ranging from 24 to 32 inches. It is impermeable to roots and very slowly permeable to water. The cemented substratum tends to restrict the rapid downward movement of moisture. Not more than about 5 percent of this soil has been cleared and is used for crops or pasture. Most of the cultivated acreage is near the inlets of Puget Sound in the vicinities of Arcadia and Allyn. In this area, the Alderwood soils are associated with the better agricultural soils of the Cloquallum, Sinclair, and Kitsap series. Hay, small grains, pasture, fruits, nuts, grapes, and berries are the principal crops grown on the Alderwood soils. Nearly all the uncleared acreage is in second-growth forest 70 to 80 years of age. Shallowness of the compact till often inhibits growth of older trees. This soil is in capability i subclass VIs and in site classes 4 and 5 for Douglas fir. Small areas along the border, where the soil is more than 32 inches deep to compact till, are in site classes 3 and 4 for Douglas fir. Ac Alderwood gravelly sandy loam, 15-30% slopes. This soil varies more in depth, but otherwise it is similar to Alderwood gravelly sandy loam, 5 to 15% slopes. It occurs in close association with and adjacent to that soil. It is on moderately steep ridges, along drainageways, and on elongated irregular slopes. Small areas with slopes of more than 30 percent are mapped with this soil. Surface drainage is more rapid than on the more gentle slopes. Runoff and erosion on the logged and semicleared areas are controlled by the dense growth of plants. Ad Alderwood gravely sandy loam 30-45% slopes. This soil is similar to and adjacent to other Alderwood soils. It occupies gullies and deeply cut banks of streams. Few of the profile characteristics are uniform. Mtelo II NO=Category I �5 32 17.01.070 WETLANDS The purpose of this section is to avoid, or in appropriate circumstances, minimize, rectify, reduce or compensate for impacts arising from land development and other activities affecting wetlands; to maintain and enhance the biological and physical functions and values of wetlands with respect to water quality maintenance; stormwater and floodwater storage and conveyance; fish and wildlife habitat; primary productivity, recreation, education and historic and cultural preservation. When avoiding impacts is not reasonable, mitigation shall be implemented to achieve a no net loss of wetlands in terms of acreage, function and value. A. CLASSIFICATION The following shall be classified as wetland areas: Areas that are inundated or saturated by surface or ground water at a frequency and duration sufficient to support,and-that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes, bogs and similar areas. However, wetlands may include those artificial wetlands intentionally created from non-wetland areas created to mitigate conversion of wetlands, if permitted by the county or city. B. DESIGNATIONS The following lands, shorelands and waters of Mason County are hereby designated under RCW 36.70A.060 and RCW 36.70A.170, as critical areas requiring immediate protection from incompatible land uses: Wetlands and their vegetation area as specified by Section 17.01.070.E. In making a determination regarding a wetland,Washington State Wedend IdendFceddn and Delineation Manual(Ecology 196-94), shall serve as the technical resource guide on determining If an area possesses hydrophytic vegetation, hydric soils, and/or wetland hydrology. • 1. The following are designated as regulated wetlands under this Chapter: a. All areas described in Section 17.01.070.A.; b• Wetland ponds less than twenty acres; C. Wetlands created as mitigation, and those modified for approved land use activities, including their submerged aquatic beds. i 2` The following are designated as non-regulated wetlands: Artificial man made wetlands created from non-wetland sites, including, but not limited to, irrigation and drainage ditches, glass-lined swales, canals,. detention facilities, wastewater treatment facilities, farm ponds, and landscape amenities or those wetlands created after July 1, 1990, that were unintentionally created as a result of the construction of a road, street or highway. Wetlands regulated under this chapter do not include Category II and.11l wetlands of less than 2,500 square feet or Category IV wetlands of less than 10,000 square feet. 3. Owners and applicants with non-regulated wetlands are strongly urged to cooperate voluntarily in this plan of wetland protection, using the guidelines in this ordinance and in materials provided by the Department of Community Development. C. PROCEDURES i 1. Responsibilities for the determination of wetland boundaries: a. Formal determination of.wetland boundaries is the responsibility of the County. The responsibility to provide all necessary and accurate data to the County for its ( determination rests with the applicant. This information will include a field delineation by a qualified wetland professional applying the Washington State Wetland Identification and Delineation Manua/ (Ecology #96-94),. When, in the opinion of the Director, sufficient information exists from the County's wetland inventory, or other sources, the requirement Mason County Interim Resource Ordinance 21 Rev: 12130197 for a full or partial delineation may be waived. For instance, in some cases, the applicant may only be required to determine the wetland boundary, or portion thereof, of the wetland system. The Director shall determine when a permit application is required and what additional information may be necessary. Wetland delineations shall be performed in accordance with the procedures as specified in the Washington State Wetland Identification and Delineation Manual(Ecology 1196-94). Evidence documenting the results of any boundary survey, or other submitted data, may be required by the Director. b. Mason County, at a fee, when requested by the applicant, or the affected party, may perform the delineation in lieu of direct action by the applicant. Mason County may use hydrology, soils, plant species, and other data, and consult with biologists, hydrologists, soil scientists, or other experts, as needed, to perform the delineation. The County shall make a good faith effort to provide this service, consistent with budgetary constraints and available in-house expertise, for smaller projects and especially for those property owners with lesser financial capabilities. c, Where Mason County performs a wetland boundary determination at the request of the applicant, it shall be considered a final determination unless contested. a d. Where the applicant has provided a determination of the wetland boundary, the Director shall verify the accuracy of, and may.render adjustments to, the boundary delineation. e. In the event the boundary delineation is contested by the applicant or affected party, the Department of Ecology, or a mutually agreed upon party, shall settle the dispute. D. LAND USES 1. Mason Environmental Permit Required Uses and Activities A Mason Environmental Permit shall be obtained from the County, using the administrative review process.in this Chapter, prior to undertaking, in a regulated wetland or its vegetation area, for the following activities. a. In all regulated wetlands, the removal, excavation, grading, dredging, dumping, discharging, or filling of any material; or the draining or flooding of the site, except where undertaken for maintenance (but not construction) of drainage ditches or for emergency repair; b. The construction of stormwater management facilities; or C. The driving of pilings; d. The placing of obstructions; e. The construction, reconstruction, demolition, or expansion of any structure; f. The destruction or alteration of wetlands and wetland vegetation area through clearing, harvesting, shading, intentional burning, or planting of vegetation that would alter the character of a designated wetland or vegetation area, provided that this subsection shall not apply to the following activities undertaken in a manner which minimizes impacts: (1) The harvesting or normal maintenance of vegetation in a manner that is not injurious to the natural reproduction of such vegetation; (2) The removal or eradication of noxious weeds so designated in Chapter 17.10 RCW or other exotic, nuisance plants; (3) Site investigative work necessary for land use application submittals such as surveys, soil logs and percolation tests; (4) The construction or trails which shall be unpaved when located in the vegetation areas and elevated when located in wetlands, which are not intended for motorized use, and which are no wider than three (3) feet, unless additional width is necessary for safety along a precipice, steep hillside, or other hazardous area. (5) Emergency services or repairs for health and welfare; or (6) Activities of a mosquito control district. Mason County Interim Resource Ordinance 22 Rev: 12130197 (7) The removal of a danger tree, provided that such removal is mitigated by planting in the vicinity of the removed tree a total of six (6) new trees, each of a minimum three (3) feet in height and each of the same species or native species as the removed tree. If the replacement tree planting is judged to be unnecessary to replace the canopy structure of a vegetation area, the Director may request the applicant leave or place the danger tree within the vegetation area as habitat. g. Activities that result in a significant change of water temperature,.a significant change of physical or chemical characteristics of wetlands water sources, including quantity, or the introduction of pollutants. 2. Activites Permitted without a Mason Environmental Permit The following uses shall be.allowed, in addition to.those defined in General Exemptions (see Section 17.01.130), within a wetland or wetland vegetation area to the extent that they are not prohibited by the Shorelines Management ACT of 1971 (Chapter 90.58 RCW), Federal Water Pollution Control Act (Clean Water ACT), State Water Pollution Control Act (Chapter 90.48 RCW), State Hydraulic Code (RCW 75.20.100-.140), Forest Practices Act (Chapter 76.09 RCW and Chapter 222-16 WAC) or any other applicable ordinance or law and provided they are conducted using best management practices, except where such activities result in the conversion of a regulated wetland or wetland vegetation area to a use to which it was not previously subjected and provided further that forest practices and conversions from forest land shall be governed by Chapter 76.09 RCW and.its rules: a., Conservation or preservation of soil, water, vegetations fish, shellfish, and other wildlife; b. Outdoor recreational activities that do not have a significant adverse impact on the wetland and Its related vegetation area; C. The harvesting of wild crops in a manner that is not injurious to natural reproduction of -such crops and provided the harvesting does not require tilling of soil, planting of crops, ( or alteration of the wetland by changing existing topography, water conditions or water resources; d. Existing and ongoing agricultural activities, including farming, horticulture, aquaculture, irrigation, ranching or grazing of animals. Activities on areas lying fallow as part of a conventional rotational cycle are part of an ongoing.operation. Activities which bring an area into agricultural use are not part of an ongoing operation. An operation ceases to be ongoing when the area in which it was conducted has been converted to another use or has lain idle so long that modifications to the hydrological regime are necessary to resume operations. e. The maintenance (but not construction) of drainage ditches; f. Education, scientific research, and use of nature trails; g. Site investigative work necessary for land use application submittals such as surveys, soil logs, percolation tests and other related activities. In every case, wetland impacts shall be minimized and disturbed areas shall be immediately restored; and h. The following uses are allowed within wetlands and/or wetland vegetation area, provided that any required permits or approvals are obtained and further provided that wetland impacts are minimized and that disturbed areas are immediately restored: (1) Normal maintenance, repair, or operation of existing serviceable structures, facilities, or improved areas. Maintenance and repair does not include any modification that changes the character, scope, or size of the original structure, facility, or improved area and does not include the construction of a maintenance road; and (2) Minor modification of existing serviceable structures within a vegetation area zone where modification does not adversely impact wetland functions. Wetlands Rating System A four-tier wetlands rating system is hereby adopted as the rating system for Mason County. Wetlands vegetation area widths and replacement ratios shall be based on this rating system. Procedures for applying the wetland rating system are set forth in the Washington State Wetlands Rating System -Western Washington Second Edition Washington State Department of Ecology (Publication #93-74), as modified herein; a. Wetlands shall be categorized as follows: CATEGORY I WETLANDS (A wetland is considered a Category I if it meets any one of the following criteria.) 1. The wetland contains documented Federal or State listed Threatened or Endangered plant and/or wildlife species. 2. The wetland is on record with the Washington Natural Heritage Program as a.high quality native wetland or it has great potential to become listed*. 3. Wetlands documented to contain regionally significant waterfowl or shorebird concentrations.. 4. Wetlands that contain irreplaceable ecological functions*. Bogs and fens y Mature forested wetland Estuarine wetlands over one acre • Eelgrass and kelp beds Documented wetlands of local category I significance. CATEGORY 11 WETLANDS (A wetland is considered a Category II if it meets none of the Category I criteria and it meets any one of the following:) 1. Confirmed presence of sensitive plant, animal or fish recognized by federal or state agencies. 2. Documented priority habitats and/or species recognized by state agencies. 3. Wetlands with significant functions which may not be adequately replicated through creation or restoration (specifically estuaries, bogs and fens). 4. Wetlands with significant habitat value (Greater than or equal to 22 points on the Washington State Wetlands Rating Form). 5. Wetlands identified as a Category II wetland of local significance. CATEGORY III WETLANDS' (A wetland is considered a Category III if it meets none of the Category 1 or II criteria and it meets any one of the following.) 1. Wetlands where the significant habitat value score is equal to or less than 21 points on the Washington State Wetlands Rating Form. 2. Wetlands identified as a Category III wetland of local significance. 3. Estuarine wetlands less than one acre*. Mason County Interim Resource Ordinance 24 Rev. 12130197 CATEGORY IV WETLANDS (A wetland is considered a Category IV if it meets any one of the following.) 1. Wetlands less than one acre, hydrologically isolated and comprised of one plant layer dominated (>80%) by one invasive plant species*. 2. Wetlands less than two acres, hydrologically isolated and comprised of one plant layer dominated (>90%) by a combination of invasive plant species`. 3. Wetlands that are ponds smaller than one acre and excavated from uplands, without a surface water connection to streams, lakes, rivers or other wetlands. 4 See Ecology, 1993 publication titled.Washington State Wetlands Rating System, Western Washington for additional information. 2. Wetland Vegetation Areas. a. Standard Vegetation Area Widths. Wetland vegetation areas shall be required for all regulated wetlands. Any wetland created, restored, or enhanced as compensation for approved wetland alterations shall also include the standard vegetation area required for the.category of the created, restored,.or enhanced wetland. All vegetation.areas-shall be measured horigontally from the wetland boundary as surveyed in the field. The width of the wetland vegetation area shall be determined according to wetland category. Increased Wetland Vegetation Area Width The Administrator shall require increased standard vegetation area widths on a case-by-case basis . when a larger vegetation area is necessary to protect wetland functions and values based on local conditions. This determination shall be supported by appropriate documentation showing that it is reasonably related to protection of the functions and values of the-regulated wetland. Such determination shall be attached as a permit condition and shall demonstrate that: a. A larger vegetation area is necessary to maintain viable populations or critical habitat of threatened or endangered species living within the subject wetland(s) boundaries; or b. The adjacent land is susceptible to severe erosion and erosion control measures will not effectively prevent adverse wetland impacts; or Mason County Interim Resource Ordinance 25 Rev: 12130197 C. If the wetland contains variations in sensitivity, increasing the vegetation area widths will only be done when necessary to preserve the structure, function and value of the wetland. ;! 4. Wetland Vegetation Area Width Averaging The boundary of the vegetation area may be modified by averaging vegetation area widths. If vegetation area averaging is used, the following conditions must be met: a. The total area contained in the vegetation area after averaging shall be no less than that contained within the vegetation area prior to averaging; and b. Vegetation area averaging will incorporate site conditions to minimize (to the maximum extent.possible) impacts on the functions of the wetland; and C. In no instance shall the vegetation area width be reduced to less than 100 feet for Category I, 75 feet for Category 11, or 25 feet for Categories III or IV. 5. Wetland Vegetation Area Conditions Except as otherwise specified, wetland vegetation areas shall be retained in their natural condition. Where vegetation area disturbance has occurred during construction, revegetation with native vegetation may be required. 6. Permitted Uses In A Wetland Vegetation Area Regulated activities shall not be allowed within a vegetation area except as follows: a. Activities that are permissible.within a wetland shall be,permissible within a wetland vegetation area; and b. Stormwater management facilities (bioswales and dispersal trenches) only when required ;to allow a reasonable use of the property. Encroachment into the vegetation area shall be the minimum necessary and will be permitted only.within the outer twenty-five (25)feet or outer twenty-five percent (25%) of the vegetation area, whichever is more restictive. , c. Other passive activities such as recreational trails and tot lots are also permitted.within the outer twenty-five percent (25%) of the vegetation area. d. Selective commercial timber cutting will be limited to the outer twenty-five percent (25%) of Category I and 11 wetland vegetation areas and fifty percent (50%) of Category III and IV wetland vegetation areas. No more than thirty percent (30%) of the merchantable trees may be harvested in this area on a one-time-only basis as associated with a land use conversion application. The thirty percent (30%) harvest must be representative and maintain an intact forest community character. The percentage and species distribution of all trees must be consistent before and after the selective timber harvest. 7. 'Building Setback Lines A building setback line of fifteen 0 5) feet is required from the edge of any wetland vegetation area. Minor structural intrusions into the area of the building setback may be allowed if the Administrator determined that such intrusions will not negatively impact the wetland. F. MITIGATION FOR WETLAND IMPACTS As a condition of any permit allowing alteration of wetlands and/or wetland vegetation areas, the County shall require that the applicant engage in the restoration, creation or enhancement of wetlands and their vegetation areas in order to offset the. impacts resulting from the applicant's actions. Mitigation sequencing should follow the avoidance, reduction and compensation analysis, (in that order of preference). The County may suspend or revoke a permit if it finds that the applicant has not complied with the conditions or limitations set forth in the permit or has exceeded the scope of work set for in the permit. The overall goal of any compensatory project shall be no net loss of wetlands function and acreage.
