This letter is to provide you with written confirmation of our voluntary shutdown of harvest
operations in the vicinity of the six-inch pipe near the 3700 block of 856`Avenue NW adjacent to
the Olympic View residential community.
We are not planning any harvest activities until Spring 1998.

Subject: North Bay Voluntary Closure Agreement
Dear Mr. Meriwether:
This letter is to provide you with written confirmation of our voluntary shutdown of harvest
operations in the vicinity of an identified discharge flowing out of a concrete bulkhead on the
western shoreline approximately 1000 feet north of the boat ramp in North Bay.
This voluntary shutdown will occur within a 200 yard radius around the discharge point and will
be in effect until such time the fecal coliform loading is reduced or flows from the discharge
have decreased sufficiently to resume operations in all or part of the shutdown zone.

Dear Mr. Dewey:
The Washington State Department of Health (DOH) Office of Food Safety and Shellfish
Programs recently completed a series of tests of the water quality at a bulkhead discharge in
North Bay. The bulkhead, which our office refers to as the "zigzag bulkhead", is located at the
VanArnam residence several hundred yards north of the dock in Allyn. Repairs to the greywater
system at this residence were completed last summer, under the supervision of the Mason
County Environmental Health Program.
The results of our samples this year are similar to, but somewhat less than, those obtained last
year following the repairs. These results indicate that the shellfish water quality standard of 14
FC/100 ml will be met within 100 yards of the bulkhead. Since the Taylor United oysters are
located at least 100 yards from the bulkhead, the present discharge does not appear to
significantly impact the water quality in the staked oyster area. Therefore, DOH recommends
that the emergency closure for this discharge be lifted at this time.
It is possible that rainfall in the fall or winter will increase the bulkhead flow or fecal coliform
loading to a level requiring another emergency closure at this area. As I discussed last year
with Dave Robertson and the VanArnams, trenching the surface drainage that runs through the
VanArnam's yard may be helpful in reducing fecal coliform contributions. Your company may be
able to assist in such a project and thereby help protect water quality near your shellfish beds in
the future.

Dear Mr. Dewey:
The Washington State Department of Health Shellfish Program has recently become aware of a
contaminated discharge into North Bay near some of your shellfish beds. The discharge is flowing
out of a concrete bulkhead configured in a zigzag arrangement located on the western shoreline
approximately 1000 feet north of the boat ramp. Shellfish Program staff have recently visited this
discharge site with employees of your company to discuss this situation, so I believe that you are
familiar with this discharge location.
I was requested to assess a closure zone for this discharge, based on its loading of fecal coliforms to
the marine waters. We have collected the following data for this discharge:
March 17, 1998 79 FC/100 ml at 20 gpm
May 26, 1998 >2400 FC/100 ml at 10 gpm
June 1, 1998 23,000 FC/100 ml at 10 gpm
June 2, 1998 350 FC/100 ml at 10 gpm
June 17, 1998 920 FC/100 ml at 4 gpm
The fecal coliform and flow information collected on June 1, 1998 was used in the CORMIX3
computer model to estimate the size of closure zone needed to satisfy the shellfish water quality
standard of 14 FC/100 mi. The CORMIX3 model estimates dilutions and dispersions of surface water
discharges into receiving waters. Information on water temperatures and salinities, flow rate,
pollutant level, water depth, current speed and intertidal slope is required for this program. The input
parameter which could have the most variability is the current speed of the receiving (marine)water at
the discharge location, which could vary significantly with the wind and tidal conditions.
The CORMIX3 model was run for the measured parameters of this discharge at two different current
speeds: 5 and 10 cm/second. These current speeds are common along shorelines of enclosed,
protected bays. Using a current speed of 5 cm/second, the CORMIX3 model predicts that the
shellfish closure zone would extend approximately 300 meters in the prevailing current(i.e.,
downstream) direction. It would take an object 100 minutes to travel the 300 meters at a speed of five
cm/second. However, using a current speed of 10 cm/second, CORMIX3 estimates the closure zone

extends approximately 180 meters (200 yards) in the prevailing current direction. The transit time for
an object to travel 200 meters at this speed is approximately 33 minutes.
The assumption of a current speed of five cm/second over 100 minutes may be overly conservative
for several reasons. It is likely that there would be a significant reduction of fecal coliforms in the
discharge stream over this time period due to settling, predation and dispersion by environmental
factors. Therefore Shellfish Programs recommends that a 200 yard radius emergency closure zone
be imposed around this bulkhead discharge. No shellfish within this radius should be harvested for
consumption.
Mr. Will Satak (427-9670, extension 293) of the Mason County Health Department has spoken with
the owner of the residence where the discharge is located, and has recently completed a dye study at
this location. The dye study results indicaie that there likely is a direct or near-direct connection
between a portion of the resident's wastewater and this bulkhead discharge. Greywater from the
house sink and washing machine may be discharged near the drainage that eventually flows out of
the bulkhead. The owner will be directed to re-route these discharges to the house's septic tank and
drainfield, which are located behind the house (i.e., not next to the bulkhead). We hope that this
correction will reduce the measured fecal coliform loading to North Bay, and result in a reduction or
removal of the 200 yard closure zone.
Attached to this letter is a written agreement for your company's voluntary harvest closure near an
intermittent pollution source in Gallagher Cove. Our North Bay growing area file will also require a
written agreement for the voluntary harvest closure around this bulkhead. Please send us a signed
letter agreeing to this voluntary closure, to be in effect until the fecal coliform loading in this discharge
to North Bay is significantly reduced.
