Grace,
I've reviewed the Mark Robbins grading proposal and the only concern I feel is
that adequate silt fencing or hay bales be employed to ensure surface water
escaping the construction does not deliver silt or contaminated water to
Sherwood Creek.
I've also crudely estimated the amount of fill material I would expect this
construction to entail , and feel 100 cubic yards is a realistic estimate.

Dear Mr. Yando:
Thank you for the opportunity to comment on the determination of
nonsignificance to construct a driveway proposed by Mark Robbins
(95-109) . We reviewed the environmental checklist and have the
following concerns.
Erosion and sediment control is a key to preserving habitat and
preventing denudation of a developing area. The following
practice is recommended:
1. Erosion control measures must be in place prior to any
clearing, grading, or construction. These control measures
must be effective to prevent soil from being carried into
surface water by stormwater, runoff. Sand, silt, and soil
will damage aquatic habitat and are considered pollutants.
2. A sedimentation and erosion control plan for the project
site may be required and must be developed by a licensed
engineer. The plan must be implemented before and during
construction. The site must be carefully monitored to
determine effectivenessof the plan. The, plan must be
upgraded as necessary during the construction period.
3. Erosion and sediment control Best Management Practices are
essential for this project. Sherwood Creek drains into
North Bay which has over 1,100 acres of commercial shellfish
beds. Siltation will negatively impact shellfish resources.

The area where' you are proposing to `place_ the mobile• home� is not
only, , Subject, to, periodic flooding but also appears to be an
associated biological :wetland to Sherwood Creek". There ." s: a
transition area from these wet-lands to upland forested wetlands and
then 'there are,, uplands on the-site. _
Staff :recommends :that the. mobile horns be located further from the
creek. to lessen the possibility of flooding and'assure, that .it',is,
not. located in the wetlands. Landf ill- in..biological wetlands is
prohibited. . Staff could conduct an additional site inspection once
the location :of' the -mobile home is staked on the aite:� to verify
that ahe. residence or any associated - fill, such as` that :proposed
for the' driveway, is-.indeed out of the associated wetlands.
In, addition 'to being regulated -by the Shoreline Master Program, the
development site is located''within- a Flood;:Hazard Area -which :has -
been mapped ron the FEMA or Federal Emergency,:Management y Ageocy
maps All areas within. Flood Hazard- Areas in Mason County .are
�regul;ated-,by .the Flood-pamage. Prevention ,Ordinance.' Your property
is located within an un-numbered'A Zone which Is an area of. 100-
year flood 'wliere base flood elevations .and flood.hazard. factors .are
not determined. There are 'criteri ` that most be met prior t0 the
Planning- Department being able to. approve your building ' permit
application. The criteria are as follows:
1. The first habitable floor of' your mobile home must be elevated
two :(2) feet above the surrounding finished grade:
2 . Vents .in the foundation must not be any, -higher than one (I)
-foot above' finished grade so that there is , an allowance for the
entry and exit of flood waters in the foundation.

3 . You must have a licensed surveyor certify on an elevation
certificate (supplied by the County) that the structure's As-Built
first floor is two 92) feet above finished grade. Please submit a
letter from a land surveyor stating that you have retained their
services to certify the elevation.
Once the letter from a surveyor stating that you have retained
their services has been received by the Planning Department, we can
approve the Building Permit. Once the Building Permit is
conditionally issued to you and you have installed the mobile home
meeting the conditions, you will need to have the surveyor complete
the elevation certificate. This will verify that the floor of the
mobile home has been installed at least two feet above surrounding
finished grade. The Building Department will not be able to final
your inspections and approve occupancy of the mobile home until the
elevation certificate has been received in the Planning Department
I have enclosed an elevation certificate, an example surveyor's
letter and a copy of the FEMA map. If you have any questions please
give me a call. I have forwarded your permit on to the other
departments for their review in the meantime. Thank you.
