Substantial Shoreline Development Permit Exemption
Dear Ladies and Gentlemen:
Enclosed please find a Joint Aquatics Resources Permit Application (JARPA) for an
exemption from a Shoreline Substantial Development Permit for the above referenced
project proposed by the Washington State Department of Transportation(WSDOT). This
project is located on State Route 3, in Mason County. Also enclosed you will find a
Mason County Shoreline Permit Application, a vicinity map and a check in the amount of
$450.00 for processing.
The proposed project is within 200' of Sherwood Creek,North Bay and Case Inlet.
Construction activities include:
• Pavement repair and overlay of the existing pavement.
• Permanent signing.
• Shoulder finishing.
• Replacing a failed cross culvert.
• Adjusting drainage inlets:
• Striping and pavement markings.
• Pavement grinding.
• Guardrail work.
Based upon our knowledge of the project and the language in the Mason County
Shoreline Management Master Program, we believe this project is exempt from the
Shoreline Substantial Development Permit requirement. We interpret this work to be
exempt under WAC 173-27-040(2)(b) as normal maintenance or repair of existing
structures or developments, including damage by accident, fire or elements.
Bid advertisement for this project is scheduled for February 2008.

7a. Describe the proposed work that needs aquatic permits: Complete plans and specifications should be provided for all work waterward
of the ordinary high water mark or line, including types of equipment to be used. If applying for a shoreline permit,describe all work
within and beyond 200 feet of the ordinary high water mark. If you have provided attached materials to describe your project,you still
must summarize the proposed work here. Attach a separate sheet if additional space is needed.
This proposed paving project is located on SR 3 beginning at MP 18.00 and ending at MP 22.00. Construction activities
include pavement repair and grinding, upgrading guardrail, permanent signing,shoulder finishing, replacing a failed cross
culvert(non-fish bearing)at MP 20.93,adjust drainage inlets,overlay the existing pavement to improve the condition rating,
and pavement markings.
PREPARATION OF DRAWINGS: See sample drawings and guidance for completing the drawings. ONE SET OF ORIGINAL OR GOOD QUALITY REPRODUCIBLE
DRAWINGS MUST BE ATTACHED. NOTE: Applicants are encouraged to submit photographs of the project site,but these DO NOT substitute for drawings. THE CORPS
OF ENGINEERS AND COAST GUARD REQUIRE DRAWINGS ON 8-112 X 11 INCH SHEETS. LARGER DRAWINGS MAYBE REQUIRED BY OTHER AGENCIES.
7b. Describe the purpose of the proposed work and why you want or need to perform it at the site. Please explain any specific needs that
have influenced the design.
This proposed work provides for rehabilitation of the existing pavement to increase the pavement condition rating. The
pavement condition rating is projected to drop below the adopted standards.
7c. Describe the potential impacts to characteristic uses of the water body. These uses may include fish and aquatic life,water quality,
water supply, recreation and aesthetics. Identify proposed actions to avoid, minimize,and mitigate detrimental impacts and provide
proper protection of fish and aquatic life. Identify which guidance documents you have used. Attach a separate sheet if additional
space is needed.
We anticipate no impacts to characteristic uses of Sherwood Creek,Case Inlet and North Bay. Work being performed within
200 feet of these waterbodies will be minimal. To ensure that no petroleum projects or other construction materials enter the
river,a Spill Prevention Control and Countermeasures Plan will be developed and implemented. A Biological Assessment
will be performed,and any conservation measures recommended for protection of threatened or endangered species will be
included in the contract.

The Washington State Shoreline Management Act (RCW 90.58) requires that substantial developments within
